Oscar Thomas
Mr. Thomas stated the problem he has come befOre Council
a problem of K.U.S.C.O. and a community problem and would
like some assistance in the sblution. ~

The contractors employed by the City have been the cause of
,a lot of recent damage to the gas system. There was one
incide~ in Davidson S/D and four in Bush Lanes. The lines
have been marked and there is. no excuse. He feels the Council
should consider putting teeth in Ordinance 125-67 and consider
increasing the amount of property damage, exposure by hand
digging around utility lines and no excavating performed,
except in emergencies, ~vhen the frost is down one foot, and
there should be a full time inspector on the jobs at all times.
Mr. Glotfelty stated that', some of your suggestions are good
and should be reviewed.
Mayor Steinbeck asked Council if there were any objections
to having the City's legal counsel review this to see if the
ordinance could be up-dated. There were no objections. Mr.
Steiner thought it would be a good idea to see that Mr. Fisher
had a copy of the Occupational Safety and H'ealth Act.
Kenai Peninsula Rac.i. ng_..Association
The Clerk read the letter from the Kenai
Association.
Peninsula Racing
The City Manager stated a legal agreement has been drawn up
between the City of Kenai and the Kenai Peninsula Racing
Association. The Administration recommends the City enter
into such an agreement with them. He further stated the
grant has not been funded as yet for permanent rest rooms.
The Mayor asked Mr. Self if it would be agreeable with the
Racing Association for the City to wait to install the
permanent rest rooms until the grant has been funded? Mr.
Self stated yes, they would be agreeable.
Johnson moved and Doyle seconded to enter into an agreement '
with the Kenai Peninsula Racing Association per the City M.anager's'
recommendation. The motion carried unanimously by roll call vote.

Read under Agenda Item B - 2'
Vernon L. Perry - Governors Advisory Committee on Aging
Mr. Perry, Acting Executive Secretary - Governors Advisory
Committee on Aging wrote the Committee passed unanimously
a resolution expressing their appreciation for the many
evidences of genuine hospitality shown them during their
recent meeting in Kenai.
Nels .Kjelstad - Fort Kenay_ Restoration
Mr. Kjelstad outlined the progress on the Fort Kenay Restoration.
The progress has been slow on the Fort Kenay Project due to
much inclement weather.
D. E. Kirkpatrick - Kenai Peninsula Borough School District
Mr. Kirkpatrick, Assistant Superintendent of the Kenai
Peninsula School District asked for the Ci2y's consideration
in respect to budgeting for and eventual construction of a
sidewalk, extending from.the newly paved highway along Forest
Drive to the Sears Elementary School and provision for snow
removal as required. In addition they requested funds be
allocated for snow removal from the newly constructed side-
walks paralleling the new highway.
Mr. Glotfelty stated that Forest Drive is a State road and the
sidewalks on the Urban Section is not our responsibility. The
State is not, .at this time, ready to enter into a contract
with the City for snow removal.

Mr. Keith C. McKinney, Vice President and General Manager
of Pacific Alaska LNG Company wrote Mr. Steinbeck his trip
to Kenai was a delightful experience and was good to see the
area and to gain the assurance that the community looks
forward to our project.

Mr. Howard, Chairman, Southwest Alaska Section - Society
of Petroleum Engineers of AIME wrote they recently est-
ablished a Technical Information Gommittee. The purpose
of the Committee is to provide technical assistance to
governmental officials, communications media personnel and
to civic groups on matters relating to the exploration and
production of petroleum and natural gas.
Councilman Steiner stated he is happy such a service is
offered where you can get technical questions answered.
There are many inaccurate figures tossed around.

as hav'ing been accomplished.

Municipal League Meeting
Mr. Glotfelty reported Councilman Hornaday spent three days
and Councilman Steiner one day at the Alaska Municipal League
Meeting. Mr. Massey wa's el'e'cted Vi.ce-President to the Alaska
Water Management Assoc., Councilman Hornaday retained on the
Legislative Committee and he was re-elected to the Board of
Directors. The Planning & Zoning Commission had 3 members
attend.
Ordinance 206-72 - D.og Control
Mr. Glotfelty reported that after a two weeks notice, Ordinance
206-72 will be enforced for a 4 week period.

