Commission Chair Twait called the meeting to order at 7:00 p.m.

City Clerk S. Modigh and City Attorney S. Bloom provided an overview of the Open Meetings
Act and Parliamentary Procedures.
7. PUBLIC HEARINGS:
a. PZ16-12 – Application for a Conditional Use Permit for a lodge to be located on the
property known as 1530 Angler Drive, Tract 2, Anglers Acres Subdivision, submitted by
Curt and Debra Shuey, P.O. Box 515, Kenai, AK 99611.
Applicants Curt and Debra Shuey participated telephonically.
City Planner Kelley reviewed his staff report, reviewing the conditions that are to exist as a
prerequisite to issuance of a conditional use permit and recommending approval of the permit
with the following conditions:
• Compliance with all Federal, State, and Local regulations
• A biennial fire inspection must be completed by the Fire Marshall for the City of Kenai
• A yearly conditional use permit report must be submitted to the City of Kenai prior to the
31st day of December of each year.
• Prior to issuance of the conditional use permit, applicant shall submit verification from the
State of Alaska, Department of Conservation that the septic system which is installed is
adequate to service the lodge
MOTION:
Commissioner Fikes MOVED to approve Resolution No. PZ16-12 with staff recommendations
and Commissioner Peterson SECONDED the motion.
Chairman Twait opened the public hearing.
Applicants advised that it was their intent to rent out rooms at the lodge.
Planner Kelley noted that this residence is being converted to a lodge with a commercial use via

b. Borough Planning – Commissioner Glendening reviewed the action of the May 9 meeting.
c. Administration – Kelley reported on the following:
• Thanked all that attended the fourth town hall meeting related to the
comprehensive plan update and reminded of upcoming work sessions.

Council Liaison Knackstedt advised of the Board of Adjustment hearing scheduled on
Monday, May 16.

ANALYSIS
General Information:
The applicant has requested to construct an approximately 160 square-foot Coffee Wagon on the
subject parcel. The applicant purchased the subject parcel on July 22, 2015. The property is
currently vacant and is approximately .46 acres in size. The subject parcel is located within the
Limited Commercial Zone; therefore, pursuant to Kenai Municipal Code 14.22.010 a Restaurant
requires the issuance of a Conditional Use Permit prior to construction and operation of the
proposed Coffee Wagon.
Kenai Municipal Code (KMC) 14.20.150 details the intent and application process for
conditional uses. The code also specifies the review criteria that must be satisfied prior to
issuing the permit. The criteria are:
The use is consistent with the purpose of this chapter and the purposes and intent of the
zoning district.
The subject parcel is zoned Limited Commercial (LC), and is therefore subject to the Conditional
land-uses as shown in KMC 14.22.010 – Land Use Table. Zone. Restaurants are a conditional
use in the Limited Commercial zone; therefore, the applicant has submitted an application for a
Conditional Use Permit. The Limited Commercial Zone as outlined in KMC 14.20.115, is intended
to provide transition areas between commercial and residential districts by allowing low to medium
volume businesses, mixed residential and other compatible uses which complement and do not

materially detract from the uses allowed with adjacent districts.
Pursuant to the submitted site plan, primary access to the subject site would be via North
Dogwood Road. The subject site is located at the corner of North Dogwood Road and the Kenai
Spur Highway. The Kenai Spur Highway is classified by the State of Alaska Department of
Transportation and Public Facilities as a Major Collector. A collector is defined as “A road
classification applicable to roads serving a mixture of local access and through traffic, for which
the volume, average speed, and trip length of vehicles using the road are usually lower than for
principal or minor arterials, but higher than for local roads.” Furthermore, KMC 14.20.320 defines
a Collector as “…a street located and designed for the primary purpose of carrying through traffic
and of connecting major areas of the City”. A Driveway Permit issued by the City of Kenai Public
Works Department will be required prior to construction or operation of the Coffee Wagon.
Therefore, given the above discussion within the context of the proposed land-use project, it
seems reasonable the proposed Coffee Wagon would be consistent with the purpose of KMC
14.20.150 and the intent of the Limited Commercial Zoning District given the compliance with staff
recommended specific conditions of approval.
The value of the adjoining property and neighborhood will not be significantly impaired.
The construction of the proposed Coffee Wagon will not significantly impair the surrounding
neighborhood. The proposed Coffee Wagon will only occupy a small portion of the subject parcel
and will only have one driveway access from North Dogwood Road. The applicant has also
indicated that they plan to retain the existing trees and vegetation to the west and north to aid if
visual screening.
The proposed use is in harmony with the Comprehensive Plan.
The subject parcel is defined in the 2003 Comprehensive Plan as Neighborhood Commercial.
The plan defines Neighborhood Commercial as “The Neighborhood Commercial district applies
to areas along the arterial road system that are suitable for small-scale neighborhood-serving
retail, service, and office uses.” The Limited Commercial Zone closely resembles the Mixed Use
Zone in the 2003 Comprehensive Plan. The Mixed Use District fosters a compatible mix of retail,
service, office, public, institutional recreational and multi-family residential uses. The district does
not prescribe specific proportions for these uses, only that all these uses are desirable within the
district. As proposed, the proposed use would be in harmony with the 2003 Comprehensive Plan
and mixed use nature of the larger surrounding neighborhood and is consistent with existing
development along the Kenai Spur Highway.
Public services and facilities are adequate to serve the proposed use.
Pursuant to KMC 17.10.010(a) – Mandatory Connection and Abandonment of Old Well, based on
the submitted site plan and the dimensions of the subject parcel, the proposed Coffee Wagon
would be located within 200 feet on an existing city water main. Therefore, unless an exemption
is granted by the City of Kenai, the applicant will be required to connect to the existing water main
located within North Dogwood Road prior to operation of the proposed Coffee Wagon.

