The following items were approved as additions to the agenda:
G-7: Resolution No. 76-51- Appointment of City Manager
G-8: Assignment of Lease - Andy's Flying Service to United Bank of Alaska
GI -7: Mayor Elson requested that Council take up item G-7 at this time -- there being
no objection, Mayor Elson read Resolution No. 76-51, "A resolution of the Council
of the City of Kenai, Alaska, appointing a City Manager and setting his salary.
Whereas, the Council at their regular meeting of August 18, 1976, moved that
City Manager applicant John E. Wise be contacted with an offer for the position
of City Manager at a salary of $2,624 per month, and Whereas, Mr. Wise has accepted
the position of City Manager, Now, therefore be it resolved, by the Council of
the City of Kenai. Alaska, as follows: Section 1: Mr. John E. Wise is hereby
appointed City Manager of the City of Kenai effective September 1, 1976, to serve for
an indefinite term in accordance with the Charter of the City of Kenai. Section 2:
The Salary of the City Manager shall. be $2,624 per month."
MOTION:
Councilman Ambaarlan moved, seconded by Councilman Whelan, for adoption of
Resolution No. 76-51, Appointing a City Manager and setting his salary .
Motion passed unanimously by roll call vote.
U. PUBLIC HEARINGS
8 k Ordinance No. 309-76 - Penalties for Operation of Motorized Vehicles
on Bicycle Paths
Mayor Elson read Ordinance No. 309-76 by title only as copies had been made available
for the public. "An Ordinance of the City of Kenai, Alaska, amending the Code of
the City of Kenai to provide penalties for operation of motor vehicles on bicycle
trails within the City of Kenai."

G Mayor Elson opened the hearing to the public so that they could be heard. There
being no comment from the public, the hearing was returned to the Council table.

Councilman Morgan moved, seconded by Councilman Ackerly, for adoption of
Ordinance No. 309-76, providing penalties for operation of motor vehicles on bicycle
trails within the City of Kenai.
Councilman Ambarian inquired as to how many warnings had been issued for operation
of a motor vehicle on the bicycle trails and Mr. Wise advised that several people had
been stopped but he had no statistics at this time.
QUESTION:
Motion passed unanimously by roll call vote.
B-2: Ordinance No. 310-76 - Revising Schedule of Rates for Users .Connected
to Water/Sewer Systems
Mayor Elson read Ordinance No. 310-76 by title only as copies had been made available
to the public. "An ordinance of the Council of the City of Kenai, Alaska, 'revising
the schedule of rates for users connected to City water and sewer systems."
Mr. John Wise, City Manager, requested that this ordinance be tabled to allow
Administration additional time to work out some of the details as the ordinance is some-
what unclear as it now reads.
Mayor Elson stated that proper procedure would be that the Couincil must open the
matter to the public for their comment. At this time, the hearing was opened to the
public so that they could be heard -- there being no comment, the matter returned to
the Council table.
MOTION:
Councilman Ambarian moved, seconded by Councilman Sweet, that Ordinance
No. 310-76, Revising Schedule of Rates for Users Connected to Water/Sewer Systems
be tabled until such time Administration submits recommended amendments at which
time a public hearing will again be scheduled on the matter.
Motion passed unanimously by roll can vote.
B-3: Ordinance No. 311-76 - Transferrring of Funds for Purchase or Construction
of Animal Shelter
Mayor Elson read Ordinance No. 311-76 by title only as copies had been distributed
to the public. "An ordinance of the Council of the City of Kenai transferring funds
for the purpose of purchasing or constructing an Animal Shelter."

C -b Kenai Property Owners Association
Mr. David Thornton, Vice president of Kenai Property Owners Association,

came before Council to request that Council consider the ordered handed down by
the Courts with regard to Water District #8 and Sewer Improvement District 73-S2.
Mr. Thornton asked that Council rectify the assessments of the properties in question
as requested by the Court and in compliance with the Kenai Code which specifies
that not more than 25% of the assessed value of the property be charged. For example,
Mr. Thornton explained that two lots had been appraised by a local realtor and had
been valued at $1,200 in 1973. The water and sewer assessments billed in 1973
were $1,418.98 on each of the lots. Many people in that area received water/sewer
statements that for exceeded the value of the property advised Mr. Thornton.

Councilman Morgan inquired if there was any other involvement other than the 256
assessment -- is the Council looking at resolving the 256 differential or something
beyond? Mr. Thornton replied that what the Kenai Property Owners Association
desired was that the City of Kenai evaluate the property at the 1973 value.
Mayor Elson inquired if the Kenai Property Owners Association would consider the
case settled if the City of Kenai were to adjust the assessments to satisfy the 25%
of the 1973 appraised value? Mr. Thornton stated that yes, the Kenai Property Owners

Association would pay the fair taxes in compliance with City laws. Also, those

members involved in the Court finding, asked that the City not levy the penalty or
interest charges for payments not being made during the time this matter was in the
Court system. Mayor Elson advised that at this moment, Council did not have enough
time to take action as they were just supplied with the Administration's recommendations

prior to the opening of the meeting. Mrs. Vi Rimer, also a member of the Kenai

Property Owners Association, advised that the Judge only acted upon those

individuals who had submitted written objections so, therefore, would all those
-
Kenai Property Owners Association members who had not submitted a written
objection also have their assessments reversed and be reimbursed? Mayor Elson
advised that Council would not be able to act upon this situation at this moment.

Councilman Ambarian suggested that the matter of the resolution of the Kenai

agreed to table this matter.

MOTION:
Councilman Ambarian moved, seconded by Councilman Sweet, for approval of
the minutes of the regular meeting of September 1, 1976, as distributed. Motion
passed unanimously.
B. CORRESPONDENCE
E1: Telegram from Senator Stevens
Mayor Elson advised that a telegram had been received from Senator Stevens
advising the City that he had received word that EDA would waive the meter
.requirement on the RDA/City of Kenai Nater Well Project. Also, it was indicated
that EDA would make available additional funds in the amount of $86,000 to aid
in the construction of the project.

