ROLL CALL' Members Present - Robert Norene, H.J. Steiner, James Hornaday, C.E. Jo]~nson, Tru McGrady, Junior Councilman Navarre and Vice Mayor, James Doyle. Members Absent - Mayor John Steinbeck (excused) B - 2 With consent of Council, first on the agenda. A.G. Heibert - KTVA-TV agenda item B-2 will be heard Mr. A.G. Heibert, Manager of KTVA-TV and Jeff Bowden drove down from Anchorage to discuss with Council KTVA-TV's plans for improving the TV reception in the area. He stat'ed they have had'a translator at the white alice site for some time now. The translator has not worked well because of a background of interference. They are looking for another spot to omit the interference and to increase the power. They have made a location study. possible and in the line of sight. They look good but will need more. study. an .application with the F.C.C. They need a site as high as They have found two locations.. This will take 90 to 120 days and by spring, should be ready' to go. He stated if Council had any questions, .he would be glad to answer them. Councilman Norene thanked Mr. Heibert for making a special trip to Kenai. He asked about the overlap .of signals in the wint.er time in the extreme cold. Jeff Bowden stated i{ could be because of the change of signal strength coming in. We get. a feea back when there is not enough signal. Councilman Norene asked Mr. Heibert, if when there is an outage do you have to get permission to climb the tower? Mr. Heibert stated yes, they do have to get a security cl.ear- ante every time it is necessary to clim~7~ the tower. Kenai would benefit but would be poor in Soldotna. It might not be possible to get all the areas served with one unit. The City Manager said then we cannot expect any improvement until spring. McGrady moved and Norene seconded to amend 'Ordinance 208-72 page 4, Section 10-13(5), to read, all taxes and other ob- litigations due to the City and Borough must be curr'en't prior to license renewal. The motion carried unanimously. Vice-Mayor Doyle recessed the meeting and opened it up to a public hearing. Mr. Ackerson stated he does not understand. pass the ordinance? · Did you just Councilman Hornaday stated we merely made an amendment. you want some changes, now is the time to do so. If Fisher stated in Section 20-12(b), should be deleted. "i bus and 1 limousine" Mr. Ackerson stated he accepts the deletion. Mr. Sullivan stated that accordin'g to the new Ordinance, there are 10 cabs listed. How .long can you fail to use this permit and still retain it, or is it open for life? Mr. Glotfelty stated the way the Ordinance is written, the Council felt 10 cabs can serve the needs of the community. It is the perrogative of Council to approve or dissapprove the re- quests. If an owner does not meet the criteria at the end of the year, then those allotted positions will be dropped from the Ordinance. Mr. Glotfelty asked the City Attorney if this was a reasonable interpretation. Mr. Fisher stated it was a reasonable interpretation. The way to find out is to try. MINLPrES, KENAI CITY COUNCIL MEETING, OCTOBER 18, Public Hearing, Taxicab Ordinance continued 1972 Page -3- Mr. Ackerson stated he can't understand how Council can allow another company to go into business when the other two aren't making a living. He stated he would like to see the minutes where the third company was allowed a permit. He further stated the second permit must also go through Council and it did not. Mr. Glotfelty stated he would try to answer several questions. The Council felt the public was not being served properly and authorized the issuance of a license to a new' cab company. The administrations interpretation of Council was a man cannot run a business with one cab, one being down for repair, main- tenance and inspection. Mr. Ackerson stated it seems that the administration is leading C.ouncil and not otherwise. By the old ordinance, it must go through Council. Mr. Love asked if there were any stipulations set out for safety.and insurance. He has seen some discrepancies. Mr. Glotfelty reported there were. Mr. Deering stated that many of you are quite aware by seeing things that the community is on the down grade. It should be obvious that if business was here, we would have more cars on the road to serve the people. In re:gards to the issuance of a permit to the third party, he worked for each of the other cab companies. We gave him a job and-he