HomeMy WebLinkAboutResolution No. 2015-70Sponsored by: City Manager CITY OF KENAI RESOLUTION NO. 2015 -70 A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI CONSENTING TO THE VACATION OF A 10 -FOOT PUBLIC UTILITY EASEMENT WHICH IS SET FORTH ON THE PLAT OF JAYNES SUBDIVISION BIG MIKES ADDITION, WHICH IS ATTACHED HERE TO AS EXHIBIT "A ". WHEREAS, on May 13, 2015, by Resolution PZ15 -13, the Planning and Zoning Commission of the City of Kenai recommended that the Kenai Peninsula Borough Planning Commission approve JAYNES SUBDIVISION BIG MIKES ADDITION & RIGHTS -OF -WAY DEDICATION subject to certain conditions: and, WHEREAS, on July 13, 2015, the Kenai Peninsula Borough Planning Commission met and approved Preliminary Plat and Rights -of -Way Dedication consistent with the Planning and Zoning Commission for the City of Kenai; and, WHEREAS, on November 4, 2015 the Council of the City of Kenai consented to the Acceptance of Dedication of Rights -of -Way for Van Antwerp Avenue and Childs Avenue; and, WHEREAS, Ordinance No. 2802 -2014 which became effective on January 16, 2015, amending Kenai Municipal Code 22.05.110(b) - Determination as to Need for Public Use, as follows: "Whether land previously dedicated to public use or should no longer be needed for public use shall be determined by the City Council by ordinance, except in cases of vacation of rights -of -way or easements which may be determined by resolution. "; and, WHEREAS, the Utility Companies of: Alaska Communications Inc. (ACS), General Communications Inc. (GCI), ENSTAR Natural Gas, and Homer Electric Company have submitted statements which offer no objection to the removal of the Public Utility Easement; and, WHEREAS, the Public Utility Easement was not vacated by virtue of the Preliminary Plat and the applicant has petitioned the Kenai Peninsula Borough to vacate the Public Utility Easement by separate document; and, WHEREAS, the Public Utility Easement listed below is no longer needed for public use and is consistent with the development of Jaynes Subdivision Big Mikes Addition. NOW, THEREFORE, BE IT RESOLVED, BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that the following Public Utility Easement within the Jaynes Subdivision Big Mikes Addition, within the City of Kenai is no longer needed for public use: 1. Vacate approximately 464 feet of the Public Utility Easement, a 10 -foot wide Easement, as dedicated and shown on Tract 2A of Jaynes Subdivision Childs Addition KN 1983 -14. The petitioner must secure and submit written comments from utility companies. ff the easement is within city limits; secure and submit city's written comments. The completed petition, with all required attachments, accompanied by a $75.00 non - refundable fee, must be submitted to the Planning Department a minimum of thirty (30) days prior to the meeting at which the Planning Commission will take action. ✓❑ Fees - $75.00 non - refundable fee attached. To accomplish an approved vacation; a Planning Commission Resolution must be filed with the State Recorder to enter the vacation into the public records unless the vacation is accomplished by plat. Petitioner must pay filing fees (usually $22 -$27). Matt Kelley, City Planner DATE: December 10, 2015 SUBJECT: Resolution No. 2015 -70 The purpose of this communication is to introduce Resolution No. 2015 -70, Consenting to the Vacation of a 10 -foot Public Utility Easement which is set forth on the Plat of Jaynes Subdivision Big Mikes Addition, which is attached hereto as Exhibit "A ". On May 13, 2015, by Resolution No., PZ15 -13, the Planning and Zoning Commission of the City of Kenai recommended that the Kenai Peninsula Borough Planning Commission approve the Preliminary Plat. At their meeting of July 13, 2015, the Kenai Peninsula Borough Planning Commission approved the Preliminary Plat and Rights -of -Way for Childs Avenue and Van Antwerp Avenue for public -use, consistent with the proposed subdivision plans. Subsequently, on November 4, 2015, the Council of the City of Kenai consented to the acceptance of dedication of Rights -of -Way for the above mentioned streets. The subject Public Utility Easement was dedicated and shown on Tract 2A of Jaynes Subdivision, Childs Addition KN 1983 -14. As shown as a part of Tract 2A, the Public Utility Easement is approximately 464 feet in length and 10 feet in width. The applicant has requested to vacate this easement though a Petition to Vacate Utility Easement application to the Kenai Peninsula Borough. As part of the application, the Utility Companies of ACS, GCI, Enstar and Homer Electric have all consented that they have no objection to the vacation. Thank you for your consideration.
