CORRESPONDENCE
JOhn Hayward- Kenai Peninsula Borough- School District
Mr. Hayward wrote of the Kenai P.eninsula Borough Board
of Education's desire to hold a meeting with Council
exploring the possibile joint venture of having one
center that would provide recreational and educational
outlets for pe.ople of all ages in the general community,
such as, a swimming poOl, an auditoriu, gymnasium,
library, museums, meeting rooms etc.
.The Council agreed-on setting the meeting for next
Wednesday, December 8, 1971, at 8'00 P.M., in the C.ity
Manager's Office.
Congressman Ni'ck Begich - Wildw.ood Air Force Station
Congressman Begich wrote to Melvin Laird, of the
Department of Defense, thanking him of the hospitality
shown to the three community leaders of Kenai, and
representatives from his office and Senators Stevens
and Gravel. He feels it is imperat.ive that an
imformal transfer occur before the actual closing of
Wildwood.

- Clarify_ road situation in Highland Trailer
The precident was set a few years ago on snow
removal in this area. The Administration feels
the-City should provide as many services as
poss'ibie and if there were no 'objections would
continue snow removal-. There were no object'ions.

The City Manager stated the Police Department is
doing a survey and writing a report on this. He
personally objects to a ban. McGrady and Doyle
'also personally object.

Trip to All American Cities - Atlanta
The City Manager reported Kenai was one of 18 cities
represented in Atlanta and the one with the least amo.unt
of representation' There was one interesting aspect,
Kenai was the only city reported on citizen's involvement
because the community xvanted to get something done. The
other cities was the result of a catastrophy, such as
a race riot, college riot, etc.
Mr. Gallup of the Gallup Polls was the moderator.
The ones they consider winners , they will send a
team of photographers. By the first part of March,.
we should know if we get the award or an alternate award.
Mr. Hubert Humphrey gave' an interesting luncheon speach.

Washington D.C. - Wildwood Air Force Station
Representatives from Gravel's Steven's, and Begich's
Offices went with Mr. Glotfelty, Mr. Steinbeck and
Mr Russel to the Pentaoon to meet with the Office
of Economic Adjustment. Mr. Smalling is head of the
team, Wildwood is his assignment.
The process now is to proceed with the transfer from
Military to Federal Government then back'to Local'
Government. '

Dinner Meeting- Kenaitze Indians
The dinner meeting with the Kenaitze Indians will be
held on December 13, 1971. The City Manager will
inform Council just where this will be held.
City Attorney's Report
Furnishing a lawyer for anyone charged with an offense
or a violation of a City Ordinance if un'able to pay
for it themselves is not effective yet. Mr. Fisher
would be surprised if the cost to the City would be
$1,0'00 a year. He has received a proposal from another
firm to serve as a'public defendor. '
Mr. Fisher is going to request' de-certification - C.U.L.
asking for the hearing at the same time as the rate
increase hearing.

A~vard of bid - Public Safety Building
The City ,~
~.-:ana~er._, reported the Council gave Administration
the authority to put together a proposal for force
account using local 'labor. The b.a.se bid without extras
is $742,047. No bond would be required, no builders
risk insurance,-no furniture, no vinyl gyp board, no
ramp for fire trucks, etc. After reviewing, the City
Manager feels force accounting is an~unacceptable way
to proceed because of the risk. He feels the facility
should not be without alternates #1 or #2 and recommends
awarding of the bid to Kelly Construction Co. with a
b-a.se bid of $785,000 plus Alternate #1 - $25,435 and
Alternate #2 - $22,388, making a total award to Kelly
Construction of $832,.823. The monies available are:
$4 50,000 Bond Sale
$322,526 F.A.A. Grant
$100,000 Surplus in Airport Capital Improvement Program.
Kelly Construction Co. gave the City a 30 day extension
on their bond for the City to make a decision. The
extension expires December 2, 19 71.

Manager's recommendation and award the Public Safety
'Bui'lding Bid to Kelly Construction, the base bid
plus Alternates #1 and #2, in the amount of $832,823.
The motion carried 3 - 1 by roll call vote with Malone
dissenting.

