The Minutes of the Regular Meeting of March i5,
were approved as corrected.

Malone asked it be recorded on page 15 of the Hinutes,
that the reason he abstained from voting is because he
felt the item of business could 'wait for a few more days
for a full Council. Also he made a motion to ~able,
which died for lack of a second.

Two Ordinances were introduced concerning rezoning - one
within, the City of Seward and one within the City of. Soldotna.

The School Board h, ada budget increase from 1.2 mil. lion
from .l. ast yeafr to 2 million t. his year. The loss of
revenue 'fro:n Wildwood was giv'e~ the reason, for the
i~crease, though the enrollment is not as bleak as it
is oainted.
.A meeting with City Council and school 'board and. possibly
the Assembly is schedu!ed for next Tuesday evening concerning
the joint use of the swimming p~ol.
Navarre reported on Wildwood responsibility transfer to the
Alaska Federation of Natives. The A.F.N. voted in a
Resolution to remove the entire body from Mt. Edgecumbe
to Wildwood.
Steinbeck reported Mrs. Bahia is worried about the third
story of the Borough Building, thinking the Health Center
could go there.

Mr. Fisher stated, he has spent the equivalent of one week
in Juneau lobbying and has submitted written reports and
was: assured Council has copies. He also pointed out that
no one has been in Juneau lobbying for two weeks.
On Ordinance 206-72, he stat. ed that if Council wanted it
to be e£fective after signing, they will need an emergency
clause~ also Section 2(c) needs to be filled in.
Mr. Fisher reported the Hearing before the 2ublic Utilities
Commission was like an endurance contest. The only reason
C.U.L. gave for an increase (35-40%) was to provide a
profit. April 24th, I believe, is the deadline and will
be an automatic increase, then the City will have to go to
Court to appeal the action.

Mr. Glotfel.ty passed around a release concerning Wildwood
Air Force Station.
George Navarre, Borou~h=~ Chairman; Vincent O'Reilly, Executive

of Natives, and the City Manager traveled to ?¢ashington D.C.
in regards to l-~'ildwood. Dur_J. ng a layover in Seattle they-met
with Cono'ressman Begich
The City'Manager continued, in Washington D.C., Mr. Sheehan
reviewed our new proposal. It was a drastic proposal as far
as they w'ere con. cerned. The transfer proposal under Native
Land Claims is very new to them. The Daily News had a news
release from Senat:or Hensley stating they are studying the
use of the Wildwood Air Force Station as a replacement for
the Mt. Ed. gecumbe Boarding School.
Mr. Glotfelty felt this is a tremendous opportunity and to
pass up such an opportunity would be detrimental to the
communi ry.
Malone stated two weeks ago I though.~of this as a white
elephant but since the cooperation of a!l the agencies,
the sky is the limit. I wish to compliment the City Manager.

Report on Meeting School Board - Pool
The Kenai members of the Borough School Board met in the City
Manager's office Monday morning and discussed the proposals
from the public hearing on the Civic Center.
The School Board have r, equested a meeting with Council, Monday
Apr_il 10th. at 10'00 P.M. in the Borough Buil'di~g.
It was the general consensus to explor,zall recommendations and
keep the options open.

Th.e Mayor asked if there were any objections to dropping
down to A~enda. Item G - 5. There were no objections.

Mr. Jaynes reported ~'Ir. & Mrs. Bob Needham have applied for
a lease on Lot 2, Block 5 of ~he Small Aircraft Apron for a
Seafood. Processing Plant. This has gone through Planning
& Zon. ing. They did have. a question of odor and open storage.
The sewer cannot take care of the waste and will have
hauled to the sanitary land fill.

Ordinance 206-72 - Dog Control
After some discussion Hornaday moved, and Bielefeld
seconded to strike Section 3-13 sub paragraph c. The
motion carried unanimouSiy by roll call vote.
After much discussion 5.~alone moved and Bielefeld seconded
to adopt Ordinance 206-72 as amended.

hearing on Ordinance 206=72 - Dog Control until the next
meeting. The motion carried unanimously by roll call vote.

Mr. Massey talked with Mr. Carter, S.B.A. and they have
verbally worked out an agreement. It will be comp'lete by
Wednesday of next week and will go to the City Attorney
for review.
Mr. Massey has gathered names of property owners
and will se~d out letters of th.e Council's Policy
in Bush Lanes
to them.

The City has received two request for payment from Harold
Galliett, one for partial payment on the Feasibility Study -
Industrial Water Line for $3,724.84 and one for expert
witness - City of Kenai vs City of Soldotna for $362.17
for a total of $4,087.0].. The Administration recommends
approval for pay~aent.
Bielefeld moved and Doyle seconded to pay Harold Galliett
$4,087.01. The motion carried, unanimously by roll call vote.
Request for Payment - Touche Ross & Co.
The City received a request for payment from Touche Ross &
Co. for invoice #85508 in the amount of $7,422.00 p~rsuant
to the agreement.
Malone moved and Bielefeld seconded to pay
in the amount of $7,422.00 to Touche Ross
carried unanimously by roll call vote.

