HomeMy WebLinkAboutOrdinance No. 2824-2015Suggested by: Administration CITY OF KENAI NO. 2824 -2015 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, ACCEPTING AND APPROPRIATING $1,585.00 IN ASSET FORFEITURE SHARING FUNDS RECEIVED FOR THE CITY'S PARTICIPATION WITH THE ALASKA STATE TROOPERS, ALASKA BUREAU OF INVESTIGATION - STATEWIDE DRUG ENFORCEMENT UNIT. WHEREAS, in March of 2015 the Kenai Police Department received an asset forfeiture sharing check in the amount of $1,585 from the Alaska State Troopers, Alaska Bureau of Investigation - Statewide Drug Enforcement Unit; and, WHEREAS, the Police Department, pursuant to conditions of acceptance, will utilize the forfeiture funds to purchase law enforcement equipment for use by the Police Department. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA: Section 1. Form. That this is a non -code ordinance. Section 2. That the City Manager is authorized to accept the forfeited funds in the amounts of $1,585 and to expend the forfeited funds to fulfill the purpose and intent of this ordinance. Section 3. In March of 2015, the Alaska State Troopers, Alaska Bureau of Alcohol and Drug Enforcement (ABADE) provided the Kenai Police Department with $1,585 in asset forfeiture equitable sharing funds. These funds were related to asset forfeitures from a drug - related criminal investigation. Per the U.S. Department of Justice Equitable Sharing Guide, equitable sharing funds used by law enforcement shall be used for law enforcement purposes only. Permissible uses of the funds include, but are not limited to, law enforcement investigations, training, and equipment. We are permitted to purchase equipment which is used by law enforcement personnel that supports law enforcement activities. I am requesting an ordinance to appropriate these funds to the General Fund, Police - Small Tools to help pay for police equipment.
