CITY OF KENAI
ORDINANCE NO. 2928 -2016
AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, INCREASING
ESTIMATED REVENUES AND APPROPRIATIONS BY $1,400,120 IN THE WATER AND
SEWER CAPITAL PROJECT FUND FOR CONSTRUCTION OF IMPROVEMENTS TO THE
CITY'S WASTE WATER TREATMENT PLANT AND BY $353,791.51 IN THE WATER AND
SEWER SPECIAL REVENUE FUND TO PROVIDE THE REQUIRED 30% LOCAL MATCH
TO THE PROJECT.
WHEREAS, the City has received a $980,084 Municipal Matching Grant (MMG) from
the State of Alaska for improvements to the City's sewer treatment plant; and,
WHEREAS, this grant requires a 30 %, $420,036, local match which will be provided by
a transfer from the Water and Sewer Special Revenue Fund, $353,791.51, and funds
previously transferred from the Water and Sewer Special Revenue Fund, $66,244.49 for
the Bridge Access Water /Sewer Main Extension Project that remained unspent at the
completion of that project; and,
WHEREAS, completion of upgrades to the sewer treatment plant will increase the
facilities operating efficiency, ensure compliance with new Environmental Protection
Agency (EPA) ammonia discharge limits, and will extend the operation life of the facility.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA:
Section 1: Form: That this is a non -code ordinance
Section 2: That the City Manager is authorized to, on behalf of the City, accept and
expend the grant in compliance with the terms and conditions of the grant offer. The
City further agrees to accept responsibility to operate and maintain the proposed
wastewater utility improvements and to comply with requirements set forth in 2 ACC
45.010 (Audit Guide and Compliance Supplement for State Single Audits) and 18 ACC
73.010 (Construction Grant Project Eligibility).

Re: Ordinance 2928 -2016 SUBSTITUTE
The purpose of this memo is to recommend moving and adoption of Substitute Ordinance 2928-
2016. The substitute includes the addition of a new Section 2 and renumbering of the subsequent
sections. The new Section 2 includes required grant acceptance language that was omitted in the
original Ordinance 2928 -2016.
In order to accept the grant, the granting agency requires the grantee, the City, to agree to the terms
and conditions of the grant offer, agree to accept responsibility to operate and maintain the
proposed wastewater utility improvements and to comply with requirements set forth in 2 ACC
45.010 (Audit Guide and Compliance Supplement for State Single Audits) and 18 ACC 73.010
(Construction Grant Project Eligibility). The new Section 2 will fulfill this requirement.

The purpose of this memo is to recommend passage of Ordinance 2928 -2016. Ordinance 2928-
2016 will appropriate the $980,084, State of Alaska Department of Environmental Conservation
Municipal Matching Grant the City received this fiscal year for improvements to the City's Waste
Water Treatment Plant.
These grant funds require a 30 %, $420,036, local match to be provided by a $353,791.51 transfer
from the Water & Sewer Special Revenue Fund and $66,244.49 of funds remaining from the
Bridge Access water and sewer main extension project that are available in the Water & Sewer
Improvements Capital Project Fund. The original source for the remaining funds was the Water
& Sewer Special Revenue Fund.
Grants funds combined with required match will provide for a $1,400,120 project to upgrade some
of the facilities equipment and other improvements that will make the facility more energy efficient
and ensure compliance with new Environmental Protection Agency standards for ammonia
distribution levels.

SUBJECT: Ordinance 2928 -2016
The purpose of this correspondence is to request Council adoption of Ordinance 2928-
2016 increasing estimated revenues and appropriations to support a project to upgrade
the City's wastewater treatment plant.
Project costs are estimated to be $1,400,120, of which 70% is provided by a State of
Alaska, Department of Environmental Conservation, Municipal Matching Grant, and
30% is provided from the operating reserves of the City's Water and Sewer Fund.
The scope of the project is to upgrade equipment and operating systems creating
significant reductions in energy consumption, as well as modifying operational
processes to reduce ammonia levels in the plant effluent.
