To date, the U.S. Army Corps of Engineers (COE) has conducted the following studies: 1. Technical Feasibility Study 2. Economic Feasibility Study 3. Cultural and Historical Resources Study 4. Socio- Economic Impact Study 5. NEPA Documentation, Environmental Assessment (80 %) 6. Conceptual Construction Plans 7. Cost Estimates Presently the COE is undertaking what is referred to as the "Final Feasibility Study" or "Decision Document." Following the completion of this Report, scheduled for August 2017 or earlier, the City can compete for Federal Funding for coastal erosion projects. The cost to the City for its share of this report exceeds $585,000, of which a portion is from Grant 12 -DC -377. One of the measures in determining the viability of a non - federal project sponsor is their financial capability. In no small part, the COE has continued to forward this project because the City of Kenai has demonstrated the financial resources necessary to support its 35% local match. Section I. The Department shall pay the Grantee for the performance of the project work under the terms outlined in this agreement. The amount of the payment is based upon project expenses incurred, which are authorized under this Agreement. In no event shall the payment exceed $1,750.000.00. Section II. The Grantee shall perform all of the work required by this Agreement. Section III. The work to be performed under this agreement begins 7/1/2011 and shall be completed no later than 6/30/2016. Project Description The purpose of this FY 2012 Designated Legislative Grant in the amount of $1,750,000.00 (pursuant to the provisions ofAS 37.05.315, SLA 2011, SB 46, Chapter 5, Section 1, Page 33, Lines 33, is to provide funding to City of Kenai for use towards Kenai River Bluff Stabilization. The objective of this project is to stabilize the erosion of the bluff located in the City of Kenai. This project may include, but is not limited to: Design, permits; Construction of erosion control structure; and Other bluff stabilization improvements. No more than five percent (5 %) of the total grant award may be reimbursed for Administrative expenses for projects involving equipment purchase or repairs and no more than ten percent (10 %) of the total grant award may be reimbursed for Administrative expenses for all other projects. To be reimbursed for eligible administrative costs, expenses must be reported on the Designated Legislative Grant Financial/Progress Report form. 2. Budget Narrative The Grant Funds identified above will be used to complete the project described in the above Project Description. If the Grantee is a City, signatory authority for execution of the Grant Agreement and subsequent amendments is granted to the Mayor. The Mayor may delegate signatory authority for executing the Grant Agreement and amendments to others within the City government via the Signatory Authority Form. The Mayor may also designate financial and progress reporting authority via the Signatory Authority Form. Such delegation is limited to others within the City government, unless otherwise approved by the Department. If the Grantee is not a City, signatory authority for execution of the Grant Agreement and subsequent amendments is granted to the Chief Executive Officer (CEO). The CEO may delegate authority for executing the Grant Agreement and amendments to others within the Grantee's organization via the Signatory Authority Form. The CEO may also designate financial and performance progress reporting authority via the Signatory Authority Form. Such delegation is limited to others within the Grantee's organization unless otherwise approved by the Department. The Grantee must establish and maintain separate accounting for the use of this Grant. The use of Grant funds in any manner contrary to the terms and conditions of this Grant Agreement may result in the subsequent revocation of the grant and any balance of funds under the grant. It may also result in the Grantee being required to return such amounts to the State. The Grantee shall submit a Designated Legislative Grant Financial/progress Report Form (see attached) each month, or quarterly, with the concurrence of the Department, during the life of the Grant Agreement. Grant Financial /Progress Report Forms are due fifteen (15) days after the end of the month or quarter being reported. The report period is the first of the month through the last day of the month. If quarterly reporting is approved, the report period is the first day of the first month through the last day of the third month of the quarter. The final Financial/Progress Reports must be submitted within thirty (30) days following completion of the project. Under no circumstances will the Department release funds to the Grantee unless all required reporting is current. 5. Grant Forms Packet The following page, which includes the Designated Legislative Grant Financial /Progress Report Form, is to be used by the Grantee for monthly /quarterly reporting. Additional copies of this form are available from the Department, electronically or in hard copy. Construction of Wastewater Treatment Plant Upgrades — Phase II In August 2015, the City responded to a Request for Questionnaire's from the Alaska Department of Environmental Conservation, for Municipal Matching Grants. The City's Questionnaire scored very well, and would likely be funded if the program is funded at the same level as in last year's capital budget, approximately $8 million. Over the past four years, funding for the MMG program has been reduced from an average of approximately $25 million to last year's $8 million. This is an important program which provides Alaska communities the funding required to support water and sewer infrastructure projects. 2. Paving and Improvements to City Streets 3. Suggested by: Administration CITY OF KENAI RESOLUTION NO. 2015 -53 A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, ADOPTING THE CITY OF KENAI RECOMMENDATIONS FOR STATE -WIDE PROJECTS FOR THE STATE FISCAL YEAR 2017 WHEREAS, the State of Alaska undertakes capital improvements projects that provide a benefit to all of the citizens of Alaska; and, WHEREAS, certain ongoing and proposed State of Alaska Capital Projects providing State -Wide benefits are located within and /or near the corporate boundaries of the City of Kenai; and, WHEREAS, the Kenai City Council recognizes the benefit of these projects for all of the citizens of Alaska; and, WHEREAS, the Kenai City Council supports the funding and construction of State - Wide Projects; and, WHEREAS, the Kenai City Council held a public hearing on the Capital Improvements Program adoption on September 16, 2015 which included the discussion regarding State -Wide Projects; and, WHEREAS, if unforeseen circumstances occur, the City Council authorizes the City Manager to modify as necessary the City of Kenai's Recommendations for State -Wide Projects for the State Fiscal Year 2017, and that any modification will be brought before Council for approval at the next regularly scheduled Council meeting, NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, adopts the attached City of Kenai Recommendations for State -Wide Projects for the State Fiscal Year 2017.
