PUBLIC HEARING, WATER LINE' - WSF-AK-10-19-'1017
Mr. Massey asked Harold Gallie'tt, Engineer for the
project, to explain the general scope of the project.
Mr. Galliett related the water transmission line is the
middle third of the Industrial Water Line that will start
at the Sol dotna "Y" and go to the Nikiski area. This
sect-ion will primarily serve 'the citizens of Kenai. This
transmission line will be a high pressure line connected
with artesian wells in the Beaver Creek area. The pipe
will be approximately 36,000 ft. long, 24" diameter, with
a maximum of 8,000 gallons per minute. The water will be
used for public water supply and firefighting.
Coral Seymour asked when Mommsen Subdivision was going
to b'e hooked up to water.
Mr. Galliett explained Mommsen would be hooked up to
WildwOod's water supply for the winter. The water lines
will be put in this fall, but not hooked up t'o City water
until a new well is drilled.
A'lady in the audience wanted to know who "is .paying for
how much of the line.
Mr. Massey stated the people are assessed for what
on their land. They-will be assessed for a small
not a large one.

Mr. Quandt stated he is and he is sure others are in
favor of what you're doing, it's just taking forever..
Mayor Steinbeck asked if there were any more' questions
o.r if there were any objections.
There were no objections from the floor. Mr. Massey
stated if there were any further questions, he would be
glad to answer them in his office.
Ruby Coyle, A1 Cruver, Nick Poppin and Chairman A1 Hudson
of the Kenai Planning & Zoning Commission retired to the
conference room. It was by unanimous consent of the
Planning & Zoning Commission that the water line project,
WSF-AK-10-19-1017, be approved.

Mr. Fargo reported they held final inspection on the
Urban Section today. There ~/ere 13 minor deficiencies
which will be cleared-up.
Mr. Bielefeld stated the shoulders are giving away and
the finish is rough east of town, it has a wash board
effect.
Mr. Fargo stated that when the painted lines are on,
this should be alleviated as people are cutting the
corners short.
Mr. Bielefeld stated a letter should be sent to the
State Highway Department stating the discrepancies as
we see them.
Mr. Hornaday objected to the 50 MPH speed zone from
Beaver Loop to the highway. He felt it should be 35 MPH
throughout the urban section except for the 20 MPH school
zones. He further stated this is the worst project he
.ever saw and it's time we said something.
Mr. Glotfelty asked what steps be taken to reduce the
speed. Mr. Fargo stated a letter to Jack Spake. There
were no objections to writing Mr. Spake.
Mr. Fargo reported the District Traffic Engineer will
· count traffic probably late next summer.

Mr. Hayward stated the schOol board is determined t.o
complete Kenai Central High School to accomodate 800

Mr. Hayward showed Council a d.rawing of the proposed
improvements. There will be an additional 20,000 sq. ft.
of flexible space and will modify and upgrade existing area.
A swimming pool, 75 ftc. x 42 ft. (aluminum tank), and shower
room will be .connected by a corridor.
Councilman Hornaday asked how can Council assist
completion of this.

Mr. Hayward stated your input was valuable to give support
at the Assembly and express positive interest and vote on
the bond issue.
Mayor Steinbeck thanked Mr.

Mr. Filler stated he met with various groups who were
interested in various aspects of the Civic Center. Every-
one seemed to be satisfied. The swimming pool group con-
sidered deleting the 3 meter board. Mr. Filler would
suggest as an alternate to delete the bleachers or other
equipment. If the 3 meter board is deleted, it will be
deleted forever.
Mr. Plunkett stated the auditorium wil.1 seat 700 at the
most and 180 at the smallest division. Convention or
dining will hold 400 people, the small theatre will seat
250 along with an exhibit area. There are four meeting
rooms. The library has 4,200 sq. ft. and will hold
20,000 to 25,000 volumes.
The clinic will have 1,400 sq. ft.
Mr-; Filler reported the 110' x 42' pool wi.Il have six
racing lanes, will hold 170 people, 200 lockers, and
accomodate 170 people .on the bleachers. The pool is
flexible and will have a moveable bulkhead to accomodate
diving at one end and swimming competition at the other.
The parking lot will have 300 parking spaces.
Emily DeForrest, Librarian, reported the ir group has
reached an understanding as far as the library is con-
cerned.
Lance Pettersen stated he is pleased with the conceptual
plan, there is so much in a little space. The concept is
modern and up-to-date. The auditorium is totally flexible.
It can be used for a theatre, conventions, boxing matches,
auto shows, etc. The accoustical tile is adjustable. The
expensive curtains we don't need. '~