NEW BUSINESS
Resolution 72-9 - Authorizing Assistant Cit[ Manager to
WPC-Alaska-33 Contract.
WPC-Alaska-33 Contract required final execution prior to
March 31, 1972, and in the absence of the City Manager the
Assist.ant City Manager signed the contract. The Administration
is asking for ratification and execution of prior documents
and the authorization for the Assistant City Manager to sign
the WPC-Alaska-33 Contract.
Bielefeld moved and Malone seconded to Adopt Resolution 72-9 -
A Resolution of the City of Kenai, Alaska, authorizing signature
of contract and ratification of all prior submittals and
execution of documents for construction of Kenai Sewage
Treatment Plant, WPC-Alaska-33. The motion carried unanimously
by roll call vote.

The City 'received seven (7) sealed bids on WPC-Alaska-35.
Aspeotis Co~struction was the low bidder at' $420,874.60.
His bid is under the engineers estimate ($545,250.50).
Aspeotis is capable of doing the project and the
Administration recommends accepting his ].ow bid of
$4z0,874. 0.
Malone moved and ~icGrady seconded, to accept the low
bid of Aspeotis Construction in the amount of $420,874.60
for WPC-Alaska-35, subj'ect to State and' Federal approval of
project and subject to grant participation assurance
from State and Federal agencies for reimbursable projects.
The motion carried unanimously by roll call vote.

Lee, Wince and Assoc, a revised bill from $3,178.60 to
$2,102.28. Administration recommends payment.

Mr. Jaynes reported Mr. Ladd applied for a Tidelands Permit
directly below the bluff where he lives, for ty._ing and
anchoring fish. ing boats.
The City Manager recommends disapproval of this request,
stating it could be a menace to navigation and leave the
City respons.ible. There is a need for an overall plan for
the tidelands and shouldn't be piece mealed out until there
is such a plan.
Bielefeld moved and Doyle seconded to approve the' Tidelands
Permit to Clarence Ladd. The motion failed. Voting yes;
Do'yle and Steinbeck. Voting no; Bielefeld, Hornaday, Malone,
McG.rady and Junior Councilman Navarre.

The Administration recommends approval of this assignment.

security purposes - Katmai Motel. The motion carried
unanimously by roll call vote.
Resolution 72-10- Fishing In_~,ustry
Malone moved and Hornaday seconded to adopt Resolution 72-10 -
A Resolution relating to the Cook Inlet salmon fishery -
Resolving that the Cook Inlet salmon fishery be designated
for special emphasis by the State and that this Special
emphasis take the form of a "pilot project" in which an
inventory of all spawning streams and lakes be.conducted and
all available techniques of enhancement and rehabilitation
such as gravel incubators, lake and stream rehabilitation and
salt water rearing be utilized in an effort to greatly increase
the productivity of the Cook Inlet fishery and that new money
be allocated for the above purposes, such that other fisheries
throughout the State who may themse].ves be pressed for proper
funding will not be deprived of the funds necessary to sustain
their present programs. The motion carried unanimously.

SUBJECT' PROGRESS REPORT
The following is a progress report regarding the twelve steps
listed in Touche Ross & Co's letter ~of March 10, 1972 to
the City Manager~
STEP 1.
The chart of accounts is completed. After several
work sessions with the Finance Director resulting
in revisions, we now have a chart of accounts
that will allow the Finance Department to not
only make additions and/or revisions as needed
but readily produce varied types of financial'
reports, ie., revenues and disbursements by fund,
by department and by capital or special projects.
STEP 2.
Only preliminary work has been done on the design
for journals. This item will be completed
through 12/31/72 by 5'/1/72. The final forms of
the various journals can best be determined
after working awhile with the City's day to day
transactions.

The general ledgers for all funds have been
implemented and beginning balances as of July 1,
1971 have been recorded.

date has been searching files, sorting doCuments
and tying these into bank accounts, etc. Once
this phase has been completed the rest of the
accounting work will fall rapidly into place
and the remaining months to be completed will take
much less time. Progress has been made on the
following items:
(a) Cash Disbursements ..... completed.
(b) Vouchers Payable ..... .-.-completed.
(c) Cash Receipts Cash tied-into bank'
statements. Now auditors are searching for some
missing supporting documents.
(d) Sales Reconstructing and
looking for documents.
(e) Coding and posting cannot be accompolished
until the above items are completed.
STEP 6.
Payroll distribution will be done through
12/21/72 by 5/1/72.
STEP 7.
Same as item 6. However, the filing system for
documentation is being created 'as work progresses.
STEP 8.
Preliminary work has been done on journals,
(see step 2). This will also be completed
through 12/31/72 by 5/1/72.

