Mr. Fargo reported the paving should be finished sometime
next week. Paving should be to Forest Drive tomorro~
night. By' Friday night all the detours Will be over.
Mr. Glotfelty asked Mr.. Fargo about paving the access
into businesses that haven't been paved yet. They didn't
pave anticipating the construction of the Urban Section.
Mr. Fargo answered, if an approach was paved, prior to the
project, it Will be re-paved, with the exception of Broad,
Bluff and Willow Streets.
Mai one in now.
Mr. Glotfelty said that these businesses have developed
since the inception of the project. They knew the Urban
Section would come along.. If you pave for one you should
pave for all.
Mr. Fargo stated he has no power to do this.
but has to stand by the policy.

Mr.
Glotfelty asked him if the paving could be done at cost.
Fargo stated he didn't know but would look into it.
Mr. Glotfelty .reported he 'had a meeting with Mr. Fargo and
the contractor Monday morning. The contractor will pay for
time and equipment the City used to maintain the detours this
last week end.

Ken Rice - Kenai Peninsula Racing Assoc.

Mr Rice gave the Activity Report from the Peninsuls Racino
Assoc. They had eight cars at the track Friday night.
They were rained out Sunday. The enthusiasm is great.
The association is going to get together with Fairbanks,
Anchorage, Whitehorse and Palmer and co-ordinate th.e rule.s
so they can race on each oth'ers track.
Mid Knight reported he talked with Mr. Kulawik of Peter
Kiewit and Co. They have-in excess of 1,000 yards of
reject material that can be put on the track. We have
donated, trucks, loaders and operators to put this on the
track. He also reported, because of prevailing winds,
they will have grandstands on the other side of the track.

Mr. Thomas is before the Council on behalf of K.U.S.C.O.
According to Section 13 of Ordinance 115, the corporation
is required to obtain consent of the City to transfer the
controlling interest in the shares of stock.'

Mr. Glotfelty'recommends approval of the concept. A
Resolution has been prepared under Agenda Item G - 4 and'
with consent of Council this will be heard at this time.
There were no objections.
Bielefeld moved and Norene seconded to adopt Resolution
72-.26 approving the transfer of controlling interest in
Kenai Utility Service Corporation. The motion carried
unanimously by roll call vote.
Mr' Thomas was asked 3 questions concerning the gas pipe
line under the proposed Gusty S/D.
Could construction take place over the pipe line?
If not, what is the cost of relocation?
What written easement do you have._.t this time?

approved as corrected. The last paragraph of page eleven
amended to read "Councilman Hornaday suggested a Mayor's

The Administration has received one bid and expect 2
more on the four foundations and four roofs at Fort Kenay.
Agenda Item G - 14 will be deferred until the next meeting.

Library and Convention Center
Mr. Glotfelty reported the architect will1 be in attendance
at the next Council meeting. Councilman Hornaday stated
Senator Palmer has offered to hand carry the plans to the
Governor. He feels we should take him up on this. The
City Manager stated the plans should be ready next month.
(f)
Industrial Water Line
Bru~e Massey reported by phone he was very successful in
his trip to Juneau concerning the water line. One half
of the total line from Kenai to North Kenai will be funded
if the bond issue passes in November. They approved award
before the first of the governmental fiscal year for our
loop system with Mommsen S/D, Bush Lanes S/D and Wildwood.

Mayor Steinbeck was pleased with the Kenai Historical
Society's 'report for July. He is particularly pleased
with the City seeking bids to clean up the. log cabin
situation. He urges the Council to support the "We-Care"
program to promote the museum. The figure of 1427 visitors
in July is surprising.

Report
Mr. Whelan reported he has just received the appraisal for
City property. He gave one to each Councilman.
Mr. Whel.an gave Council copies of the Financial Statement..
He apologized fOr it being hand written. He pointed out
no ~taxes are shown yet and no shared revenue. There are
adjustments to be made to enter interdepartmental charges.
It will be refined by the second Council meeting in
September. If the Council have any questions, feel free
to contact him at any time.

