Steiner, James Doyle, James Hornaday * C E Johnson & Mayor John S teinbeck ) · · · * In late Members absent - Robert Norene Pub 1 ic Hear ing - Trailer Ordinance - Ordinance 210-72 Mayor Steinbeck closed the meeting and op'ened it up to the public for a hearing on Ordinance 210-72 - Trailer Ordinance. The Clerk read the Ordinance by title. The Mayor then asked for comments from the public. Mr. Green - What areas is this Ordinance going to cover? Mr.~ H_~ckneX - This will cover all commercial trailers in the city limits. East of Main Street, in the rural residential area, residential trailers will be allowed and replaced,with a building permit. West of the boundary, residential trailers there are permitted to stay indefinitely but not replaced. Mr. Green- What is help? the reason, for this? What's it going to Mr_.~Ha_ckney- It will upgrade the cit. y. Mr. Green - This will cause people to move out. If they burn out in this one area, they can't have another trailer. This should have the vote of the people. Mayor Steinbeck asked Mr. Hudson, Chairman of the Planning & Zoning Commission to explain .the Ordinance. Mr.. Hudson stated it was the Commission's feeling that this is a system for upgrading the city. The people of the East side of town can replace trailers. The west side has the least numtyer or persons affected. Several subdivisions restrict trailers by covenants. The commercial trailers will be phased out over a period of five years. Mr. Carlson - ~hat constitutes a trailer? One certain -foundations they are no longer a trailer. Hornaday in now. Mr. Fisher read the definition of a mobile home from the Kenai City Code. "A mobile home is any vehicle or structure used or intended for use as a dwelling and designed for transportation after fabrication on streets and highways on its own wheels or on flatbed or other trailers, and arriving at the site where it is to be occupied as a dwelling complete and ready for occupancy except for minor and incidental un- packing and assembly operations, location on jacks~or permanent foundations, connection to utilities and the like." Mr. Chapman - I live on Tinker Lane. This ordinance does not ~ncl-ude us at this time but what about the future? Mr. HackneX - We have no idea of what will happen in the future. It is not our intention to rezone that area. Councilman McGrady.- The people who build homes are discriminated against. They have to go down to frost free base. A trailer now can pull up and sit on anTthing. If you live i.n a residential area there :is nothing to protect you from having a trailer house move in beside a $40,000 or $50,000 home. ~hat would you do 5f you wanted to build? Mr. Hood - No doubt build in something like Redoubt Terrace where there are covenants against trailers. Mr._ _~_ Quandt - If the ordinance is adopted, when is it effective?. Mr. Hackn_.ey - January 1, 1973. Mr. Miller - Can trailer parks be built and what constitutes a trailer park? Mr. Jaynes - Two or more trailers constitutes a trailer park in the city. They are allowed. Mr. Hudson reported the Planning & Zoning Commision have been working on a trailer ordinance for over a year. They have held two public hearings. At the first hearing there were four in opposition, only two were affected. At the other public hearing, three showed up and they were in favor of the ordinance as written. You can't put each issue up for vote. Mr. Miller - How many names would it take. Councilman Hornaday - One fourth of the voters of the las't city election or approximately 210 signatures. What is tl~e approximate cost of an election? Mr. Glotfelty stated approximately $400 to $500. Mayor Steinbeck, hearing no f,urther discussion,closed the public hearing. Johnson moved and McGrady seconded to approve for 2nd reading and adoption of Ordinance 210-72 - Providing for Additions to the Planning &Zoning Chapter of Kenai Code, 1963, by addition of regulation of structures, commonly known as "mobile homes" or"house trailers" and providing for an effective date. The motion carried unanimously by roll call vote. Voting yes; McGrady, Steiner, Doyle, Hornaday, Johnson and Mayor steinbeck. Voting no; None. Absent - Robert Norene. Minutes of regular meeting of November 1, approved as distributed. 1972, were CORRESPONDENCE Ne!s ,Kje!,stad - For.t ..... Kenay Mr. Kjelstad wrote, three of the four buildings were raised and blocked. Foundation timbers and gravel backfill for two buildings. They felt cedar shingles are the best for the money. The work will continue as weather permits during the winter with work being concentrated on the first two buildings nearest Fort Kenay. Mr.