CITY OF KENAI
ORDINANCE NO. 2923 - 2016
AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING
KENAI MUNICIPAL CODE SECTION 21.05.020 - AIRPORT RESERVE BOUNDARY MAP,
TO RELOCATE THE AIRPORT RESERVE BOUNDARY FROM THE KENAI SPUR
HIGHWAY TO NORTH SIDE OF COHOE AVENUE AND TO REPLACE THE AIRPORT
RESERVE BOUNDARY MAP IN APPENDIX I OF CHAPTER 21.05 - AIRPORT
ADMINISTRATION AND OPERATION.
WHEREAS, the City of Kenai has undertaken an Airport Master Plan process in which
a comprehensive review of city policies regarding the use, lease and sale of airport lands
was reviewed; and,
WHEREAS, Kenai Municipal Code Section 21.05.010 established an Airport Reserve to
allow for the development, expansion, maintenance, operation, protection and
perpetuation of the Kenai Municipal Airport; and,
WHEREAS, Kenai Municipal Code Section 21.05.020 and Appendix I established an
Airport Reserve Boundary Map on which the Airport Reserve Boundary is depicted; and,
WHEREAS, Kenai Municipal Code Section 21.05.030(c) defines "Airport Reserve" as
City -owned land reserved from sale and designated under KMC 21.02.010 and
21.05.020; and,
WHEREAS, the City has sold property within the Airport Reserve Boundary when
properties have been identified as not needed for aviation purposes or for future
expansion of the Kenai Municipal Airport; and,
WHEREAS, Phase II and Phase III of the Airport Master Plan Report prepared for the
City of Kenai identifies relocating the Airport Reserve Boundary from the Kenai Spur
Highway to the North Side of Coho Avenue; and,
WHEREAS, at their regular meeting of July 14, 2016 the Airport Commission
unanimously recommended that they Airport Reserve Boundary be relocated north of
the existing commercial properties on the Kenai Spur Highway along Colic, Avenue; and,
WHEREAS, at their regular meeting of September 14, 2016 the Planning and Zoning
Commission recommended the Council of the City of Kenai 4Oh (l this

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA, that
Section 1. Form: That this is a code ordinance.

Section 2. Amendment of Section 21.05.020 - Airport Reserve Boundary Mau: That
the Airport Reserve Boundary Map is hereby replaced and amended as
shown on the revised Appendix I map which is attached to this Ordinance.
Section 3. Severability: That if any part or provision of this ordinance or application
thereof to any person or circumstances is adjudged invalid by any court of
competent jurisdiction, such judgment shall be confined in its operation
to the part, provision, or application directly involved in all controversy in
which this judgment shall have been rendered, and shall not affect or
impair the validity of the remainder of this title or application thereof to
other persons or circumstances. The City Council hereby declares that it
would have enacted the remainder of this ordinance even without such
part, provision, or application.
Section 4. Effective Date: That pursuant to Kenai Municipal Code Section
1.15.070(1), this ordinance shall take effect 30 days after adoption.

Subject: Relocation of Airport Reserve Line
At the direction of the City Manager, the relocation of the airport reserve line was added to the
agenda for the July 14, 2016 Airport Commission meeting.
City Manager spoke to the location of the reserve line along the Kenai Spur Highway and wanted
confirmation from Commission that they were supportive of relocating the reserve line north of
the existing commercial properties on the Kenai Spur Highway along Cohoe Avenue. City
Manager also noted that there is a recommendation to relocate the line in the Phase III report to
the airport master plan. City Administration would like to move forward on the relocation.
Airport Commission confirmed that the Commission is supportive of the relocation of the airport
reserve line recommended in the Phase III report.

SUBJECT: Ordinance No. 2923 — 2016 — Relocate Airport Reserve Boundary
The purpose of this communication is to introduce Ordinance 2923 - 2016 to the City Council
The proposed Ordinance would relocate the existing Airport Reserve Boundary from its present
location along the Kenai Spur Highway to Cohoe Avenue. Presently there are 9 parcels which
front onto the Kenai Spur Highway which are zoned Central Mixed Use. These parcels are
located within Gusty Subdivision, Gusty Subdivision Addition No. 1, and Gusty Subdivision No.
4. It has been requested by the Airport Commission to relocate the Airport Reserve Boundary in
this area based on recommendations found in the Phase II and Phase III of the Airport Master
Plan Reports. These 9 subject parcels are zoned Central Mixed Use and are not currently being
used for aviation purposes which serve the Kenai Municipal Airport. Therefore, by relocating
these parcels outside of the Airport Reserve Boundary, it would allow for their potential future
lease or sale for purposes which are better suited to commercial or retail uses along the Kenai
Spur Highway.
At their regular meeting of July 14, 2016 the Airport Commission unanimously recommended to
support the relocation of the Airport Reserve Boundary. At their regular meeting of September
14, 2016, the Planning and Zoning Commission will consider supporting the proposed Ordinance
as well.
For the benefit of the City Council, I have attached a map which shows the present location of the
Airport Reserve Boundary. A revised map which shows the location of the relocated Airport
Reserve Boundary is attached to the proposed Ordinance.

SUBJECT: Ordinance No. 2923 — 2016 — Relocate Airport Reserve Boundary
The purpose of this communication is to provide additional information to the City Council with
regards to Ordinance 2923 — 2016.
At their regular meeting of September 14, 2016, the Planning and Zoning Commission
unanimously approved Resolution PZ16 -33 to relocate the existing Airport Reserve Boundary.
Staff would like to recommend an amendment to Ordinance No. 2923 -2016 by replacing the 8th

WHEREAS, at their regular meeting of September 15, 2016, the Planning and Zoning
Commission recommended that the Council of the City of Kenai enact this Ordinance.

Boundary from the Kenai Spur Highway to the North Side of Coho Avenue and to
Replace the Airport Reserve Boundary Map in Appendix I of Chapter 21.05 —
Airport Administration and Operation.
