ANALYSIS
This plat reconfigures an existing original approximately 29.4-acre parcel and
would create a new parcel known as Tract A. The existing parcel is an original
parcel and is described as that portion of SE ¼ lying North of the Kenai Spur
Highway and Easterly of Beaver Creek Alaska Subdivision excluding ASLS 76-
118; Section 36, T6N, R11W, Seward Meridian. The resulting parcel would be
approximately 28.77 acres in size.

As reconfigured, the subject parcel would meet the minimum lot size of 20,000
square feet for the Rural Residential Zone.
North Fern Street is a 33-foot gravel right-of-way which is accessed off of the Kenai
Spur Highway. As shown on the preliminary plat, an approximately 666-foot long
by 30-foot wide portion of North Fern Street would be dedicated via the subject
plat. This newly dedicated portion of North Fern Street would make this right-of-
way 66 feet in width, therefore, making it complaint with Kenai Municipal Code
Section 14.10.070(b)(2). The subject preliminary plat would also dedicate an
approximately 300 portion being 60 feet in width Public Access Easement would
serve as an extension of Boundbrook Drive. The subject Public Access Easement
would be located in the southwestern corner of subject Tract A and would not be
considered a dedicated Right-of-Way. It would remain as an Easement for public
travel until such time it is vacated by the City of Kenai upon build out of North Fern
Street. Thus, Tract A would remain as one parcel.
RECOMMENDATIONS
The subject parcel is currently undeveloped and contains a public access road with
is approximately 100 feet in width. The public access road is located is the western
portion of the subject parcel and is known as Shotgun Drive. Upon entering the
subject parcel, Shotgun Drive changes from a dedicated Right-of-Way to a Public
Access. In this location Shotgun Drive contains an intersection with roadways
leading to Twin City Raceway to the West and Snowshoe Gun Club to the North.
This roadway is approximately 100 feet in width and approximately 1,515 feet in
length and is not currently maintained by the City of Kenai. The subject Preliminary
Plat would also dedicate a public Right-of-Way of North Fern Street which is 30-
foot wide by approximately 666-foot long. The subject Preliminary Plat would also
dedicate a Public Access Easement to with is 60 feet in width and approximately
300 feet in length which would serve as an extension of Boundbrook Drive. This
Public Access Easement would remain in place until such time as it is vacated by
the City of Kenai.
The Planning and Zoning Commission recommends approval of the plat of Alaska
State Land Survey No. 2013-49, with the following conditions:
a. Further development of the property shall conform to all Federal, State and
local regulations.
b. The City Council of the City of Kenai must approve the acceptance
dedication of Rights-of-Way for North Fern Street and the acceptance of
Public Access Easement for Boundbrook Drive and Public Access Road for
Shotgun Drive and the 10-foot utility easement, pursuant to Kenai Municipal
Code 22.05.110 and Kenai Peninsula Borough Code 20.28.100.
c. The portion of the lot shown as “Remainder of Govt. Lot 4” shall be shown
on the Plat as having a 33-foot Right-of-Way of North Fern Street.

d. The name of Fern Street shall be changed to North Fern Street to correct
the spelling.
e. The City Manager for the City of Kenai must sign the plat acknowledging
acceptance by the City of Kenai of the final plat.

SUBDIVISION PLAT
A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI RECOMMENDING THAT THE ATTACHED SUBDIVISION PLAT BE APPROVED
SUBJECT TO THE FOLLOWING CONDITIONS:
WHEREAS, the attached plat of ALASKA STATE LAND SURVEY NO. 2013-49 was
referred to the City of Kenai Planning and Zoning Commission on June 8, 2016, and
received from Integrity Surveys, Inc.; and,
WHEREAS, that the following Rights-of-Way within the ALASKA STATE LAND SURVEY
NO. 2013-49 are dedicated within the City of Kenai for a public use: An approximately 666-
foot portion being 30 feet in width and known as North Fern Street as set forth on the plat
of ALASKA STATE LAND SURVEY NO. 2013-49, which is attached hereto as Exhibit
“A”; and,
WHEREAS, the following Public Access Easement within the ALASKA STATE LAND
SURVEY NO. 2013-49 is dedicated within the City of Kenai for a public use: An

