HomeMy WebLinkAboutResolution No. 2017-08VIA %_510 KENAIALASKA Sponsored by: Administration CITY OF KENAI RESOLUTION NO. 2017 -08 A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA REQUESTING AN AMENDMENT TO THE ALASKA BOARD OF FISHERIES PROPOSAL NUMBER 201 WHICH PROPOSES TO AMEND THE AREA OPEN TO DIPNETTING FROM SHORE IN THE KENAI RIVER PERSONAL USE DIP NET FISHERY, BY MOVING THE PROPOSED UPSTREAM BOUNDARY. WHEREAS, Proposal Number 201 requests an amendment to 5 AAC 77.540 which would close the banks of the Kenai River between No Name Creek and the Warren Ames Bridge to shore -based dipnetting; and, WHEREAS, Proposal Number 201 is proposed by the Alaska Department of Fish & Game in order to reduce the negative impact to habitat downstream of the Warren Ames Bridge; and, WHEREAS, residents of the City of Kenai who regularly participate in the dip net fishery from their private property will be impacted by the amendment as they will no longer be able to fish from shore; and, WHEREAS, moving the proposed upstream boundary from No Name Creek to the western boundary of Section 16, Township 5 North, Range 11 West would reduce the negative impacts to habitat downstream of the Warren Ames Bridge without affecting private property owners who participate in the fishery. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that the Council of the City of Kenai requests an amendment to Alaska Board of Fisheries Proposal Number 201 to amend the area open to dipnetting from shore in the Kenai River personal use dip net fishery as follows: 5 AAC 77.540 (c)(1)(D) is amended to read: (c) Salmon may be taken by dip net in the Kenai and Kasilof Rivers as follows: (1) in the Kenai River, as follows: (D) from shore, in the area from ADF&G regulatory markers located on the Cook Inlet beaches outside the terminus of the river to a line at the mouth of the Kenai Ranee 11 West. This resolution addresses the same concerns as the letter and, if adopted by Council, will be submitted to the Alaska Board of Fisheries during their Upper Cook Inlet Finfish 2017 meeting. This would replace the amendment originally proposed in the referenced Resolution. (c) Salmon may be taken by dip net in the Kenai and Kasilof Rivers as follows: (1) in the Kenai River, as follows: (D) from shore, in the area from ADF &G regulatory markers located on the Cook Inlet beaches outside the terminus of the river to a line at the mouth of the Kenai River from No Name Creek on the north shore to an ADF &G regulatory marker on the south shore and on the south shore within Section 17, Township 5 North, Range 11 West.