Dedication
The dedication of the new Public Safety Building, the Urban
SectiOn and the Airport improvements will be held November
'5, 1972, at 2'00 P.M. Governor Egan, Senator Stevens and a
host. of other officials will be present.
There will be a dinner at 7'30 P.M. at the Harbor View for
invited guest, Councilmen and their wives, Architect and
Administration. The dinner is at the request of Kelly
Construction Co, who will be picking up the tab.
Bud g e t Se s..s i on -
Mr. Glotfelty reported the budget session d4a take place
Saturday. The Administration recommends the next budget
session be postponed until Wednesday, November 8, 1972,
7'00 P.M. in the City Manager's office and then on the
following Saturda7. There were no objections.

Mr. Morris Fuller from Pacific Alaska LNG C.Ompany was in
the City Manager's office today. The site has been picked
for the plant but there will be no announcement of the site
at this time.

Mr. Fisher asked if the auditors show the pending litigation
of the City of Kenai in their report. The City Manager stated
yes it does.
Mr. Fisher reviewed the past litigation for the benefit of the
new Councilmen.

The City Clerk gave a brief report on her meetings at the
Alaska Municipal League. The second meeting, Lt. Governor
Boucher was there to discuss registration and election problems.

Planning. &- Zoning's Report
Chairman Hudson reported on the meeting of October 25, 1972.
There was no quorum due to three members attending the Alaska
Municipal League.
A Public Hearing was held on the proposed Trailer Ordinance.
There were three people in attendance and they"were in favor
of the Ordinance. -'
A poll by telephone Was taken of the remainder of the
Commissioners and they.all agreed to send the Ordinance on
to Council for their consideration.

Ass.emblyman McGrady reported on the Assembly Meeting of
October 31, 1972.
An Ordinance was introduced providing for a supplemental
appropriation of' $14,700 - Emergency £mployment Act.
The Assembly heard the results :of the canvass.
The new assemblymen were seated.

Ordinance 72-19 ' Rezoning within the City of Kenai was passed.
Ordinance 72-20 - Adjusting the hours of work for personnel
was introduced. This would provide evening hours for tax
payments.
An Ordinance for a supplemental appropriation for $100,000
Central Peninsula Hospital was introduced.
Ordinance 72-22 - Relating to the term of office of Borough
Mayor, limiting to two terms, was introduced.

Doyle moved and Steiner seconded to appoint C.E. Johnson as
Kenai's representative to the Kenai PeninsUla Borough Assembly
to replace Robert Norene: The motion carried unanimously.

This has been resolved, agreeing to restore to the
original state and pay $10 per unit and take care of

A hold harmless and bill of sale from Mrs. Killen.
We have received a bill of sale but not hold harmless
agreement. It has been sent back but to date have
not received it. --
Fisher reported Mrs. Killen's attorney wanted a hold harmless
agreement sent up to Mrs. Killen. It was sent up. They
objected to it and sent back their versSon. If we accept
their counter proposal, we would have no general hold harmless

Administration recommends the introduction of the trailer
ordinance.
McGrady moved and Doyle seconded to introduce Ordinance
210-72 Trailer Ordinance for first raading. The motion
carried unanimous 17 b7 roll call vote.
Assignment of Lease -
Sus itna Supply B.!dg.
to Haliburton
Mr. Glotfelty asks and 'recommends approval of the assignment
of lease from Susitna Supply to Haliburton. Haliburton will
use this for an acid storage facil.ity. Administration is
sending them the instructions on handling acid via the Fire
Department. Mr. Glotfelty stated there is a time element
involved and not enough time to go through Planning & Zoning
first.
There were no objections from the Council for approval of the
assignment of lease Lot 5. & 6, Block 4, CIIAP from Susitna
Supply to Haliburton. It was recommended this go to Planning
'and Zoning for their concurrence.

Five New Police Cars
Mr. Glotfelty stated that in the next budgetary year he is
going to request the purchase of 5 new police cars.
Kenai River Brid~e Recreational Area
The Administration recommends Council designate 1/4 mile on
either side of the Kenai River Bridge be declared a recreational
ar~t.
Steiner moved and Johnson seconded that 1/4 mile on either
side of the Kenai River Bridge span right-of-way be declared
a recreational area. The motion carried-unanimously.
Resolution 72-32 -:Beer & Wine served on Election
Johnson moved and Doyle seconded to adopt Resolution.72-32
Permitting licensed premises to serve beer and wine on
Blection Day providing it is served with a full meal. The
motion carried with Hornaday dissenting.