Mr. Wise advised that all bills were budgeted items and recommended approval.

Ordinance No. 312-76, an ordinance of the Council of the City of Kenai establishing 1
procedures for the sale of City -owned lands, as amended.
Motion passed unanimously by roll call vote.
G-3: Resolution No. 76-48 - Establishing Depositories & Authorized Signatures
Mayor Elson read Resolution No. 76-48 by title only as copies had been made avail-
_ able to the public. "A resolution establishing depositories for municipal funds and
establishing the authorized signatures for depositories or withdrawing of funds from
said depositories".
Mr. Wise advised that this resolution provided for the deletion of Acting City Manager,
Phillip Aber, from the list of authorized signatures and adding the name of new
City Manager, John E. Wise..
MOTION:
Councilman Ambarian moved, seconded by Councilman Sweet, for adoption of
Resolution No. 76-48, establishing depositories for municipal funds and establishing
the authorized signatures for depositories or withdrawing of funds from said
depositories.
Motion passed unanimously by roll call vote.

0-4: Resolution No. 76-49 - Certification of Population for City of Kenai
- i Mayor Elson read Resolution No. 76-49, by title only as copies had been made
available to the public. "A resolution of the Council of the. City of Kenai certifying
the census of the City of Kenai, Alaska, as of duly 1, 1976, as 5, 223."
Mr. {Mise explained now this figure was derived and recommended approval.
MOTION:
Councilman Whelan moved, seconded by Councilman Sweet, for adoption of
Resolution No. 76-49, certifying the census of the City of Kenai as July 1, 1976, at

G-5: Resolution No. 76-50 - Division of corrections Lease of Kenai Jail Facility

Mayor Elson read Resolution No. 76-50 by title only as copies were available for
the public. "A resolution of the Council of the City of Kenai, Alaska, requesting
that the Division of Corrections, State of Alaska, immediately lease and staff the
City of Kenai Jail Facility.
Mr. Wise advised that this resolution was prepared at the direction of the Council
and would be, upon adoption, forwarded on to the Division of Corrections.
MOTION:
Councilman Sweet moved, seconded by Councilman Whelan, for adoption of
Resolution No. 76-50, requesting that the Division ;of Corrections, State of Alaska,
immediately lease and staff the City of Kenai Jail facility.
Motion passed unanimously by roll call vote.
G-6: Special Use Permit - N. J. Poppin construction Company & Ratification of Vote
Mr. Wise reported to Council that this Special Use Permit had been extended in order
for the N. J. Poppin Construction Company to store materials that had arrived earlier
than anticipated. The Special Use Permit is for the right to use the building located
on Lot 2, Block 18, in the Original Kenai Townsite from the 10th day of September to
the 9th day of October, 1976 for a total fee of $100. Permittee may renew for an
additional 30 days for a total fee of $100 under the same conditions and terms if they
should so desire.

'1 Councilman Sweet moved, seconded by Councilman Ackerly, for approval of issuance
of Special Use Permit to N. J. Poppin Construction for a period of 30 days at a total
{ fee of $100 and Council ratification of the vote resulting from a telephone poll
conducted on Thursday, September 9th with regard to this matter.

G-8: AssiKnment of Lease - Andv's Flying Service to United Bank of Alaska
Mr. Wise advised that this assignment of lease from Andy's Flying Service, Inc.
j to the United Bank of Alaska on Lot 3, Block 1, General Aviation Apron, was for the
i purpose of securing the repayment of a loan.

H. REPORTS
a H-1 City Manager's Report
City Manager's Report A, dated September 15, 1976, as submitted by City Manager
John E. Wise is attached as an addendum to these minutes and hereby becomes a part
of the official transcript of the Council proceedings on September 15, 1976.
H-2: CM Attorney's Report
(a) PEP Suit - the City's offer was conveyed to the State, however, they have not
responded as of this date.
(b) Kenai Property Owner's Association Suit - Judge did remand properties owned by
21 persons back to the Council for reassessment and dismissed the others who did
not submit an objection either orally or in writing. City has eholve of either
appealing or reassessing the properties. City Attorney Williams requested that
this matter be taken up in an Executive Session

immediately into an Executive Session for consideration of the Kenai Property Owner's

RECONVENE
3 Mayor James Elson called the regular meeting of the Kenai City Council bacic to
order at 10: 20 p.m.
MOTION:
Councilman Whelan moved, seconded by Councilman Morgan, that the Council of
the City of Kenai accept the order remanding certain properties for reassessment
and direct the Attorney to petition the Court to rescind the order setting pre-trial

conference and to declare the order remanding the properties as final judgement
in the case and this be subject to procedural approval by the Attorney of record.
At this time, Councilman Ambarian wished to express as to the reason he would
vote against this motion in that it was his belief that this was not a fair and equitable
settlement of the situation wherein only certain property owners were named and
the remainder dismissed because they failed to submit their objections in writing
to the Court.
QUESTION:
Motion passed by roll call vote. Voting yes; Ackerly, Sweet, Morgan, Whelan,
and Elson. Voting no; Ambarian.
H -S: Mayor's Report

