submitted by Integrity Surveys, Inc. Kenai, Alaska 99611 on behalf of the RPM’s LLC,
14096 Kenai Spur Highway, Kenai, AK 99611.
City Planner Kelley reviewed his staff report provided in the packet noting the plat vacated two
property lines resulting in two lots which with minimum lot size requirements and recommended
approval with the following conditions:
• Further development of the property shall conform to all Federal, State and local
regulations,
• The owner’s name and address be corrected in the title block,
• The word, “aread,” under the Legend section of the plat be corrected to read, “area.”
MOTION:
Commissioner Peterson MOVED to approve Resolution No. PZ17-04 and Commissioner Fikes
SECONDED the motion.
Commission Chair Twait opened the public hearing; there being no one wishing to speak, public
hearing was closed.

PZ17-06 - A resolution of the Planning and Zoning Commission of the City of Kenai,
recommending an Ordinance to the Council of the City of Kenai, Alaska, conditionally donating
certain foreclosed city-owned properties described as Lots 8, 9, and 11, Block 9, and Lots 4
and 5, Block 10, Mommsens Subdivision Replat of Addn. 1 & 2, Addn. No. 2, (parcel numbers
03910208; 03910209; 03910211; 03910304 and 03910305) to Central Peninsula Habitat for
Humanity, Inc. for construction of housing

City Planner Kelley reviewed his staff report provided in the packet noting:
• In 2009 the City Council donated five properties to Habitat for Humanity for building
houses;
• Council currently considering donating a second set of five properties to the entity;
• Borough valued the homes built previously between $158,000 and $213,000;
• City had previously attempted to sell the property via land sale but no bids were received
on the property.
MOTION:
Commissioner Askin MOVED to approve Resolution No. PZ17-06 and Commissioner Halstead
SECONDED the motion.
Commission Chair Twait opened the public hearing; there being no one wishing to speak, public
hearing was closed.
It was clarified that all five lots were presently vacant and former owner could no longer cure the
foreclosure as the one year redemption period had passed. It was noted that, if approved, Habitat
for Humanity had planned to begin building the first home in 2017.

10. REPORTS:
a. City Council – Council Member Glendening reviewed the Action Agenda of the March 15
City Council meeting which was provided in the packet; clarified that the proposed jump
in cemetery fees was because they hadn’t been reviewed for many years and had been
relying on a legacy investment.
b. Borough Planning – Council Member Glendening reviewed actions from the March 13
meeting noting everything was approved except for a Conditional Use Permit for a gravel
pit, which was postponed until additional information was provided.
c. Administration – City Planner M. Kelley reported on the following:
• Provided a reminder regarding upcoming meetings;
• Noted the Kenai Peninsula Borough plat committee reviewed the
plat of the property being donated to Kenai Peninsula Housing
Initiative and discovered a potential issue with a platted road.

City Manager Ostrander thanked the Commission for the time and energy they put into the City;
gave a brief background of his history prior to being hired as City Manager; provided an update
on the Bluff Erosion Project noting an upcoming milestone that, if met, meant potential
groundbreaking in 2019. Also provided an update on budget shortfalls and the need to use the
Fund Balance to balance the budget and the creation and adoption of a Fund Balance Policy.

ANALYSIS
At their meeting of February 8, 2017, the Planning and Zoning Commission
passed Resolution PZ17-02, recommending approval of the Original Preliminary
Plat of Kenai Meadows.
The Plat Committee for the Kenai Peninsula Borough reviewed the original
preliminary plat of Kenai Meadows on March 13, 2017. The surveyor, Segesser
Surveys, requested that the Kenai Peninsula Borough grant at exception to Kenai
Peninsula Borough Code Section 20.30.110 - Half Street, providing a matching
right-of-way for Nightingale Street. The request for the exception failed; therefore,
the Kenai Peninsula Borough has requested that the surveyor add a half
dedication for Nightingale Street and submit a revised plat with the half right-of-
way dedication for Nightingale Street shown on the plat.

