CITY OF KENAI
ORDINANCE NO. 2886 -2016
AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, ACCEPTING
AND APPROPRIATING FUNDS FORFEITED TO THE KENAI POLICE DEPARTMENT.
WHEREAS, the Kenai Police Department has received notice from the Court authorizing the
forfeiture of $1,185 in cash to the primary investigating agency (Kenai Police Department);
and,
WHEREAS, the Alaska State Troopers also provided the Kenai Police Department with
an asset forfeiture sharing check in the amount of $4,936; and,
WHEREAS, the Police Department will utilize the forfeited funds to purchase equipment for
use by law enforcement officers for law enforcement purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA
Section 1. Form. That this is a non -code ordinance.
Section 2. That the City Manager is authorized to accept forfeited funds in the amount
of $6,121 and to expend the funds for use by law enforcement officers for law
enforcement purposes.
Section 3. That estimated revenues and appropriations be increased as follows:

SUBJECT: Request ordinance appropriating asset forfeiture funds.
Forfeiture 1
In March of 2016, the Alaska State Troopers, Alaska Bureau of Alcohol and Drug
Enforcement (ABADE) provided the Kenai Police Department with $4,936 in State asset
forfeiture sharing funds. These funds were related to asset forfeitures from a drug -
related criminal investigation. The Police Department will utilize the funds to purchase
equipment for use by Kenai Police Officers for law enforcement purposes.
Forfeiture 2
The State court has authorized the forfeiture of $1,580 to the primary investigating
agency. The cash was seized for its connection to a drug - related investigation in which
the Kenai Police Department was the primary investigating agency. Per Alaska Statutes
the court may award 75 percent ($1,185) to a municipal law enforcement agency. The
remaining 25 percent ($395) will be transferred to the State. The Police Department will
utilize the funds to purchase equipment for use by Kenai police officers for law
enforcement purposes.
I am requesting an ordinance to appropriate these funds to the General Fund, Police -
Small Tools to help pay for police equipment to be used in by police officers in the
course of their duties. The total appropriation requested is $4,936 + $1,185 — total of
$6,121.