H-4: City Clerk's Report
City Clerk, Sue Peter, advised Council that Mrs. DeForest would be conducting
a tour of the new library facility for the City Manager on Thursday at 2: 00 p.m.
and any members of Council wishing to be in attendance were welcome to do so.
Also, Mrs. Peter reported that a .sample of the up -coming ballot was submitted to
members of Council and if any Council member had questions concerning the ballot
to please advise.
H-5: Finance Director's Report
Mr. Kinney advised that his report was included in the City Manager's Report
#l.
H-6: Planning & Zoning Commission's Report
Councilman Ambarian reported that the public hearing on the request for a
Conditional Use Permit for Kenai Baptist Temple was held and the request was
denied for the building• to be used as either a church or a school.
H-7: Kenai Peninsula Borouffh Assembly's Rem
Mayor Elson reported that among the items for consideration at the Assembly
meeting of September 7, 1976, was that the Assembly turned down Ord. 76-49,
an ordinance concerning rezoning within the City of Homer. Passed by the Assembly
were ordinances 76-50, amending KPB 16.04.040 to provide for public hearing outside
the boundaries of a proposed service area when facilities in the area are not adequate

to hold the public meeting; Ord. 76-52, an ordinance making a supplemental appropri-
ation for the insurance program for the Kenai Borough and Borough School District.
Ordinance 76-54. authorizing indebtedness by the issuance of General Obligation
Bonds in an amount not to exceed $20,645,000 for the purpose of constructing and
equipping several schools in the Borough was set for hearing. Mayor Elson also
advised that a Sales Tax Committee meeting was scheduled September 21 at 10 a.m.
at the Borough building.

Mr. Thornton expressed his gratitude to the Council for their action with regard
to the Kenai Property Owners Association.
I-2: Mr. Bob Jackson
Mr. Jackson also thanked Council for taking action with regard to the Kenai
Property Owners Suit and also stated that people joining together were effective.
I-3: Mrs. Vi Rimer
Mrs. Rimer, a member of the Kenai Property Owners Association, who did not
submit her objection and who was then not included in the 21 property owners
whose property would be reassessed asked Council if they would not do something
for these property owners as their property was unfairly assessed and should
also be re-evaluated without Court order. Mayor Elson stated that the Council
would not be able to make a comment with regard to this matter at this time.
EXECUTIVE SESSION
Mayor Elson suggested that Council hold an Executive Session to discuss travel
and moving expenses with new City Manager John Wise. Mr. Wise requested that
this be postponed until such time he had estimates and figures to present to Council.
ADJOURNMENT
There being no further business to be brought before the Council of the City of
Kenai, Alaska, Mayor Elson adjourned the meeting at 10: 40 p.m.

CITY MANAGER'S REPORT - #1
September 15, 1976
(ministration - Finance
Kenai Property Owners Association
Enclosed is a Position Paper relative to the Kenai Property Owners Association's
legal suit against the City pertinent to several Assessment Districts. This
Position Paper, inasmuch as it relates to a lawsuit, should be considered
confidential and the matter. should be discussed in an Executive Session.
Insurance
You will find also as an enclosure a report on various insurance policies of
the City as of this date. The important fact to recognize is that the City is
under -budgeted. for this type of activity. We will have to provide additional
funding so we may have adequate insurance coverage. At the next Council
meeting, we will have prepared a resolution for the transfer of funds.
Manager's Appointment - Resolution
I have placed on the agenda a resolution for formal appointment of myself
as City Manager. This, I believe, will legally provide the vehicle for
proper appointment and operation as City Manager. One item I would like
to discuss with Council, perhaps in an Executive Session, is the question
over movement of my household goods inasmuch as the cost will far exceed
the amount of money appropriated.
Depositories
On the agenda is a resolution to provide my name as an addition signature -
wise to the several depositories of the City.
Population Data
Relative to the State Revenue Sharing program, data we have worked up
Illustrates figures which are most beneficial to the City and it should be
certified by the Council. The additional information we need to submit the
State Revenue Sharing Application are roads now being worked up which we
must be very careful on to insure that these roads can be verified.
Bureau of Land Management
Representatives from the Bureau of Land Management were in the office

a reduced cost under a specified Federal program providing for Public or

in fact, being used for the purposes stated in the application. We are reviewing
the projects and will have a report for the Council and for the bureau of Land
Management, hopefully, by the next Council meeting.
3 7. Baptist Temple

Mr. Stock, representing the Baptist Temple, dropped in to the office and j
questioned whether or not the City might reconsider its denial of the Conditional
Use request if, in fact, the Temple had a contract to sell the property and building
in question to someone say perhaps in June of next year. Assuming that they
had a contract to sell it was deemed possible by myself that the Planning
Commission may well grant a temporary periodic use. j
S. Personnel Rules and Regulations
I have enclosed a Position Paper trying to eliminate some of the questions
that I have with reference to the Personnel Rules and Regulations. I would
request that a work session be held to provide the Administration with some
guidelines on these several questions.
9. ADAP Study
The consultants will be in Kenai on the 28th and 28th of September as well
as the FAA Planning Representative and we will review and proceed on the
initial design study. I plan to request an Advisory Commission meeting on the
night of the 28th to review the Consultant's plans and to provide input to the
consultant. Regretably, this is in conflict with the Chamber of Commerce
visit from Seattle and necessarily this is the only time we can expect the
f consultant to be available.
10. Kelifonft Subdivision
This subdivision final platting was reviewed by the Planning Commission
Thursday evening. I was present at that meeting and noticed that a 30 ft.
right -of --way was being recommend for approval for this particular tract.
In my thinking on the matter later I realized that we were accepting a 30'
right-of-way street on the presumption that at some future date the other 30'
adjacent tract would be dedicated to the City. This, I believe, is an erroneous
assumption in that the property could change hands, the development could
perhaps never occur and we would be stuck with a 30' right-of-way. I have
written the Borough requesting that a change be made in the plat requiring a
80' right-of-way at this time from within this final plat.

U. Senior Citizens Nutritional Meal Program
Administration has been briefed on the program -- we have some questions
as to implementation of same and we expect to have. the complete program pre-
pared for Council at the next regular meeting.
12. Land Sale Ordinance
The Land Sale Ordinance prepared by the Attorney for guidance as to the
development and conduct of land sales. This has a specific bearing on the
question, I believe, which has been active within the City on the foreclosure
of the Western Auto property. The point at hand being that foreclosed property
cannot be leased inasmuch as we do not have a final clear title. A question is
when the City takes the land for public use, which we have not yet done in this
case, could we then use it under an enterprise system as leasing it to a private
party. The Attorney is researching this particular matter and hopefully we
will have a legal opinion on this for this evening's meeting.