The Finance Department is ready for the auditors to
come in for a General Fund balance sheet. The auditors
will give a written opinion on the balance sheet before
Christmas and request a work session with Council.

Project - Approx.
In order for the Kenaitze Indians to get monies for the
low cost housing, it is necessary fOr the Ci.ty of Kenai
to pass a resolution, entering into an agreement between
the Alaska State Housing Authority and the City of Kenai.
Part o'f the agreement is to exempt the Housing Development
from all real and personal property taxes and special
as se s sment.s..

Malone moved and Doyle seconded for the adoption of
Resolution 71-46 - Entering into an Agreement with
Alaska State Housing authority. The motion carried
unanimously by roll call vote.
Bielefeld moved for. reconsideration for the next meeting.
Mommsen S/D - Water & Sewer Systems - Memo-Nov 6/15-'71
The Administration recommends the City acquire owner-
ship of Mommsen S/D Water & Sewer Distribution Systems
at no cost to the City and the same acquisition and
committments made to Bush Lanes S/D contiguous on
funds available. The Council has no objections for
Administration to pursue this matter.
Recommendation - Industrial Water Line - Memo.
The City Manager recommends Council put off final
selection until they have time to review DCW's proposal.
McGrady felt it would be wise to have a full Council.
Malone stated, because he does work for one of these
firms and may work for the one that gets the contract,
he will not take part in ,the discussion and will
,abstain from voting.
The Council agreed to have a work session on this before
the next Council meeting.

Ordinance 205--71- Sale' of $2,000,000 G.O.
Bonds
Doyle moved and McGrady seconded to introduc Ordinance
205-71 - An Ordinance of the City of Kenai, Alaska,
providing for the issuance and sale of $2,000,000 of
General Purpose General Obligation Bonds of the City
of Kenai for the purpose of providing funds to design,
plan, acquire, construct, install and equip a Civic
Center Complex, additions and improvements to the
water system, additions and improvements to the sewer
system, additions and improvements to the Municipal
Airport and additional Park and Recreational Facilities
and finding the date, form, terms and materials of suCh
bonds. The 'motion carried un,animously by roll call vote.

The Administration recommends payment to Ken Stock
in the amount of ~1,824,50.
Doyle moved and ~'talone seconded to accept the Adminis-
tration's recommendation and pay Ken Stock $1,824.50.
The motion carried unanimously by roll call vote.
Surplus equipment sale
The Administrati-on recommends accepting bids on
Item 2; 1969 Ford ½ ton pick up; Item 5, IHC-5 ton
dumptruck; Item 6, Reo Digger 2¼ ton; Item 8, Clark
Fork Lift and Item 9, 1962 Chev. ~ ton pick up and
reject all other bids.
McGrady moved and Doyle seconded to accept the City
Manager's recommendation and accept the bids on Items
2, 5, 6, 8 & 9 and reject all the others. The motion
carried unanimously.
There was no objection .to the City selling the
rejected items at the auction yard by the shop
building getting the minimum the City is asking.

Malone stated he has the majority of the work completed
at Barite and has received payment from the City.

The Kenai Peninsula Borough Board of Education asked me to write to you
regarding their interest in exploring the ramifications of deVeloping
a complex which would provide a swimming pool for the Kenai area, specifi-
cally 'located adjacent to the Kenai Junior Iiigh School and Kenai Central
!tigh School, in conjunction with the civic center facility that the City
of Kenai is planning. ·
I' am sure we can all see some of the discinct advantages of having one
center that would provide recreational and educational outlets .for people
of all.ages in .the general community. A swi~vaning pool, an auditor&um
for musical programs and other purposes, the g)nnnasiums nearby, library,
museums, meeting rooms,, etc., could provide very excellent central meeting
places which I think are 'needed in this area. The swimming facility could
be operated in the su~me'r and on. weekends by the City of Kenai And by the
school district for the use of children in the area during the school year.
Some of the problems of course would be joint funding of the facility,
the lOcation, the mutual development of the plan by both the school
·
district and the city, etc.
The Board proposes that a meeting be set up in the very near future
between the Board and. the Kenai City Council to explore the possibili-
ties of such a joint venture.
Please let me know your reaction to this and set a possible meeting
time.

