Johnson moved and Steiner seconded to, in the best interest
of speeding up the Agenda, that Agenda Item E - Reports,

PUBLIC HEARING - ORDINANCE 211-72 - SENIOR CITIZENS TAX
EXEMPTION
Vice Mayor Doyle recessed the meeting and opened it up 'for
a Public Hearing on Or.dinance 211-72 - Senior Citizens Tax
Exemption. There was no public participation and the public
hearing was closed.
The Clerk read the Ordinance by title. To have the Ordinance
enacted by January 1, 1973, to conform with the Municipal Code,
the emergency clause wkll need to be utilized.
McGrady moved and Hornaday se.conded to declare Ordinance 211-
72 - Senior Citizens Tax Exemption an Emergency. The moti°n
carried unanimously by roll call vote. Voting yes; Hornaday,
Johnson, McGrady, Steiner and Vice Mayor Doyle.
McGrady moved and Johnson seconded for adoption of Ordinance
211-72 - Senior Citizens Tax Exemption. The motion carried
unanimsouly by roll call vote. Voting yes; Hornaday, Johnson,
McGrady, Steiner and Vice Mayor Doyle.

Senator Palmer, Representative Tillion and Representative
Malone were given a list of the proposed Kenai Legislative
Program for 1973.
The Council and the Legislative Delegation went down the
list of State Projects' and discussed each item. In the
priority list of Governmental Personnel, the Legislative
Delegation fel't the first five items should be put further
into the future, due to lack of funds. It was felt a
provision should be made in the revenue sharing program
where the city could claim persons outside the city, utilizing
the city's facilities, such as the Senior Citizens Center.

The State Public Works priority list Was discussed. The.
Federal funding will be increased and the State and City's
share decreased on the Industrial 17ater Line. The Legislative
De].egation felt it was doubtful the Civic Center bond issue
~,~ould be put on the special election ballot. They felt the
· Kenai Court House would be put back in for funding.
The Legisl'ative Delegation felt the lobbying Kenai does
adequate but for the City not to relax on this and where
issues are. before them,where the Governor has an impact,
telegrams should be sent to ~the Governor.

The Mayor and Councilmen thanked Senator Palmer, Representative
'Tillion and Representative Malone for attending' the Council
meeting and discussing the 1973 Legislative Program.

Ivan Hansen -
The Council invited Pos'tmaster McBride and other Post Office'
delegates and Don Oines and Morgan Richardson of Wien Airlines
to discuss the reduction in airmail se'rvices. Mr. Odder and
Mr' Hansen with the Post Office Dpet. were unable to attend.
Mr. McBride stated there is very little reduction in service
and airmail is off very little. There is mail via truck at
7:00 A.M., 6 days a week and airmail via Wien at 1:30 P.M.,
5-days a week.
Mr. Glotfelty stated a gentleman at the last Council Meeting
indicated the airmail service was poor and below standards
and has deteriorated in the past year.
Mr. McBride stated that Kenai has better airmail, s"ervice
than most areas in the State.
Councilman McGrady asked when does the mail,th:at comes
the Post Office at 5'30 P.M. on Friday, leave Kenai.

Mr. McBride reported, it goes out Satur~day at 6'30 A.M. by
Mukluk Frieght, the first way available. It does not sit in
the Post Office until Monday.
Councilman McGrady asked about freight service.
Mr. McBride stated Wien Airl'ines carried the air freight and
Mukluk also carries it. They use the ~irst way available.

