Total revenues and expend- itures are $927,476. The Mayor stated this is a balanced budget, keeping the mill levy at 7 mills. This has had input from the Administration and from the Council. The Mayor is now asking for input from the audience. The Mayor opened the meeting to the Public. Hearing no public participation the Public Hearing was closed and brought back to the Council table. Norene moved and Malone seconded to adopt the Budget for the City of Kenai for Fiscal Year 1972-73. The motion carried unanimously by. roll call vote with Mr. Hornaday abstaining from voting on. that portion of the budget pertaining to the City Attorney. Mr. Fargo reported that grass will be planted from the edge of the road to the clearing limit or right-of-way whichever is the.closest. Mayor Steinbeck asked if the contractor is on schedule. Mr. Fargo stated they are picking up. Robert Norene - Will they seed the downtown area? Mike Fargo - Yes, where it is applicable. They desire to reach a point of understanding. Councilman Doyle in now. He further stated they desire to locate, designate and restore historic sites. Councilman Bielefeld in now. Mr. Stringham told of four categories the Society is interested in. · · Restoration and. designation Preservation, collecting and finding diaries, photos, documents, etc. Historical research and writing Tourism - the museum fits i'nto the program. MINUTES, B - 4 - KENAI CITY COUNCIL MEETING, JUNE 7, Guy Stringham- Historical Society- 1972 continued Page ~hree C· D~ D - D_ · D - 3' He further added Kenai is setting on a gold mine. The museum would bring, tourists in. He submitted that Council might give the Historical Society the authority to assume the responsibility for the museum. If given the respon- sibility for the museum, they would immediately get someone to be in the museum. The City Manager recommends COuncil pass a motion giving the Historical Society the authority to run the museum, feeling this is best for community promotion. After much discussion Hornaday moved and Norene seconded to authorize the Historical Soc.iety to operate the museum and tourist center for the term of one year subject to ratific- ation of plan of action and comments of City Administration and the Russian Church at the next meeting. There were no objections in casting a unanimous ballot and was so ordered. MINUTES The Minutes of the Regular Meeting of approved as distributed. WSF-AK-10-19- 1017 CORRESPONDENCE · ~0u¢cilman._Hornaday - Juneau Trip Councilman Hornaday gave Council a review of his Juneau trip - May 26 & 27. Letter from Senator Palmer Senator Palmer wrote House Bill No. 514, which contains the bond money for Kenai Municipal Airport, has not yet been approved by the House Finance Committee. The City received a carbon copy of a letter to Mr. Bert Williamson from-James P. Mr. Hayward said he wants to review this with the School Board and the Assembly, then he will attend a Council Meeting to review this with Council. The remainder of items on the Things to do list accomplished or on the Agenda. is Alaska Municipal Le_a..gue - June 22-23-24 - Board of D!_r ec t,?r__s and Mr. Glotfelty reported the Board of Directors and the Legislative Committee will meet in Kenai, June 22, 23, & 24. Reservations have been made at the Royal Redoubt. Councilman Hornaday is a member of the Legislative Committee and the City Manager is a member of the Board of Directors. There will be 30+ people in attendance. B.L.M. move to Soldotna With the construction of a new taxi-way, there is not an area for B.L.M. to have their equipment or a place' for their planes. B.L.M. will move to the Soldotna Airport. C.U.L. The Public Utilities Commission did grant a rate increase to Consolidated Utilities Limited. Homer Electric purchased C.U.L. so there will be no rate increase. Municipal Code Mr. Glotfelty has a copy of the Municipal Code and if anyone would like to read it, it is available at the City offices. The City Manager went to Anchorage with Vince O'Reilley, Dick Hansen, George Miller, John Monfor and Don Gilman. They sPoke with Don Wright regarding Wildwood. · E - S' There are still many details to work out before the 200 children will be placed at Wildwood this fall to be placed in the Borough schools. There~will be 13 caretakers. Guy Moore will be in charge. There will be no provisions for security or fire protection