training and format of financial statements

In conclusion, at the present time the auditors
appear to be keeping close to time schedules
and costs. By May 1, 1972, we will have completed
six (6) months of accounting and financial
statements and the auditors team effort and costs
will have been 6 1/2 weeks plus completing steps
1 and 3. You' will remember that their letter of
March 10, 1972 estimated the team could construct
one month of city activity for each week they ~
function. .
Regarding the daily operations of the Finance Department,
I'm happy to report that no interest has been lost on
i~nvestments because of premature cashing since January 1,
1972. The total intere~st received for Time Certificates of
Deposits and U.S. Government's since January 1, 1972 is
$34,000.00. .
The disbursements and receipts will have to be recoded because
of the new system, but' I'm confident that we have nearly
100% documentation starting with January 1, 1972. Since that
.
~date we have issued checks-in excess of $575,000.00. However,
a large portion of this figure was for past due invoices,
and for items., which can be charged to special projects or
capital projects and once we are current, we can apply for
grants and matching funds.

a. I believe that the City is within its authority to l~SS and add
the proposed section 3-24. There is a potential of some conflict with
A. S. 03.55.03 in that proposed Section does not provide for notification
or reasonable, inquiry on the whereabouts of an owner of a dog running at
large.
b. The confinement of dogs proposed in Section 2 of Ordinance 206-7
which Would be accomplished by the addition of Subparagraph (b) and (c)
to Kenai Code, Section 3-13, are clearly within the authority of the City
Council.
c. The City Council should, and will have to, decide upon~ whetherh
or not they want to implement Subparagraph (c) and if they i fact wis
to change Section 3-13, Kenai Code, 1963, (the leash law)'.

3-13, KENAI CODE) AND TO ADD A PROVISION AUTHORIZING DESTRUCTION OF DOGS
TRAVELING IN GROUPS OR "PACKS" AND I~ECLARING AN EblERGENCY
WltEREAS, residents of this city and state have had occasion to observe
that when dogs, either abandoned or wild or household pets, travel in
groups or packs, said packs of dogs constitute a threat to people, especially
small children, domestic animals, and wildlife; and
I~rHEREAS, the licensing, restriction, or regulations presently, provided for
in Kenai. Code, 1963, and the State Statutes have not been effective 'in the
controlling of dogs acting in groups or "packs" within the City; and
WHEREAS, recent complaints to the administration of the City of Kenai
demonstrate a continuing and apparently increasing hazard from dogs, both
licensed and unlicensed, which are traveling in groups or packs Oithin
the City limits of the City of Kenai; .~.
BE IT ORDAINED BY TttE COUNCIL OF THE CITY OF KENAI, ALASKA'
Section 1. There shall be added to Kenai Code, 19'63, as amended, a further
Section-3~-24, entitled, "Authority to Deal with Dog Packs"-
Authority to Deal with Dog Packs
.... Sectioi~--3-~2~-. A pollCd'' 'officer or the dog Catcher of the. City
of Kenai, in addition to all other actions authorized pursuant to
the Code of the City of Kenai, 1963, as amended, may destroy,
kill, capture, or otherwise dispose of any one or all of any
dog packs or groups of dogs which, in the view of the said desig-
nated official, or officials, appear hazardous to persons, property,
or wildlife. Such destruction or disposal of the dog, or dogs, is
to be accomplished by any reasonable means.
Section 2. The Code of the City of Kenai, 1963, as amended, is hereby
amen~ie~t- to change Section 3- 13, Subparagraph (b) as follows'
Confinement of certain dogs

(b) The City Manager may, after publication for not less thah
two weeks, declare that all dogs will be restrained by fence,
leash or otherwise on-the property of the owner, such restriction
to continue for a period of not more than _g~ days at any one
time. During-'such,-des.ignated period, the dog catcher shall
impound ail dogs running at large. No dog shall be released
except upon payment of the fee provided in Section 3-8.
(c) All dogs, regardless of sex, weighing more than
pounds, shall be chained or enclosed in a fenced yard in such a
fashion as not to be wandering loose off the owners' premises or
otherwise unrestrained inside a house.,~,[...~o~her enclosure except
for the hours of __/2 P.M. to ~%"when such dogs may
be permitted to run at Iarge. Such dogs ranging at large out-
side the desi. gnated hours shall be subject to impound or other
disposal as permitted in this Code.

estimating for a project of reduced, scope, conferences with
City personnel and appearance before Council to render an
interim report of findings. A $4,~000,000 project to use
Beaver Creek aquifer water has been defined and proposed as
a practical interim project to supply the City, the North
Road and the industries with water.

