Robert Norene (excused) and Junior Councilman PERSONS PRESENT SCHEDULED TO BE HEARD' Emmett Egan - Recreation Tra21er Mr. Egan was not present. Mr. Glotfelty referred this City Attorney, who has worked with Mr. Egan on this. to the Mr. Fisher stated that Mr. Egan has gone to the Bo.rough School Board and they have agreed to be the governmental entity to take over the City's obligations concerning the recreation trailer. Doyle moved and Johnson seconded to bring the subject of re- creation trailers back on the table. Mr. Glotfelty stated he would like to see in the agreement that if the facility was-not used for the 'intended purpose it would revert back to the..Eity, a.t no cost to the City. Mr. Love reported the School Board did take action an~ Mr. Hayward did sign an agreement with the City and an agreement with the North Kenai Playground Assoc. This would be for the interim period only. After much discussion the motion to bring the recreation trailers back to the table failed with Hornaday, Johnson, McGrady, Steiner and Steinbeck dissenting. The Administration was directed to prepare a memo with all the facts concerning the. recreation trailer. William Wells Mr. Wells came before Council concerning air mail and air freight. He stated that 19 years ago we had air mail twice a day with a Lockheed. When the DC 3's were flying, we had air mail 3 times a day. With the Constellation 3 or 4 times a da'y and with. the El ectras over 4 times a day. Now a Joe McGee airlines have come in and undercut Wien and haven't paid their landing fees. He further stated a National Company could not establish a business in Kenai and it is partly the fault of the City. ~INUT~S, KBNAI CITY COUNCIL MEET lNG, B - 2 - William Wells - continued. DECEMBER 6, 1972 Page two C~ D, D - 1° D - 2' Councilman McGrady stated he has researched this also. This is .the first time in eleven years there has been only one flight a day. A research is desperately needed. It takes ? or .8 days for air mail to get here from Seattle. The I.C.C. does control the carrier of the mail. Mr. Glotfelty stated it is true AAI is behind on their payments, however, they have made arrangements to make a monthly payment and keep the landing fees current. If they don't a lawsuit will be initiated. There were no objection from Council to instruct the City Manager to cut them off if they fail to do so. Councilman Hornaday stated we~ should undertake a program to put the finger on wheres the problem and take a progressive step and invite Wien, the Post Office Department and our Congress- ional Delegation and set up a Mayor's Admisory Committee. There was no objections from Council to pursue this. MINUTES The Minutes of the Regular Meeting of November 15, approved as distributed. 1972 were CORRESPONDENCE Jam_e.s.__E_~._._Fj.s_h_e_r_ , Shgo.t~i~g_.' within City. limits Mr.. Fisher wrote as an individual resident-and taxpayer, he felt' shooting should be prohibited in the city limits with perhaps the exception for shooting shotguns and bird shot on the lowlands of the Kenai River. · After some discussion the Administration was directed to put this on the next agenda and publicize and invite people to come and expr'ess themselves. Small Business Administration - Kenai Communi. tX Water Co. F.~r. Ressler with the Small Business Administration wrote that because negotiations between the City of Kenai and the Kenai Community Water Co.', Inc. have reached an impasse, the .Small Business Administration will foreclose on the Kenai Community Water Co., Inc. After some discussion on the emergency of the situation the City Attorney was directed to write another letter to Mr. Hendrickson to see 'if we could enter into an agreement to take over the company and get good water to these people. Doyle moved and McGrady seconded for Council's approval of the letter Administration sent to Mr. Ressler as a letter of authorization to commit the City to take over the Kenai Community Water Co., Inc. when the foreclosure becomes effect- .... ive. The motion carried unanimously. REPORTS ........... City Manager's Report Things t.o.,do l:.i.st,.,- .... !