Mr. Glotfelty stated the Council will be receiving the
Financial Statement the second meeting of each month and
felt the Council should reserve a half hour of the meetino
to go. over this.
Mr. Whelan stated the Ledgers and Journals are set up and
current. Each statement will be easier to prepare.
Mr. Glotfelty reported we will have at least the preliminary
audit for the next meeting.
Planning & Zoning's Report.
A1 Hudson reported on the Kenai Planning & Zoning's
meeting of August 9, 1972.
The Commission approved a development plan for the 'First
Addition £tolin S/D.
The Commission discussed Mobile Homes. They also discussed
the trading of City lands to enhance the continuity of the
park. They did arrive that it should be traded if some
agreement could be worked out.
Bo rough Assemblym. en' s Repo_r_t-
Assemblyman Norene reported on the Assembly meeting of
August 15, 1972.
The Assembly was again faced with the Planning & Zoning
Ordinance. A motion to table until 7/1/73 failed, for lack.
of a majority. They will continue with hearings within
the Borough.
The Assembly introduced an Ordinance -, Supplemental
Appropriation Capital Improvement fund for $105,0'00
repair of roof on the Homer School.

Councilman Hornaday expressed extreme concern on tBe
addition to Kenai Central High School and suggested we
invite the President of the Assembly and President of the
School Board to a Council Meeting. There were no
objections and was so ordered.
The Council discussed the Planning, Platting & Zoning
within first class cities as outlined in the new
Municipal Code. This will be put on the next Agenda
for review..
The Mayor de. clared a 10 minute recess.

It was the general consensus of the Council to-see the
proposed agreement before coming to any decision.

Trade City lands for recreation lots
The City has received a request to trade lands located
a~'djace~nt t~o the Ci'ty park 'for lands in the highway 'right-
of-way about to be released to the City. Planning & Zoning
recommend some form of trade be made for the park land.
The City Attorney feels this is in Airport-Land and thereby.
restricted in use by F.A.A. Deed.
The City Manager does not feel this is part of the airport
package. The appraisal of this land is $108,000. The
appraisal cost approximately $1,200. He furt'her stated
the Administration has no objections to a land trade on an
equal value basis. There needs to be a couple items se'ttled
first; the City Attorney's opinion and an appraisal of Mr.
Cruver's land.
After much discussion, Norene moved and Malone seconded to
negotiate for trade of equal value of Mr. Cruver's five
acre site for a portion of land in thee proposed Gusty S/D
Addition provided we can overcome any legal problems with
F.A.A.
After much discussion, Malone moved and Hornaday seconded
that because of not enough information-to table this until
the next meeting and direct the Administration to prepare
a course of action and ob.tain additional information. The
motion carried unanimously.

Mr.. Glotfelty reported the big hand up on acquiring right-
of-way for WSF 10-19-1017 is GLO Lot 50, Section. 34, T6N,
RllW, SB~{. The Administration recommends buying this land
from Mr. Vincent Root to obtain the right-of-way. This
could be subdivided and sold at a later date.
Norene moved and Hornaday seconded we phrchase GLO Lot 50,
Section 34, T6N, RllW, SBM from Mr. Vincent Root for $4,500.00
for Davidson Drive Water, Sewer and Street Improvements. The
motion carried by roll call vote with Malone and McGrady
dissenting.

Mr.'"'Jaynes reported the Administration received one bonus
bid for L3, Bi, First Addition Etolin S/D from Mr. 'Steinbeck.
He submitted and the Planning & Zoning Commission approved
his development plan~ The Administration recommends approval
of this lease.
Hornaday moved and Bielefeld seconded to accept 'the Admin-
istrations's recommendation and lease L3, BI, First Addition
Etolin S/D to Mr. Steinbeck. The motion,carried with
Steinbeck abstaining.

In regard to your phone call concerning the Kenai River Crossing, we are
proceeding as rapidly as possible with final design and right-of-way
appraisals and acquisition. However, since federal regulations did
not permit these phases to begin until after approval of the final
environmental statement, we have been delayed to the point that it
is not possible to get any on-the-ground construction done before
winter.
In addition, as you may know, we are allowed to obligate only 70% of
federal funds apportioned to us during this fiscal year. Consequently,
we are forced to severely modify timing of our projects throughout the
State.
We are trying to hold as many critical projects on schedule as possible,
although some will have to be delayed. However, we do plan to adver-
tise the Kenai River Crossing as soon as final plans and right-of-way
are completed and approved. Unless unforeseen problems develop we
expect that it wil,1 be under contract in time for a spring construction
start. '

projects to improve airport safety throughout the
State.