I. Forest Drive Water Line
Forest Drive Water Line has been complicated by the fact that the Borough is
also putting in on 5th Street a drainage line connecting the Sears Elementary
School with the existing drainage main. Both programs are proceeding adequately
however, there has been a problem in coordination between the two projects and
the school. At this time, we are proceeding extremely well on the water line
and presume the project will be completed in the not too distant future. Access
to the school is now open and will remain open with no further problems for
the school itself. The next problem of any significance will be when the tie is
made at Redoubt Avenue. At that time, we will again have to out the water off
for the western section of the City.
2. Senator Stevens' Telegram
As you have been advised Senator Stevens has informed the City by telegram
that EDA will provide the additional $86, 000 required for the water project and
that the EDA has agreed to drop the meter requirement.
3. Little Ski -Mo
There is a problem relating to sewer access to the Ski -Mo building being
constructed in the Gusty Subdivision. The problem is essentially is that we do
not have records as to where the sewer.line terminates and whether or not the
property now leasing has direct access to that line. Our records indicate that
the basic constructed line under City control terminated at Main Street mid -way

in the Tesoro lot. From thence, an extension was made up on Birch Avenue.
However, we have no record of who made the extension or how far it extends.

exactly what the nature of the problem is.
4. Water and Sewer Permit Schedule Ordinance
We asic that this ordinance be tabled at this time, preferably prior to the public
hearing. We are not satisfied as to the viability of the rate schedule or whether
or not we have identified all variety of rates that should be applied. Until we
can complete our analyzation it is best that the ordinance be tabled. Hopefully,
by the next meeting we shall have completed our study and have an acceptable
amendment prepared.
S. Public Employment Act
Application forms have been received and are being reviewed to determine our
requirements to comply with the Act. We are coordinating the unemployment data
with the Borough to insure that we have data which can be and will be certified
by the State. We are reviewing the cost estimates of the reservoir to insure
that we are providing sufficient requests for sufficient funds that will meet
Inspection and other administrative expenses as well as inflate the construction
costs due to the probable rise in construction costs.
6. Library
The Contractor is acting upon the list of deficiencies -- notably the steps and
other deficiencies within the building.
7. Dog Pound
Footings are.in and the slab to to be laid today.
S. Pre -construction conference with EDA and Contractors on the Well Project
We expect clearance by EDA this afternoon and should shortly be able to issue
the notice to proceed.
8. Water Outage
On Tuesday at the Well House, apparently a cover on our transformer"
was dislodged, presumably by the wind. It fell and made contact with the electric
terminals resulting in a short which caused a water outage. We were able to get
prompt response by Homer Electric and within an hour and a half, electricity
was restored and we started to re -build water pressure in the system.

KENAI PROPERTY OWNERS ASSOCIATION
The agenda carries the above organization as "Scheduled to be Heard". It is
presumed that they will speak in reference to the recent court decision limiting
the number of property owners who may obtain relief and directing the City to
insure the provisions of the City Charter are adhered to in limiting assessments
so as not to exceed 256 of thqi�property value.
We have analyzed the names listed and identified all applicable properties; on some
approximately 75 individual assessments. Using Borough assessment values, we
could meet objections by writing off some $16,610.81 on some 29 indivfdual billings.
Some of these 29 individual billings are clearly in excess of the 25% limitation.
Others with detail study could perhaps be reduced to a smaller sum. However, the
cost to the City to properly analyze these properties could be excessive for the
benefit gained.
What is interesting is the fact that the City has three ,.(3) assessment district
projects as yet unapproved to the tune of $121,000 which should be confirmed.
Currently the City is paying for these unconfirmed assessments.
Recommend:
1. Assessments be corrected on the 29 individual assessment
billings - re 25% limitation.
2. Assessment Districts W-3, W-4, and S-4 be confirmed subject to
verification of 25% limitation in the expected amount of $120, 000.

relative to Police and Fire, for whom basic rules should be established by the
Council and yet there's no delegation of authority to the Police or Fire Chief.

Mr. Phillip Aber, Acting City Manager, reported to Council that this transfer of
monies would facilitate the purchasing of proper materials and instalation of same
for heating and lighting equipment in the Warm Storage Facility. The estimated
cost would be $4,600.
Mayor Elson opened the meeting to the public so that they could be heard. There
was no comment from the public and the Mayor, therefore, returned the hearing
to the Council table.
MOTION:
Councilman Morgan moved, seconded by Councilman Whelan, for adoption of
Ordinance No. 308-76, an ordinance of the Council of the City of Kenai, transferring

Mr. Fisher came before Council to request the Council's consideration in utilizing
the Kenai Jail Facility to better serve the residents of the Kenai Peninsula. Mr. Fisher
further advised that the facility, could be leased to the Division of Corrections and
would, therefore, provide revenue to the City. Mr. Fisher reported that there was
no single jail on the Kenai Peninsula available for residents and members from our I
community have to be incarcerated in the Anchorage jail facility. Conditions are very i
poor in the Anchorage facility and being sent to Anchorage to serve out a sentence
can be very disruptive to theperson's employment ment and family life. Mr. Fisher
n
urged the City to prepare a resolution to be sent to the State and "bird dog the
- matter until arrangements could be made for the Division of Corrections to lease
the Kenai facility. Mr. Fisher stated he had investigated the matter and feels there
are funds available for
guard hire, etc. and that the Division of Corrections could
-- enter into an agreement with the City of Kenai.
Mayor Elson inquired as to the outcome of the Soldotna election -- Mr. Fisher advised
he felt that the Kenai facility would be used for theose individuals who had been
sentenced and the Soldotna facility for those placed under arrest (alcohol abusers,
etc.)
Mayor Elson stated that the City spent considerable time working out an agreement
with the Division of corrections last year and also felt that the Division of Corrections
would be reluctant to enter into another agreement as the facility was not used last
- - year.
Chief Richard Ross advised the Council that the Seward facility had recently
closed as they were faced with the some problems as Kenai -- the Seward facility
had been ordered to provide 24-hour guard service and they too do not have the
approximately $100,000 and the Division of Corrections found those figures quite
unacceptable as far as reimbursement to the City. Chief Ross further stated that H
the Division of Corrections approached the City to lease the facility for a nominal fee
' and they would assume all other responsibilities (guard, liability, etc. ) the City
might find this arrangement areeable. Councilman Morgan asked Chief Ross if he
felt that the City should make use of the facility, taking the cost factors into
consideration and Chief Ross replied that the cost factor, as in the case of the
Seward facility, did not appear to meet the Division of Correction's requirements
and also another factor to consider to that the Magistrate in Seward found the audio
surveillance not acceptable and that is all the City of Kenai has at this time.
~_ Mr. Fisher stated that he was fust requesting that the City urge the Division of