~.,Sarasin, Loss Control Consultant, Leo Oberts Insurance Inc. wrote that City Employees, George Jaynes, Ernie Kleineick, Howard Hackney, Ernie Rimer, Victor Segu,ra and John Coveyou have successfully completed the United States Dept. of Labor 10 hour Construction Safety Course. REPORTS ' Cit~ Man~ager's Report Mr. Glotfelty announced Bruce Massey has accepted the position of City Manager with the City of Cordova and will be leaving in approximately three weeks., Mr. Glotfelty stated.he was honored but unhappy to have him leave. Mayor Steinbeck gave Bruce his best wishes, done a fantastic job for the City. stating he has Bruce thanked Council, saying he never worked for a better employer than the City of Kenai. Things to do list - 11/1/72 The Things to do list of 1.1/1/72 have been accomplished. Mr. Glotfelty reported he traveled to Seattle and Denver Sunday a. nd Monday and he feels we will be able to come up with money for the Civic Center on a revenue type basis. Bids were scheduled to be opened December 1, but because of the responce, it has been extended until December 11. Eighty five sets of plans have been taken out. · Mo n th.1 y_.. p_o 1 ice _Re p 0~r~t The Monthly Police Report is in the Council packet. The major item was 456 hours of uncompensated overtime during the month of October. Kenai Community Water Co. Mr. Fisher summarized the actions taken in the past several months trying to get things together so the City is in a position to take over and operate the. Kenai Community Water Co. Mr. Massey stated he talked with S.B.A. a week and a half ago. They asked for a hold ha'rmless agreement from Mrs. Killen. We sent one up, they didn't like it and drafted up one. I feel the best procedure now is to start foreclosure. It is too late to put it in this year. Councilman Hornaday directed the Administration to draft a letter to the people in Mommsen's S/D telling of the developments, what has been done and why and put it on the next agenda. Mr. Glotfelty asked Mr. Fisher to draft a let.ter. MInUTEs, KENAI CITY COUNCIL MEETING, NOVEMBER 15, 1972 Page five E_ (e) F. - 2' · _Revenue Sharing MeetinOo, Seattle - November 22, 1972 Mr. Glotfelty reported that on November 22, 1972, there will a meeting introducing the revenue sharifig package. There are a number of restrictions on the funds. Mr. Galliett, Mr. Massey and the City Manager will attend. They will also see Environmental Protection Agency on funds for WPC-AK-3S and Housing and Urban Development for funds for WPC-AK-33. Senior Citizens Exemption' Ordinance Mr. Glotfelty reported the new Municipal Code has provisions for Senior Citizens Exemptions. Our ordinances will have to be revised to comply with the Municipal Code. Liquor License approvals - City and Bor~.ugh obliga~tions The Borough request the city would make sure all Borough taxes, as well as city obligations, are paid before approving renewals or transfers. 2 Letters - H.U.D. Edgar Nea! of H.U.D. wrote the Borough. Mayor that the Kenai Peninsula Borough is not certified for planning requirements, a prerequisite for approval of water ~ sewer grants. Sam Best, Acting Planning Director, wrote Mr. Neal stating the requirements, as outline, are being processed and should be in 7our off±ce on or before November 15, 1972. Mr. Glotfelty reported Sam McKee has agreed to accept the position of Acting Finance Director until June 30, 1973. He will be on board November 27, 1972. The audit is complete and will be in your hands by the first meeting in December. Mr. Glotfelty recommends we hold off the work sessions until Mr. McKee is on board. He also reported 't.he Mayor's Committee on Aging have received a grant of $14,000, $8,357.00 of which they are going to spend on 2 V.W. buses. Mr. Fisher stated he had some literature.on these buses he 'would forward to the City and to the Committee on Agin.g. Administration was directed to. find out if this could go to bid to the Chevrolet, Dodge and Ford companies also and report to the n-ext meeting. ~ity Attorney's Rep.0rt No report MINUTES, KENAI CITY COUNCIL MEETING, NOVEMBER 15, 1972 Page six F, - 4' - - 6' M__a_~or' s Repo?t_ Mayor Steinbeck reported there is an Ail Alaska Travel and Trade Fair, February 23 through March 4 in San Francisco, promotir..g and selling communities. Mr. Glotfelty stated we are not budgeted for this and should turn it over to the Chamber of Commerce. There were no objections. Mayor Steinbeck stated he has been contacted by persons concerning the lighting on the entrances and exits at Sears Elementary School. Mr. Glotfelty stated the Sears Administration should contact the School Board.' C_~ity Clerk's Report No report. Finance Di'rector's Report No report. PlannJ:ng & Zoning's Report A1 Hudson, Chairman Kenai Planning & Zoning Commission, reported on the meeting of November 8, 1972. The Commission approved the Subdivision Plat - Hornad. ay Property Survey. The Commission forwarded their comments on Borough Ordinance 72-2.5 to Kenai's Representatives of the Borough Assemb~_y. The Susitna as.signment was approved at this time, however, when the actual time of assignment a written request should come through Planning ~ Zoning and Council. The Glacier State lease was screening requirements. tabled pending researching Mrs. Coyle reported there are funds available for training planners. The Commission is going to look further into this. Councilman Hornaday asked Mr. Hudson if the CommiSsion was going to study the cemetery problem. Mr. Hudson stated yes, the Commission intends to. The Assembly passed an Ordinance of Rezoning within the City of Homer. An Ordinance for a Supplemental Appropriation - School Retirement -Maintenance Personnel - retroactive to July 1, 1972, was passed. An Ordinance was introduced concerning Senior Citizens Exemptions. NBW BUSINESS Change Order #3 - Public Saf~'~_? Buildin~g- Administration recommends approval of Change Order #3 Kenai Public Safety Building. Johnson mbved and Doyle seconded to approve Change Order #3 - Public Safety Building. The motion carried by roll call vote with McGrady dissenting. Notification of paym~en_t__._- West-e-r-n & Assoc. $36__~727.2_ 1 Administration has paid West-e-r-n & Associated $36,727.21 WPC-AK-33 - Estimate #?.