for meeting with the three community leaders of Kenai,
Alaska on November 18, 1971. 'A repres~entative of my
of.fice was fortunate to attend along with representa-
tives of Senators Stevens and Gravel.
With'the closure of .the Wildwood Air Force Station
next july 1, I know the CZuy of Kenai is most anxious
to have the facility transferred to it for the im-
plementation of their outlined proposals. The Office
of Economic Adjustment will continue to be of assis-

tance, but it is imperative that an informal trans-
fer occur before the actual closure of Wildwood.
Any expedi~tious action that will be taken to insure
the maintenance of- the facility will be .very much
appreciated by all Kenai citizens and myself.

held by Blocky Rutherford during sewer extension
contract.
In response to Council r. equest, the foll'owing is a clari-
fication on bonding and ins.urance coverage held by Blocky
Rutherford on the sewer extensions which he and Mr. Wolf er
constructed late this fall.
First, the Lawton Drive sewer extension was constructed
under the contract hel'd by Cook Inlet Construction; and,
as such Rutherford and Wolfer were sub-age'nts for Cook
Inlet Construction working under Jess Robinson's perfor-
mance bond and insurance coverage. The p'ar. tial payment
check to cover this item was made out jointly to both
Cook Inl'et Construction and Blocky Rutherford at CoOk
Inlets request.
The remaining construction encompassing th'e Beauty School
eXtension and the Fourth and Birch lateral was constructed
by Rutherford and Wolf er as an extension of t'he same con-
tr'act prices. On those projects, Blocky Rutherford was
required to have a "certificate of insurance" 'for $100,000/
$300 , 000/$50 , 000 li'ab'itity in addition to underground .
insurance. Along with this, he was required to have a
'-contractors bond and a State contractors license. Paper

work and verification of those requirements were made
through Mr. Harold Dale of Obert's Insurance Company.
However, Mr. Rutherford did not have a City Excavation
Bond; _but, such a bond offers no more protection than a
certificate o~ i~s,,~anc~''
..... with underground coverage.

The excavation bend serves only to duplicate existing
coverage at a much increased cost to both the contractor
and the City. Oonsidering this along with the critically
short time remaining in this years constuction season,
the excavation bond was waived.
I would mention that the lines were installed as ~er
specifications despite ~reezing conditi.ons and this
department is well satisfied with the work performed.

Mr. Robinson will have to accept the calculation figures of
the City of Kenai concerning the project, which is the above
amount Stated. It is our feeling that the dif. ference of
$5,342.62 is not justified.

Ed,
In your absence, the City received final billing from
Cook Inlet Construction for the water and sewer extensions
across the Kenai Spur Highway. The quantity calculations
for classified excawation, (gravel and sand), as submitted
by Cook Inlet Construction total $23,249.71; however, my
·
calculationS total, only $17,907.09 for a difference of
$5,342.62.
The City- has discussed this difference in some detail
with Jesse Robinson on two different occasions; and, Mr.
·
Robinson agrees to an over billing of $4000.00. This still
leaves us with a gap in agreed quantities amounting to
$1,B42.62. Of this figure, I would recommend giving Cook
Inlet "benefit of the. doubt" for an additional $500.00 for

Kelly Construction has extended their bond for a period of
30 day, which expires December 2, 1971, for the City to
make a decisSon on the:ir bid of the Public Safety Building.
Administration has requested the bid be put together by
Kenai S'teel Buildings Inc. for force account work on the
Public Safety Building. Their base bid, without extras
is $742,047. This bid included the basic building only.
No bond would be required, no builders risk insurance,
no furni.ture, no vinyl gyp board, no ramp~ for fire trucks,
etc.
THE ADMINISTRATION RECO~B~IENDS that the Council accept
Kelly Construction's basic bid of $785,000 plus alternate
31, $25,435, and alternate #2., $22,388, making a total
award to Kelly Construction of $832,823.
$450,000 authorized out of bond sale for 'the Public Safety
Building, $332,526- Grant from F.A.A., $100,000 - from
additional monies from Airport Development Capital Improve-
ment Fund, is the money the Administration feels we have
available. .