PROPOSAL:
We, the Kenai Peninsula Racing Association propose to operate
the facilities of the race track for t'he next two years as
follows.
To furnish all maintenance to the track and surrounding
area.
2. To furnis'h the insurance for the frivers and pit crew.
3. To complete the bleachers within this period.
4~ To be sol®ly responsible for all upkeep ar~ debts
incurred on these oremises within this two year
period excluding spectator insurance.
5. To complete lighting installation on the pron~ses.
6. All ~eneral improvements will be furnished at the
Clubs expence.
7. For the City to furnish permenant rest room facilities.

Gentlemen:
The administration of the Kenai Peninsula Borough School District would
be very appreciative of your consideration in respect to budgeting for,
and eventual construction of, a sidewalk, extending from the newly paved
highway along Forest Drive to the Sears Elementary School, and provision
for snow removal as required.
In addition to the above request may we suggest that funds be allocated
for snow removal from the newly constructed sidewalks paralleling the
new highway, this being quite critical.
Our requests are based primarily on the fact that each year it becomes
more difficult to procure sufficient funds for our "hazardous transport-
ation routes" (service within one and one half miles of the school) as
they are funded fifty per cent by the local authority, fifty per cent by
the State of Alaska, a total of some $50,000 throughout the district. In
the near future it would appear that the local 'districts are going to be
asked to support possibly as much as 20 to 25 per cent of the "regular
to and from" (services outside one and one half miles of the school). Any
additional expenditures in trans'portation from the local authority is
most certainly going to reflect reduced expenditures in other programs.

The Southwest Alaska Section of the Society of Petroleum Engineers
of the American Institute of Mining, Metallurigical, and Petroleum
Engineers has recently established a Technical Information Committee.
The purpose df the Committee is to provide technical assistance
to governmental officials, communications media personnel and to .
civic groups .on matters relating to the exploration and production
of petroleum and natural gas. Because our membership in Alaska
also includes mining industry engineers, we extend this technical
assistance to exploration and production of other minerals.
The 'Soci'ety of Petroleum Engineers of AIME is the internationally
recognized technical and professional .organization for persons en-
gaged in the exploration and production phases of petroleum and
natural gas. The Society has a membership totalling more than 17,000
individual members, and there are no company memberships. Our South-
west Alaska Section has some 237 engineers, and the 1972-1973 chair-
man of our Technical Information Committee is R. Dean Allen of In-
duStry Services, Incorporated. Vice Chairman is Harry. C' Wi'ese
of Schlumberger Offshore Services. Either can be reached by mail
at the Southwest Alaska Section letterhead address, or by telephone
at their respective Anchorage business offices, 279-5115 for Mr.
Allen or 279-6611 for Mr. Wiese.
If our Technical Information Committee can be of assistance to you
in examining the technical feasibility or accuracy of issues re-

RE' Present status, Kenai Community Water Co. turnover
' . Prompted by your telephone call of 10/24/72, I collected .as
much information as possible and would outline the situation as
follows:
1. After collection of as much information as possible from
City sources, I attempted to call bir. Dennis Marvin only to find
that he had been ill for approximately a month. I did talk to
a bir. "Bud" Carter who indicated that the hold-up had been with
the owners. SBA would waive lien rights, but not being a mortgagee
in possession, didn't have any other authority. 'The agreed waiver
of lien rights was only if the owner would, turn over to-the City.
Up until about two weeks ago, the required paperwork for turnover
of Kenai Community Water Co. to the City had not been accomplished.
2. After talking to Mr. Carter, I reported back to Mr. Massey
who then additionally advised'
a. The SBA had agreed to hold the City harmless (this
would not be a general hold harmless, which was the apparent impres
sion that the City had).'

b': If the transaction would fall through, then SBA
would take care of all expenses (comment on this later).
c. That revival of or repair of the system would
enable SBA's mortgagor (Killens) to sell lots and pay off the
SBA lien.
3. I received a call from a Mr. Ted Ressler, an attorney for
SBA who was acting for the agency '(due to illness of Attorney
Dennis' Marvin) and he advised as follows-

a. SBA has been ready to release since September, 1972.
b. They have received the release by the borrower.
4. City Attorney outlined to Ressl'er that the City was
worried about the system as .to lien, condition, status and the
fact that the system itself would really not be of any assistance
for fire insurance rating.s.
Il 5. Mr. Ressler said that it was the first time that he under-
st.ood the City was not anxious to have the system because they