Another major project of the Society is the repair and new cement block
foundation of the Russism Shrine. ~ork is progressing under the volunteer
direction of Roger Meeks,Society President and Emil Carlson assisted by

the report will be based is being sent to our data

erty. In addition, there is a Sununary for each Depart-
ment showing the costs by Account. .
It should be noted 'that .the coSts shown do not necessarily
reflect your actual acquisition costs of the assets~ ex-
cept for items that were recently acquired or erected.
The original costs shown for older items of buildings,
machinery and equipment, etc., are based on the current
cost of replacement new, less depreciation. The costs
shown for 1.and represent our estimate of the current mar-
ket value. '

neighborhood is considered to be that area lying within

the boundaries of the Cmuy of Xenai and influenced by
the Kenai Spur Highway. Kenai proper lies on the west
coast of the northwesterly Kenai Peninsula lowlands' The
neighborhood is primarily flat with some gently sloping
land and has good drainage characteristics which provide
natural b~aring for construction and development. Natural
drainage is also provided by small rivulets running from
the northerly to the southerly through ~he central portion
of Kenai. .City services include-fire and poli c~ protection
as well as ~l~ctricity~ public water, sewer and natural gas.
Telophone facilities are operated by a private corPoration.
The dovrnto~:~ area is comprised of a modern enclosed mall-
type shopping center, an elementary s.chool with a high school
nearby~ several modern office complexes~ plus adequate
medical and dental facilities. In addition, there are two
full servic~ banks~ two theabers~ a now centennial museum,
plus the nOrmal robail and service outt~ts found in most
modern communities. Within the area ther~ are approximately
250 acres of land zoned for either .lm,~.ho or heavy industrial
use. Of the go%al amount of land available, approximately.
75 acres are presently being utilized while the remaining .,
175 acres are vacant. Prices paid for the use of these lots

Park is the center of development and located just north.
of the main Kenai business dist~ict adjacent to the
municipal airport. In addition~ the City has a modern
municipal airport with a 7,200-foot paved runway. An
expansion 'of this facility is presently underway. Two
scheduled airlines provid~ daily service from Kenai to
all major points both north and south. Several charter
services are also available for business or recreation