Mr. Richardson from ~.'~ien Airlines outlined the mail service
of the past. I--Ie stated the mail comes in about 1'30 P.M.
by Wien and 7'00 .A.M. by Mukluk and you are actually getting
airmail service twice a day, ~hich is equal, to or better than
five years ago. He showed a graph showing the total flights
in and out of Kenai since 1965. He further stated Wien feels
Kenai is going to come back up and Wien will be here to give
the service needed, l'~ien does not want to get out.
Councilman Johnson stated he was satisfied with the explanation,
but thought a public information program would be of a benefit.
Mr. McBride stated the schedule is posted in the Post Office.
People won't read notices.
Vice Mayor Doyle thanked the Gentlemen for attending the
Council MeOting and discussing this matter with them.
Vice Mayor Doyle recessed the meeting for 10 minutes
brought the meeting back to order at 10'30 P.M.

Mr. Glotfelty st.ated there ar.e thre-e parcels of land the
State Highway Department need to acquire from the City of
Kenai for the Kenai River Crossing. They have. offered
$1,800 for parcel 5, $1,300 for parcel 12 and $800. for
parcel 8. .
Administration recommends sale of these parcels,
the oil, gas and mineral rights below 100 feet.

parcels 5, 8, and 12 to the Department of Highways retaining

Public Utilities Commission -
Glacier State
The Public Utilities Commission have suspended the tariff
revision as filed by Glacier State Telephone Co. November
13, 1972 for a period not to exceed six months after December
12, 1972 and an investigation is instituted into the reason-
ableness and propriety of the proposed tariff revision.

Mr. Glotfelty reported the Borough will be recertified. The
Dept. of Housing & Urban Development have listed six objectives
and hopefully these will be approved.

The Planning & Zoning Commission is requesting, through Council,
that Mr. Brockel - Kenai.Community College, pursue a training
program for planners with Federal and State monies that are
available.
OLD BUSINESS
Shooting within the city limits
Mr. Fisher reiterated he raised the idea of prohibiting
shooting within the city limits with the exception of rifle
ranges and the low lands. He passed a lett.er around to the
Council .from Mrs. Mark Necessary stating she felt the' practice
of target practicing off the bluff should be stopped for the
safety of persons living in the area.
After some discussion, it was the consensus of the Council,
that under our existing Ordinance, shooting is prohibited
within a one mile radius of the post office, and the one
mile area should be posted and the police department alerted
'to such to have it. enforced.
Bids
Kenai Civic Center
Mr. Glotfetly reported the bids for the Civic Center were
opened December 11, 1972 at 4:00 P.M. Stewart and Co. were
apparent low bidder. He feels that the first four alternates
should be included, which would bring the low bid to $2,108,000
-and with A.rchitec't fees, Administration, etc. up to 2.35 to
2.S million. He listed some alternative and recommends
alt.ernative #2 - Acquiring additional commitments within the
next 60 days for additional funds and the Mayor name a
construction advisory committee to review the plans and
specificati~ons to reduce the cost of the bid but still obtain
a functional facility.

The Planning &' Zoning C.omm:ssion passed a motion to recommend
accepting the bid on the .Civic Center with the four alternates,
providing the local effort does. not exceed that voted on in
the bond issue.
Mr. Glotfelty feels that having 45 days, we can receive
commitments and asked authority to advise the two low bidders
we will notify them with 60 days and notify the other contractors
their bids have been rejected.
Steiner moved and Johnson seconded to adopt Administrations
recommendation on page three of. his Memo to Council dated
December 14, 1972 and bring back to Council for final review
and to notify the bidders.
A Representative of Stewart & Co. was asked if he sees

problems in this and he said he saw no problems.

Recreation Trailer - Emmett E_g. an
Administration recommends signing the agreement between the
City of Kenai and the Kenai Peninsula School District.
Steiner moved and McGrady seconded t.o bring recreati.on
trailers off the table. The motion carried unanimously by
roll call vote.
Johnson moved and McGrady seconded to authorize the City
Manager to enter into an agreement with the Kenai Peninsula
School District as se~ forth in the Memo to Council dated'
December 19, 1972. The motion carried unanimously by roll
call vote.
There was some discu.ssion that at the time of the transfer
of the title in May 1973, a clause be added that the trailer
be reverted back to the City if not used for the purpose
intended, and at the City's discretion.
-American Legion- F.A.A. Buildi__ng.- L__e. as_~_e
The American Legion wrote they would like to enter into a
5 year lease on the building in the F.A.A. complex to give
them more confidence in putting, money, material and time int. o
this building. In compensation they are willing to pay a
$500.00 a year lease, carry Ii. ability insurance on the b.uilding
and pay all utilities and upkeep. The Administration recommends
the City enter into the lease agreement with the provision, if
any other public structure is built in that area with a five
year period, they ~vill have to vacate the house.