The Clerk read a telegram from Senator Palmer. He stated
he had talked with Governor Egan about the Kenai Civic
Center requesting one million dollars of .State bond issue
be allotted Kenai.

Lt~. Governor Boucher sent two memos to the City Manager,
one concerning roads in Kenai; one concerning a welfare
worker/marriage counselor for Kenai.

£mmett Egan - Recreation Center
Mr. Egan wrote that since the recreation building is
not being used by the City, he would like to make a
proposal to move it to Aurora Heights Subdivision on
the North Road to be used as a recreational facility
and snack bar.
Mr. Glotfelty stated this was donated to the City for
recreational purposes and before we give it away,
Phillips Petroleum should be contacted.
There were no object:ions for the administration to
look further into this and bring it back to Council.
Chamber of Commerce - Request for $849.50
The Chamber of Commerce requests the City to pay $849.5~
for brochures on the City of Kenai.
There were no objections to writing the Chamber a--letter
commending them for all their efforts but stating the
City has maintained a 7 mill levy and cannot give the
Chamber monetary assistance.
George Ackerson - Golden Key. Cab _Company-
Mr. Ackerson wrote his protest against Ordinance 208-72.
He'feels the cab companies should have a hand in the
writing of this ordinance. The ordinance is under
Agenda Item F-2.
James £. Fisher- Election Code
Mr. Fisher wrote, it is his opinion that a 3 year resi-
dency requirement set forth in the charter of the City
of Kenai, Section 2-1 is constitutional and must be com-
plied with until it is either repealed by charter revision
o.r declared unconstitutional by action of a court.

Th.e~ City Attorney stated the City should keep the case of
C.U.L vs. City of Kenai vs. Chicago Pneumatic Tool Co.,
in surveillance even though the situation has changed be-
cause of the buT-out of C.U.L. by H.£.A.

Commissioner .Campbell wrote that if the bond issue passes
· in November, the allocation to the City of Kenai for
local service roads and trails will be $2~,~.29.

REPORTS
City Manager's Report
Mr. Glotfelty asked Chief Pegram and Chief Wisecarver to
present their reports.
Chief Pegram gave his report for the past month'
6 vehicle accidents - $2,400 damage
81 traffic warnings
57 citations
3 arrests - possesSion of drugs - one cocaine.
1 arrest - issuing checks, without funds
Since Friday, there has been 23 citations, 8-10 for speed,
on the new urban section. The accident rate is not too
high, hopefully held down by the citations. There were 2
burglaries. The police are doing security check.s at night.
Chief Pegram was asked his opinion on the speed limit on
the urban section. He replied he has no statistics available
right now. Ail his accident reports are in the office as
to where accidents occured.

The Police Department is running routine mobile patrol
through Wildwood.
Chief Wisecarver reported there were 1S rescue and 5 fire
calls with minimal damage during the last month.
The Fire Department occupied Wildwood August 28. The
department increased their manpower by .six. A lot of time
has been spent in training and have been doubling up on
shifts. Wildwood has been tied in with the alarm system.
We have an inspection in progress at Wildwood-building and
hydrant flow. Part II of' the State School in Petro-Chemical
training will take place September 11-12 and will continue
the 13, 14, and 15th.at Anchorage International Airport.
There is a fire prevention program going on at Wildwood.
There will be a change over of finance from the Volunteer
Fire Department to the Finance Department. Fire prevent ion
week will be the second week in October. September 23rd
there will be a Firemen and Policemens Bal.1.

