KENAI CITY COUNCIL CHAMBERS, 210 FIDALGO AVENUE, KENAI, ALASKA, 99611 http://www.kenai.cit MINUTES CALL TO ORDER Vice Mayor Gabriel called the meeting to order at approximately 6:00 p.m. 1. Pledge of Allegiance Vice Mayor Gabriel led those assembled in the Pledge of Allegiance. 2. Roll Call There were present: Pat Porter, Mayor Mike Boyle Tim Navarre comprising a quorum of the Council. Also in attendance were: Rick Koch, City Manager Terry Eubank, Acting City Manager Scott Bloom, City Attorney Sandra Modigh, City Clerk 3. Agenda Approval MOTION: Bob Molloy Henry Knackstedt Brian Gabriel Council Member Molloy MOVED to approve the agenda. Councilor Boyle SECONDED the motion. MOTION TO AMEND: Council Member Molloy MOVED to amend the agenda by adding "or take other action" to the new business agenda item. Councilor Boyle SECONDED the motion. UNANIMOUS CONSENT was requested. There being no objections, SO ORDERED. VOTE ON MAIN AS AMENDED: City of Kenai Meeting Minutes September 6, 2016 Page 1 of 4 YEA: Knackstedt, Porter, Molloy, Boyle, Navarre, Gabriel NAY: MOTION PASSED. It was noted that Councilor Bookey attempted to participate telephonically, but missed the deadline pursuant to code. City Attorney Bloom advised that Council could not suspend the rules to allow his participation. PUBLIC COMMENTS Hal Smalley encouraged the body to postpone the hiring process of the city manager position until the new council members were seated. Bob McIntosh spoke in favor of the City taking it's time in hiring the city manager position; spoke favorably about the City's current financial status. EXECUTIVE SESSION 1. Review and Discussion of Applications Submitted for the City Manager Position. [AS 44.62.310(C)(2)(D)(5) a Subject that Tends to Prejudice the Reputation and Character of an Applicant; and Meetings of the Governmental Body when Holding a Meeting Solely to Act Upon Matters of Professional Qualifications] fuToy reIiA Council Member Navarre MOVED to convene in executive session for the review and discussion of applications submitted for the city manager position. [AS 44.62.310(C)(2)(D)(5) a Subject that Tends to Prejudice the Reputation and Character of an Applicant; and Meetings of the Governmental Body when Holding a Meeting Solely to Act Upon Matters of Professional Qualifications]. It was requested that the City Attorney, City Manager and City Clerk be available. Council Member Knackstedt SECONDED the motion. Attorney Bloom advised that pursuant to AS 44.62.310(C)(2), he provided a waiver to all applicants regarding the option of having their application discussed in open session. It was noted that George Ducas objected to his application being discussed in executive session pursuant to AS 44.62.310(C)(2). It was clarified that only Ducas' qualifications as a candidate could be discussed in executive session. Councilor Boyle noted that he was not in favor of entering into executive session; wanted to see this process completed on a broader spectrum to receive a larger pool of qualified applicants. September 6, 2016 Page 2 of 4 City Manager Koch noted that this position was advertised for approximately a month pursuant to the process that was previously provided to Council. Councilor Molloy agreed with Boyle in part and noted that the pool of qualified applicants wasn't enough; expressed that he didn't have a problem with executive session to review the first submission of applicants; recognized that this was a very important process and decision and noted that in the past, the process went through two city council's and the time needed was taken. Navarre commented that there was no rush on the process, but felt that the process should continue to see if an applicant meets the needs of the City; was prepared to move forward with this group of applicants. Knackstedt noted that this had been a long process and that there were a good group of qualified applicants; advised that it's the duty of the Council to proceed and not wait on the next Council to proceed. Mayor Porter spoke in favor of Council proceeding and in favor of executive session. Gabriel agreed that it was a very important decision of the Council and believed that Council would be providing a disservice to the community by not proceeding with the outline previously approved by council; was concerned with losing qualified candidates; spoke in favor of executive session. VOTE: YEA: Knackstedt, Porter, Molloy, Navarre, Gabriel NAY: Boyle MOTION PASSED. Council reconvened in open session and Councilor Navarre advised that Council met in executive session and provided direction to administration to correspond with the selected applicants, develop a questionnaire and background matrix and correspond with applicants that weren't selected thanking them for applying. NEW BUSINESS 1. Action /Approval — Schedule Interviews with Selected City Manager Applicants or take other action. MOTION: Council Member Navarre MOVED to approve the hiring process with the following five applicants in no specific order: Steven Dahl, Jim Dinley, Jason Hooley, Martin Moore, Paul Ostrander. Councilor Knackstedt SECONDED the motion. VOTE: YEA: Knackstedt, Porter, Navarre, Gabriel, Boyle City of Kenai Meeting Minutes September 6, 2016 Page 3 of 4 NAY: Molloy MOTION PASSED. MOTION: Council Member Navarre MOVED to approve schedule a special council meeting on September 14, 2016 beginning at 6:00 p.m. to approve the questions to be submitted to applicants and review the background check questionnaire. Mayor Porter SECONDED the motion. VOTE: YEA: Knackstedt, Porter, Navarre, Gabriel, Molloy NAY: Boyle MOTION PASSED. ADJOURNMENT There being no further business before the Council, the meeting was adjourned at approximately 7:20 p.m. City of Kenai Meeting Minutes September 6, 2016 Page 4 of 4