~1/,!5/.72 Mr. Glotfelty reported the letter t'o people in Mom.rosen S/D is in progress. The City Manager has spoken with the Committee on.Aging in Juneau and the Senior Citizens can purchase any kind of buses they want. Payment will be made to Northwestern as soon as we get the release. Revenue Sharing Meeting Most of you have a report from Carl Hilte on the revenue sharing, meeting. Our first check should come sometime in December. This will be discussed more thoroughly at the work session December 19, 1972. Hearings on new borough Mr. Glotfe]_ty reported, the Local Boundary Commission has requested that the newly created Department of Community and Social Services hold public hearings on the formation of the Nikiski Borough on Friday, February 23, 1973 at 7'30 P.M. .in---.t.he Little~.~T-heatre in the Kenai High School. Status - Bush Lanes Water, .Sewer & Street Improvements Mr. Massey reported the Bush Lanes Improvements is 99% complete. He felt the .contractor.was entitled to a reduct'ion in retained pay percentage from 10% to 2%. Wildwood Contract Mr. Glotfelty reported the contract for fire and police protection on Wildwood has been signed' General Fund Audit The City Manager passed out copies of the General Fund Audit. The bound volume will be available by the first meeting in January. He further stated that according to the Borough, the revenue not collected last year in the City of Kenai because of the -.Senior Citizens T~ax--Exemption amounted to $1-,091.31. We had nine claimants and should have two or three more this year. M_ aD?r_, s Repo._rt Mayor Steinbeck reported the Oberts Insurance Company has finished a comprehensive 10ss control evaluation report on the City of Kenai. They have gone through the City buildings -and f-acilities from one end to the other. · He further reported he has received the first resignation from a Mayor's committee. The committees are still enthusiastic. Vice Mayor Doyle reported he attended the Mayors snow machine race in Soldotna. City Clerk's Report No report Finance Director's Report Mr. McKee reported the cash in the bank is $58,731.80 and temporary investments ~n time CD's etc is $1,445,231.80. He has no statement on receivables. Very shortly he plans to have a monthly financial statement to Council by the sec.ond---meeting of the month for the month proceeding. On the finance report we will be adding the necessary statistical data to come up with a certificate from the Municipal Finance Department to come up to their standards. This will greatly, effect our bond ratings. Planning & Zonin~'s Repor.t No .meeting. Borough assemblymen's Report Assemblyman Johnson reported on the last Borough Assembly Meeting. The Assembly passed an ordinance on rezoning within the City of Ken. ai, an ordinance regarding work hours, an ordinance limiting the term of Borough Mayor and an ordinance eliminating the use tax. McKee - Finance Direct?r Steiner moved and Johnson seconded to ratify the appointment of Mr. McKee as the Finance Director. The motion carried unanimously by roll call vote. Buses for Committee on Aging Heard under Agenda Item E - 1 Correction - Approval of controlling.i~tere,s,t,~ - .... K.U.S.C.O. Mr. Glotfelty reported the Council passed Resolution '72-26, August 16, 1972, approving the tranfer of controlling interest in Kenai Utility Service Corporation. Since this time there has been some change as outlined in Mr. ThQmas' letter of November 29, 1972. The Administration has no objections to the change. Johnson moved and McGrady seconded, to. approve the Change in controlling interest as outlined in Mr. Thomas' letter of November 29, 1972. The motion carried unanimously by roll call vote NEW BUSINESS Kenai Legislative Program for 1973 Councilman Hornaday has submitted a legislative program for 1973, which is in the packet. The motion carried by roll call vote with Hornaday dissenting. Ordinance 211-72 - Senior Citizens Tax Exemption Hornaday moved and McGrady seconded to introduce Ordinance 211-72 - Amending the Kenai Code as amended, to conform to AS 29.53.020 for Property Tax Exemptions. The motion carried unanimously by roll call vote. Request to a.