McGrady moved and Steiner seconded to accept the Administration's
recommendation and enter into a 5 year lease with the American
Legion with the provision if any other public structure is
built in that area within a five year period, they will have
to vacate the house. There were no objection to a unanimous
ballot and was so ordered.
NEW BUSINESS
Resolution 72-36 - KCL Fund
Mr.
McKee stated that Item 1 is a bookkeeping entry and Item
can be far better acomplished by a collection agency.
Steiner moved and McGrady seconded to adopt Resolution 72-36 -
KCL Fund. There were no objections to unanimous consent and
was so ordered.

Council Policy on non-pa~yment of water~bills
The Administration recommends a Council pol-icy be established
that if a person has not paid his water & sewer bill within
a 90 day period, the service be terminated. The Administration
will prepare a Resolution to that effe.ct and bring it back
to Council.

The Borough and City obligations are current.
The Administration has received a fire inspection of the
Elks Club and recommend protesting the issuance of the license
until the deficiencies are corrected.
Steiner moved and Johnson seconded to accept Administration's
recommendation and protest the issuance of the license of the
Elks Club until the deficienci.es are corrected. The motion
carried unanimously by roll call vote.

The Borough and City obligations are current. Administration.

Revenue Sharing - Federal - $36,942.00
The City of Kenai has received a check for Revenue Sharing
in the amount of $36,942.00. This is for the first half of
the year. Early in January we should receive anoth'er check.
Mr. Glotfelty stated this money will be placed in a special
trust account. Administration will make requests on how the
money will be spent. The expenditures will be approved by
Council. This amount represent $10.46~ per person. It
could be ~as tow as $2.92 or as high as $21.46 per person.
Federal Aviation Administration - #107.1
The City of Kenai has received a Memo from the F.A.A. stating
the President has directed the Secretary of Transportation
John A. Volpe to order the expansion and strenghtening of
security practices to deter hijacking and extortion efforts
against U.S. air carriers.
All certified aircraft that come under Section 107.1 require
a law enforcement officer for airport security at the point
of departure 30 minutes before flight time and until the
plane has taxied away. This will begin February 6, 1973.
Mommsen Water & Sewer
S.B.A. will hold a private sale early in January for Kenai
Community Water Co. Inc.
The City has received°a bill from Mrs. Killen in the amount
of $230.65 for paym'ents of power (H.E.A.) for the past three
months. Administration would like to have the authority to
pay this bill and back bill S.B.A.
Steiner moved and McGrady seconded to authorize the

Mr. Glotfelty reported the Council has before them this
information tonight and he will make this a part of the
Finance Director's Report. At the next Council Meeting
you will have the Capital Improvements Program, Water &
Sewer and Airports on the same type of format.
Mr. Glotfelty reported AAI have made $3,500 in their bill
and .will be current by the end of January.

Councilman Steiner asked if the Finance Dept. is working on
a cash flow statement and Mr. McKee stated yes, you will be
getting them regularly and in addition to the finance statement.
Mr. McKee reported that on. the financial statement just given
you the Borough reported they paid the City $267,558' in
property tax. $36,245 of this was sales tax. It was their
mistake. Mr. McKee report_ed he received a check from th'e
Borough toady £or $39,800 for sales tax collected.