did more harm to the equipment. ' Vice-Mayor Doyle stated this is not.the issue. having a public hearing on a taxicab ordinance. Mr. Ackerson stated you cannot Stop a-public hearing. Mr. Deering stat'ed he did not know why all this transpired. Three weeks ago everything was perfect, t.hen we received by registered mail a c6py of a new proposed ordinance. Why weren't we told about the other permit. The City Manager stated he had received many calls Cab companies were not responsive. that the Mr. Deering asked for specifics. MINUTES, K. Mr. ^ckerson stated he would like to go through the ordinance step by. step. 20-1(3), the last word "owner s'hould read '~company." 20-2 (25) h, is no body's business 20-3(a) (2) [ (3). - how do you prove 20-3(c), where do the police check this. 20-6(c) should include uniforms; 20-4 the first paragraph should be deleted, or (e) should be changed. 20-7(b) .10-minute is not enough, it doesn't equal the 9.00 waiting time per hour. 20-12(a)(1) no one checks the records. Mr. Steirs asked w~y give the Chief the a, uthority to pick one specific garage. . The City Manager stated a service station may have a pre- ference over cab companies. After some discussion on taxi meters, Hornaday moved to continue the public hearing until the next meeting. The motion died for a lack of a second. Vice-Mayor Doyle closed the public hearing back to the Council table. and brought it ~ Norene moved and Johnson seconded to delete 20-2(3)(h) "whether the same is mortgaged, the name of the mortgagee and the amount of the mortgage." The mot ion carried with McGrady dissenting. Steiner moved and McGrady seconded to change the last word "owner" to "company" in 20-1(3). Unanimous consent was asked and granted. McGrady. moved and Norene seconded to change the word "shall" to "May" in Section 20-4(e). Unanimous consent was asked and grant ed. · ~ . Norene moved and Johnson seconded' that in Section 20-7(b) ,10-minute and delete the $9.00 ~aiting time per hour. The motion carried with Hornaday and McGrady dissenting. McGrady moved and Norene seconded to delete "1 bus, 1 limousine" in Section 20-12(b). Unanimous consent was asked and granted. Sullivan dba Flash Taxi Service.- 2 taxicabs to 1 taxicab. The motion failed. Voting yes, Steiner and' HornadaT; voting no, Norene, Johnson and McGrady. Norene moved and Hornaday seconded to Adopt Ordinance 208-72 Taxicab Ordinance as amended. The motion carried unanimously by roll call vote. Voting, yes; Norene, Steiner, Hornaday, Johnson and McGrady. Public Hearino Relations Act. - Ordinance 209-72 - Public Empl_o~m.ent The Clerk read the Ordinance by°title. Vice-Mayor Doyle recessed the meeting and opened the meeting for a public hearing. There was no publi'c participation and the public hearing was closed. Hornaday moved and Johnson seconded to adopt Ordinance 209-72 Rejection of provision of Chapter 113, Session Laws of Alaska, 1972, (.Public Employment Relations Act). The motion carried unanimously by roll call vote. Vot±ng yes, Norene, Steiner, Hornaday, Johnson and McGrady. PERSONS PRESENT SCHEDULED TO BE HEARD Emmett Egan, Recreation Trailer Mr. Egan stated that since the last meeting, he requested an audience with the City Attorney and he set forth some guidelines. He felt that perhaps if this trailer was transferred to.the North Kenai Fire Dept., or a governmental entity, it could be moved before May, 19.73. The North Kenai Playgrounds Assoc. would assume the responsibility. Norene moved to take the motion off the table. for lack of a second. The motion died Mr.. Fisher explained the North Kenai Playgrounds is a non-pro£it organization and not-a political subdivision. A.G. Heibert- KTVA-TV Heard first on the agenda. Vice-Mayor Doyle declared a 10 minute recess at 10'15. and then brought the meeting back to order. Esther Borgen blrs. Borgen requested a meeting with the Chief of Police and police officers .concerning harassment. The roads are terrible and the site is poor shape. ill Councilman Hornaday stated this should go to the Planning and Zoning Commission to see if we should double this 'site or get a new site. Councilman Norene suggested Council direct the administration to immediately put more gravel on the access road. Mrs. Borgen-further stated the City should not have a local boy on the police force for this communitY. (b) Alaska Mun.icipal ,League .-.. 