gnus Th~ 1968 population of the City of Kenai was
estimated at ~$00 with an additional 2,S00 people located
in the comm~unity service area- This represents a more
than $00 percent increase since 1960. Projections made
· by ~the Alas, ks ~Depar~tmant of Economic Development in the
City of l£enai predict 7,800 people by 19~$. At .the present
time housing demands within tho City appear to be satisfied.
In recent years numerous apartment complexes have been
const~ucoed to meet increased rental demands. Discussions
with the Kenai Peninsula Borough Assessor and his staff,
local buildors~ bankers~ real estate brokers, and other
local businessmen, plus this appraiser's o~ observations
in the area~ indicates that tho City experienced an
economic boom as the result of nearby oil activities in the
1960~s. During this inflationary trend, real estate
activity increased during a period of rising prices, even-
tually reaching a peak between late 1967 and early 1969.
Subsequently, real estate activity has decreased drastically.
~However~ today the trend appears optimistic for the future.
Property ov~ers seem to be hanging' on to these peak prices
and refusing to sell for less, hoping that a more planned
grey, th will eventually overtake and stabilize the local
economy at this contemporary plateau.
DESCRIPTION OF THE SUBJECT SITE: The Subject Property is
irregular in shape and encompass'es 4.127_+ acres. The
tract has a-total of 380+_ feet adjacent to the Kenai Spur
Roadway. The property is near level with a gentle slope
cross-falling in a northerly and easterly direction. The
majority o{'the tract has been cleared and .graded, with
only the southwesterly quarter of the property remaining
wooded, primarily with spruce trees. The property is at
grade with all adjoining roadways. According to a State
of Alaska Department of Highways' soils report, borings
adjacent to the Sub~oct Tract indicate'an average of 2.9 feet
of bro~-silt overlaying green-brown' sand.
ACCESS- Kenai Spur Highway along the northerly and easterly
property boundaries. The. roadway is presently being upgraded.
Paving, while, not completed at the date of 'this appraisal, is
scheduled for completion this summor. Curbs, gutters, side-
walks and streetlights are present.
UTILITIES: All are i~mcdiately available. Sewer and water.
are located adjacent to the Subject and within the i'4ain
Street and the Overland Street rights of way. However~
natural gas crosses through the center of the property in
a Curving east-w~st direction (see Plot Plan herein). Th~
lin~ is 30+ inches deep and prohibits construction over it.
However~ one area can be paved and used for parking. Per
instructions~ this' appraisal is being made exclusiv~ of
present or future assess:uents.
RESTRICTIONS: Per instructions~, the Subject is being appraised
irrespective of any sales limitations which may be imposed
by the ?.A.Ao. Eowever~ it should be noted that the portion
referred to on the Plot Plan as Tract G-2 (F.A.A. designation)
has b~een released for sal~e~ while th~ easterly portion
designated as a "clear zone'~ has not.
According to the F.A.A.~ Airports Division~ the maximum
building height allowed within the most restrmctive portion
"is $0+ feet. In no
of the pr.operty~ the "clear zone~ _
case can any improvement ~xtend upward beyond 242~ fe~t
above mean sea l~vel.
No development will be allowed that is not compatible with
airport uses.
ZONING: Central con~mercial
HIGHEST AND BEST USE: ..... Commercial development as permitted
by zoning.

City of Kenai is 13.0. -However, the Subject Parcel is
considered exempt from taxation.
PROPERTY VALUATION: The Market Data or Direct Comparison Approach
was utilized in estimating the Fair Market Value of the
property u~der appraisal. In this case, the problem of
estimating market value was increased due to the lack of
recent pertinent sales information in the Subject area.
However, investigation of the market did reveal, several
sales during the past 8~ years. These wer~ subsequently
inves.tigated and analyzed. Particular notice was given to
the date of sale., location, quality of access, physical
characteristics, availability o~' utilities, and the back-
ground of the sale, including tho buyer's and Seller's
motives. The following sales are considered the most
pertinent indicators of land value to the Subject:

Re: Alert on Problems with using lands r.eleased by the
Highway Department
SITUATION- It is understood that practically all of the land
being "deeded" by the Alaska Department of Highways to the City
along the new right-of-way are located on, or within the
boundaries of, land which was initially deeded- by the United
States of America to the City of Kenai in the deed of the
1st day of December 1963. That being the situation the City
should be very careful about any new use of those lands because
of the following reservation in that deed which states in perti-
nent part as follows:
"That no 'prope'rty trans'ferre'd by-'this-instrument shall be us'ed,
leased, sold, salvaged, or disposed of by the Grantee for other
than airport purposes without the written consent of the
Administrator of the Federal Aviation Agency, which shall
be granted only if said Administrator determines that the
property can .be used, leased, sold, salvaged or disposed
of for other than airport purposes without, materially and
adversely affecting the development, improvement, operation
or maintenance of the airport at which such property is
located."
OPINION: This is a rather t_entative opinion because there has
not been an opportunity for detailed analysis of the status of
each individual tract. Th~ would take a status of title report,
considerably more study of the deed ~on the airport lands and

City should make no plans for sale, lease or any conveyance of
the land being received by way of release of the Highway Depa~ment