concept of the agreementmade last year with the Division of Corrections was that they
would man the facility and assume all responsibility. Chief Ross advised that yes this
was part of the agreement.
Councilman Morgan suggested that the City Attorney be directed to draw up such a
resolution urging the Division of Corrections to enter into an agreement with the City
and this resolution be ready for presentation at the next regular meeting of the
Council. There were no objections to Councilman Morgan's suggestion.
D. MINUTES
D -I- Minutes of the Regular Meeting of August 18, 1976
Mayor Elson requested that on page 11 under "City Attorney's Report" his
comments be included that the Mayor felt a settlement offer of this magnitude was
not in the best interest to the public (regarding PEP Suit) .
The minutes stood approved as corrected.
B-1: Chamber of Commerce
Mayor Elson advised that on September 28th, members of the Seattle Chamber of
--Commerce will be in Kenai and will host a cocktail party that evening -- members
of the Council are invited to attend.
8-2: Governor Jay Hammond
Mayor Elson advised that Governor Hammond had sent a copy of his views on
the North Slope Haul Road issue.
2-3: Alaska Municipal League
Mayor Elson advised that correspondence had been received from the Alaska
Municipal League thanking the City of Kenai for their assistance in hosting the
Board of Directors' meeting.
B-4: State of Alaska
Mayor EIson advised that a report on the Alaskan economy from the State of Alaska
was available at City Hall.
Mayor Elson reminded members of the Council that all the above correspondence
was on ffie in the Clerk's office and was available for their perusal.

Mr. Aber advised that all was in order to proceed with the signing of the
necessary documents for the Kenai Water Alain Project. Administration and the
Legal Department have reviewed the contracts and found everything in order.
Construction cost on the project will be $383,804.80. Councilman Morgan inquired
If the City had received approval from EDA to proceed with the increased cost of the
project. Mr. Aber advised that the situation was the same as explained at the last
meeting of the Council in that EDA had advised the City to proceed at its own risk
and EDA verification of increased funding, if received, will not be forthcoming until
sometime after two months or so.
MOTION:
Councilman Ambarian moved, seconded by Councilman Morgan, that the City of Kenai
enter into an agreement With Brown & Doyle Construction for a contract amount of
$383,804.80 for the construction of water mains.

Mr. Aber advised that Administration had reviewed this contract also and all bonds.

a contract for construction of a water well and aver -hauling of present well with
interstate Construction for a contract amount of $675,000.

F-3: Contract between City and PR&S - 10" Water Line Project -- Forest Drive
Mr. Aber advised,that all required documents (bonds, etc.) should be received by
the City no later than Thursday and as the State ha0 awarded the contract for the
paving of Forest Drive and want to start construction immediately, it would be well
to start construction of the 10" water line as soon as possible. Mr. Aber further
advised that he had talked with the State Division of Environmental Conservation
and they have approved the plans. The plans have been forwarded on for aid in
funding (50%) . At the completion of the project, the City must submit a certified
set of plans to DEC for their files so that aid in funding can be received.

Councilman Morgan stated he felt that if the project were held over until next ;
construction period, the cost increase would be only 30% and the additional time would
enable the City to form assessment districts, obtain funding, etc.
MOTION:
Councilman Ambartan moved, seconded by Councilman Ackerly, that the City, of Kenai
enter into a contract with PR&S, General Contractors, for the construction of a 10"
water line along Forest Drive in the amount of $81,933, contingent upon receipt of
contract and required bonds.
Councilman Whelan inquired if this project would "cure" the water problem suffered
In the Woodland area? Mr. Aber stated he feels it would alleviate the problem and
would have to be done eventually. Councilman Morgan advised he had talked with
Ed Hollier of the State Highway Department and it was Mr. RoMer'9 opinion that
the project of paving might not be done until next construction season as the equipment,
materials, etc. had not even been brought down to Kenai.
QUESTION:
Motion passed by roll call vote. Voting yes; Ambarian, Ackerly, Sweet, Whelan
and Elson. Voting no; Morgan.
Councilman Ambartan inquired if Council should direct Administration to investigate
the possibility of setting up an Assessment District. Mayor Elson stated he felt
Assessment Districts could not be set up at this late date but could assess the property
owners on the Sears Elementary side of Forest Drive if they wished to hook into the
system.

Mr. Aber advised that because of many citizen requests, the City is trying to j
eliminate all motorized vehicles on the pedestrian and bicycle path. The City will
purchase small signs to be posted in various points along the path.
Councilman Ambarian stated that first of all the City is talking about State property--

the State should then place the signs along the trail. Councilman Ambarian also
stated he disagreed with the fact that both pedestrians and bicycles used the same
path and disagreed with the fact that snow machines would not be allowed in the
winter months. Mayor Elson stated that in the original agreement with the State,
the project was to be constructed as both a bicycle and pedestrian path. Chief
Richard Ross stated it would be just as hard to catch snow machines and motorcycles
on the bicycle trail as on the highway, however, he would not be able to enforce any,
prohibition of motorized vehicles without this ordinance.

