ORDINANCE NO. 2927 -2016
AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING
KENAI MUNICIPAL CODE 23.55.020- COMPENSATION STRUCTURE BY GRADE, AND
23.55.050 - HOURLY RATES, TO CLARIFY STEP INCREASE DIFFERENCES BETWEEN
PERMANENT FULL -TIME AND PERMANENT PART -TIME EMPLOYEES.
WHEREAS, Kenai Municipal Code 23.55.020- Compensation Structure by Grade,
currently provides in relevant part: "[t]he time period normally between steps B to C to
D to E to F is one (1) year. The time normally between Steps F to AA to BB to CC is two
(2) years; and,
WHEREAS, Kenai Municipal Code 23.55.050 - Hourly Rates, provides in relevant part:
"[t]he time period normally between steps B to C to D to E to F is two (2) years. The time
period normally between steps F to AA to BB to CC is four (4) years. Current part-time
employees who have completed their probation prior to the effective date of the
ordinance codified in this section shall be given a step increase from A to B. Thereafter,
they shall receive a step increase at the appropriate biennial or quadrennial year
anniversary date, subject to receiving a satisfactory evaluation "; and,
WHEREAS, the two code sections appear to contradict each other with regard to the
amount of time required to advance between steps with respect to permanent part-time
employees; and,
WHEREAS, the intent and practice of the City is for both permanent full -time and
permanent part -time employees to advance from step A to B after successful completion
of probation and for permanent full time employees to advance steps B through E and
F through CC in one and two year increments respectively and for permanent part-time
employees to advance in two year and four year increments respectively; and,
WHEREAS, it is in the City's best interest to amend KMC 23.55.020 and 23.55.050 to
be consistent and reflect the City's intent and practice.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA, as follows:

Section 2. That KMC 23.55.020- Compensation structure by grade, shall be amended
as follows:
23.55.020 Compensation [S]Structure by [G]Grade
(a) Compensation structure by grade is hereby established in accordance with the
table that is appended to this title and which may be amended, modified, or
replaced by ordinance, in which case a copy of the amended, modified, or
replacement table shall be substituted for the prior table and placed in the code
at the end of this title.
(b) On completion of the probationary period, each permanent full-time employee
shall be advanced one (1) step. At succeeding anniversary dates, subject to
evaluation, employee may be advanced a step increment. The time period
normally between steps B to C to D to E to F is one (1) year. The time normally
between Steps F to AA to BB to CC is two (2) years.
(C) On completion of the probationary period, each permanent part-time employee
anniversary dates thereafter, subiect to the employee's most recent annual
evaluation being satisfactory or better, the employee may be advanced a step
increment. The time period normally between steps B to C to D to E to F is two
(2) years. The time period normally between steps F to AA to BB to CC is four
4 ears.
Section 3. That KMC 23.55.050 Hourly rates shall be amended as follows:
23.55.050 Hourly [R]Rates.
(a) Hourly rates for employees not exempted from minimum wage and overtime
provisions of the Fair Labor Standards Act (with various experience, skills, and
responsibilities) are hereby established in accordance with the table that is
appended to this title and which may be amended, modified, or replaced by
ordinance, in which case a copy of the amended, modified, or replacement table
shall be substituted for the prior table and placed in the Code at the end of this
title.
[(B) ON COMPLETION OF THE PROBATIONARY PERIOD, EACH EMPLOYEE SHALL
BE ADVANCED ONE (1) STEP. AT APPROPRIATE BIENNIAL OR QUADRENNIAL
ANNIVERSARY DATES THEREAFTER, SUBJECT TO RECEIVING A SATISFACTORY
EVALUATION, THE EMPLOYEE MAY BE ADVANCED A STEP INCREMENT. THE
TIME PERIOD NORMALLY BETWEEN STEPS B TO C TO D TO E TO F IS TWO (2)
YEARS. THE TIME PERIOD NORMALLY BETWEEN STEPS F TO AA TO BB TO CC
IS FOUR (4) YEARS. CURRENT PART -TIME EMPLOYEES WHO HAVE COMPLETED
THEIR PROBATION PRIOR TO THE EFFECTIVE DATE OF THE ORDINANCE
CODIFIED IN THIS SECTION SHALL BE GIVEN A STEP INCREASE FROM A TO B.
THEREAFTER, THEY SHALL RECEIVE A STEP INCREASE AT THE APPROPRIATE
BIENNIAL OR QUADRENNIAL YEAR ANNIVERSARY DATE, SUBJECT TO
RECEIVING A SATISFACTORY EVALUATION.]

Section 4. That pursuant to KMC 1. 15.070(1) this Ordinance shall take effect 30 days
after enactment.

Re: Ordinance 2927 -2016
The purpose of this memo is to recommend passage of Ordinance 2927 -2016. Ordinance 2927-
2016 will amend KMC 23.55.020 and 23.55.050 to clarify step advancement of permanent part-
time employees. Currently these two sections of code appear to contradict each other and the
proposed changes will clarify and align code with the City's practice of step advancement of
permanent full -time and permanent part-time employees.