WHEREAS, the contract agreement for construction of Kenai's
Sewage Treatment Plant, WPC Alaska 33, required final execution
prior to March 31, 1972, and

the Assistant City Manager, in the absence of the City
signed and executed this agreement, and
WHEREAS, it would be to the advantage of the City of Kenai to

AWARD - KENAI SEWER INTERCEPTOR PROJECT-
WP C - ALA- 35.
On Tuesday, March 30 at 2'00 p.m., the City
received and opened seven sealed bids for the construction of
the proposed sewage interceptor project, WPC-Alaska-35.
Attached for your review, is a certified
copy of the bid summary as compiled by Wince -Co rthell and
Associates, along with the Water and Sewer Department's
recommendat ions.
The three low bidders are as follows'
1. Aspeotis COnstruction $420,874.60
2. Cooper Construction Not responsive*
3. May Contractors 567,573.45
· 4. Felton Construction 605,770.00
5. Engineers Estimate 545,250.50
Although there is a great disparity in the
spread of bids, it is the opinion of the City's consulti.ng
engineers that the low bidder, Aspeotis Construction, is
capable of performing the work at the bid price. Aspeotis
presently owns all the necessary equipment for completing
the contract including facilities for manufacturing his own
manholes locally; however, he has few prospects of working
in. the Anchorage area this year. Therefore, from a cost
analysis viewpoint, it would in all probability be nearly
as expensive for Aspeotis to hold the equipment idle in
Anchorage as it would to work it on the Kenai project.
Secondly, Aspeotis has successfully con-
structed other sewer and water projects under similar con-
ditions in the past.
Considering the above recommendations, it
is the Water and Sewer Department's recommendation that the
low bidder, Aspeotis Construction, be awarded the contract
with the following provisions'

may have been the second low bid in the amount of $S49,S09.70.
However, the bid was treated as non-responsive and is not
reflected in the bid summary for the following reason:
Cooper Construction, while recognizing addendums
1 and 2, did not submit the Equal Employement Oppor-
tunity (EEO) worksheets, which were specifically called
for in addendum number 2. This phase of all EPA funded
projects has been made a strict requirement of the Federal
government; and, it is my opinion that a waiver at this
time would be extremely difficult if not impossible to
obtain. ~'

A resolution relating to the Cook Inlet salmon fishery.
BE' IT RESOLVED by the City of Kenai
WIIEPZAS, the Cook Inlet salmon fishery is more intensely
utilized than any other fishery in the State of Alaska both

in reaard to the number of sports fishermen involved in
conseguence of the major population concentrations in the
area as well as the highest gear registration per fish of
any commercial fishery in the State;
WHEREAS in a given year such as 1968 when the commercial
fishermen caught 5.1 million dollars worhhof fish the potential
economic impact on the Kenai Peninsula- Anchorage Area
economy can be as much as~ $35,000,000 from the commercial fishing
alone;
WItEREAS the Cook Inlet sport fishery generates a'~
source of income to businessmen involved with the sports
fishery;
WHEREAS the Anchorage economy derives very valuable
stimulation from both the sports and commercail fishery
as a secondary, supplier of the Peninsula economy;
WHEPEAS population pressures alone need not of
necessity spell the demise of a fishery since in the Puget
Sound area which enjoys a population density far in excess
of that of the Cook Inlet area, a viable fishery is being
maintained due to major emphasis on rehabilitation nad
enhancement of that fishery;
WHE?EAS the major management tools utilized in the
Cook Inlet fishery have been found less accurate than is
desirable presenting problems of a grave maqnitude to
management;
I..;t~EREAS according to the Alaska Departmen't of Fish
and. c..a~, the Cook Inlet salmon stocks have sustained a drastic
jecline due' to intensity of use;
,.,~[EREf~.S present management tools may not in themselves be
~;:~:',.!.e to reverse this decline;
· - ~L, IEP£AS recent breakthroughs in the area of gravel
~nc~a. ticn, stream and lake rehabilitation, and salt water
rearinc seem to hold major promise for the enhancement of
our fisheries without constituting major expense to the State;
WliEpj~AS_approximately 83% of the Commercial fishermen in
the Cook INlet fishery are resident Alaskans;
BE IT RESOL\~D that the Cook Inlet salmon fishery be
designated for special emphasis by the State;
DE IT FURTHER RESOLVED that this special emphasis take
the form of a "pilot project" in which an inventory of all
spawning streams and lakes be conducted and .all available
techniques of enhancem.ent and rehabilitation such as gravel
incubators, lake and stream rehabilitation and salt water
rearing be utilized in an effort to greatly increase
the productivity of the Cook Inlet fishery;
BE IT FURTHER RESOLVED that new money be allocated
for the above purposes, such that other fisheries throughout
the State who may themselves be pressed for proper funding
will not be deprived of the funds necessary to sustain their
present programs.