City Attorney, Janis Williams, advised the Council it has the authority to enact
a temporary regulation until the ordinance is up for public hearing to prohibit
the operation of motor vehicles on the bicycle trails in the interim period.

Councilman Morgan moved, seconded by Councilman Whelan, for adoption of
Resolution No. 76-47, a resolution of the City of Kenai, enacting a temporary
regulation providing penalties for the operation of motor vehicles on bicycle trails
in the City of Kenai.
Councilman Morgan stated he felt that the Kenai Police Department should use some
discretion in Issuing tickets until the public is fully aware of the new regulation.
Mayor Elson stated he would vote against adoption of Resolution 76-47 as the right
of public hearing for a regulation has not been exercised.

revising the schedule of rates for users connected to City water and sewer systems."
Mr. Aber advised that this ordinance amends Schedule H of Ordinance No. 266-75.
Previously, there had been a fiat fee of $400 each for hook up to the water and sewer
system. With the revision of Schedule H, Mr. Aber advised the fee would be broken

Mr. Ross Kinney, Finance Director, requested that a stipulation be made that
the Kenai Peninsula Community Care Center make the remainder of their lease payment
prior to the City giving our share of the contribution.

purpose of providing funds for the payment of Kenai Air Service invoice number 18898,
for the rental of a Bell 206-B helicopter used to search for a drowning victim in the
Kenai River August 23, 1976.
Mr. Aber advised that the rental of this helicopter was based primarily on flood lights
to aid boats searching for a drowning victim. After considerable Council discussion,
Councilman Sweet stated it was his opinion that the City should pay this statement

but should take steps in the future to insure that this type of expenditure has Dept. Head
approval. Councilman Morgan stated he felt that it was good that this step was taken as

Mayor Elson read Resolution No. 76-46, by title only as copies had been made available
to the public. "A resolution of the Council of the City of Kenai, Alaska, requesting
that the State of Alaska, Department of Highways, redesign and reconstruct the inter-
section of Kalifonsky Beach Road and the Warren Ames Memorial Bridge Access Road".
Mr. Aber advised that he had contacted the State Highway Department and they advised
that they would try to do something with the intersection this construction season
but at this point in time. no monies are available. The State did comment that they were
aware that it is a dangerous intersection and would place caution"lights but the State
II, s will not consider the intersection a "hazard" as they would then be held liable if
it were declared a "hazardous intersection".

Mr. Aber reported that this contract was drawn up as Lt. Mahurin had been selected
to attend a three month course at the F.B.I. Academy beginning October 3, 1976 and
ending December 16, 1976. During his attendance at the course, the City will continue
to pay Lt. Mahurin his regular monthly salary subject to certain conditions as outlined
in the contract.

enter into an agreement with Lt. Marshall Mahurin subject to the conditions outlined
in the contract.

Mr. Aber advised the Council that this transfer in the amount of $5,796 from Animal

Mr. Aber advised that the next to inial inspection had been held last Friday and
thus the retainage would be reduced from 10% to 5%. Councilman Ambarlan questioned
the slope on the entry steps and stated he felt someone may fall as they appeared
hazardous. Also, Councilman Ambarian stated he believed that there was still some
question on the finish of the wood doors on the inside. Mrs. DeForest advised that
the architect was very displeased with the finish also and will get back to the City
with regard to this matter.

H L City Report
(a) Surplus or obsolete materials - Mr. Aber requested the Council declare 400 landing
mats as City owned surplus or obsolete materials so that the City could proceed
with the sale at $5 a mat two the Kenai Peninsula Borough and a contractor out of
Anchorage. Mayor Elson stated due to past information on value of the mats he felt
that the market value would be around $8-12 per mat and suggested the City go out
to competitive bid to establish a price on them.
MOTION:
Councilman Ambarian moved, seconded by Councilman Ackerly, that the City declare
500 landing mats as surplus and obsolete and that they be sold on competitive bid.

MAYOR AND COUNCIL - QUESTIONS AND COMMENTS
Councilman Whelan asked Administration if they had looked into two existing leases
he had questioned previously and Mr. Kinney reported that he had looked into
the leases and determined that all leases with the renegotiated lease rates would have
to be re-recorded. One of the parcels in question (where Western Auto is located)
was picked up by the City on a foreclosure and also needs determination as to status.
Mr. Aber reported that the City owned land along the front of the bank should also
be investigated as to the entire strip along the highway -- the bank had inquired as
to leasing this strip in front of their building for parking but were hesitant when
advised of the lease rate. Mr. Aber further reported he felt that the City would have
to have this area surveyed. Councilman !Morgan stated he felt that it would be
beneficial to the City to have it surveyed and offer it up for sale with other lands
owned by the City at an auction.

Councilman Ambarian inquired on the status of the City trading sand for gravel
with local contractors -- Mr. Aber advised that no additional materials had been
removed thus far.
Councilman Ackerly asked the status on the Lighting Agreement with the State of
Alaska and Mr. Kinney advised that unless the City signs the last three agreements,
the State will not pay the billing on the utilities.
H-2: City Attornev's Report
(a) Tidelands - City Attorney, Janis Williams, reported that she had talked with the
Division of Lands and that a decision has not been released with regard to the protest
issued last January - the staff of the Division of Lands feel that a rejection of the
protest will be forthcoming from the Director's office. The protestant can then appeal
to the Commissioner of Natural Resources and from their onto Court if he so wishes.
(b) Land Sale Ordinance - City Attorney Williams advised that she has just about completed
a draft of a land sale ordinance and will present it at the next meeting of the Council.
(c) The Kenai Planning h Zoning Commission has requested that the Legal Department
file a complaint against the Kenai Bible Temple as they are in violation of the zoning
ordinance and have riot ceased operation until a decision is rendered by the Commission
at the public hearing to be held september 8, 1976.
H-3: Mavor's Report
Mayor Elson stated he needed a decision from Council as to whether or not they
wished to fill the vacancy on Council. It was the unanimous decision of Council
not to fill vacancy at this time and wait for the election to be held in October .