1972 Conference Mr. Glotfelty asked for the authority to have four Councilman, 3 Planning & Zo'ning Commissioners and four persons from administration attend the Alaska Municipal League Conference in Anchorage, October 25- 27. · Johnson moved and Norene seconded that these people be allowed to attend the Alaska Municipal League Conference in Anchorage. City Telephone Glacier State objected to hooking up on the electronic P.B.X. system of F.A.A. Friday, Glacier State is going to install regular phones at the new Public Safety Bldg. Dedication - November 5, 1972 Mr. Glotfelty reported the dedication for the Public Safety Building, the Urban Section and the Airport Improvements will be held November 5, 1972 at 2'00 P.M. Governor Egan and Senator Stevens and hopefully Congressm~an Begich will be there. Grant - Committe.e 6n Aging The Committee of Aging have received a grant in the amount of $14,361.60. City Attorney's Report No report. Mayor's Report Mr. Glotfelty reported Mayor Steinbeck phoned and said the bonds on the latest $1,000,000 bond'issue are signed · and he is on his way home. Zoning Commission T'he Commission held a public hearing on rezoning of Waldo Coyle's property. They approved, with a few qumstions, Ron Kiel's. a subdivision of MINUTES, KENAI CITY COUNCIL MEETING, E-6, Planning/Zonings Report OCTOI~ER 18, 1972 Page -8- The Commission will hold 'a public hearing on a proposed trailer ordinance on October 25, 1972. F, - Boro..ugh Assemblymen's Report Assemblyman Norene reported on the assembly meeting of October 10, 1972. The election results were ratified. and Borough Mayor were seated. The new assemblymen The assembly adopted an ordinance for a supplemental appropriation to the Homer School for $105,000. An ordinance to ke~p the Borough dry on e. lection day was adopted with some objection. An ordinance was adopted for a supplemental appropriation for service roads and trails in the amount of $104,000. 'A rezo~ing ordinance within the City of Homer was adopted. An ordinance regarding solid waste disposal was tabled. The assembly accepted the receipt of the auditor's report. ASsemblymen Arness and Norene were appointed on the Committee to review the sales tax ordinance. The sales tax will not be in effect in December unless replaced by a use tax. They will ~ake a report to the Council after their review. F· OLD BUSINESS · Alaska' Municipal League Legislative Program There is a copy of the Alaska Municipal League 1973 pre- liminary policy statement prepared by the League Legislative Committee in June, 1972. Councilman Hornaday is a member of the Legislative Committee. He stated he would be supporting some of their resolutions, one o.f which is return platting, planning and zoning power to first class cities and another the one year residency. F - 2' Fire Rescue Account The Rescue Account is now in the Central Treasury. Mr. 6lotfelty would like Council's authority to set up a $1,000 rescue account in the custodian of Chief Wisecarver and Captain Thomas. The checks would require both signatures. The rest of the monies in Capital Improvements and authorized to be spent only by Council. Councilman McGrady suggested to transfer the remainder _into time deposits. COuncilman Hornaday asked if there would be $1~000 account at al 1_ times. in the Mr. Glotfelty stated they. would start at $1,000 and when they reached say $300, ask for approval out of'revenues to bring it back to $1,000. The motion carried unanimously by roll call vote. · Ratification - Mommsen Water/Sewer System Hornaday moved and McGrady seconded to ratify the Council's ~action of October 11, 1972 and instruct administration to contin~'e working to obtain necessary easements, use...permit and oth.er permits necessary from government agencies to obtain an agreement from the subdivision owners and necessary government agencies to pass clear title to the water and sewer systems and apertenances in Mommsen S/D to the City and that the City go no further than to provide the basic maintenance to the present systems. That maintenanc.e to be at the expense of Small Business Administration until the above forement.ioned objectives are obtained and further moved the residents in Mommsen S/D be urged to contact the appropriate agencies, individuals, and organizations responsible; and Council being aware of the emergency measures' of the problem. After some discussion, Norene moved to amend the mOtion to read "in the event the water source is depleted or