Councilman Bielefeld asked how many volunteer firemen
there are. Chief Wisecarver reported there are nine
active volunteers.
Councilman ,Malone asked for a brief outline on the
training program for aircraft crashes.
Chief Wisecarver reported they have simulated crashes,
involving the Fire Department, City and State Police,
dispatchers, and the Flight Service Station for alerts
No. 1 and 2.
Councilman Malone asked whether Chief Pegram investigated
the volunteer program for policemen. He ~reported that
hopefully with the profits from the Firemen and Policemen's
ball, we will be able to finance a volunteer reserve' police
department.
Councilman Norene asked Chief Wisecarver the justification
east of Kenai for a water system and a-sub-station.
Chief Wisecarver stated there will be a 2

13, 1972 at 8'00 P.M.
Bielefeld asked the City Manager the status of city
· employees living outside the City. Mr. Glotfelty reported
he has extended 2 on an individual basis.

Mayor's Report
Mayor Steinbeck reported he and his wife attended a dinner
in Anchorage given by So'uthern California Oil Company. Forty-
three people were given a tour of Canada, North Slope and
Kenai. There were people from advertising, public relations,
Councilmen from Los Angeles, Legal Counsel and to.p personnel.
The Plant Manager of Pacific Light and Gas was introduc'ed.
The gas plant will be in oper.ation by 1976. If they are
able to get more reserves, it will be in operation before
then. A smaller group will be back in October for 4-5 days.

Boroug. h Assemblymen's Report
Assemblyman Norene reported on the assembly meeting of
September 5, 1972.
The Assembly passed an ordinance for a Supplemental
Appropriation for General Operation and School 0perktions
in the amount of $27,000.

An Ordinance for a Supplemental Appropriation for
School Operations in the amount of $14,700 was intro-
duced.
The Assembly set priorities on the Local Service Roads
and Trails Program.
The Kenai Booster Club requested the Assembly to put up
a fence around the football field in the amount of$7,984.
The next meeting will be in Seldovia, Saturday, September
30, 1972 at 10'00 a.m. They will hold a Public Hearing on
the Planning & Zoning Ordinanee and will have the dedication
of the new school.

Street Signs - $10,000 appropriation -memo - City Manager
Mr. Glot£elty reported he.attended the Planning & Zoning
meeting. They feel it is important to get started on the
street sign project. The cost would be somewhere in the
neighborh.oo.d of $10,000.
After some discussion, the Administration was directed to
write a letter to the Planning and Zoning Commission that
the Council will bring this up at the next budget session.
Taxi Cab Ordinance - 208-72

Doyle moved and Norene seconded t.o introduce Ordinance
208-72 - Taxi Cab Ordinance. The motion carried unanimously
by roll call vote.
There were no objections to holding a work session with
the Cab Companies before the next Council meeting.
Airport Lands
, ,
Mr. Glotfelty reported with the re-alignment of the new
road, the land coming back to the City is in the Airport
package and is unavailable for sale. The City has asked
for a release for 2 pieces of land. One in front of Alaska
State Bank and one in the addition to Gusty Subdivision.
The Administration is still working on the situation.

stantial offer from Alaska State Bank on City Lands in
front of the bank. We wi. il have to wait until F.A.A.

Kenaitze Native Association
September 1, 1972
The Kenaitze Native Association are trying to get the
40 units of the 236 Program off the ground. The admin-
istration &s assisting them in getting funding. The
City of Kenai agrees to an easement on the Kenaitze Sub-
division for the' length of time that the Federal Housing
Administration guarantees the loan to the Kenaitze Indians.
At such time as the commitment is paid, it will be deeded
to the City. Everything will conform to the code.
The Administration recommends adoption of Resolution 72-28 -
Kenaitze Native Subdivision.
Malone moved and Doyle seconded to accept the Administrations
recommendation and adopt Resolution 72-28 - Kenaitze Native
Subdivisi.on. The motion carried unanimously by roll call
vote.