Gentlemen'
The City of Kenai's audit is progressing on s-chedule.
The Finance Department has informed me that the-balance
sheets of June 30, 1971 will be ready for the auditors on
December 1, 1971. We have had several meetings with the
City's auditor, Mr. Jay Siddle of Touche Ross Inc. and
they will have a balance sheet report on all the funds of
the City back for your consideration before the last meeting
in December.
There are several items that are going to need Council action
be'fore the auditor can finish the reports. The Financ.e
Department will have these actions for your consideration
on the December 1st meeting. This audit, that we are going
to receive from the accounting firm of Touche Ross,will be
a balance sheet audit only and will give us a starting point.
for our complete operations as of 1 July 1971. We are
proceeding to keep the accounts and materials up to date
and are presently current with our finincial statements as
far as monies received and monies dispursed are concerned.
The fixed assets accounts, and the water, and Sewer system and
the airport.funds-will not be completely tied down at the
end of this audit but. we feel that progress is being made
and that these fixed asset funds will be inclUded in our
1972 audit report.
This balance sheet audit will give us a cut off date of
June 30, 1971-on all accounts and we will receive a favorable
opinion from our auditing firm as to correctness and relia-
bility as of our'. end-of the year statement

~"/ATER AND SEWER SYSTEM.-
Enclosed are copies of memos from 5ir Massey, Water and
Sewer Superintendent, to myself,, dated November 6, 1971' and
November 15, 19"1. ?,ir. ;,lassey has outlined to us the process
that he reconmends for acquiring the ownership of the Mommsen
Park Subdivision Sewer and Water Distribution Systems.
It is the Administrations's recommendati, on that the City of
Kenai acquire the sewer and water systems in the Mommsen
Subdivision. It is not our intent to cause Mrs. Dovie Killen
any hardship because of this acquisition. We.feel that these
people who are living in this subdivision are not getting
served adequately with their present sewer and water system.
Apparently Mrs. Killen is not able to update this system to
provide adequate service f'or the people of this area. It is
our further feeling that we should work with 'Mrs. Killen's
Attorney, Mr. John Hendrickson and request that Hrs. Killen
donate 'the land, the. water and sewer systems-and appurtenances
to the City o-f Kenai for their upkeep and maintenance as well
as a committment from us that we will provide within the next
two years an adequate hook-up for water and sewage igto this
area and provide to the constituents the much needed services
that they are entitled to.
Our future development plans include a sewer interceptor
line that would reach to the Mommsen and Bush Lane subdivision
areas and it would be relatively inexpensive for us to hook
the sewer system into our interceptors at that time. Our
Industrial Water Line Complex Project would provide water
within the near vicinity of the blommsen and Bush Lanes Water'
Distribution Systems and at that time the City would hook .
into these .systems with a line that would provide .potable and
acceptable water for their Use.
THE ADMINISTRATION'S RECOS,~IENDATION to the Council that the
City acquire the ownership of the blommsen Subdivision Water
and Sewer Distribution Systems at no cost to the City and
operate these as part of our total water and sewer distrib-
ution system. We would also further recommend that the same
acquisition and committm'ents be made.on .the Bush Lane Sub-
divis ion.