declared unfit for human consumption, the City of Kenai will do everything in its power to aid them." Vot±ng yes; Norene, Steiner, Johnson, McGrady and Doyle. Voting no; Hornaday. Absent, Steinbeck. Johnson moved and McGrady seconded to ratify Council's action of October 11, 1972 and approve the transfer of the beverage dispensary license from La~rence H. Lancashire and Florence T. NEW BUSINESS 'Resolutions 72-31, Planning and Zoning Mr. Glotfelty stated this resolution doesn-'t concern the specific problem with the Borough deleting a certified Planning Director within the Borough. Hopefully, this will be corrected soon. The Federal agencies require an area wide plan for future development before they can approve .grants. This rbsolution has to do with returning platting, planning and zoning within first class cities. McGrady moved and Johnson-seconded to adopt resolution 72-31 returning platting, planning and zoning to first class cities. The motion carried unanimously by roll call vote. Notification. ,of payment - WEST-E-R-N & Associates. The administration has made payment to WEST-E-R-N and Assoc. for estimate #6 in th'e amount of $91,160.47 - WPC-AK-33.. AdvisorY,Committee Charter Commission Councilman HornadaY stated that several members of the community are interested in working on the Charter Commission. We-have had good results from Mayor's Advisory Committee. Hornaday moved and Steiner seconded to announce in the papers and on the radio and ask persons interested in working on a Mayor's Advisory Committee on the Charter .Commiss±on to contact City Hall. COUNCIL MEE~ NG OF October CITY OF KENAI - ORDINANCE NO. 208-72 AMENDING KENAI CODE, 1963, TO MAKE A SUBSTANTIAL REVISION IN THOSE POSTIONS OF THE CODE PROVIDING FOR REGULATION OF TAXI DRIVER, TAXICAB COMPANY AND LICENSING, AND DECLARING AN EMERGENCY. WHEREAS, recent efforts to utilize those pr'ovisions of Kenai Code, 1963, as initially established in 1961 have proved difficult and revision thereof appears to be in the public interest, it is BE IT ORDAINED BY 'THE COUNCIL OF THE CITY OF KENAI, ALASKA: Section 1. The Code of the City of Kenai, 1963, as amended is hereby further amended to repeal and re-enact Chapter 20, such re-enacted provisions of the Kenai Code to read as follows: Definitions. Section 20-1. Unless otherwise expressly stated, whenever used in this article, the following words shall have the meanings given to them by this section: (1) "taxicab" means a motor driven passenger, vehicle having a seating capacity of not more than seven persons, including driver, which is offered for public hire on a time or distance basis and which is not operated on a predetermined schedule or over fixed routes. (2) the word "street" shall mean and include any street, alley, avenue, court, bridge, land, or public place in the City of Kenai. (3) the word "taxicab driver" shall mean and include any person who drives a taxicab, whether such person be the owner of such taxicab or be employed by a taxicab ,~w~er. ~--~~~-~c~]/ ~ (4) the word "taxicab company" shall mean and include any person owning or having control of the use of one or more taxicabs used for hire upon the streets or engaged in the business of operating a taxicab within the City. (5) the words "taxicab stand" shall mean and include any place ~ · along the curb or street or elsewhere which is exclusively reserved by the city for the use of taxicabs. (6) the word "person" .shall mean and include one or more persons of either, sex, natural persons, corporations, partnerships and assoc- iations. (7) the words "chauffer's license" shall ~ean a written author- ization granted to an individual driver permitting such person to drive a taxicab in the City of Kenai. ., License required to operate taxicab comPany. Section 20-2. To operate a taxicab within the city limits a taxicab company shall obtain a taxicab license therefor first. Each applicant for a taxicab license shall apply upon a form provided by the City, and comply with the following: (1) be a citizen of the United States. (2) be of the age of nineteen (19). years or a duly qualified corporation. (3) file a statement describing each vehicle to be so licensed, giving: .' a. full name and address of the owner. · b. the class and passenger-carrying capacity of each vehicle for which a license is desired. c. the length of time the vehicle has been in use. d. the make of car. e. the engine number. f. the serial number. g. the state license number. h. ~+b..et~r-the same ism_~~d, the--?.