A1 Hudson reported on the Planning & Zoning Meeting of
December 13, 1972.
The Commission approved the lease of L4', BS, CIIAP, on the
condition they screen the portion visible from the' road
according to the Ordinance.
The Commission did concur with Council on designating a
recreation area ~ mile on either side of the bridge span,
but did question the reason.
The Commission is making some progress on .expanding and
bettering the cemetery.
The Commission approved Gilbertson S/D with the recommendation
a street continue through the S/D.

December 12, 1972. -
The Assembly passed an Ordinance regarding rezoning within the
City of Homer, An Ordinance regarding Planning & Zoning Members,
An Ordinance providing for a suppl_emental appropriation for
the School District on janitors retir'ement, An Ordinance for the
tax exemption for senior citizens, an ordinance providing for
a supplemental appropriation for the Cen' 'al Peninsula Hospital
and an Ordinance providing for a supp. lemental appropriation for
the Homer School wate.r & sewer connection.
The Assembly received the scho~! district budget.

The new municipal code provides for mandatory exemptions'
1.. The exemptions are found a A. S. 29.55.020 (a) (6) and
29.53. 020 (e).

procedural as to applications by individuals and establishes
method for reimbursement by' the State.
3. Present ordinance exemptions on a five mill levy would

4. In addition, Kenai Code 7-3, (as enacted in Ordinance
194 ' 70) provides for an exemption for disabled persons
who have been found to be totally disabled within

Act. The City of Kenai provision--also requires a 10-year residency
in Alaska.

On November 13, 1972, GLACTER STATE TELEPHONE
COMPANY (Glacier ~uate) filed a tariff ~evision designated
by the Com~nission as TA!9-49. Glacier State described the
proposed revision as 'a co'.,nplete new tariff which will
entirely replace its existing tariff. The filing was duly
noticed to the public and known interested parties.
Numerous protests to this filing have been re-
ceived by the Commission. The protests are directed prin-
cipally at the subs'tantial increase in rates and at appa-
.rent rate discrimination plus deficiencies in the serv. ice
offered by Glacier State. Questions have also been raised
as to whether the increase exceeds the guidelines esta-
blished by Federal price regulations.
The Commission notes that Glacier State expects
the revision to increase its revenue by the amount of
$328,701 per'year. Preliminary calculations by the Commis-
sion indicate that this increase may result in an unreason-
able rate of return for Glacier State. Likewise, the Com-
mission believes that the rate increase here proposed may

Unquestionably the higher rates will have a serious economic
impact upon Glacier State's subscribers.

iod to allow additional time for the protestants and staff
to investigate the reasonableness and propriety of the pro-

there are Federal and State monies available for such training.
This was discussed at the City of Kenai's last planning Commission

training along these lines going in Ancho.rage at the present
time.

On 5 December 1972, by direction of President Nixon, Secretary of Trans-
portation John A. Volpe ordered the expansion and strengthening, of
security practices to deter hijacking and extortion efforts against U. S.
air carriers.
The Secretary has instructed the Federal Aviation Administration to
issue an immediate emergency order to amend procedures under existing
regulations to carry out the intent of the President's directive.
As a result of the foregoing~ Part 107 of the Federal Aviation Regula-
tions (14 ~"R Part 107) was amended on 5 December 1972 as follows'
1. By amending ~ 107.1 by adding a new paragraph (E)~ to read as
follows'
Section 107.1 "General"
(E) For purposes of this part "Law Enforcement Officer" means an
armed person --
(1) Authorized to carry and use firearms;
(2) Vested with a police power of arrest under Federal, S{ate,
or other political subdivision authority; '
(3) Identifiable by uniform, badge~ or other indicia of
authority; and
(4) Assigned the duty of providing law enforcement support for
the pre-board screening aspects of the security programs
filed by Part 121 certificate holders, foreign air carriers
requesting such support, and for airport security programs.
By adding a new Section 107.4 to read as follows' .L
Section 107 4 "Law Enforcement Officers" ~ ~
~otwithstanding Section 107.3 (A) (2) (I) (D), each Airport Operator
shall, not later than January 6, 1973~ submit for approval by the
Administrator an amendment to the Master Security Plan included in