Mayor Elson requested Council concurrence in that Mr. Kinney has been representing -
the City at Sales Tax meetings and the Coastal Zone Management meetings and was
somewhat apprehensive as to representing the City of Kenai while presenting his
views. The Council unanimously felt that Mr. Kinney's presence at these meetings
were an asset to the City and directed him to act as representative of the City

WHEREAS, the State of Alaska has provided bicycle trails within the City of Kenai.
WHEREAS, such trails are intended to be used by bicycles and pedestrians only, and

AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA ESTABLISHING
PROCEDURES FOR THE SALE OF CITY -OWNED LANDS.
WHEREAS, the Code of the City of Kenai at present contains no provisions relating
to the sale of real property by the City, and
WHEREAS, the Council desires to establish procedures for the sale of City -owned
lands.
NOW, THEREFORE. -BE IT ORDAINED by the Council of the City of Kenai. Alaska,
as follows:
That the Code of the City of Kenai is hereby amended by adding to
Chapter 20, Lands, a new Article IV which shall read in its entirety
as follows:
ARTICLE IV
SALE OF CITY-OIVNED LANDS
Section 1: Power to dispose of real property.
The City may sell, oonvey, exchange, transfer, donate
dedicate, direct or assign to use, or otherwise dispose of City -owned
real property, including property acquired or held for or devoted to
a public use, only in accordance with this Article. Disposal or sale
of lands shall be made only when, in the judgment of the City Council,
such lands are no longer required for municipal purposes.
Section 2: Sale or disposal -- Form
The City may sell or dispose of real property by warranty or
quit claim deed, easement, grant, permit, license, deed of trust, mortgage
contract of sale of real property, plat dedication, lease, tax deed, will or
any other lawful method or mode of conveyance or grant. Any instrument
requiring execution by the City shall be signed by the City Manager and
attested by the City Cierk. The form of any instrument shall be approved
by the City Attorney.
Section 3: Public Sale -- Required When
Unless otherwise provided in this chapter, real property
no longer used or useful for a public use or purpose shall be sold to the
highest responsible bidder at a public sale. Public sale shall be by
auction or competitive bid.

Section 4: Public sale procedure
. Real property of the City, except as provided otherwise
in this chapter, shall be sold or otherwise permanently disposed of as
follows:
A. An estimated value of the property by a qualified
appraiser or the Borough Assessor shall be made.
B. The following procedure shall be followed:

not required H special circumstances, as determined by the Council,
warrant, or H such a Planning Commission review and recommendation
Me been made within six months prior to submission to the Council:
1. The parcels of land to be sold shall be reviewed by
the Planning Commission which shall make recommendations concerning
desirable uses of the property, including projected need, if any, of the
land for present or future recreational or other public use.
2. After review of the Planning Commission's recommendations,
the City Manager may, 9 in his opinion it is in the best interests of the City
to do so, recommend to the Council that such parcels of land be sold. Such
recommendation shall set out the estimated value of the property as made
by the Borough Assessor or a qualified appraiser and the recommended
terms and conditions of sale. . .
3. After receipt of the recommendations, the Council may,
by resolution, direct the sale of such lands. Such resolutions
shall not be passed until opportunity for public hearing has been afforded.
4. Notice of sale and the manner in which the land is to be
sold shall be published in a newspaper of general circulation within the
City once each week for two successive weeks not less than thirty days
prior to the date of sale.
S. Notice also shall be posted in at least three public places
within the City and Borough for at least thirty (30) days prior to the disposal.
6. Notice may also be given by other means considered reasonable
by the City Manager or Council.
7. The notice must contain a brief description of the land,
Us area and general location, term, minimum offer. limitations, if any,
and time and place set for the auction or bid opening H applicable.

B. The procedure for sale shall be in the manner provided
by resolution of the Council.
9. In cases in which no offers meet the minimum acceptable
offer as set by the Council, the City Manager may negotiate for the sale of
the land, but the Council must, by resolution, approve the terms and price
of any such negotiated sale before such sale shall be binding upon the
City.
Section 5. Parcels held for public use
In cases in which land proposed for sale has been acquired
or devoted or dedicated to public use, the resolution of the City Council
directing sale shall contain a section stating the date of acquisition of
the property, if applicable, the purpose for which the property was acquired
or the use to which it was dedicated or devoted and the reasons why, in
the judgment of the Council, the property is no longer needed for public
use.
Section 6. Tax Foreclosure Parcels
Any real property acquired by tax foreclosure and not held
for immediate public use in accordance with applicable statute shall be sold
In accordance with the procedure set out in Section 4 hereof.
Section T. Property exchanges
The Council may approve, by resolution, after public
- notice and an opportunity for public hearing, the cpnveyance and exchange
of a parcel of City property owned by another person subject to such conditions
as Council may impose on the exchange, whenever in the judgment of the
City Council it to advantageous to the City to make the property exchange.
Section 8. Grant or Devotion to Governmental Agencies
The Council, by resolution, may grant or devote real property
no longer needed for public purpose to the United States, the State of Alaska,
a local subdivision, or any agency of any of these governments, for a con-
- sideration agreed upon between the City and Grantee without a public sale
If the grant or devotion is advantageous to the City.