~p!y for sewer interceptor grant - Thompson Park Bruce Massey reported that Wince, Corthell and Assoc. have prepared maps and a grant appl~ication for a'sewer interceptor Thompson Park. Johnson moved and Doyle seconded to adopt Resolu~ion 72=34 - Grant Application - Sewer Interceptor Line - Thompson Park. The motion carried unanimously by ro]~l .call vote. Mr. Glotfelty reported the City has written a letter of protest to the Alaska Public Utilities Commission concerning Glacier State's request for a rate increase. Johnson moved and Doyle seconded to adopt Resolution 72-35 - Protesting Glacier State's request for a rate increase. The motion carried unanimously. Council is invited to attend. CLOSING COMMENTS Mayor Steinbeck reported he had a request for use of the old fire hall by a theatrical group. It is being used now to store water & sewer equipment. As you know, the City of Kenai is also vitally concerned with the welfare of those persons now being served by Kenai Community Water Company, Inc., and we appreciate your continued interest and help in seeking a remedy to the problem. Basically, the foremost impediment responsible for the delay in making an ownership transfer stems from the fact that Mrs. Killen and her attorney have not agreed to furnish the City with an acceptable hold-harmless agreement which will protect the City's interest against future claims. It is the feeling of the City that witho.ut such an agreement, no further nego- tiations are possible. Therefore, as you suggest, it appears the only altern, ative is to request a foreclosure by the SBA against Kenai Community Water Company, Inc., and assume ownership of that system from SBA after foreclosure; and, the City of Kenai hereby, agrees to assume ownership from SBA after foreclosure proceedings are complete. Your earlier "release of collateral" dated October 24, 1972 is enclosed with this letter, as per your request. The City of ~enai regrets the necessity of taking such drastic action; however, at this time, we can see no other alternative. We are also ouite concerned about the fact that negotiations have reached - an impasse because an agreement on all _matters had already been reached and we were of the understanding that all that remained wa~ the mere formality of exchanging papers. We regard the agreement reached previously as still being in effect, however as a means of overcoming the impasse and of pro%~.ding water and sewer facilities to those persons in the area served by the Kenai Comunity Water system we offer the following pro~,osal. It ~is recommended that the City terminate the Construction Con- tract and complete the re~aining items with City Forces. But, if the City chooses not to do so, the Contractor's Completion ~ate should be extended to June 15~, 1973 to allow for completion of all construction items. I think it is a very desirable thing to have the service available~ that has been decided upon by the participants in the Senior Citizen's Center. However, concern for the s~fety of the participants impelois me to commun- icate with you as I said I would ~hen I learned of the prospective purchase of two Volkswagon Buses for the Center. Volks~vagon Buses have been criticized as b~ng unsafe. Enclosed is-a publication sho~ving some of tt~e problems ~ith this type of equipment. It is possible other types of equipment would have similar ~eaknesses; how- ever, the Volk$~agon Bus has come under the strongest criticism. It ~ould do no good to attempt to make a collection against the Volk$~agon peop~ if someone was injured in a collision causing injuries to persons who, because of their age, migent already be less responsive t? curlng treatment than younger persons. In other words, I think use of such buses for a public purpose has even greater hazards than us.e of a bus by a private individual. While it is my understanding the City Co~ncil does not have to do anything about the purchase, I do believe it is important that the matter of safety be called to the attention of participants in the Senior Citizens Center, and that is the reason for this communication. In order to expedite the matter to the attention of the participants in the Senior Citizens Center, I will take the liberty of sending a copy of this communication ~ith its attachments directly to that organization. If additional time was a~ilable, I would make a check with tF~e National Transportation Safety Board for a recommendation on the more safe types of conveyance and the companies that mi~]~t offer reductions to Senior Citizens. cc. They are a little safer-but not much. Passengers in the front are still riding a tiger, and a stiff wind will still push the car around. If you already own a VW Bus, here's what you should do' 1. Have all obcupants of the car wear t both seat belts and shoulder harnesses. 