The addition of the half right-of-way dedication for Nightingale Street constitutes
a major change to the Original Preliminary Plat of Kenai Meadows; therefore, it is
appropriate that the Planning and Zoning Commission review the plat an
additional time.
RECOMMENDATIONS
Staff recommends that the Planning and Zoning Commission approve PZ17-07
subject to the rescinding of Resolution No. PZ17-02. The original staff
discussion presented to the Planning and Zoning Commission in support of
Resolution PZ17-02 is as follows:
The proposed plat would create two approximately 1.2 acre parcels, shown as
Lots 1, and 2. The subject plat would also create an approximately 74-acre
parcel shown as Tract A. Presently, the subject parcel is an aliquot parts parcel
and is approximately 77 acres in size. The subject parcel is bound to the south
by Redoubt Avenue and Fifth Street to the east. It is further bound by the Kenai
City Limits to the north and Nightingale Street to the west.
Pursuant to Ordinance No. 2899-2016, Lots 1 and 2 are being created from the
existing aliquot parts parcel for the purposes of donating them to Kenai Peninsula
Housing Initiative. The newly created lots would be utilized for the development
of income restricted and senior housing, which would be owned and operated by
Kenai Peninsula Housing Initiative.
The subject parcel is zoned Rural Residential, therefore, pursuant to Kenai
Municipal Code 14.24.010 the minimum lot size is 20,000 square feet. As
proposed, Lots 1, 2, and Tract A would meet the minimum lot size. Furthermore,
the new lots would also meet the minimum lot width of 90 feet as required by the
Rural Residential Zoning.
Water and sewer would serve the new subject Lots 1 and 2 and well as the
reconfigured Tract A, which is presently located on Redoubt Avenue. Driveway
access for the subject lots would be taken from Redoubt Avenue. Therefore, an
installation agreement would not be required.
Staff discussion as set forth above remains the same, with the exception of the
paragraph shown below.
The proposed preliminary plat would also dedicate an additional 30-foot right-of-
way along Fifth Street, thereby creating a 60-foot right-of-way. As shown on the
Preliminary Plat, Tract A does not contain a 30-foot right-of-way along its eastern
property line. Thus, only a half street would be crated along that portion of Tract
A, according to Plat KN 76-66.

SUBDIVISION PLAT
A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI RECOMMENDING THAT THE ATTACHED SUBDIVISION PLAT BE APPROVED
SUBJECT TO THE FOLLOWING CONDITIONS:
WHEREAS, the attached plat of KENAI MEADOWS was referred to the City of Kenai
Planning and Zoning Commission on April 12, 2017, and received from Segesser Surveys;
and,
WHEREAS, the Kenai Peninsula Borough Plat Committee approved the plat of KENAI
MEADOWS at their regular meeting of March 13, 2017 with a provision that a right-of-way
dedication of 30 feet for Nightingale Street be dedicated subject to approval of the City of
Kenai and,
WHEREAS, the City of Kenai Planning and Zoning Commission finds:
1. Plat area is zoned Rural Residential and therefore subject to said zone conditions.
2. Plat does not subdivide property within a public improvement district subject to special
assessments. There is not a delinquency amount owed to the City of Kenai for the
referenced property.
3. Installation agreement or construction of improvements is not required.
4. Status of surrounding land is shown.
5. Utility easements, if required, shall be shown.
6. Surveyor shall verify that no encroachments exist. If an encroachment exists; the plat
does not create nor increase the encroachment.
7. Street names designated on the plat are correct.
8. CONDITIONS:
a. Further development of the property shall conform to all Federal, State and local
regulations.
b. The City of Kenai must sign the final plat as property owner.
c. The preliminary plat should be revised to reflect Paul Ostrander as the City
Manager of the City of Kenai.
d. Tract A, according to KN 76-66 as shown to be outside the preliminary plat should
be revised to show that a 30-foot right-of-way is not located along its eastern

ANALYSIS
At their meeting of March 22, 2017, the Planning and Zoning passed Resolution
PZ17-04, recommending approval to the original preliminary plat of Carl F.
Ahlstrom Subdivision RPM’s Replat.
Integrity Surveys, Inc. submitted that original preliminary plat of Carl F. Ahlstrom
Subdivision RPM’s Replat to the Kenai Peninsula Borough for their review. At that
time, it was discovered that ten foot (10’) utility easements exist along the interior
lot lines. These utility easements must be vacated; therefore, Integrity Surveys, Inc
has revised the plat showing the easement vacation.
In reviewing plat K-216, which is the parent plat of the subject replat, there is a plat
note, which says that a 10-foot utility easement is located on the rear and sides of
each lot. Therefore, pursuant to KMC 14.10.070(c) a 10-foot utility easement
would be required to be dedicated via the subject plat.

The vacation of the utility easements constitute a major change to the original
preliminary plat of Carl F. Ahlstrom RPM’s Replat which was recommended for
approval by the Planning and Zoning Commission, therefore, it is appropriate that
the plat be brought forward to the Commission for additional review and
recommendations.
RECOMMENDATIONS
Staff recommends that the Planning and Zoning Commission approve PZ17-08
subject to rescinding of Resolution No. PZ17-04. The original staff discussion
presented to the Planning and Zoning Commission in support of PZ17-04, is as
follows:
The subject plat vacates the property lines between Lots 22, 23, and 24, Block 13,
Carl F. Ahlstrom Subdivision. The lot line vacation will result in the proposed Lot
22A, Block 13, Carl F. Ahlstrom Subdivision RPM’s Replat, containing
approximately .630 acres. Access to the proposed lot is provided by two driveways
off the Kenai Spur Highway, which is a State maintained paved road. An additional

ANALYSIS
The subject plat vacates the property lines between Lots 22, 23, and 24, Block

approximately .630 acres. Access to the proposed lot is provided by two