for the facility. Councilman Hornaday said he would be willing to work with the City Manager to set up procedures for the Alaska Municipal League, Board of Directors and Legislative Committee Meetings. There were no objections and was so ordered. C~_ty- ~Att ornery' s. Re_~_~_~ Mrs. Kulawik stated she has had the opportunity to meet ~ith var-ious people -in Adm-in-istration. A number of the items I have ~orked on 5s on the Agenda tonight. Mr. Glotfelt7 reported Mrs. Kulaw-ik as do-lng an outstand:ing job on every project he has asked her to work on. The City Manager stated the City -is ~orking on condemnation procedures on burned out bu-ild-ings or old delapidated vacant build-ings and would like Counc-il approval. Counc-ilman Norene stated the majority of these bu-ildings are in the down town area and he feels that if th-is ~ere rezoned to general commercial the property owners ~ould clean up their lots. Counc-ilman Malone stated this part of the C-ity 'is only a small portion that ne'eds cleaned up. Mayor' s Re op_9~ - Mayor Steinbeck reported the tree planting went off very well and would like to see the City continue in this line. City_ Clerk's Report No report Finance Directo~ Mr. Whelan presented Council with Touche Ross & Co. Progr'ess Report #5. He feels they will meet the time schedule. MINUTES, K£NAI CITY COUNCIL MEETING, JUNE 7, Planning & Zoning's Report 1972 Page six A1 Hudson reported Kenai Planning & Zoning held a Public Hearing at their last meeting on streets, water & sewer improvements on Davidson Drive. It was a length and very good hearing. Everyone was in fay. or of the improvements. The Commission have initiated, a rezoning of the area by Anchor Trailer Court, Kenai Supply, Peninsula Builders, etc. The rezoning was based on the use for many years. Mr. Hudson is all in favor of cleaning up old burned out and delapidated buildings but also assured Mr. Norene the Commission would look into rezoning according to the Master 'Plan. Councilman Malone put this in the form of a request. were no objections and was so ordered. There Councilman Hornaday would like the Commission to give some attention to the preservation of river marshes and declare the entire Kenai River an environmental and habitat area. E · Borough Assemblymen's Repo.r~_ Councilman Malone reported on the Assembly meetings of May 16 & 23 and June 6, 1972. Mr. Lewis Fields filled the vacant assembly seat. · A rezoning from unclassified to industrial was denied within the City of Soldotna. The Assembly reviewed the Capital total program - $3,735.000. ImproVement program. The There was a del&gation from Homer.. The roof is leaking and the tile buckling at the Homer school. The pool cannot be used. There is a pending lawsuit. The tariff was enacted in 1967 and the billings since then has been in error. New customers were billed according to the new tariff but the old ones contin- ued to be billed at the regular rate. Mr. & Mrs. Earl Towner & Jerry Thompson protested the increase saying it was discriminatory. Another gentleman, who lives near Jerry Thompson, has not received a written or o'ral notice from Glacier State. After much discussion, Hornaday moved and Norene seconded that though the City has no legal responsibility it has a moral interest and would direct the Administration to request the Public Utilities Commission to ask Glacier State to hold a public meeting to explain the rate structure of the tariff in Kenai. There were no objections in casting a unanimous ballot and was so ordered. Request for payment - T_o_u_che Ross & Co. The Administration recommends Council pay Touche Ross & Co. $7,566.10 for time expended through May 31, 1972. Bielefeld moved and McGrady seconded to pay Touche Ross & Co. $7,566.10 for Invoice #84144. The motion carried unanimously by roll call vote.. o Gras.s. &. F!0.wer Pl..an~..in~g around_.Ci.ty offiqe Councilman Hornaday reported the Garden Club has done a good job coordinat'ing the tree planting and asked how the progress is concerning the grass & flower planting around the City office. Mr. Jaynes reported top soil has been dumped and spread around the City offices. There is a little more work to do and then it will be ready for planting. .V.a.l,hal'la Heights 'S/D Councilman Norene would like the City to do something about the streets in Valhalla S/D. Mr. Robbins entered into an agreement