Sponsored by: Council Members Bookey and Molloy CITY OF KENAI ORDINANCE NO. 2865 -2015 COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING SECTION 1.10.040 - TIME OF REGULAR MEETING, TO FOR ESTABLISHING, CANCELING AND CHANGING WHEREAS, on October 6, 2015 the voters of the City of Kenai approved Proposition No. 2, which amended Section 2 - 6, Council: Meetings, of the Charter of the City of Kenai to allow for cancelation of meetings by the Mayor due to lack of a quorum or for an emergency, or by a majority of council members for any reason as long as at least twenty (20) regular meeting are held each calendar year and at least one each month; and, WHEREAS, it is in the best interest of the City to codify the procedures for canceling or changing meeting dates consistent with the direction provided by the City's Charter to ensure a consistent process with reasonable public notice; and, WHEREAS, annually establishing a calendar of regular Council meetings allows Council to schedule meetings around known or anticipated conflicts well in advance and would provide as much notice as is reasonably possible to administration and the public; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, as follows: Section 1. Form: That this is a code ordinance. Section 2. Amendment of Section 1. 10.040 of the Kenai Municipal Code: That Kenai Municipal Code, Section 1. 10.040 - Time of regular meeting, is hereby amended as follows: 1.10.040 Dates and Time of [R]Regular [M]Meetings. (f) Unless otherwise approved as provided in this section, [T]the regular meeting of the Council of the City of Kenai, Alaska shall be at a time set by a resolution of the Council on the first and third Wednesdays of every month [UNLESS CIRCUMSTANCES WARRANT DEVIATION OF THE REGULAR MEETING DATE WHEN THE COUNCIL, BY MAJORITY VOTE, MAY CHANGE THE DATE AND GIVE PUBLIC NOTICE OF SUCH CHANGE]. each year and at least one regular meeting each month. Section 3. Severability: That if any part or provision of this ordinance or application thereof to any person or circumstances is adjudged invalid by any court of competent jurisdiction, such judgment shall be confined in its operation to the part, provision, or application directly involved in all controversy in which this judgment shall have been rendered, and shall not affect or impair the validity of the remainder of this title or application thereof to other persons or circumstances. The City Council hereby declares that it would have enacted the remainder of this ordinance even without such part, provision, or application. Section 4. The default dates of Council meetings continue to be the first and third Wednesdays of each month, unless otherwise approved by Council [Paragraph (a)]. The proposed procedures are: On or before the last meeting of December, the Council establishes the dates for the subsequent year's Council meetings by resolution. Per Proposition No. 2, this calendar must include a minimum of twenty (20) regular meetings each year and at least one (1) regular meeting each month. [Paragraph (b]. 2. If the Council needs to vary the year's calendar during the year, then the Council may cancel or reschedule a regular meeting for any reason by a majority vote on a resolution, as long as the Council complies with the minimum requirements for regular meetings. The reasons for canceling and/or rescheduling a meeting are to be set forth in the resolution. [Paragraph (c)]. The Mayor may cancel any regular meeting due to lack of a quorum or for an emergency that, in the judgment of the Mayor, calls for immediate action to cancel the regular meeting. The City Clerk is to give as much public notice of the meeting cancellation as is necessary or reasonable under the circumstances. [Paragraph (d)]. That part of the existing code that requires the time of the regular meetings to be set by resolution is not changed, so this ordinance does not change the present 6:00 pm start time for regular meetings.
