RESOLUTION NO. 2016 -48
A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AUTHORIZING
THE CITY MANAGER TO ACCEPT A DONATION, ON BEHALF OF THE CITY, OF
PROPERTY DESCRIBED AS LOT 1, BLOCK 20, ORIGINAL TOWNSITE OF KENAI,
KENAI, ALASKA FROM KENAI BIBLE CHURCH, FOR THE PUBLIC PURPOSE OF
INCLUDING THE PROPERTY IN THE BLUFF EROSION RESTORATION PROJECT AND
DETERMINING THAT THE PUBLIC INTEREST WILL NOT BE SERVED BY AN
APPRAISAL.
WHEREAS, Kenai Bible Church has offered to donate to the City of Kenai for its use,
the following described real property:
Lot 1, Block 20, Original Townsite of Kenai, according to Plat No.
K -2970, Kenai Recording District, Third Judicial District, State of
Alaska.
WHEREAS, pursuant to Kenai Municipal Code 22.05.135(a) the City may acquire
property needed for a public use on such terms and conditions as the Council shall
determine; however, no purchase shall be made until a qualified appraiser has
appraised the property and given the Council an independent opinion as to the full
and true value thereof unless the Council, upon resolution so finding, determines that
the public interest will not be served by an appraisal; and,
WHEREAS, the Kenai Peninsula Borough tax assessment for the Parcel is $600.00,
and Kenai Bible Church is donating the subject parcel to the City without a request
for return consideration, and the public interest would not be served by an appraisal;
and,
WHEREAS, the subject parcel will be included in the project to stabilize the erosion of
the bluff at the mouth of the Kenai River.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA,
1) That the City Council hereby accepts a donation of property described as Lot 1,
Block 20, Original Townsite of Kenai from Kenai Bible Church, for the purpose of
including it in the project to stabilize the erosion of the bluff at the mouth of the
Kenai River and determines that the public interest will not be served by an
appraisal; and,
2) That this Resolution shall be effective immediately upon its adoption.

The reason for this decision is that the property can no longer be used for Church purposes and
we know that the city will need it for inclusion in the future "Bluff Erosion Project". We
believe this action will help expedite any required future actions on your /our part.
Please advise us of any City actions that we could be a part of in order to assure our intentions
are clear in this matter.

Accept a Donation of Land known as Lot 1, Block 20, Original Townsite of Kenai
Kenai Bible Church
The purpose of this communication is to provide additional information in support of Resolution
No. 2016 -48, which authorizes the City Manager to accept a donation of real property on behalf
of the City from Kenai Bible Church.
The City was contacted by Mr. Fred Swen and Pastor, Vance Wonser of Kenai Bible Church
expressing an interest in donating Lot 1, Block 20, Original Townsite of Kenai (KPB Parcel No.
047 - 093 -01). The subject parcel is a bluff top parcel and is approximately .33 acres in size.
Most of the parcel has eroded into the Kenai River as a result of bluff erosion, therefore, it is no
longer viable for use by Kenai Bible Church.
The subject parcel would be included in the project to stabilize the erosion of the bluff at the
mouth of the Kenai River.