Bielefeld moved and .Norene seconded to accept the-recommenda-
tion of the Kenai Planning & Zoning Commission and approve the
Water Line Project WSF-AK-10-19-1017. The motion carried
unanimously by roll. call vote.

The administration received 2 bids to put cement floors
and roofs on 4 buildings at the Fort Kenay complex. One

Norene moved and Bielefeld seconded to introduce Ordinance
207-72'
AN ORDINANCE OF THE CITY OF KENA1, ALASKA, PROVIDING FOR
THE ISSUANCE AND SALE OF $1,000,000 OF GENERAL PURPOSE,
GENERAL OBLIGATION BONDS OF THE CITY OF KENAI FOR THE
PURPOSE OF PROVIDING FUNDS TO DESIGN, PLAN, ACQUIRE, CON-
STRUCT, INSTALL AND EQUIP A CIVIC. CENTER COMPLEX, ADDITIONS
AND IMPROVEMENTS TO WATER SYSTE.:X~, ADDITIONS AND IMPROVEMENTS
TO MUNICIPAL AIRPORT, A NEW SMALL BOAT HARBOR AND IMPROVEMENTS

Child Development Center
There are monies available from the State to initiate a
Child Development Center on a 75-25% match for pre-school
retarded children. Dr. Dipple, Dr. Hansen and a young lady
are willing to work with the kids.
The City Manager needs the authority to proceed and a
$15,000 commitment from Council.
Bielefeld felt this was beyond the scope of City business.
It should be handled by the Borough or State.

Hornaday moved and Doy~l.e seconded to direct the Administration
to pursue the Child Development Center for retarded pre-
school children in this area. The motion carried ~ith
Bielefeld. dissenting.
Bid - Kaknu [orners
Davidson-Cone Subdivision
Bruce Massey reported the Administration received two
bids on Kaknu Korners - Davidson-Cone Subdivision. Although
the engineers estimate and low bids are not far separated,
the contractors original estimate of what the job would cost
was considerably lower. In considering the two bids, the
assessments would be in excess of 31-33~ per sq. ft.

VOting no; McGrady, Bielefeld, Hornaday and Steinbeck.
Bielefeld moved and McGrady seconded to pay Anchorage. Asphalt
& Paving final payment less Change Order #1 ($7,983.68). The
motion carried by roll call vote with Malone dissenting.
Mommsen/Wildwood Water Line Connection
The City Manager would like the authority to expend up to
$12,000.00 for a water line to connect Mommsen S/D to Wildwood.
George Miller stated this will be discussed at the next board
meeting and the results should be favorable.
Malone moved and Doyle seconded to authorize the Administration
to spend money, not to exceed $12,000.00 from Capital Improve-
ment Funds on the Mommsen/Wildwood Water Line.

the University is going to suggest $500,000 for our vocational
building for the Kenai Peninsula Community COllege. Although
the master plan for the college on the Peninsula indicates
the the vocational building~ is to be located close to the
academic structure, you might want to discuss the possibility
of having the vocational building built in Kenai as it would be
close to the vocational building at the high school, and the
Wildwood program, the sewage treatment training center, etc.

The enclosed brochure has become an official" Kenai Ambassador"
and proved very popular with all visitors enjoying our city'.
The chamber of commerce purchased 15,000 of these a year ago
at a cost of $ 2101.00 with the aid of a bank loan which still has a
balance due. The brochure supply has dwindled until now it has become
necessary to reorder.
The members of the city council certainly realize the exposure of
these brochures, and are also aware of the limited financial facilities of
the Kenai Chamber. Therefore you will understand why it is necessary
to ask for assistance from the city in financing the second printing of
10,000 at a cost of $ 849.50. ~

taxi cab companies in. Kenai, especially Golden Key, should and
must have a hand in the writing of this ordinance.- Due to the

A 5-year residency requirement for the Kenai Council
is set forth in the Charter of the City of Kenai, Section 2-1,
in the second paragraph which reads in pertinent part- '
Only qualified voters of the city who, at the
time of their election or choice to fill a vacancy
are at least twenty-one years old, and have
resided within the city for three years, one

The question has arisen if the portion of the Charter,

the recent court decisions regarding residency for voting-.