Pursuant to the submitted application, the applicant has indicated that the Coffee Wagon would
be self-contained and use a gray and black water holding system. The applicant has indicated
that they would use a water delivery service to bring fresh water to the Coffee Wagon. As
discussed above the subject Coffee Wagon is located within 200 feet of an existing water main,
therefore, a connection to City of Kenai water will be required, unless an exemption is approved.
Furthermore, the applicant has indicated that they will use an incinerator toilet system. Staff has
contacted the State of Alaska, Department of Environmental Conservation (DEC) and discussed
the application. DEC has stated that they will require approval of these systems prior to operation
of the Coffee Wagon.
The proposed use will not be harmful to the public safety, health or welfare.
The proposed use of the subject parcel as a Coffee Wagon will not be harmful to the to the public
safety, health or welfare provided that all Conditions of Approval are met.
Any and all specific conditions deemed necessary by the commission to fulfill the above-
mentioned conditions should be met by the applicant. These may include, but are not limited
to measures relative to access, screening, site development, building design, operation of the
use and other similar aspects related to the proposed use.

RECOMMENDATIONS
Based on the application and a review of the criteria required to approve the permit, it appears
the application meets the intent of the Limited Commercial Zone and complies with the
Comprehensive Plan. Staff, therefore recommends approval with the following conditions:
The issuance of the Conditional Use Permit shall be conditioned upon the following:
1. Further development of the property shall conform to all Federal, State, and local
regulations.
2. Prior to issuance of the Conditional Use Permit, the property owner shall submit an
approval letter that the water holding tanks and incinerator toilet are approved by the State
of Alaska, Department of Environmental Conservation.
3. Prior to issuance of the Building Permit, the property owner shall submit an application to
connect to the water main located within North Dogwood Road, unless an exemption is
granted by the City of Kenai.
4. Prior to issuance of the Building Permit, the property owner shall submit an application to
the City of Kenai Public Works Department for a Driveway Permit.
5. Prior to issuance of the Conditional Use Permit, the property owner shall submit a
Landscape Site Plan for review and approval by Planning Administration. The Landscape
Site Plan shall demonstrate compliance with Kenai Municipal Code Chapter 14.25 –
Landscaping/Site Plan Regulations.
6. Prior to issuance of the Building Permit, the property owner shall submit a revised site plan
which shows the setbacks from all property lines for the Coffee Wagon and the Storage
Shed.
7. A Sign Permit will be required for all signage located on the property for the Coffee Wagon.
8. Prior to final inspection of the Building Permit, the property owner shall submit approval
from the City of Kenai Fire Marshal that the Coffee Wagon has been inspected and
approved for operation.
9. A biennial fire inspection must be completed by the City of Kenai Fire Marshall.
10. Pursuant to Kenai Municipal Code Section 14.20.150(f) the property owner shall submit
an Annual Report to the City of Kenai.

A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI GRANTING A REQUEST FOR A CONDITIONAL USE PERMIT TO OPERATE AN
APPROXIMATELY 160-SQUARE-FOOT COFFEE WAGON.

WHEREAS, an application meeting the requirements of Section 14.20.150 has been
submitted and received on April 18, 2016; and,
WHEREAS, the application affects land which is zoned as Limited Commercial (LC); and,
WHEREAS, a duly advertised public hearing as required by Kenai Municipal Code
14.20.153 was conducted by the Planning and Zoning Commission on May 25, 2016;
and,
WHEREAS, the applicant has demonstrated with plans and other documents that the
prerequisites of a Conditional Use Permit have been met. Kenai Municipal Code 14.20.150
details the intent and application process for conditional uses. The code also specifies the
review criteria that must be satisfied prior to issuing the permit. The criteria are:
1. The use is consistent with the purpose of this chapter and the purposes and intent of the

OF THE CITY OF KENAI, ALASKA THAT THE APPLICANT HAS DEMONSTRATED THAT
THE PROPOSED OPERATION OF AN APPROXIMATELY 160-SQUARE-FOOT COFFEE
WAGON MEETS THE CONDITIONS REQUIRED FOR SAID OPERATION AND THEREFORE
THE COMMISSION DOES AUTHORIZE THE ADMINISTRATIVE OFFICIAL TO ISSUE THE
APPROPRIATE PERMIT.