STATE LAND SURVEY NO. 2013-49, which is attached hereto as Exhibit “A”; and,
WHEREAS, the following Public Utility Easement as set forth by ADL 224182 and shown
within the ALASKA STATE LAND SURVEY NO. 2013-49, which is attached hereto as
Exhibit “A” being a width of 10 feet and a length of approximately 100 feet is accepted for
a public; and,
WHEREAS, the City of Kenai Planning and Zoning Commission finds:
1. Plat area is zoned Rural Residential and therefore is subject to said zone conditions.
2. Plat does not subdivide property within a public improvement district subject to special
assessments. There is not a delinquency amount owed to the City of Kenai for the
referenced property.
3. Installation agreement or construction of improvements is not required.
4. Status of surrounding land is shown.
5. Utility easements, if required, are shown.
6. Surveyor shall verify that no encroachments exist. If an encroachment exists; the plat
does not create nor increase the encroachment.

ANALYSIS
The Planning and Zoning Commission granted a Conditional Use Permit (PZ 97-24) to
Mary Ann Alfano on June 25, 1997, for a coffee house. The business has been open
since 1997, and has changed ownership numerous times as evidenced by the Transfers
of Conditional Use Permit PZ97-24, as set forth below:
On September 8, 2004, Conditional Use Permit PZ97-24 was transferred to Rebecca
Lambourne and Stanley Coleman by Resolution PZ04-398;
On December 10, 2008, Conditional Use Permit PZ97-24 was transferred to Diane E.
Hooper by Resolution PZ08-61; and
On December 11, 2013, Conditional Use Permit PZ97-24 was transferred to the
Transferee, Shilo Miller, by Resolution PZ13-38.
When the yearly Conditional Use Permit report was mailed to Ms. Miller in November,
2015, it was discovered that she had sold the business to Mary S. Darling. Ms. Darling
was contacted by Planning and Zoning staff to inform her that since the business had
been sold to her, Conditional Use Permit PZ97-24 had to be transferred from Shilo
Miller to her.

On March 27, 2016, an Application for Transfer of Conditional Use Permit was
submitted by Transferee, Mary S. Darlin, pursuant to Kenai Municipal Code as set forth
below:
KMC 14.20.150(i)(5) A Conditional Use Permit is not transferable from one (1)
parcel of land to another. Conditional Use Permits may be transferred from one
(1) owner to another for the same use, but if there is a change in use on the
property, a new permit must be obtained.
KMC 14.20.158(a) No Conditional Use Permit issued hereunder shall be
transferred until the proposed transferee has made application for transfer in
writing filed with the administrative official, which application shall state that he
intends to be bound by the plan and statements contained in the application of
the permit holder or shall contain the amendments to the plan his proposed
operation would mandate. The Commission shall approve the application for
transfer and in so doing amend the site plan and statements if such amendments
as are contained in the application for transfer would have been approved had
they been contained in the original application.
Mary S. Darling, Transferee, has indicated that she agrees to operate under the terms
and conditions of the original Conditional Use Permit PZ97-24, as set forth below:

Staff hereby recommends approval of the Transfer of Conditional Use Permit PZ16-16,
subject to the original conditions as set forth on the original permit and the following
additional conditions:
A. Applicant must comply with all Federal, State and local regulations.
B. Applicant shall file an annual report for the Conditional Use Permit as set forth
in Kenai Municipal Code 14.20.155.
C. If there is a change of use for the above described property, a new Conditional
Use Permit must be obtained, pursuant to KMC 14.20.150(i)(5).
D. Applicant shall file a 2015 Annual Report.