The City of Kenai has been negotiating with a
Mr. Vincent W. Root for a 30 foot right-of-way on the southern
portion of GLO Lot 50, Section 34, T6N, RllW, SBM, Alaska.
This right-of-way was to have been used for the installation
of City water, sewer and street improvements with the cost
of these improvements assessed back to the property owners
in that area. Our calculations determine that the best in-
terests of the City and blr. Root could be served by a direct
purchase of Mr. Root's entire lot and subsequent re-subdivision
and sale to other individuals. The Kenai Peninsula Borough
assessed this property for $4,000 during 1972 and our
negotiations with Mr. Root have determined that he would
accept a price of $4,500. We have verbally agreed to this
price and feel that it is a fair, reasonable price for the
land considering the new improvements will increase values
c.ons.iderably .~within the area.
We will require a check in the amount of
$4,500 made payable to Mr. Vincent W. Root, full payment
for GLO Lot S0, Section 34, T6N, RllW, SBM, by noon on

pursuant to Public Law 8].-311 (63 Stat. 700), has issued a deed of re-
lease for Etolin Subdivision from the terms and con-
ditions of the quit-clai:.~ deed, dated December 1, !963, from the Fed-
eral Government to the City of Kenai.
2. A public sale by sealed bid will be held, with the bids to be pub-
].icly ooened, on the 16 day of Au~ust~ , 1972 at
City ~.~n~rs. Office - ~]Ti--.rporf , in the City of Kenai. The bids
shall provide for- Terminal
a. A cash one time bonus over and in addition to the established
annual rental rate per square foot for real property in question.
b. A bid for an increased amount per square foot over the minimum
annual rental rate established by the City. That increased rate
bid shall thereafter be the annual established rental rate.
3. The terms of the lease shall be as indicated on the unexecuted from,
a copy of which is attached hereto.
~. The established annual rental for the lot leased at the sale shall
be ' ~2'5'~' per square foot per year; any lot leased
for a term of more' than five years shall be subject to rental increase or
decrease at five year intervals.
In-the event that the lot is-not leased as a result 'of the sealed
bids, it shall be available for "over the counter" lease.

5. The real property in this offering is on an "as is, where i's" basis;
the land is unimproved, although utilities (power, water, sewer, and gas)
may be located near by.
The lessee of the lot will be required to hook up to the City water
and sewer systems when available. The utilities regulation and prices.
for service will apply to the leased land. Hook up to the City water
and sewer mains shall be at the expense of the Lessee with construction
to meet al%,City, standards.
I'f the City, or others, do not extend the water and/or sewer mains
prior to the time that-the lessee of the lot requires water and/or sewer
service, the Lessee will extend that portion of the water and/Or sewer
necessary to service the lot, in accordance with the engineering standards
and specifications of the City of Kenai.
T~e cost of any main so extended may be credited to water and/or
sewer assessments for that lot.
The cost of water and sewer service from the main to the property
line, and from the property line to the building, shall be at the expense
of the Lessee.

'7, Bidders and prospective lessees shall be deemed to have familiarized
themselves with the site and all of the conditions of this lease sale, of
the property plats, of the City Zoning Ordinances and site conditions.
The.uses permitted shall be those as defined under thel~g.h.~t_ industrial

· 8. The Lessee agrees to commence development of the lot within one )'ear
of the execution of the lease. Commencement of development shall con-
. $ist of improve~.ents (site preparation and building construction)"of
'- a substantial nature. Structures shall be completed within two years
of execution of the lease unless a specific extension of time is granted
by the Ci, ty Council. In the event improvements as above described are
not completed or begun in the.time specified, the lease may be terminated
by the City.
CONDITIOXS OF SALE
9. A 'le. ase will be offered for a term not to exceed 30 years;
Bidders will be required to submit a detailed plan of--t{~e, and descrip-
tions and schedules of development on forms supplied by the City to the
Kenai Planning and Zoning, Commission prior to their regular meeting on
August 9 197. This development plan will become
part of anY~iease granted by t-~ City. .
10. By execution of the City's. lease, the Lessee acknowledges lease rental
payments or purchase (bonus) price paid do not include the assessments
for water and sewer and/or other improvements which may be installed.
Such assessments for water and sewer may be made at the time water and
sewer is available to the property.