COURT DECISIONS WITH RESPECT TO RESIDENCY REQUIREMENTS'
Residency requirements for office holding, such as mayor
council have apparently been relatively uniformly upheld. Such
office holding required compliance with rh~ governing law -- in
this case it would be the Charter of the City of Kenai
Note in the quoted portions of the law that even the new Municipal
Code anticipates ~ requirement for residency of the mayor which
appears to excees that of just being a qualified voter The gen-
eral law on matters of residency as it has been decide~ i'n other

Tool Co. .He.i.~ ..... a brand new attorney and I keep pointing out to
him that money is now available so a settlement would be possible.
The persons whose,depositions were taken were Odin Strandberg,
in his capacity as'Manager of Consolidated Utilit'ie~'S, Ltd. from
1962 to June 1970; and Jerry Blevins,. Manager from 1970 until the
present tine (I ~vas unaware of the fact that he had worked for
CUL starting in 1968, until this deposition).
This lawsuit is one of those which was excluded from"the agreement
of transfer to HEA because it occurred prior to the ls't day of
September, 1971. It is a continuing matter which is primarily
a. claim_by'CUL' that-the Chicago Pnuematic engines were defective
and were never made to operate correctly.~ The City is included
because the City was restrained from paying an assignment by CUL
to Chicago Pnuematic.
The City should only stay in this case to keep it under surveillance.
There was a.time when it was important that we stay in the c~se in
order'to prove that the Chicago Pnuematic generating machines
were defective and thereby prove the inadequacy of CUL's performance.
Such is not exactly the situation now because of the buy-out of
CUL by ILEA.

SB 280 am H which became effective June 3, 1972 made provisions for
issuance of general obligation bonds in the amount of $4,000,000 for
funding of local service roads-and trails, subject to approval by
the voters in the general election in November. Also, these bonds
must then be sold at a satisfactory interest rate.
.Although it is .not definite this money will be made available, you
should still initiate action for utilizing your anticipated allocation.
It. is proposed that $3,500,000 will be allocated initially to local
governments and unorganized boroughs, the remainder being reserved
for contingencies and possible overruns.
AccOrding to the allocation formula, the anticipated allocatiOn

OF THE CODE PROVIDING FOR REGULATION OF TAXI DRIVERS, OPERATORS, AND
LICENSING,~ AND DECLARING AN EblERGENCY.
WHEREAS, recent efforts to utilize those provisions of Kenai Code, 1963, as
initially established in 1961 have proved difficult and revision thereof
appears to be in the public interest, it is
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA;
Section 1. The Code of the City of Kenai, 1963, as amended, is hereby

_License required to operate taxicab company.
Section 20-2. To operate a taxicab within the city limits
an operator shall obtain a taxicab license therefor first,

form provided by the City, and comply with the following'
(1) bet a citizen of the Ilnited States.
(2) be of the age of nineteen (_19) years or a duly
qualified corporation.
(3) File a statement describing each vehicle to be so
licensed, giving-
a. Full name and address of the owner.
b. The class and passenger-carrying capacity' of
each vehicle for which a license is desired.
c. The length of time the vehicle has been in use.
d. The make of car.
e. The engine number.
f. The serial number.
g. The state license number.
h. Whether the same is mortgaged, the name of the'
mortgagee and the amount of said mortgage,
i. Whether said vehicle is leased, licensed, or
under any form of contract.
j. What person, .firm or corporation collects the
revenues from the operation of said taxicab and pays
the expenses of operating the same. (Ord. 12, Sec. 2,
7-18-1961).