ensure that as soon as possible, but in no event later than February

(A) At least one law enforcement officer is present at the
point of, and prior to and throughout, the final passenger
screening process prior to boarding, for each flight
conducted by a certificate holder required to have a security
program under Section 121.538 of this chapter, and for each
foreign air carrier that requests such law enforcement support;
(B) The law enforcement office'r is present continuously until all
doors on the aircraft being boarded are closed and the aircraft
has taxied away from the boarding area; and
(C) The requirements of paragraphs (A) and (B) are complied with
in the event that the aircraft returns to the boarding area
before take-off.

We live at the end of Fathom Drive in Redoubt ~£errace
Subdivisi'on. It is not unco~-~m~On for us to see several
young people carrying high powered rifles go by our home
and do target practicing off the bluff. This practice is
carried on not only in the summer but on occasion we have
seen them shocking at the ice in the Inlet.
~t is our opinion that for the safety of persons living
in t~.~e araa, this practice should be stopped.

The City Council within the next 60 days must decide whether
to accept one of the bids or reject all bids and rebid the
project at a later date°
I will outline several of the alternatives that the Council
may want to discuss.
1. BUILD THE CIVIC CENTER WITH THE REMAINING FUNDS
~-ITHiNTHE-- LCAPITA-----~ IMPROVEMENT PROGRAM-
The City has within its Capital Improvement funds
sufficient monies to construct, the Civic Center and
complete all of the projects presently under construc-
tion. If the Council were to take this approach, there
wouldn't be sufficient funds to construct the Industrial
Water Line, and that project would have to be considered
by the Council on a revenue bond issue in the future.
The Administration is going to recommend to the Council
that the Industrial Water .project not be bid until late
next fall, which will allow us time to obtain definite
commitments from industry of their intentions .to expand
the present complex within the Nikiski Area and the
projects and commitments for new facilities in the area.
We have obtained the commitments from the State of Alaska
and the Department of Housing and Urban Development to
proceed with the first phase of this project, but more
information is needed from the industry.

I don't feel that a facility of this limited design and
space would meet the present need~r0-f .... %he community. It
has been demonstrated through public meetings that the
need as designed and bid would be the type of facility
that Kenai needs. Deleting large portions of the facil-
ity would not be consistent with public desire but would
be consistent with the bond issue passage.
4. BUILD THE FACILITY - BORROWING .... THE ADDITIONAL MONIES

I have spoken with several of the investment firms in the
lower 48 and ~2~ey have indicated that this means of fin-

entially a lease/purchase by the City. This is a very
...... expensive means of financing and I would not recommend
this .... at this time, for example t~'-is type of financing
would cost the City about $720,830.40 in interest alone
over the next 10 years.

Reject all bids and wait tO see if the 1973 legislature
will pass and provide for a referendum vote for the state-
wide Civic Center bond issue question.

With the involvement of the North Kenai Playground Association
into the development of programs that,will be beneficial for
the youth of North Kenai, I feel that it is in the City"s best
interest to agree on the assignment and assumption agreement
with the Kenai Peninsula School District for the transfer of
this trailer to them.
In my discussions with the people at the Borough School District,
they-will assume all the liability for the trailer until the
'City transfers ownership in May to the North Kenai Playground
Association.

