Commissioner Twait called the meeting to order at 7:00 p.m.

a. Discussion — Personal Use of marijuana to begin February 24, 2015
Police Chief Sandahl and City Attorney Bloom provided an overview of the legislation as
currently presented and the timeline of effective dates. The pros and cons were discussed of
other states /communities which have legalized marijuana related to regulation, licensing, safety
and criminal activity.
b. Yearly review of 2003 Comprehensive Plan — Chapters 1 through 3
Administration advised the Kenai Municipal Code requires the Commission complete an annual
review of the Comprehensive Plan and suggested the Commission review a few chapters at
each meeting, then conduct a work session to discuss proposed revisions, if any.
Administration and the Commission reviewed chapters 1 through 3 and discussed options on
how the Commission could move forward with proposed amendments following review.
9. PENDING ITEMS: None.
10. REPORTS:
a. City Council — Council Member Knackstedt reported on the February 4 council meeting
action agenda included in the commission meeting packet.
b. Borough Planning — No report.
c. Administration — Attended the storm water training provided by the Kenai Watershed
Forum. Advised Council is reviewing its telephonic participation ordinance and was
unsure if this is something the Commission would like to review related to its regulations.

Reported the Planning Department proposed budget for FY16 had been submitted.
11. PERSONS PRESENT NOT SCHEDULED:
Kristine Schmidt, Kenai resident spoke in opposition to the development method used for
the 2013 Plan and requested the Commission review Soldotna's process and recommended
an established outline for review and public comment.

Commissioner Glendening, Petty and Kiel thanked administration for the overview of the Plan
and for public comment provided by Ms. Schmidt.
Twait inquired about filling the vacancy's for both the Borough and Kenai commissions.

ANALYSIS
This Preliminary Plat proposes to subdivide the Northwest one - quarter of the Northwest
one - quarter of the Northwest one - quarter (NW Y. NW % NW % ); and North one -half of
the South one -half of the Northwest one - quarter of the Northwest one - quarter ( N Y2 S
F NW % NW %); and Government Lot 13; and North one -half of Government Lot 14; and
the South one -half of the South one -half of the Northwest one - quarter of the Northwest
one - quarter (S % S % NW 'X NW Y4 ) and South one -half of Government Lot 14, Section
17, Township 5 North, Range 11 West, Seward Meridian, into Tract 1 and 2, Kenai River
Shores Subdivision. The property is zoned Heavy Industrial. Both tracts meet the
minimum lot requirements for development in the Heavy Industrial zone. Onsite water
and sewer are not available. A private well and septic system would need to be installed
at the time the property is developed by the property owner. The well and wastewater
disposal system shall meet the regulatory requirements of the Alaska Department of
Environmental Conservation. An installation agreement is not required.
The tracts are accessed from Bowpicker Lane. The right of way of Bowpicker Lane is
sixty -six (66) feet in width. The west thirty -three (33) feet of Bowpicker Lane was
dedicated to the public by the plat of Cook Inlet Shores Phase Two; this portion of
Bowpicker Lane lies within the boundaries of the Kenai Peninsula Borough. The
remaining thirty -three (33) feet of the right of way of Bowpicker Lane will be dedicated
to the public by the recording of this plat; this portion of Bowpicker Lane lies with the
city limits of the City of Kenai. Bowpicker Lane is a gravel road which has not been built
to City of Kenai road specifications and is therefore, not maintained by the City of Kenai.
RECOMMENDATIONS
Recommend approval with the following conditions:
A. Further development of the tracts shall conform to all Federal, State and Local
regulations.
B. The following items should be revised on the plat:
• The legal description within the title block should be corrected to include
Government Lot 13; and correct the Northwest one -half (NW %) to the
Northwest one - quarter (NW %), Section 17, Township 5 North, Range 11
West;
• Bowpicker Rd. should be changed to Bowpicker Lane
• Cannery Rd. should be changed to Old Cannery Road
• The spelling of Kenai should be corrected in the notation " Keani Spit Sd
No. 2 Tract A"

A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI RECOMMENDING THAT THE ATTACHED SUBDIVISION PLAT BE
APPROVED SUBJECT TO THE FOLLOWING CONDITIONS:
WHEREAS, the attached plat of KENAI RIVER SHORES SUBDIVISION was referred
to the City of Kenai Planning and Zoning Commission on February 28, 2015 and
received from Integrity Surveys; and,
WHEREAS, the City of Kenai Planning and Zoning Commission finds:
1. Plat area is zoned Heavy Industrial and therefore subject to said zone conditions.
2. Water and Sewer are not available.
3. Plat does not subdivide property within a public improvement district subject to
special assessments. There is not a delinquency amount owed to the City of Kenai
for the referenced property.
4. Installation agreement or construction of improvements is not required.
5. Status of surrounding land is shown.
6. Utility easements, if required, shall be shown.
7. Surveyor shall verify that no encroachments exist. If an encroachment exists; the
plat does not create nor increase the encroachment.
8. Street names designated on the plat should be revised as set forth in Paragraph
9(B), as shown below.
9. CONDITIONS:
A. Further development of the lots shall conform to all Federal, State and Local
regulations.
B. The following items should be revised on the plat:

has been received to construct a pedestrian and vehicular bridge across
Otter Creek and within the 50 -foot Habitat Protection District of Otter
Creek. Request and Location: A Conditional Use Permit pursuant to
KPB 21.18 for the construction of a pedestrian /vehicular bridge across
Otter Creek to stop vehicles from driving through the creek degrading the
creek banks. This project is located at Otter Creek ( #247 -80- 10015),
T9N, R9W, S14, SM, AK, (adjacent to Parcel 025- 370 -19). Description
as Stated in Permit: The Kenai Watershed Forum is proposing to install
a pedestrian /vehicular bridge across Otter Creek. The bridge will stop