2. Never drive the car whenit's windy: · / 3. Eve,n better, trade it in. Pegram Police Reports on the Last Frontier Bar Also Known as Eadie's Club and the Casino Bar December 6, 1972 The following is a brief synq?sis of contacts that the Kenai Police Department nas had with the above mentioned bars t~n from the files of tl~e Kenai Police Departm]ent. Case No. 72-01976, Date 1-23-72, George J. Peteroff was arrested for drunk in public in which defendant was drunk in Eadie's bar and r~fused to leave the premises. Case No. 72-01977, Date 1-24-72- This case involved the arrest of Estelle Mae (~d~A Betty) Granum for being drunk in public at Eadie's Bar and causing a problem. Subject was arrested for same. Case No. 72-0198~, Date of offense 1-30-72, case involved a Robert L. Henderson who was drunk on the premises of Eadie's bar and refused to leave. Subject was arrested for same. Case No. 72-02016, Date 2-08-72. Ti%e Kenai Police Department responded to a call of Bob Henderson being drunk on the premises of Eadie's and refusing to leave. Subject was noted to be drunk at this time and was arrested on existing warrant on anot~%er charge. Case No. 72-02120, Date 4-10-72, Albert Ephim Baktuit was arrested on a charge of armed robbery. This incident, subjeCt entered the bar with a .264 Winchester Magnum and demanded $150 from the bartender. He stated that someone there had stolen $150 dollars from him and he wanted $150. $150 dollars was counted from t~]e till and given to him. He departed the premises and was arrested shortly thereafter. Case No. 72-0217~, Date 5-1-72, Ronald David Lorenzo, age 18, was arrested for being a minor on the premises. Bob Lloyd Henderson was also charged with allowing a minor to remain on licensed premises. P age 2 Report on Casino Bar and Eadie's Club (continued) Case No. 72-02691, Date 9-8-72, case involved an individual who went into Eadie's bar with .a colt .45 caliber revolver. A patron of the bar who was later found to be extremely intoxicated, stated that he had been threatened by the man with the gun. There were several conflicting state- ments in this case but not enough evidence 'could be obtained for an~f type of criminal prosecution. Case No. 72-02979, Date 10-31-72, case involved the purchase of three fifths and one pint of vodka from the package store at Eadie's. TWo juveniles, one age 15 and the other age ~16 from Wildwood made the pur- chase. The youth who made t~'~e purchase had a phoney draft card on him showing his age to be 19. Subjects were arrested for minors purchasing liquor and a sun, nons nas been filed against the license holder for selling liquor to minors. The following incidents occured in and around t~%e Casino Bar. Case No. 72-02449, Date 7-15-72, involved two subjects who were arrested for disorderly conduct after a fight in t~'~e Casino, parking lot. Case No. 72-02620, Date received 8-21-72, involved the issuance of bad checks by Robert G. Klink to the Casino Bar in which Klink was arrested for same. Case No. 72-02865, Date 10-7-72, involved tl~e arrest of..a subject for operating a motor' vehicle while intoxicated while trying to leave the Casino parking lot. Case No. 72-03072, Date 11-19-72, involved the arrest of a subject on the premises of the Casino Bar for disorderly conduct after shouting obscene language and conducting herself in a disorderly manner. In addition, Kenai Code 7-3, (as enacted in Ordinance 1~4 - 70) provides for an exemption for disabled persons who have been found to be totally disabled within the meaning of, and by administ.ration of, the U.S. Social Security Act. (Emphasis added) Psge 3. Senior Citizens Tax Exemption For ~.urpose of this opinion we assume that the above statutes have been complied with by a city or borough. (i.e. that proper voting procedures have been followed by assembly and that cities involved if any have appropriated sufficient monies to equal los~ revenues caused by exemptions and exclusions.) Since the matter is inter~wined with city exemptions, I am inc].uding the above Statute (c). Although the appropri~te provisions of the new municipal codel appear in full in the attached memo, I set forth herein Sections !i (g)' (h)' and (i) as f°ll°ws: "(g) The state shall reimburse a borough or city, as appropriate, f'or the real. property tax revenues lost to it by the operation of (e) of this section. (h) Nothing in (a) -' (i) of this section affects similar exemptions from property taxes granted by munici-i palities on the e.