commercially until that person obtains a chauffer's license
from the City of Kenai upon meeting the following requirements'
(1) Ability to read and write the' English language'.
{2) Non-addiction to the use of intoxicants or narcotics.
(3) Good moral character and repute.
[4) No conviction of a felony for ten years previous to
application.; no conviction at any time of a felony or
misdemeanor involving moral turpitude or assault with
a deadly weapon or use .of or ~traffi-c in narcotic drugs
traffic in women for immoral purposes.
('S) Possess a current motor vehicle operator's license
for A1 aska.
{6) Demonstrate familiarity with the traffic laws of the
City of Kenai and the State of Alaska~
(7) The driver shall be over nineteen (~19) ¥.ears of age.

(b) With application shall be submitted the necessary fees,
photograph of applicant, and a full set of fingerprints to be taken
by' the Police Department. This sub-.section shall also apply to
officers, agents, servants, and employees of corporations, companies,
and partnerships. '
(c) If the application for a chauffer's license indicates
that the applicant meets the qualifications for a license, the Chief
of Police may issue a temporary license pending completion of the in-.
vestigation of the applicant's background and qualifications. This
temporary license shall expire at the end of forty-five (45) days
from the date of issuance. If the applicant meets all of the re~
quirements, the Chief of Police shall issue a permanent chauffer's
license renewable annually on or before July 1 of~ each year.
~d) If the applicant does not meet the requirements, the
Chief of Police may deny the issuance of either a temporary or a
permanent chauffer's license. When the Chief of Police refuses to
issue either a temporary or pernanent chauffer's license, such
denial shall be in writing, stating the reasons for such decision,
The applicant may appeal this decision to the City Council within
ten (10) days after the receipt of the written notice from the Chief
of Police, in the event that such an appeal of the denial of a
license is desired by the applicant. ~Ord. 12, Sec. 3~ 7-18~.61~

Examination of taxicabs.
Section 20.4. At least once each year, and more often if
deemed necess'ary, the Chief of Police or'a garage or repair business
designated by the Chief of Police shall carefully examine each taxi-
cab. No taxicab shall be licensed which does not comply with the
fo 1 l~owi, n g:
(a) It must be in a thoroughly safe condition,
(b) It must be clean and of good appearance.
(c) Such other examinations as may be ordered by the
Chief of Police from time to time.
Granti.n.g and .transferring. l'icense,
Section 20-5. Upon ~atisf¥ing the. City Council that the
public convenience and good order will be served thereby, the City
Council may grant an operator's license. A taxicab operator's
license may only be transferred-after approval by the City Council
is granted. [Ord. 12, Sec. 5, 7-18-1961).
License plates and numbers.
Section 20-6. Each licensed 9ehicle sh. all bear the license
number of the taxicab and proper descriptive words, including the
year for which the license was issued and be .displayed on the
taxicab 's. windshield'
Every taxicab accepting business on tt~e st.reets within this
municipality shall have some designation of the character of the
vehicle painted in plain visible letters on each side thereof,
and shall have an illuminated sign with tke word '.'taxi': or "cab't
or "taxicab" affixed thereto.