~_m.e of thc i. whether said vehicle is leased, licensed, or under any form of contract. j. what person, firm or corporation collects the revenues from the operation of said taxicab and pays the expenses of operating the same. Chauffer' s License. Section 20-3. (a) No person shall drive a taxicab commercially until that person obtains a chauffer's license from the City of Kenai upon meeting the following requirements: (1) Ability to read and write the English language. (2) Non-addiction to the use of intoxicants, narcotics, or dangerous drugs. (3) Good moral character and repute. (4) No conviction of a felony for ten years previous to application, no conviction at any time of a felony or misdemeanor involving moral turpitude or assault wi th a deadly weapon or use of or traffic in narcotic drugs, or traffic in women for immoral purposes. (5) Possess a current motor vehicle operator's license for Alaska. (6) Demonstrate familiarity with the traffic laws of the City of Kenai and the State of Alaska. (7) The driver shall be over nineteen (19) years of age. (b) With each application shall be submitted the necessary fees, photograph of applicant, and a full set of fingerprints to be taken by the Police Department. This sub-section shall also apply to officers, agents, servants, and employees of corporations, companies, and part- nerships. (c) If the application for a chauffer's license indicates that the applicant meets the qualifications for a license, the Chief of Police may issue a temporary license pending completion of the investigation of the applicant's background and qualifications. This temporary license shall expire at the end of forty-five (45) days from the date of issuance. If the applicant meets all of the requirements, the Chief of Police shall issue a permanent chauffer's license renewable annually on or before July 1 of each year. (d) If the applicant does not meet the requirements, the Chief of Police may deny the issuance of either a temporary or a permanent Chauffer's license. When the Chief Of Police refuses to issue either a temporary or permanent chauffer's license, such denial shall be in writing, stating .the reasons for such decision. The applicant may appeal this decision to the City Council within ten (10) days after the receipt of the written notice from the Chief of Police, in the event that such an appeal of the denial of a license is desired by the .applicant. · Examination of taxi cabs. Section 20-4. At least once each year, and more often if deemed necessary, the Chief of Police or a-garage or repair business designated by the Chief o'f Police shall carefully examine each taxicab. No taxicab shall be licensed which does not comply with the following: . (a) It must be in a thoroughly safe condition. (b) It must be clean and of good appeared- (c) Such other examinations as may be ordered by the Chief of Police from time to time. (d) Examination or inspection of mechanical condition shall be accomplished at the cos~o~fx~the applicant. (e) Mechanical inspection ~be at city garage at a cost not more than $20.00 per inspection. -3- Grantinq and transferring license. Section 20-5. Upon satisfying the City Council that the public convenience and good order will be served thereby, the City Council may grant an operator's license. A taxicab operator's license may only be transferred after approval by the City Council is granted. License plates and numbers. Section 20-6. (a) Each licensed vehicle shall bear the license number of the taxicab and proper descriptive words, including the year for which the license was issued and by displaying on the taxicab's windshield. (b) Every taxicab accepting business on the streets within this municipality shall have some designation of the character of the vehicle painted in plain visible letters on each side thereof, and shall have an illuminated sign with the word "taxi" or "cab" or "taxicab" affixed thereto. (c) Taxicab companies shall select a color combination for their taxicabs and all cabs will be painted . that combination. Taxicab cards and rates. Section 20-7. (a) The operator of any taxicab shall display inside the taxicab a card legible to a customer seated in the rearmost seat stating the license nu3nbers, the maximum rates of fare, and a notice that any article left in the taxicab must be returned to the City