=fective date of this Act or prevents municipalities from granting similar exemptions by ordinance as provided in Sec. 25 of this chapter. However, under (e) - (i) of this section on]_y the amount of revenue los% to the municipality by reason of the exemption authorized in those provisions may ! be reimbursed to the municipality by the s~.ate. (i) In (e) - (i) of' this sect:ion the term "real · property" includes but is not limited to mobile homes, whether classified as real or personal property for municipal tax purposes." The gist of ~:hese provisions is-of course, as allude~ to above, that the state "picks up the tab" from Borough and city as to all tax revenue lost by the exemption as to the state exemption only. This is important, because although all taxes come out of the same taxpayers pocket, nevertheless, there are two' separate ~nd distinct tax-paying entities - State and Borough-, and each has to some extent an adverse interest to the other. · There are a few genera]_ rules of 'zbolicy" and statutory construction which should be recognized. A cardinal rule of policy, in interpreting tax l~ws is the old one that all doubts and ambiguities are to be resolved against the state and in favor of the taxpayer. However, due t.o the omnivorous appetite of all~ governmental bodies for revenue this princip].e has pretty well~ been eroded away and the rule, if such it might be called, is now merely meaningless shibboleth. Nevertheless, I point it out as sometimes it is helpful in certain situations. .! Page 4 Senior Citizens Tar Exemption Next. we 'find this rule of policy becomes somewhat twisted when it comes to "exemptions" - and we are dealihg with e×e.mptions in this instance. In fact, what was formerly a rule of policy, becomes a rule of "statutory construction" which generally holds th~.}t tax e×emption statutes are strictly construed .a¢__~ainst the -eJJ?!!~qJ~-i°]!°- This should also be kept in mind as we discuss the problem. ~ ........... · Does ~he Borough exemption under our ordinance or under one based upon its formula gran't wider or more generous benefits to the taxpayer? If so, the state will not reimburse the borough for revenue lost solely due to the portion of the ordinance ~,hJ. ch goes beyond that provided by the state in its gross income formula. Borough ordinance grants exemption without regard to income. It does place a ten year residence requirement on the applicant. The state does not. Neither does the state limit the actual exemption-to $250.00 or to any figure whatsoever. Conceivably the state might exempt and forgive the entire tax liability of a piece of property worth several hundred thousand dollars J_f the owner had a gross income of less than $10,000. Although this is not likely it is possible. In raany instances those who make less than $10,000 gross income and who otherwise qualify might own pieces of property assessed at a figure much less than the $42,000 one given in the first part of the opinion and. thus obtain a smaller exemption. The possibilities of incongrous inequities are myr:[ad and opportunity for speculation infinite. Vexatious administrative problems could plague the assessors and tax officials no end. political, subdivisions from attaching burdensome residence require ments to numerous exercises of power.. Going over the above little chart of comparison shows a most difficult problem in trying to determine which exemption is the most liberal. However the kind of exemption the Borough wants, is up to its legislative body - the Assembly. I respectfully suggest that it dete_~nine at the earliest date what policy of exemption they prefer and fort_hwit]-~ enact the same. One can cope with the i practical problems o'f administering and effectuating the exemption when the time comes. Clearly the dates for making application should be clarified 'and confotnned,. Otherwise a hopeless situation would exist in seeing to it that the exemptione~s obtained the exemption. It is my under:standing that the Borough has until about February l, 1973 to make its adjustment on the above matter, that is - to come up with an ordinance on the exemption problem and to try to harmonize the s~ne with the states law. This opinion does not in any way concern itself with policy m~king and is submitted and limited as an opinion on the law as it applies to such facts which are within my knowledge.
