AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, MENDING KMC
23.50.010- EMPLOYEE CLASSIFICATION, TO REMOVE THE CLASS ITLE OF HUMAN
RESOURCE OFFICER AND CLASS CODE 123 IN ITS ENTIRETY AND AMEND THE
CLASS TITLE HUMAN RESOURCE SPECIALIST /ASSISTANT T CITY MANAGER TO
HUMAN RESOURCE OFFICER PURSUANT TO A POSITION RE ASSIFICATION.
WHEREAS, on October 5, 2016 the City Council enactA Ordinance 2920 -2016,
appropriating funding for and amending KMC 23.50.01 to create a new full time
Human Resource Officer position; and,
WHEREAS, to avoid unintended consequences elf implementation of the prior
Ordinance, amendments are necessary; and, /
WHEREAS, reclassifying the existing position 9,d opposed to creating a new job class is
intended in part to avoid Public Employee etirement System issues related to a
termination study; and,
WHEREAS, reclassifying the position re ognizes the current duties being performed in
the position by the existing employe and eliminates the need for recruitment and
probation consistent with creating new position, and allows the current employee to
maintain employment with the Ci
NOW, THEREFORE, BE IT O AINED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA, as follows:
Section 1. Form: That is is a code ordinance.
Section 2. Amendm4nt of Section 23.50.010 of the Kenai Municipal Code: That Kenai
Municipal Code, Se 'on 23.50.010 - Employee Classification, is hereby amended as
follows:

Section 3. Severability: That if any part or provision of this ordinance or application
thereof to any person or circumstances is adjudged invalid by any court of competent
jurisdiction, such judgment shall be confined in its operation to the part, provision, or
application directly involved in all controversy in which this judgment shall have been
rendered, and shall not affect or impair the validity of the remainder of this title or
application thereof to other persons or circumstances. The City Council hereby declares
that it would have enacted the remainder of this ordinance even without such part,
provision, or application.
Section 4. Effective Date: That pursuant to KMC 1.15.070(f), this ordinance shall
take effect 30 days after adoption.
ENACTED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, this 21st day of
December, 2016.

SUBJECT: Ordinance No. 2931 -2016. Employee Classification
The purpose of this correspondence is to respectfully request Council adoption of
Ordinance No. 2931 -2016. This ordinance is a housekeeping measure for Ordinance
2920 -2016, creating a new full -time Human Resources Officer, ensuring that there are
not unintended consequences related to that action.
This ordinance will re- classify the existing position responsible for human resources
duties to the Human Resources Officer position, thereby eliminating the need to remove
the Assistant to the City Manager /Human Resources Specialist position from the City's
Classification Plan and triggering a PERS system termination study.

SUBJECT: Ordinance No. 2931 -2016
Ordinance No. 2931 -2016, Amending KMC 23.50.010— Employee Classification, to Remove the Class
Title of Human Resource Officer and Class Code 123 in its Entirety and Amend the Class Title Human
Resource Specialist /Assistant to the City Manager to Human Resource Officer Pursuant to a Position
Reclassification was introduced at the Council meeting of December 7, 2016 and will be considered for
adoption on January 4, 2017.
After careful consideration of the changes proposed by the ordinance and discussions with the Human
Resource Specialist /Assistant to City Manager who would be most impacted by these changes, I am
respectfully requesting that the Council fail this ordinance.
I would like to have an opportunity to fill the role of City Manager and complete an assessment of
staffing needs. Administration will prepare a separate ordinance for the Council's consideration if that
assessment determines that changes should be made.