with Mr. Bolstridge to bring the streets up to standard and then the City would accept the streets. The agreement terminated .as of last September and nothing further has been done. After much discussion Malone moved and Doyle seconded to request.the presence of Mr. Bolstridge and property owners in Valhalla S/D at a Council meeting and have Administration and the City Attorney prepare a report on this. The Planning & Zoning held a public hearing on this. The Commission approved the improvements and we' are no~ asking for Council's approval. The cost per lineal ft. will be around $19.86 and will be completed by freeze-up. Malone moved .and McGrady seconded to direc't the Admin- istration to proceed with the construction phase of Davidson Drive street, water & sewer improvement district in the amount of $70,000. The motion carried uanimously by roll call vote. Franchise Re..quest - Golden .... Key Enterprises_ ......... - City._;_.Attorney__.._ The Clerk read the letter from George Ackerson requesting a franchise. Mr. Ackerson said the letter properly explains what he is requesting. Mary Kulawik, Acting City Attorney stated all he needs to operate in the City is a license approved by Council, which he already has. Malone asked if he were asking for exclusive right to operate the agency. Mr. Ackerson stated this is true.. Malone stated according to Section 8-1 of the City Code, granting franchise required an Ordinance and the vote of the people to do this. Hornaday moved and Norene seconded to table.this until the next meeting. The motion carried unanimously by roll call vote. With consent of Council, Agenda Item G - 5 will be heard now. New Taxi Cab License _ Application Mr. Thomas F. Sullivan is asking for a permit for a new cab service for Kenai. He ~ould like to pursue the taxi cab business as a caterer. Mr. Ackerson protested the issuance of a'permit, stating the present cab companies can ask for more cabs as the demand needs. MINUTES, KENAI. The motion died for lack of a second. Norene moved and Malone seconded to approve the taxi cab license according to Section 20-2, Kenai City Code providing he meets all requirements. Safety Building - Generator The City of Kenai has received quotes from various companies for a 175 kw emergency generator to be put in the Public Safety Building Alaska Generator & Engine Airport Machinery Fremont Electric N.C. Machinery 17,975 19,194 20,412 17,235 The estimated cost of installation is $2,500. Bielefeld moved and Norene .seconded to approve the purchase of a caterpillar generator from N.C. Machinery in the amount of $17,235. The motion carried unanimously by roll call vote. Engineering Contract - Galliett Mary Kulawik, Acting City Attorney explained the additions she recommends to the engineering contract. Mr. Galliett is not in agreement with some of the additions. After some discussion this item of business was moved to the end of the Agenda. Condemnation Old Town Malone moved and McGrady seconded to direct the Administration to proceed ~ith the condemnation. The motion carried by roll call vote with Norene and Hornaday dissenting. Unanimous consent was asked and granted. Resolution 72-20 - Jess H. Nicholas - Administrator of Magistrates Malone moved and Doyle seconded to adopt Resolution 72-20 Requesting that Jess H. Nicholas, Jr. be appointed as Administrator of Magistrates for the State of Alaska and that said training program be headquartered in Kenai. Unanimous c-onsent was asked and granted. Transfer of' Liquo.r License - Rainbow Bar . _ The Cit7 has received a letter from the ABC: Board requesting Council's feelings on the transfer of beverage d-ispensary license from George Rust, Helen Rust, and Ronald Rust dba Rainbow Bar to Robert N. fi Genevieve M. Williamson dba Rainbow Bar. Malone moved and Doyle seconded to approve the transfer of beverage dispensary license from the Rusts to Robert N. & Genevieve Williamson subject to-fire & police report. The motion carried by roll call vote with~ Hornaday dissenting. Request for payment - West-e-r-n & Assoc. Mr. Glotfelty reported the Administration 5s~ paying Estimate #2 to West-e-r-n & Assoc. in the amount of $123,739.89. The job is 29% completed. Kenaitze Subdivision #2 _. , ,, __ Mr. Glotfelty reported because of the tightening of the Program 235; monies the /<enaitze Indians ~ould like the City to put water & ge~er into the development and get an intent from Council to sell them land directly to the east of th-is subdivision ~ith the cost of water [ se~er ($38,000) added to that subdivision. ^dministration recommends approval. Malone moved and Norene seconded to approve the recommend- ation of the ^dministration for the water ~ sewer extention on Lawton Drive and to sell the adjacent tract to the east to the Kenaitze Indians for not less than the cost of the installation. The motion failed with McGrady, Norene, Doyle, and Hornaday dissenting. ;~SF-AK-10-19-!017, City of Kenai, Alaska Administration would like the authority to file for a grant application for WSF-AK-10-19-1017 - Water Improve- ments, Mommsen S/D, BUSh Lanes S/D & Wildwood. Malone moved and Hornaday seconded to adopt Resolution 72-21 - Authorizing the Administration to file for a grant for WSF-AK-10-19-1017. The motion carried unanimously by roll call vote. Respectfully submitted, Sharon Sterling, City Clerk MINUTES, KENAI CITY COUNCIL REGULAR MEETING JUNE 14, 1972 RECESSED TO 8'00 P.M. - CITY MANAGER'S OFFICE The Mayor brought the meeting back to order at 8'10 p.m.' in the City Manager's office. ROLL CALL' Members Present - Robert Bielefeld, James Doyle, Hornaday, Hug]~--Malone~ and Mayor John Steinbeck. Jim Members Absent - Tru McGrady, C~c'~i i-man "N' a'v a r r e. Bob Norene and Junior The City Manager read a telegram from Senator Ted Stevens relating that the General Services Administration released the FAA Housing to the City of Kenai for use in connection with the Airport. The City Manager related to Council that the Public Utilities Commission will be holding a public hearing on telephone tariffs Wednesday, June 21, 7'30 p.m. at Fort Kenay. The City Manager stated that Basil Bolstridge will be at the next Co'uncil meeting concerning Valhalla Heights. The City Manager related that we have a number of un- collected bills amounting to $13,578.49. The administration would like Councils permission to publish these bills, the names of .the person and the amount delinquent, in the paper. It was the concensus of Council to publish these in the paper. The Acting City Attorney, Mary Kulawik, 'is checking on an ordinance as to whether we have one and if we need one. The City Manager stated that the Alaska Municipal League Board of Directors and Legislative Committee meetings will be held in Ken&i June 22, 23 & 24th. After much discussion on this contract, the Administration's recommendation. Council asked for It is the Administration's recommendation to accep~ the contract with Mr. Galliett as presented to Council for the fee of $92,800 to include preliminary designs, final designs, and general supervision withholding the special services project until later. Alaska Statute 42.05.561 requires each public utility to have available for public inspection an up to date copy of its tariff schedules. Schedule No. A-5, a copy of which was obtained from those records and is attached, states the applicable tariff for customers of Glacier State who reside outside the Kenai base 'rate area; that is, those who live beyond a two-mile radius from the Kenai Glacier State Exchange. As noted on the Schedule, the tariff set forth in Schedule A-5 went into effect on March 10, 1967. This is the tariff which the telephone company intends to use for billing purposes. I was informally advised that through error in the past, not all customers of Glacier State were billed to the extent authorized in the tariff schedule. Some years ago when Glacier State succeeded TransAlaska in Kenai, it continued to bill conti~nu;i'ng subs'crib'ers 'in' a'c'co'r'dance 'wi't'h past practices and failed to add an additional charge for those outside the base rate area. New customers were billed according to the tariff as published. The utility now plans to correct past error by billing all subscribers as authorized in Schedule A-5. The cost of service to customers of long standing .will be the same but many customers will be unaffected. Note again, the additional charges where made are not the result of a tariff revision but the result of correct application of an existing tariff. To verify the records available in Kenai, I have written, to the Public Utility Commission in Anchorage, a copy of which is attached. Pertaining to another matter, the notice of application for tariff revision (copy attached) was issued by the PUC upon the filing of Tariff Application TA7-49. It concerns the charge for subscription to a specialized service. The notice described that service as "long line adapter terminating equipment used for originating or receiving service from 'or .to another exchange"; and refers to telephone equipment that permits a subscriber to dial directly into the Anc.horage or other foreign exchange without funneling through the long distance operator.. The ENGINEER specifically contracts that the PROJECT, designed and built under the supervision provide, d for in this contract, will be, when put into operation, both workable and practical, in the area where it is built. II. The ENGINNER agrees that acceptance by him or his representatives of workmanship and/or materials, as provided for in this contract, that is of inferior quality will result in his joint liability with the CONTRACTOR for the affected portions of the project. III. The ENGINEER further agrees to bond his perf0~mance of this contract with a bonding company approved by the OWNER in the amount of $98,500'. IV. The ENGINEER and OWNER agree that each party retains any and all rights of recovery should breach or default' oCcur and that no provision set forth in this contract means or is intended to mean a limitation or waiver of those rights. No payment, however, final or.. otherwise, shall operate to release the ENGINEER or his surety from any obligation under this contract. · V. The ENGINEER shall furnish and perform the various professional engineering services required for the construction of the PROJECT as follows' A. PREPARE preliminary and final design drawings, construction specifications, and detailed cost estimates; and DRAFT and/or assemble forms for contract documents. B. PROVIDE ten (10) complete sets of full-size drawings, specifications and contract documents for review and approval by the OWNER and Federal and State approving and funding agencies. C. PROVIDE and issue, if requested, fifty (S0) complete sets of approved drawings, specifications-and con- tract documents, of which thirty (30) bidder's sets. may have half (1/2) scale drawings.' D. ATTEND the bid opening, tabulate and certify the tabulation of bids received, advise the OWNER in interpretation of bids and proposals, and assist in awarding a contract for construction of the PROJECT. 2. INTERPRET the plans and specifications. 3. PROVIDE general supervision and instruction to the Resident Engineer. 4. CONDUCT supervisory inspections of the PROJECT not less than once each month during the progress of ..cons truction to assure compliance with plans, specifications and contract documents. S. CHECK, approve and certify all payment estimates and requests submitted by .the CONTRACTOR. 6. SUPERVISE, receive and approve the work and reports of inspection bureaus and testing laboratories in the inspection and testing of materials entering into PROJECT construction, check CONTRACTOR shop and working drawings and data, and approve' all materials and equipment proposed by the CONTRACTOR under "or equal" provisions of the construction contract. 7. AUTHORIZE and approve all contract change orders, and make necessary revisions to the design drawings as may be required from time-to-time. 8. CONDUCT a final inspection of the PROJECT and submit a final letter report to the OWNER to include recommendations with respect to PROJECT acceptance. 9. PREPARE correspondence, reports, estimates and applications for permits for submission to Federal and State agencies as required by law, grant financing agreements, for the progress of con- struction, and for commencement of operation of the PROJECT, and consult with such agencies as required. . 10. SUBMIT "as-built" drawings for approval of Federal and State approving and financing agencies, and for review by the Board of Fire Underwriters of the Pacific. 11. DELIVER original "as-built" drawings and other pap,ers and plans prepared for or provided by the OWNER. 12. CALCULATE and recommend assessments and rates based on-final construction costs, "as-built" system per- formance, and financial r'equirements at the time of completion of PROJECT construction. 13. MEET with the OWNER when requested or' necessary for .project consultation and conferences 14. ADVISE the OWNER when requested or necessary in connection with the PROJECT E.
