Mayor Porter thanked the Commission for their work as Planning and Zoning Commission
Members and their work on the Comprehensive Plan.

a. Review of Shore Fishery Leases
During his report, City Planner M. Kelley stated all leases were renewals of shore leases North of
Cook Inlet View Drive that were renewed every ten years following the State of Alaska’s leasing
structure. He also noted that the Attorney had reviewed the leases and approved their form.
It was clarified that the leases are set net sites and fees were comparable statewide.
MOTION:
Commissioner Glendening MOVED to recommend to City Council to renew seven Shore Fishery
Leases; Commissioner Peterson SECONDED the motion. UNANIMOUS CONSENT was
requested.
VOTE: There were no objections; SO ORDERED.
9. PENDING ITEMS: None.
10. REPORTS:
a. City Council – Council Member Knackstedt reviewed the action agenda from the April 20
Council Meeting which was provided in the packet and provided clarification that the
Reservoir that was approved was funded with grant funds.
b. Borough Planning – Commissioner Glendening reported that the Plat Committee and
Planning Commission met April 25 and approved 4 plats, granted a utility easement,
approved three material extraction permits, and addressed an anadramous fish stream
issue with a State of Alaska on the Sterling Highway.
c. Administration – Kelley reported on the following:
• April 26 was the final Comprehensive Town Hall meeting for the public
• Planned to schedule work sessions with the Planning and Zoning Commission
in May and June.

• Noted a Comprehensive Plan Town Hall meeting for business members to be
held on May 10.
• Provided a reminder of the Volunteer Appreciation Dinner on May 3.

14. COMMISSION COMMENTS & QUESTIONS:
Commissioner Pettey thanked staff and the contractor for their professionalism with the
Comprehensive Plan revision.
Commissioner Peterson noted he was impressed with the way the meeting went on April 26 and
was surprised with the number of people that seemed misled, misguided and misunderstood. He
added that he hoped that there could be some education to explain that the Comprehensive Plan
is not a rezoning. He also thanked staff for their work on the meetings.
Jeff Twait thanked City Planner Kelley’s wife for her assistance with the Comprehensive Plan
meetings.

ANALYSIS
General Information:
The applicant purchased this property in April, 2015. The property contains an
approximately 3,377 square foot residence with a 732 square foot garage. This
property is located in the Rural Residential Zone which provides that a lodge is a
conditional use; therefore, a Conditional Use Permit must be granted prior to
operating a lodge on the premises.
A Conditional Use Permit (PZ96-37) was previously granted to Bryan Lowe by the
Planning and Zoning Commission on May, 8, 1996, for lodging and a guide service.
On January 24, 2001, the Planning and Zoning Commission granted a transfer of the
Conditional Use Permit to Michael Kent d/b/a Alaska Lodge (PZ01-05). In addition, to
the transfer to Mr. Kent, the conditional use was amended from “lodging and guide
service” to “hotel with guide service”. Subsequently, Mr. Kent sold the property to
Ramon Ortiz and a Transfer of Conditional Use Permit was granted to Ramon Ortiz,
d/b/a Alaskan Lodge LLC. When Mr. Ortiz filed the 2009 annual report he indicated
that the business was closed. The City of Kenai notified Mr. Ortiz that since the
business was closed, the conditional use would lapse and that he could not operate a
business from that location unless a new Conditional Use Permit was granted by the
Planning & Zoning Commission. Mr. Kent subsequently regained ownership of the
property through a foreclosure action and has now sold the property to the applicants.

KMC 14.20.150 details the intent and application process for conditional uses. The
code also specifies the review criteria that must be satisfied prior to issuing the
permit. The criteria are:
• The use is consistent with the purpose of this chapter and the purposes and
intent of the zoning district.
The RR Zone is intended to provide for low density residential development in
outlying and rural areas in a form which creates a stable and attractive
residential environment. The Land Use Table provides that a lodge is a
conditional use; therefore, a Conditional Use Permit must be granted to
operate a lodge in this zone.
The area along Angler Drive is not predominately residential. Because of the
proximity to the Kenai River, property owners along Angler Drive have
established business that are associated with the fishing and tourism industry.
There are approximately 45 parcels along Angler Drive and fourteen of the
property owners have been granted Conditional Use Permits to operate
businesses associated with fishing and tourism (i.e. cabin rentals, bed and
breakfast establishments, lodges, and guide services).
The subject property is located at the Southern end of Angler Drive. The three
story structure compliments the neighborhood surroundings with T-111 siding
painted in earth tones and a metal roof. A Conditional Use Permit was
previously granted by the Planning and Zoning Commission for a conditional
use of lodging and guide service. The conditional use was later amended to
“hotel with guide service”. Said Conditional Use Permit would most likely still
be active, if the business had not been closed by a previous owner.
• The value of the adjoining property and neighborhood will not be significantly
impaired.
As stated above, approximately thirty-one percent (31%) of the neighborhood
consists of businesses associated with fishing and tourism. These businesses
are well established and do not detract from the neighborhood.
The applicant owns the property to the south and west of the subject property.
The property to the north is undeveloped property. Riddles Fishing Lodge and
Alaska Chinook Lodge are located to the east (across Angler Drive).
• The proposed use is in harmony with the Comprehensive Plan.
The Comprehensive Plan designates this property as Rural Residential which
provides for large lots serviced by on-site water supply and wastewater
disposal system. The land use designation as a lodge is not incompatible with
the neighborhood.
• Public services and facilities are adequate to serve the proposed use.

The properties located along Angler Drive are serviced by well and septic,
natural gas, electricity, and telephone services. Angler Drive is a paved road
which is maintained by the City of Kenai. The applicant states that the septic
system is designed to accommodate the number of bathrooms located in the
structure. The property contains a large gravel driveway and parking area that
will accommodate parking for guests to the lodge.
• The proposed use will not be harmful to the public safety, health or welfare.
The use of a lodge will not be harmful to the public safety, health and welfare.
A lodge was previously operated from this location and there were not any
harmful effects to public safety, health and welfare.
• Any and all specific conditions deemed necessary by the commission to fulfill
the above-mentioned conditions should be met by the applicant. These may
include, but are not limited to measures relative to access, screening, site
development, building design, operation of the use and other similar aspects
related to the proposed use.

RECOMMENDATIONS
Based on the application and a review of the criteria required to approve the permit, it
appears the application meets the intent of the zone and complies with the
Comprehensive Plan. Recommend approval with the following requirement:
1. Further development of the property shall conform to all Federal, State,
and local regulations.
2. A biennial fire inspection must be completed by the Fire Marshall for the
City of Kenai.
3. A yearly Conditional Use Permit report must be submitted to the City of
Kenai prior to the 31st day of December of each year.
4. Prior to issuance of the Conditional Use Permit, applicant shall submit
verification from State of Alaska, Department of Conservation that the
septic system which is installed is adequate to service the lodge.

WHEREAS, an application meeting the requirements of Sections 14.20.105, 14.20.150
and 14.20.180 of the Kenai Municipal Code has been submitted and received on April
12, 2016;
WHEREAS, the application affects land which is zones as zoned as Rural Residential
(RR).
WHEREAS, a duly advertised public hearing as required by Kenai Municipal Code
14.20.153 was conducted by the Commission on May 11, 2016.

site plan designates 11 parking spaces for staff and guests to the lodge.