- Chan~e Order #3 - Northwestern - Phase II Request for final p~ayment - Northwestern-Phase II Change Order #3 reduces the total amount of $23,242.11. Steiner moved and McGrad7 Seconded to approve final payment to Northwestern- Phase II - Kena5 Airport in the amount 'of $69,343.06. The motion carried unanimousl7 by roll call, vote. Rules of the road - S~ conditSon - K'enai Urban Section Kena-~pu r Roa~. Councilman Hornaday reported the condition of 'the Urban Section is dangerous. The people don't understand the middle section of' the road. The High~ay Dept. ~as to have arrows and letters indicating it was for a left turn. He felt the Adm'inistration should have an overall plan to co-ordinate with State Highway, Dept. of Public Safety & Police. The City Manager was directed to follow up on sidewalks not being maintained. PERSONS PRESENT NOT SCHEDULED TO BE HEARD' CITIZEN'S GRIEVANCES & REQUESTS- E_dward Call - Bush Lanes Mr. Call stated he realizes the contr.actor can't roll the ice around, but wanted to know if he is to return and fix the roads in the spring. Mr. Massey told him the contractor will be back in the spring to fix the roads. Calvin Quandt - Bush Lanes Mr. Quandt state'd the survey markers are gone and the barricades has not been put back u-p. Mr. Glotfelty reported the contractor had adverse conditions to work under and that Stan McLane has been hired to replace the property, corners. Johnny Johnson Johnson moved and Doyle seconded that beings there is 'money in the Council budget, to direct the City Manager to procure some decent chairs for the Council meetings. Hornaday moved to table the motion until the budget session next spring. The motion died for lack of a second. The motion failed with McGrady, dissenting. CITY OF KENAI ORDINANCE 2.10-72 PROVIDING FOR ADDITIONS TO THE PLANNING AND ZONING CHAPTER OF KENAI CODE, 1963, BY ADDITION OF REGULATION OF STRUCTURES, COMMONLY KNOWN AS "MOBILE HOMES" OR "HOUSE TRAILERS," AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the guided development of the City of Kenai would appear to require re- gulation of structures commonly known as "mobile homes" or "trailer houses" or "trailer coaches" or other comparable structures, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA' Section 1, Chapter 14, (relating t.o Planning and Zoning) of Kenai Code, 196'3, as amended, thereto is hereby added the following- purpose for "mobile home" or "trailer house" regulation declared- Section 14-80. The provisions Of Kenai Code, 1963, as amended, Sections 14-80 shall be known as the "Trailer Regulation Code" with the purpose of as uni- form as possible regulation of "mobi°le homes" or "house trailers" for the pro- tection of the public health, safety and welfare in t~e interest of orderly development of the City of Kenai. Definitions · Section 14-81. For the purpose of Sections 14-81 through 14-89, terms or words used herein shari be interpreted or defined as follows: " "trailer coach " (a) The term "trailer," "automobile trailer, , shall be defined.in the terms that "mobile home" is defined in-Kena; Code, Section 14.50.25(b)-(47). (b) The term "trailer park" or "mobile home park" shall be the same as defined in Section 14.50.25(b) (48). (c) The term "lean-to" shall mean an accessory structure attached and appurtenant to a trailer. (d) "Utility" or "recreational" trailers are defined as vehicles and if intended for occupancy, designed for use on a limited time basis and no.t for continuous year-round use as is the custom with the trailers defined in sub-paragraph (a) of this section. certain types uses for trailers prohibited' Section 14-82. No trailers may be installed for use in {~e' C{~ty of Kenai for public, commercial or assembly purposes after the 1st day of' January, 1973. Those trailers in use for the proh~ibited purposes on the effective date of this enactment shall terminate such use on or before the 1st day of January, 1978, and such existing non-conforming uses as presently exist may not be al- tered, enhanced, or improved in any fashion aft.er the 1st day of January, 1973 Areas delineating., permitted and prohibi'ted trailer use location' Section 14-83. (a) For regulation purposes, the City shall be divided into two areas, with the common boundary being Main Street and Main Street extended to the northern boundary