11. Any lot sold or leased under the provisions contained under this
lease offer may be assigned for financial purposes after written approval
of the City Council of that assignment. Sublease to otifer individuals
prior to the lessees completion of the proposed development will not be
approved. -

AN ACT
Relating to 'intoxicating liquor.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
* ~Section 1. AS 04 .15 . 020 (g) is repealed and re-enacted
read:
(g) The governing body of a political subdivision
of the state may provide by ordinance that the provisions
of (c) of this section do not apply in the political sub-
division when elections are being held. The Alcoholic
Beverage Control Board shall adopt regulations governing
the sale of intoxicating liquor on election days in the
unorganized areas of ~he state.
' Sec. 2. AS 04.10.430 is amended by adding a new subsection
read:
(c) If the petition for a local option election is
for a community liquor license under sec.' lB9 of this
chapter, the board is precluded from issuing additional
new licenses of any other type within the boundaries of
the city or to'~n opting for the community liquor license.
This section does no~ affect the provisions of AS 0~.10.-
260 or liquor licenses issued before the effective date
of this sec.tion.
· Bec. 3. AS 0~ .10.190 (a) (5 ) is repealed.
· Sec. ~. Sec. 3 of ~hls Act is retrospective to Mmy 26,
1971.

the third most populous area in the
WHEREAS,
revenues,
the Kenai Peninsula contributes a high percentage of State
and.
W~HEREAS, completion of proposed road improvements .to existing
projects on the Kenai Peninsula are of utmost importance to the
area and the State; and
WHEREAS, the Kenai Peninsula is heavily utilized by sport and
commercial fishermen and hunters; and
WHEREAS, it is important that Highway and Fish & Game personnel
live near their work and have local orientation in the interest
of quality work and efficiency
NOW, THEREFORE, BE IT RESOLVED that the Kenai City Council respectfully
urges th.e Department of Highways and Department of Fish and Game to
retain all existing personnel on the Kenai Peninsula and expand the
resident staff so as to facilitate complet-ion and satisfact-ion of the
important proposed projects and needs.

RE: Opinion on such assistance as the City of Kenai might provide
to a resident whose property had been foreclosed upon for taxes and

i SITUATION' As the Situation is understood, a resident Of the
City of Kenai was involved as follows'
1. Real property not lived upon was owned by a City
resident.
2. The property in question lo,closed upon for failure
to pay taxes.
3. After foreclosure, the property was made available
for sale and sold by the Kenai Peninsula Borough.
4. After sale of the property in question, contact
was made with a member of the Council requesting assistance of the
City.
REVIEW OF FORECLOSURE PROCEDURE FOR TAXES' The tax foreclosure
procedures are generally as follows'
a. Foreclosure procedure', is not initiated until taxes
have not been paid for approximately 2 years.
b. A general announcement, not naming specific names,
is published stating the foreclosure role is available for
'delinquent tax payers' inspection. This notice reminds People
to pay up taxes, It is my recollection that these notices are
published in the Peninsula weekly newspapers and in one or both
of the Anchorage daily newspapers.
c. Next, the foreclosure list is published naming the
parties involved and the real property upon which foreclosure is
..to be accomplished.
d After publication of the foreclosure lawsuit, a
i!judgment is entered in favor of the Borough and against those per-
~.!~sons who have not paid up (it is possible to pay the taxes at any
~istage of the proceedings and then foreclosure is terminated for
=.~that particular piece of ~roperty for which the taxes have been
~£s£.m$~£~ paid). After the judgment of foreclosure is final, one year is
City~=o~ allowed to redeem the property by the o~mer holding the property

I C With respect to foreclosures, the Council should
,,remember the Kenai Peninsula Borough kas a $250 tax exemption for
, aged persons disabled (in accordance with the standards of Social
:~Security Administration). That exemption was made possible by the
City of Kenai's action. However, in order to claim that exemption,
one must live upon the property for which the exemption is ~laimed.
TENTATIVE OPINION'
I. There is no statutory basis for relief of the type'
outlined whether it occurs before, or after, foreclosure on
property for delinquent taxes.
[i II. The legal responsibility for tax foreclosure rests
with the Kenai Peninsula Borough and has apparently (I have not
specifically traced each step in this particular situation) conformed
to the legal basis. -
III. The time for requesting informal relief from the
Kenai Perinsula Borough administration has passedL With-~-he sale of
the property. ·
IV. There is nothing, that appears can be done at this
time by the City of Kenai (nor the Kenai Peninsula Borough, but
then we cannot speak for the B~'gh).