This is the follow-up summary of my understanding of our telephone
conversation of 24 Oct. 1972-
1. Small Business Administration has been ready to release since Sept.
of 1972 and have a release from tho Borrower.
2. I indic'ated to"you that the City was concerned about the system as
to its condition. To this, you responded that people had called tolling
you how anxious they were the transfer be accomplished.
3. You understood that the City was anxious to have the transfer accom-
plished. I pointed' out that the anxiety was directed entirely at having
the logal matters completed in sufficient time that construction would
not: be faced with winter deadlines. Those deadlines are now upon us.
4. I pointed out to you that the cost of repair, construction~ and.
upgrading would be approximately 2¢ per sq.. ft. over the entire subdivisions.
$. You indicated that your agency' had been waiting for paperwork to come
from the Borrower. -
6.. You declined to give a general hold harmless agreement which was the
understanding the City had. You indica~d that the only kid harmless
agreement that would be given by t.he agency would be'specific as to SBA's
interest.
7. If this matter is to be accomplished, there must be some rather quick
acti.on because of the impending winter freezing conditions.
8. After contact with you, I mad.e .contact with Attorney Hendrickson
.representing the Borrower. I have transmitted to him a general hold harm-
less agreement, a copy of which is enclosed.
9. I would recommend that you urge Mr. Hendrickson to get this accomplished
as quickly as possible because any reluctance .bY his client could, result
in mt getting anything accomplished this year which would, of course, slow
down anything that might be done over:..the winter in they ay of sale .of
property, etc.

This is a follow-up to my telephone call of late the evening of 24 Oct.
1972, regarding the hold harmless agreement from Dovie Killen as the
owner of substantially all of Mommsen,S Editi.ons 1 and 2.
Enclosed is a hold harmless agreement I have prepared in accordance with
your recommendation. ~--
I would also advise as follows-
a. ?he cost of repair, construction, and maintenance to bring it
to an op~ational level will be approximatzty 2¢ per foot of the property
benefited w. hich wo..u~ld be all of the two subdivisions.
b. It is my understanding that the cost per 10,00.0 lot would there-
fore be approximately $200. The City's Water Superintendent estimates
that this cost woul-d be saved the first year or so of better fire insur-
ance rates that would result from the improvements on developed property.
c. As. I indicated to you, the City has been m6st anxious to
conclude these details in the event this transaction was to be completed
in order to avoid winter cor~ruction deadlines. Those deadlines are now
. upon us.
d The present conditions of the~ater system in Mommsen's. subdivision
are such that they are of no practical':-use for firefighting because of
both fl.ow capability as well as preSent conditions on fire plugs, etc.
It is undemtood that nothing can be loaned on the subdivision as it pre-
sently stands so for ail practical purposes, any develop'ment is stopped.
· ~is situation-is' believed to be correctible by proposed operation by the
City of Kenai. .The operation cannot be undertaken unless the. City is
protected.
· e. It would be my interpretation that a:'-.signing of. the hold harmless
agreement would be, in effect, an agreement in advance that assessments
for improvements of the water and sewer systems woutt be acquiesced in by
the owner, Doyle Kill en.

1963, BY ADDITION OF REGULATION OF STRUCTUt,'.ES, COb. IitONI,Y KNOWN AS "MOBILE tlOMES"'
OR "HOUSE TRAILERS," AND PROVIDING FOR AN EFFECTIVE DATE.
h~tEREAS,;the guided development of the City of Kenai would appear to require re-
.. gulation of structures commonly known as "mobile homes" or "trailer houses" or
"trailer coaches" or other comparable structures,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA:
SeCtion 1, Chapter 14, (relating to Planning and Zoning) of Kenai Code, 1963,
as amended, thereto is hereby added the following:
Purpose for "mobi].e home" or "trailer house" regulation declared'
Section 14-80. The provJ, sions of Kenai Code, 1963, as amended, Sections
14-80 shall be known as the "Trailer Regulation Code" with the purpose of as uni-
form as possible regulation of "mobile homes" or "house trailers" for the pro-
tection of the public health, safety and welfare in the .interest of orderly
development of the City of Kenai.
Definitions · : · . ·
·
Section 14-81. For the purpose of Sections 14-81 through 14-8~, terms or
words used herein shall be interpreted or defined as follows-
" "trailer coach "
(a) The term "trailer," "automobile trailer, ,
shall be defined in the terms that "mobile home" is defined in Kenai
Code, Section ].4.'g0.25('b) (4 7).
{b) The term "trailer park" or "mobile home park" shall be the
same as defined in Section 14.50.25(b) (48),
(c) The term "lean-to" shall mean an accessory'structure attached
and appurtenant to a trailer.
(d). "Utility" or "recreational" trailers are defined as vehicles
and if intended fo:r occupancy, designed for use on a limited time basis
and not for continuous year-round use as is the custom with the trailers
defined in sub-paragraph (a) of this section.
· Certain _types uses for trailers prohibited-
Section 14-82. No trailers may be installed for use in the City of
Kenai for public, commercial or assembly purposes after the 1st day of January,
1973. Those trailers in use for tho prohibited purposes on the effective date
of this enactment shall terminate such use on or 'before the 1st day of January,
1978, and such existing non-conforming uses as presently exist may not be al-
tered, enhanced, or improved in any fashion after the 1st day of January, 1973.

