RESOLUTION NO. 2016 - 39
A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, ACCEPTING A
DONATION OF A PARCEL OF PROPERTY DESCRIBED AS LOTS ONE (1) AND TWO
(2), BLOCK ONE (1) BUSH LANES SUBDIVISION, KENAI, ALASKA FROM GENE E.
LYNN, FOR THE PUBLIC PURPOSE OF FUTURE WATER AND SEWER UTILITY
EXPANSION AND DETERMINING THAT THE PUBLIC INTEREST WILL NOT BE
SERVED BY AN APPRAISAL.
WHEREAS, Gene E. Lynn, through his attorney, John E. Sloan, has offered to donate
to the City of Kenai for its use, the following described real property:
Lots One (1) and Two (2), Block One (1), BUSH LANES SUBDIVISION,
according to Plat No. K -1018, Kenai Recording District, Third Judicial
District, State of Alaska.
WHEREAS, pursuant to Kenai Municipal Code 22.05.135(a) the City may acquire
property needed for a public use on such terms and conditions as the Council shall
determine; however, no purchase shall be made until a qualified appraiser has
appraised the property and given the Council an independent opinion as to the full
and true value thereof unless the Council, upon resolution so finding, determines that
the public interest will not be served by an appraisal; and,
WHEREAS, the Kenai Peninsula Borough tax assessment for the Parcel is $34,400.00,
and Gene E. Lynn is donating the Property to the City without a request for return
consideration, and the public interest would not be served by an appraisal; and,
WHEREAS, the public purpose of the property is the future water and sewer utility
expansion; and
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA,
1) That the City Council hereby accepts a donation of property described as Lots One
(1) and Two (2), Block One (1), Bush Lanes Subdivision, Kenai, Alaska from Gene E.
Lynn, for the public purpose of future water and sewer utility expansion and
determines that the public interest will not be served by an appraisal; and
2) That this Resolution shall be effective immediately upon its adoption.
PASSED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, this 70 day of
September, 2016.

SUBJECT: Resolution 2016 -39, Accepting a Donation of Land
The purpose of this correspondence is to submit and recommend Council adoption of the
above referenced resolution.
The City has been contacted by a Mr. Gene E. Lynn, through his attorney, John E Sloan, and has
offered to donate two lots fronting the Kenai Spur Highway near mile 14.3.
With future expansion of the City's water and sewer utilities, these lots could be used as a
location for a lift station and /or other support facilities.