ANALYSIS
The Planning and Zoning Commission granted a Conditional Use Permit (PZ15-10) to
Greg Duggan and Tom Reece on May 27, 2015 for the construction and operation of a
gravel pit for the extraction of natural resources. It should be noted that Greg Duggin’s
name is spelled incorrectly as Duggan on Conditional Use Permit PZ15-10.
There was an agreement between Greg Duggin, Tom Reece and Michael S. Brown that
Mr. Brown would operate the gravel pit. At such time as the plat of Jaynes Subdivision
Big Mikes Addition was finalized and recorded; the property shown as Tract Three (3)
on said plat would be purchased by Michael S. Brown.
On May 13, 2015, the Planning & Zoning Commission passed Resolution PZ15-13
recommending approval of the original preliminary plat of Jaynes Subdivision Big Mikes
Addition to the Kenai Peninsula Borough. The plat of Jaynes Subdivision Big Mikes
Addition was approved by the Kenai Peninsula Borough and was recorded in the Kenai
Recording District on December 30, 2015, under plat number 2015-99.
An Application for Transfer of Conditional Use Permit was submitted on January 15,
2016; however, Tract Three (3), Jaynes Subdivision Big Mikes Addition was not

conveyed to Michael S. Brown until March 15, 2016 in Statutory Warranty Deed
recorded under document number 2016-002047-0. Since Mr. Brown is now the owner
of Tract Three (3) Jaynes Subdivision Big Mikes Addition, it is required that Conditional
Use Permit PZ15-10 be transferred to him pursuant to Kenai Municipal Code as set
forth below:
• KMC 14.20.150(i)(5) A conditional use permit is not transferable from one (1)
parcel of land to another. Conditional use permits may be transferred from one
(1) owner to another for the same use, but if there is a change in use on the
property, a new permit must be obtained.
• KMC 14.20.158(a) No conditional use permit issued hereunder shall be
transferred until the proposed transferee has made application for transfer in
writing filed with the administrative official, which application shall state that he
intends to be bound by the plan and statements contained in the application of
the permit holder or shall contain the amendments to the plan his proposed
operation would mandate. The Commission shall approve the application for
transfer and in so doing amend the site plan and statements if such
amendments as are contained in the application for transfer would have been
approved had they been contained in the original application.
Michael S. Brown, Transferee, has indicated that he agrees to operate under the terms
and conditions of the original Conditional Use Permit PZ15-10, as set forth below:
a. Prior to commencement of extraction of Natural Resources, Applicant shall
obtain all necessary State and Federal Permits.
b. Prior to commencement of construction and extraction of Natural Resources,
Applicant shall be required to construct a non-climbable 6 foot high fence as
shown on the approved site plan along Childs Avenue.
c. The only processing of material that shall take place on the subject site is
screening. There shall be no crushing of material or operation of a concrete
or asphalt plant on the subject site.
d. Material extraction site shall be limited to 3-acres in size and shall be located
on the subject site as shown on the approved site plan. Any future expansion
beyond 3-acres of the material extraction site shall require the modification of
the Conditional Use Permit.
e. There shall be no extraction of Natural Resources beyond the ground water
table.
f. Hours of operation shall be 8 am to 8 pm for the moving of materials.
g. Applicant shall file an annual report for the Conditional Use Permit as set forth
in Kenai Municipal Code 14.20.155.
h. Prior to recording the Plat (PZ15-13), the applicant shall submit an application

to the City of Kenai, Planning and Zoning Division for a Transfer of the
Conditional Use Permit for the Gravel Pit (PZ15-10).
I. Applicant shall employ the use of dust control measures to ensure the
material site and Childs Avenue remain dust free. Dust control shall include
the daily use of a water truck and placement of Calcium Chloride on Childs
Avenue. A water truck shall also be used to control dust from the working face
of the Gravel Pit.
During the past year, Mr. Brown has successfully operated the gravel pit and an annual
report was filed on January 15, 2016, indicating that 9,780 cubic yards of gravel have
been extracted from the premises. Further, the Tax Compliance Certification from the
Kenai Peninsula Borough indicates that the property and sales taxes are current and
Mr. Brown is in compliance with the Conditional Use Permit.
RECOMMENDATIONS
Greg Duggin and Tom Reece, Transferors, and Michael S. Brown, Transferee,
submitted an application for Transfer of Conditional Use Permit. The transfer meets the
requirements of Kenai Municipal Code 14.20.150(i)(5) and 14.20.158(a). Planning &
Zoning staff hereby recommends approval of the Transfer of Conditional Use Permit
PZ15-10, subject to the original conditions as set forth on the original permit and the
following additional conditions:
a. Applicant must comply with all Federal, State and local regulations.
b. If there is a change of use for the above described property, a new Conditional
Use Permit must be obtained, pursuant to 14.20.150(i)(5).