Taxicab cards and rates.
Section 20-7. (a) The operator of any taxicab shall display
inside the taxicab a card legible to a customer seated in the rear-
most seat stating the l"cense numbers, the maximum rates of fare,
and a notice that any article left in the taxicab must be returned
to the City offices, where it may be identified and claimed.
(Ord. 12, Sec. 7, 7-18-1961).
(b) Rates charged for conveyance in taxicabs shall be fixed
by resolution of the City Council ~from time to time. No passenger
shall be charged a rate in excess of the fixed rate. (Ord. 12,
Sec. 7, 7-18-1961).
Taxicab Stands.
Section 20-8. Taxicabs shall be parked, at stands so desig-
na.ted for that purpose from time.to time by motion or resolution of
the City Council. No taxicab driver shall solicit passengers as
fares. No driver shall dismount from his taxicab at any time for
the purpose of soliciting passengers; provided that this shall not
prohibit any driver to assist a passenger entering or dismounting
from a taxicab. Only licensed taxicabs shall be permitted to park
at any taxicab stand. (Ord. 12, Sec. 9, 7-18-1961).
Public liability insurance.
Section 20-9. An operator shall file with the City Clerk
evidence of insurance certifying the operator insured for liability
for damages on account of bodily injurie.s or death, or for damages
to property resulting from the ownership, maintenance, or use of
any taxicabs. The limit of such insurance policy shall not be
less than $50,000 for bodily injury to, or death of, one person
and $100,000 on account of any one accident, resulting in injuries to
'and/or death of more than one person, and $20,0'00 liability for
damage to property of others, arising out of any'one accident.
Such policy shall be endorsed to give the Ci.ty 30 days notice of
expiration or cancellation. (Ord. 12, Sec. 11, 7-18-1961).
Miscellaneous
Section. 20-10. (a) All taxicab drivers shall .be clean.
and courteous at all times~
(b) No driver of any licensed taxicab shall carry any
other than the passenger first employing a taxicab without the
consent of such passenger, except for bona fide emergencies.
(Ord. 12, Sec. 12, 7-18-1961).
Penalty.
Section 20.11. Any person violating any provision of this
article shall be guilty of a misdemeanor, and shall upon conviction'
thereof, be punished by a fine of not more than one hundred ($100.00)
dollars.
Number of taxicabs in operation.
Sectio'n 20-12. After public hearing and notice to all
taxicab business licensees, the City Council shall determine from
time to time the maximum number of taxicabs required. The standards
of determination are: (1) the demands for such service as shown
by records of taxicab business licensees; (2) whether the safe use
of streets for vehicular and pedestrian traffic will be impaired;
and (3) any other fact which the City Council may deem relevant.
(Ord. 12, Sec. 15, 7-18-1961).
Taxicab license fees.
Section 20-13. The applicant for a taxicab operator's
license, taxicab license for an additional vehicle, or a chauffer's
license shall pay into the City treasury the sum set forth below
provided that, if the said license is denied for any reason, 50% of
said fee or fees shall be returned to the applicant:
(1) A taxicab operator shall pay a license fee of $50
per year which shall entitle said operator to one
vehicle for hire.
(2) In the event a taxicab operator is licensed for
more than one veh-icle, then he shall pay $20 per
year for each additional vehicle so a~thorized.
(3) An applicant for a chauffer's license shall pay
the sum of $5 per year for each and every license
so iss'ued.
(4) Ail licenses shall be for the term from 30 June of
one year until 1 July of the following year, and
are subject to review prior to renewal. (Ord. 12,
Sec. 18, 7-18-1961). ..
Taxicab rates to be comp. u. ted.
Section 20-14. (a) If an operator elects to meter all
taxi calls, then all vehicles of that operator must be metered.
The taxi meters shall be the type or types commonly used through-
out the United States. Inspection of such fares shall be monitored
and proved by the Chief of Police.
(b) If a meter is not utilized, then a "zone system" of
charges shall be followed. 'Such zones shall be established by the
Council by resolution.
Section 2. The Code of the City of Kenai shall be amended to repeal
Section 20-10 and 20-15, as they exist upon enactment of this ordinance.
Section 3. An emergency is hereby declared to exi'st and the rules govern-
'lng introduction, reading, passage and approval of ordinances are thereby
suspended and this ordinance shall be effective immediately upon passage.

an-8 inch dead end thrust block, a short pipe, an 8 inch valve-assembly, about
391 feet o~ 8 inch pipe, a 45°. elbow, a 45°x8'' thrust block, about 97 feet of
8 inch pipe, a 45° elbow, a 45°x8'' thrust block, about 60 feet of 8 inch pipe,
an 8 inch valve, a'nd a short length of pipe.
9. Verify the location of gas mains and se'rvices, a 2 or 3" PVC (reported)
chemical sewer, a 4" gas main, a 10" asbestos-cement sanitary sewer, street
drains and other buried and overhead utilities. Mark these before digging,
and excavate by hand to find same. .
10. Encase the chemical sewer i-n welded-wire-.fabric-reinforced concrete to
10 feet out horizo.ntally from the new water main.
.11. Encase the 10" sanitary sewer in welded-wire-fabric-reinforced concrete
to 10 feet out horizontally from the new water main. ,