thanks for your cooperation and assistance in acquiring a long needed
home for our post. Your recent actions in granting our request to util-
ize the green, flat roofed residental structure lccated on the.city ac-
quired FoA.A. site will we feel, be very adequate ~or our needs for some
time to come. ~
As yet, there has b.een no lease or use agreement initiated between
the City and Post Noo 2_0 on' the build±r~go._ 2-~fter much discussion amoung
the members of the post, it has been decided it would be desireable, if
possible, to acquire a five or even ten year lease on the building° This
would-give us more confidence in putting money, materials, and time into
the structure t¢ ~ake some changes which we feel would make the building _
more suitable for American Legion meetings and other club use.
In compensation for this long term lease, Post No. 20 is willing to
offer a monitary conce3s±on of $500.00 payment per year. In addition of
course, Post No. 20 will carry libali~y insurance on the building, and
pay all utilities and up-keep. .
If it i~s agreeable with the City Council to grant the above lease,
perhaps a meeting between City officials ~nd Post 1'~o. 20 l~-ommander can
be arranged to discuss any further details.

1. That it hereby declares as Dart of Alaska Route 463
all of those streets and rights-of-way, as shown
on the final plans for Alaska Project S-0463(10) on file
in the office of the Alaska Commissioner of Highways
which are within the City of Kenai.
2. That the City will coonerate with the State in not
authorizin~ or oermittin~ the installation of signs, .
or signals which will mive any intersecting street or
streets a status outranking Alaska Route ~63;~ not-
to authorize or hermit any construction or encroachment
within the riMht-of-way as shown on the right-of-way
map designated Alaska Project S-0~63(10), on file in the
office of the Commissioner of Highways in Juneau,
Alaska; not to establish any curb lines or cause or
permit any curbing to be constructed~'on the highway with
curblines less than the dimensions as shown on the
typical section of the final olans on file in the office

of the Commissioner of Highways, Juneau, Alaska, or by
first securing the written aporoval of the Alaska
Commissioner of Highways- not to install or authorize
any stoplights or traffic control devices on said
highway without the approval of the Alaska Commissioner
of Highways thereto and to resolve that the State, acting
by and through its Deoartment of Highways have the sole
resoonsibility for the regulation of parking on said
htEhway and signs orohibiting parking if necessary to
be installed at the expense of ~.he State- subsequent
to comoletion of construction it shall be the resoonsi-
bility of the City to supervise and insoect any instal-
lation of City owned under~r.oun~ facilities that require
trenching through the pavement and to reeuest that the
backfill be compacted, and the surfacing and pavement
be replaced in accordance wi'th ~he soecifications as
determined by the District Engineer of the Alaska
Department of Highways. The S~ate shall have the. right
to inspect this work and reeui~e the replacement of
substandard work and material.s by the City' the City

In recent montks we have /tad several inqu~.?.ries about the
possibility of providing low'or moderate income housing
for the elderly in Kenai. As you know, Kenai is the only
major city in Ala.~ka where the Alaska S~ate Housing Authority
does not presently provide any ~o. rm of assisted housing.
After exploring the matter, it would appear, based on HUD's
projected funding schedules, that it would be at least three
years before we could possibly hope to construct any low or
moderate income housing Zn Kenai under any of~the existing
HUD programs. Further, it appears to us that becaus~ there
is presently reported a large vacancy factor existing in
housing in Kenai, the construction o~ new moderate or low.-
income housing would only aggrevate programs for existing
landlords.
In recent months we have been exploring new prog&ams whereby
throug~h a combination of low interest mortgage loans through
the Alaska Housing Finance Corporation, and through assistance
from HUD, under the Section 23 program, that we ~could provide
low and moderate income housing. Under this program it might
be possible for us to acquire some existing housing in Kenai
and through the lower interest rate and various subsidies, make
existing units available to lower income persons at reduced
rentals.
However, since w'e are not allowed to enter Znto such projects
without having a Cooperation Agreement w~oth the local governZng
agency, we are interested in knowZng what your thoughts would
be on the subject. Do you feel that the CZty Council of
Kenai would be willing to enter into a Cooperation Agreement
with ASHA whereby we would make payments in lieu of taxes on an
existing housing pro~¢ct to be rc. nted to lower and moderate
income persons.