offices, where it may be identified and claimed. (b) Rates charged for conveyance in taxicabs shall be fixed by resolution of the City Council from time to time. As of enactment of this ordinance rates shall be: $12.00 - Charter per hour · 80 - Per mile .90 - Flag drop ~ ~ Minute · 10 - 1/8 Mile Taxicab stands Section 20-8. Taxicabs shall be parked at stands so designated for that purpose from time to time by motion or resolution of the City Council. No taxicab driver shall solicit passengers as fares. No driver shall dismount from his taxicab at any time for the purpose of soliciting passengers; provided, that this shall not prohibit any driver to ~assist a passenger entering or dismounting from a taxicab. Only licensed taxicabs shall be permitted to park at any taxicab stand. public .... !iability insqr.ance. Section 20-9. An operator shall file with the City Clerk evidence of insurance certifying the operator insured for liability for damages on account of bodily injuries or death, or for damages to property resulting from the ownership, maintenance, or use of any taxicabs. The limit of such insurance policy shall not be less than $100,000 for bodily injury to, or death of, one person and $300,000 on account of any one accident resulting in injuries to and/or death of more than one person, and $20,000 liability for damage to property of others, arising out of any one accident. Such policy shall be endorsed to give the City 30 days notice of-expiration or cancellation. Miscellaneous. Section 20-10. (a) All' taxicab drivers shall be clean and courteous at all times. (b) No driver of any licensed taxicab shall carry any other than the passenger first employing a taxicab without the consent of such passenger, except for bona fide emergencies. Penalty. Section 20-11. Any person violating any provision of this article shall be guilty of a misdemeanor, and shall upon conviction thereof, be punished by a fine of nOt more than one hundred ($100.00) dollars. Number of taxicabs in operation. Section 20-12. (a) After public hearing and notice to all taxicab business licensees, the City Council shall determine from time to time · the maximum number of taxicabs required. The .standards of determination are: (1)' the demands for such service as shown by records of taxicab business licensees; .(2) whether the safe use of streets for vehicular and pedestrian traffic will be impaired; and (3) any other fact which the City Council ~may deem relevant. Our schedule has not allowed us to complete the traffic surveys you requested until just recently. These surveys show that minimum warrants for installation of traffic signals in your City are not met and probably will not be. met for many years to come. ~',lithout these warrants, it is very undesirable from a traffic engineering viewpoint to install signals. Additionally,. federal participating funds are not available unless these warrants are met. Briefly, there are two types of warrants, volume and accident, that apply. The volume warrant requires that the. volume during the 8th highest hour less right turns total 600 vehicles on both approaches of the major street and 200 vehicles on the'heaviest approach of the minor street. Your b-usiest intersection peak hour is only 503 and 58 vehicles respectively. The accident warrant requires three items' 2) There exists a traffic volume not less than 80 per cent of the requirements specified in the volume warrant. Five or more reported accidents of types susceptible to correction (right angle) by traffic signal control have Mr. Edwin H. GLOTFELTY, CITY MANAGER FIRE RESCUE ACCOUNT Presently in the Fire Rescue Account there is $5,534.53 in the checking account and $5,760.64 in the Time Deposits, making a total of $11,295.17 in the Rescue Account. It is the Administration's recommendation that 'the account be maintained within the City records and all but $1,000 of the amount be restricted for Cap}ta~ Improvements to the Rescue Section of the Kena5 Fire Department. Any expend- 5ture of this money would be at authorization of the' Council and the recommendation of the ^dministration. We do feel that an operating account of $1,000 is necessary for the purchase o.f supplies and maintenance of the Rescue F..qu~ipment. The custodian of this $1,000, we feel, .should be the Fire Chief, Chief Wisecarver and the Chief Coordinator for the Rescue, Captain Thomas. It would be a joint signature account.