Sec. 29.28.250. ELECTION OF SUCCESSOR. If the voters recall an
officer, the clerk shall conduct an election for a~successor to ~.fill the
unexpired term. The election shall be held at least l0 but not more
than 45 days from the date of the recall election. However, if a
regular or special election occurs within 75 days of the recall election,
the successor to the recalled official shall be chosen at that regular
or special election. The procedures and requirements for the regular
election for the office from which the incumbent is recalled apply to
the election conducted under this section
CHAPTER 33. AREAWIDE BOROUGH POWERS AND DUTIES.
ARTICLE 1. SCOPE.
Sec. 29.33.010. SCOPE OF ARE~WIDE POWERS. (a) Boroughs shall
exercise the powers as specified and in the manner specified in this
chapter on an areawide basis, both inside and outside cities within thei
boundaries.

and. collect property, sales, and use taxes levied within their bound-
aries, subject to ch. 5B of this title. Taxes levied by a city and col-
lected by a borough are returned in full to the levying city.
ARTICLE B. EDUCATION.
Sec. 29.BB.050. EDUCATION. Each borough constitutes a borough
school district and establishes, maintains, and operates a system of
public schools on an areawide basis as provided in AS l~.l~.060.

isdiction is not impaired;
(3) withdraw powers delegated under this subsection.
Sec. 29.33. 080. PLANNING COMMISSION. (a) The borough ~plannlng
commission consists of five residents unIess a greater number, is
otherwise provided by ordinance. Commission membership shall be
apPortioned so that the number of members from first class cities
reflects the proportion of borough population residing within
those cities. Members shall be appointed by the borough executive
for' a term of thr'ee years subject to eonflrmatlon by the assembly,
except that appointments of members, from first class cities are
selected from a list of r'ecommendatlons submitted by the city
council. Members first appointed shall draw lots for one-, two-
and th.r'ee-year terms. ApPointments to fill vacancies, are for. the
unexpired term. The compensation, and expenses of the planning

commission and its staff are paid as directed by the assembly.
(b) The commission shall prepare and recommend to the assembly
(.1) a comprehensive plan consisting of maps and related
texts for the systematic development of the borough;
(2) a zoning ordinance to implement the plan;
(3) a subdlvlslon ordinance;
(4) the official map of the borough;

Low bidder is K-Rite Construction at $83,573.60.
.Although the engineers estimate and the low bi.ds are not far
separated, the contractors original estimate of what the job
would cost was considerably lower; and, in analyzing the bids,
I would point out that the per linear foot cost of the Davidson-
Cone Subdivision amount to $20.20 per linea.r foot for water and
$17.61 per linear foot for sewer. The latter includes 590 feet
of 4" service connections.

The breakdown for Kaknu Korners Subdivision is $15.95 per
linear foot for water and $15.53 per linear foot for sewer.
Considering the above bids,~in light of the high cost of
assessments, they would impose in excess of $.31 to $.33 per
square foot. I would recommend rejection of all bids.
As an alternative, I would suggest force account of both
projects if the work is to commence this year or, hold the
projects in obeyance until state or federal assistance becomes
available.
In the case of "force account," the City would need to pur'chase
a large backhoe and minor dewatering equipment, the original
cost of which could exceed $120,000; however, the cost could
very easily be recovered in a very short period of time if
future bids continue to come in as high as our latest projects.
In addition, the lines could be installed this year at costs
which the property owner could foreseeably afford.

On August 25, 1972, a Final Inspection was made of "Kenai MuniCipal