I. Back Ground Data
i The water dist:~'.~bution and sewage collection system servin~
that area with in the City of Kenai known as Mommsen Park
Subdivision was designed in 1964 .by Mr. Oden Strnadberg.
Ownership of the system, not counting the interest of SBA,
is held by Mrs. Dovey Killen now living on Redoubt Blvd.,
Kenai, Alaska.
The sewage collection lines constitute a combined domestic
storm sewage system which discharges directly onto the beach
near the terminus of Wildwood Road. A combined storm-
domestic sewage system was consistent with State and Federal
requirements at the time it was constructed; however, with
new laws requiring some form of treatment prior to discharge
into State receiving waters, we find that the combined systems
carry such large volumes of water that treatment is economi-
cally .unfeasible. The other problem with the Mommsen system
as previously mentioned centers around the discharge of sewage
effluent directly onto the Wildwood Beach. This discharge
is caused primarily by w, hat appears to be a broken outfall
line below the mean low-low tide level..
In'short, the Mommsen Park sewage c.ollection system will
require modification to domestic collection only, and repair of the
existin~o outfa!! before connection to the pro~osed~ Mommsen interceptor.
The work required wi!2 not be extensive, nor wi21' the expense rule out
the economic feasibility of serving the area. However, it is doubtful
that the owners of
.~.~msen Subdivision can afford the necessary re-
pairs without City ass-~.stance; and as suc.h, the City will probably have
to assume ownership_ of the~ ~svstem~ and _~ake the repairs required prior
to the interceptor "hook-up" next fall.
Insofar as water, the "as-builts" of the distribution system along
with the Mommsen well water analysis data is attached. Of particular
interest (pl~ease note) is the chemical content of the Momm~sen well.
Among other undesirable features such as color, the saline content is so
high that even grass has difficulty surviving the poisonous effects;
and, f-or the most part, residents of the area find the water totally
undrinkable.
Line sizing is .another critical factor. As you will note, many of the
water lines are only four inches,in diameter, an Under sizing problem
which will restrict high volume fire flows. Thus, even with an adequate
source of supply, it will require several connection points to the main
distribution line in order to meet fire flows high' enough to pass the
Pacific Fire Rating Buriau's. zone five requirement. In other words, the
expense of putting good water to the Mommsen Subdivision in conjunction
with up-grading existing fire ratings places a burden of expense on the
utility owners very similar in natur.e to that' of the sewe~ system. The
same .burden does not apply to the City of Kenai because of its advantage
· in securing loans and grant contribUtions which are-not, availabl.e to
private enterprise; but, it' wouid not be desirable to invest too much
money int° securing ownership.

the City contact Mr. Lee Peterson of the U.S. Attorney's
Office, who is in 'charge of preparing SBA's foreclosure
papers. In following through with Mr. Carter's suggestion,
I contacted Mr. Peterson, who gave me the same. information
and the same offer. He did mention that the City might
also contact Mr. John Hendrickson, Kill'en's AttorneY in
Anchorage and work out an ownership transfer prior to fore-
closure. Mr. Peterson stated the .City would still re.ceive
the system free and cl'ear, but the public relations aspe'ct
might be better following the. lat'ter choice.
It is my recommendation that the City follow

As you know, Pacific Lighting Company is planning
to construct a large LNG plant in th'e-Kenai - North Kenai
area. We have received recent information that the pre-
liminary design is on the boards with Fluor Corporation
in Los Angelos, California; and, questions concerning plant
design in relation to an adequate water supply are presently
being investigated by that firm.
Co'nsidering this, I feel-that it is imperative for the
City of Kenai to select, an engineering firm to do the de-

would serve the entire Kenai - North Kenai area. Decisions
which could advers'ely affect plant location are being made
at this time. Concerning this, the City of Kenai should be
able to answer with detailed accuracy what we can .so 'in re-
gards t.o quantity, quality, and Price of industrial water;
and I do not believe that we-have a great deal of time in
which to act.
With your concurrence I would recommend that an engineer-
ing firm be sele.cted and given "notice ~to proceed" no ..later
than the December 15th Council meeting.

firm has undisputed technological exDerience in water
treatment; and, in combination with Galliett and Associ-
ates I feel that we would receive a very thorough fea-
sibility study. Harold Galiiett has been working toward
this project for several years; and, I fe.el that his
motivation towards a sucessful study would be based
as much on desi.re to see the project materialize as on
fee.
Should the Council and the administration wish t° choose
from ad'dit:io'nai firms, .I would suggest they consider
Linck-Thompson. Linck-Thom~son has had a great deal
of experience in both treatment and distribution and
has just recently completed a project very similar to
that prop.osed by Kenai in Anacortes, Oregon. i mention
this firm as a third 'choice not because of their lack
of experience'. Their experience has been proven many
times over; however, I am not sure personally that we
would receive the energetic input whcih this project
is going to require on the short time span which is
remaining.
May I have your concurrence on this recommendation and
send out invitations to the above engi'neering firms to make
additional presentations on or before the December 15th
Coun.cil meeting.