Section 14-83. (a)' For regulation purpo.ses, the City shall be divided
into two areas, with the common boundary being Main Street and Main Street
extended to the northern boundary of the City limits as shown on the
official zoning map of the City of Kenai.
{b) Trailers for residential use may be parked anywhere within the
rural residential zone east of the boun'dary line described in sub-
Paragraph (a) of this section and south of the Kenai River, unless such
trailers are prohibited by restrictive covenants, zoning limitations, health
standards or other regulations.

'line described in sub-paragraph (a) of this section.
(d) Trailers in existance in areas where prohibited by this or-
dinance and used for residential purposes, may have such use continued
indefinately, except that such trailers shall not be replaced if destroyed
or removed.
(e) Trailers utilized on construction sites for offices, storage,
or other such purposes may be so used anywhere within the City limits on
the construction job they serve without permit, but shall be removed im-
mediately upon completion of shid construction.
Criteria for trailer placement
Section 14-84. Trailers placed or "set up" for occupancy within the
City of Kenai shall conform to the following criteria'
(a) Those standards prescribed by A.S. 45.30.010 through 45.30.060.
(b) The foundati.on area upon which the trailer is placed shall be
excavated to non-frost susceptible material or ~2 inches from adjacent
surface, whichever is the lesser depth. Such excavation shall be back-
filled with non-frost susceptible material to the same or hi.gher elevation
as the surrounding terrain. '.

(c) Trailers shall be placed upon substantial blocking. "Sub-
stantial'' in this context shall mean adequate to support the trailer, its
contents, and sustain the shocks or vibrations of occupancy in such
fashion as. to pern~it all doors or exits from the said trailer to operate
in accordance wit]5 their design.
(d) The determination of adequate conformance to the standards
specified herein shall be made by the Building Inspector. However, in-
stallation approval shall not require periodic evaluation for conformance
to standards.

Section 14-85. (a) Structures designated as lean-tos shall conform
to all applicable codes as 'adopted by the City of Kenai, except that
l~an-.tos of 400 sq. ft. or less may be set on foundation's as specified
in Section 14~84 (b, c, and' d) for trailer foundations.
(b) If any lean-to covers both exits from a trailer, then the
lean-to shall have two exits remote from each other.
Building permit fees applicable to trailers and 1. ean-tos-
Section 14-8'6. (a) Building permits shall be obtained before trailer
placement anywhere within the City lim'its and before starting any con-
struction on lean-tos.
(b) The fees for ~ building permit for a trailer shall be computed
at the rate of $0.04 per ft.
(c) The fees for a building permit for a lean-to of 400 sq. ft.
or less shall be computed at the rate of $0.04 per sq. ft.
(d) If work on placement of a trailer or construction of a lean-to
is commenced before obtaining a building permit, the fee specified herein
shall be doubled. The penalty fee shall not relieve the person from com-
plying with any other requirements of this ordinance.

AppliCation of trailer re_gulation code'
Section 14-87. The provisions of Section 14-80 througl~ 14-89 shall apply
to the trailers set up on individual lots, in "mobile home parks" or to
trailers moved from one location to another within the City. Any' improvements
to existing trailers or lean-.tos shall comply with this ordinance.
Penalty for violation'
Section 14-88. Any person, firm, or corporation violating anY of the
provisions of Section 14-80 through .14-87 shall be deemed guilty of~a mis-
demeanor; and, upon conviction of any such violation, such person shall be
'- punishable by a fine of not more than $300.
Separability of provision'
Section'14-89. In the event any portion, section, sub-section, clause,

portions thereof.