of the City limits as shown on the official zoning map of the City of Kenai. (b) Trailers for residential use may be parked anywhere within the rural residential zone east of the boundary line described in sub- paragraph (a) of this section and south of the Kenai River, unless such trailers are prohibited by restrictive covenants, zoning limitations, health~ standards or other regulations. (.c) Trailers may be parked only in "mobile home parks" (some- times also known as "trailer courts") in the area west of the boundary line described in sub-paragraph (a) of this section. (d) Trailers in existance in areas where prohibited by this or- dinance and used for residential purposes, may have such use continued indefinately, except that such trailers shall not be replaced if destroyed or removed. (e) Trailers utilized on construction sites for offices, storage, or other such purposes may be so used anywhere within the City limits on the construction job they serve without permit, but shall be removed im- mediately upon completion of. said construction. Criteria for trailer placement Section 14-84. Trailers placed or "set up" for occupancy within the City of Kenai shall conform to the following criteria' (a) Those standards prescribed by ^.S. 45..30.010 through 45.30.060. (b) The foundation area upon which the trailer is placed shall be excavated to non-frost susceptible material or 42 inches from adjacent surface, whichever is the lesser depth. Such excavation shall be back- filled with non-frost susceptible material to the Same or higher elevation as the surrounding terrain. (c) Trailers shall be placed upon substantial blocking. '"Sub- stantial'' in this context shall mean adequate to support the trailer, its contents, and sustain the shocks or vibrations of occupancy in such fashion as. to permit all doors or .exits from the said .trailer to operate in accordance wit]i their design. (d) The determination of adequate conformance to the standards specified herein shall be made by the Building Inspector. However, in- stallation approval shall not require periodic evaluation for conformance to standards. Lean-tos Section 14-85. (a) Structures designated as lean-tos shall conform to all applicable codes as adopted by the City of I(enai, except that lean-tos of 400 sq. ft. or less may be set on foundations as specified in Section 14-.84 (b, c, and d) for trailer foundations. (b) If any lean-to covers both exit~ fro~ a t.railer, then the lean-to shall have two exits remote from each o~ther. Building permit fees applicable to trailers and le~-tos- -Section 14-86. (a) Building permits shall be obtained before trailer placement anywhere within the City limits and before starting any con- struction on lean-tos. (b) The fees for A building permit for .a trail, er shall be computed at the rate of $0.04 per ft. (c) The fees for a building permit for a lean-to of 400 sq. ft. or less shall be computed at the rate of $0..0~ per sq. ft. (d) If work on placemen~ of a trailer or construction of a lean-to is commenced before obtaining a building permit., the fee specified herein' shall be doubled. The penalty fee shall not relieve the person from com- plying with any other requirements of this ordnance. Application of trailer regulation code: Section 14-87. The provisions of Section 14-80 through 14-89 shall apply .-.. to the trailers set up on individual lots, in "mobile home parks" or to trailers moved from one location to another within the City. Any improvements to existing trailers or..lean-.tos shall comply with this ordinance. Penalty for violation' Section 14-88. Any person, firm, or corporation violating any of the provisions of Section 14-80 through 14-87 shall be deemed guilty of a' mis- demeanor; and, upon conviction of any such violation, such person shall be punishable by a fine of not more than $300. Separability o.f provision' Section 14-89. In the event any portion, section, sub-section, clause, sentence or phrase of Sections 14-80 through 14-87 are. held to be invalid or unconstitutiOnal, such decision shall not affect the validity of the remaining portions thereof. This class was conducted at Fort Kenay the evenings of November 6, 7, 8, and 9th and these men warrant congratulations for their enthusiastic participation in discussion and their excellent attendence record. Course emphasis is on the recognition, avoidance, and prevention of construction hazards and application of these principles in the future work of these men and their subordinates will surely benefit the City. Ordinance 21'0- 72 Done MONTHLY REP OR~ KENAI POLICE DEPART~.NT OCTOBER, 1972 The month of October was a busy month, even more so considering one officer was in school all month and another officer was in school for two weeks. There were 94 verbal traffic warnings and 39 traffic citations; a total of 35 arrests were made during the month of October. They, or the borough, could then immediately advise us that there are taxes due and request that no action be taken on the transfer or renewal until such as the taxes are settled.