AN ORDINANCE OF THE CITY OF KENAI, ALASKA, AMENDING THE CODE OF THE CITY OF
KENAI TO PROVIDE PENALTIES FOR OPERATION OF MOTOR VEHICLES ON BICYCLE TRAILS
WITHIN THE CITY OF KENAI.
WHEREAS. the State of Alaska has provided bicycle trails within the City of Kenai,
WHEREAS, such trails are intended to be used by bicycles and pedestrians only, and
WHEREAS, motorized vehicles are currently being operated on such trails and creating
a hazard to bicycles and pedestrians. and
WHEREAS, it is in the interests of the public health, safety and welfare to immediately
prohibit the operation of motor vehicles on bicycle trails;
NOW, THEREFORE. BE IT ORDAINED by the Council of the City of Kenai. Alaska, as
follows:
Section 9-5 of the Code of the City of Kenai is hereby re-enacted to read in it
entirety as follows:
A person who operates a motorized vehicle on a path or trail specifically
designed and designated for bicycles or posted with signs prohibiting
motorized vehicles shall be guilty of a misdemeanor and upon conviction shall be
punishable by a fine not to exceed $300.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA ESTABLISHING
PROCEDURES FOR THE SALE OF CITY -OWNED LANDS.
WHEREAS, the Code of the City of Kenai at present contains no provisions relating
to the sale of real property by the City, and

WHEREAS, the Council desires to establish procedures for the sale of City -owned .
lands.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Kenai, Alaska,
as follows:
That the Code of the City of Kenai is hereby amended by adding to
Chapter 20, Lands, a new Article IV which shall read in its entirety
as follows
ARTICLE IV
SALE OF CITY -OWNED LANDS
Section 1: Power to dispose of real property.
The City may sell, convey, exchange, transfer, donate
dedicate, direct or assign to use, or otherwise dispose of City -owned
real property, including property acquired or held for or devoted to ,
a public use, only in accordance with this Article. Disposal or sale
of lands shall be made only when, in the judgment of the City Council,
such lands are no longer required for municipal purposes.
Section 2: Sale or disposal -- Form
The City may sell or dispose of real property, by warranty or
quitclaim deed, easement, grant, permit, license, deed of trust, mortgage
oonhcact of sale of real property, plat dedication, lease, tax deed, will or
any other lawful method or mode of conveyance or grant. Any instrument
requiring execution by the City shall be signed by the City Manager and
attested by the City Clerk. The form of any instrument shall be approved
by the City Attorney.
Section 3: Public Sale -- Required When
Unless otherwise provided in this chapter, real property
no longer used or useful for a public use or purpose shall be sold to the
highest responsible bidder at a public sale. Public sale shall be by
auction or competitive bid.

warrant, or U such a Planning Commission review and recommendation
has been made within six months prior to submission to the Council:
1. The parcels of land to be sold shall be reviewed by
the Planning Commission which shall make recommendations concerning
desirable uses of the property, including projected need, if any, of the
land for present or future recreational or other public use.
2. After review of the Planning Commission's recommendations,
the City Manager may, if in his opinion it is in the best interests of the City
to do so, recommend to the Council that such parcels of land be sold. Such
recommendation shall set out the estimated value of the property as made
by the Borough Assessor or a qualified appraiser and the recommended
terms and conditions of sale.
3. After receipt of the recommendations, the Council may,
by resolution, direct the sale of such lands: Such resolutions
shall not be passed until opportunity for public hearing has been afforded.
4. Notice of sale and the manner in which the land is to be
sold shall be published in a newspaper of general circulation within the
City once each week for two successive weeks not less than thirty days
prior to the date of sale.
S. Notice also shall be posted in at least three public places
within the City and Borough for at least thirty (30) days prior to the disposal.
6. Notice may also be given by other means considered reasonable
by the City Manager or Council.
7. The notice must contain a brief description of the land,
Its area and general location, term, minimum offer, limitations. H any,
and time and place set for the auction or bid opening H applicable.

S. The procedure for sale shall be in the manner provided
by resolution of the Council.
9. In cases in which no offers meet the minimum acceptable
offer as set by the Council, the City Manager may negotiate for the sale of
the land, but the Council must, by resolution, approve the terms and price
of any such negotiated sale before such sale shall be binding upon the
City.
Section 5. Parcels held for public use
In cases in which land proposed for sale has been acquired
or devoted or dedicated to public use, the resolution of the City Council
directing sale shall contain a section stating the date of acquisition of
the property, If applicable, the purpose for which the property was acquired
or the use to which it was dedicated or devoted and the reasons why, in
the judgment of the Council, the property is no longer needed for public
use,
Section 6. Tax Foreclosure Parcels
Any real property acquired by tax foreclosure and not held
for immediate public use in accordance with applicable statute shall be sold
In accordance with the procedure set out in Section 4 hereof.
Section 7. Property exchanges
The Council may approve, by resolution, after public
notice and an opportunity for public hearing, the conveyance and exchange
of a parcel of City property owned by another person subject to such conditions
as Council may impose on the exchange, whenever in the judgment of the
City Council it is advantageous to the City to make the property exchange.
Section 8. Grant or Devotion to Governmental Agencies
The Council, by resolution, may grant or devote real property
no longer needed for public purpose to the United States, the State of Alaska,
a local subdivision, or any agency of any of these governments, for a con-
sideration agreed upon between the City and Grantee without a public sale

A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, REQUESTING
THAT THE DIVISION OF CORRECTIONS, STATE OF ALASKA, IMMEDIATELY LEASE
AND STAFF THE CITY OF KENAI JAIL FACILITY.
WHEREAS, there is presently no jail facility on the Kenai Peninsula in which Peninsula
residents can serve jail sentences handed down by courts in the area, and
WHEREAS, it is in the interests of the citizens of the City of Kenai and of the surrounding
area that there be a facility in the Kenai area in which sentences may be served, pard-
cularly short-term and work release sentences, and where prisoners may have local
counsel immediately available, and
WHEREAS, the City of Kenai has an excellent jail facility which is almost unused at
the present time, and
WHEREAS, the City of Kenai, for the mutual benefit of the State, the City and the
citizens of this area U willing to lease its jail facility for use as a State facility.
NOW. THEREFORE, BE IT RESOLVED by the Council of the City of Kenai, Alaska,
that the Division of Correetions of the Department of Health and Sodas Services of
the State of Alaska is hereby urged to Immediately lease and staff the City of Kenai
Jail facility for short-term custody of prisoners on the Kenai Peninsula.

Section 6. Tax Foreclosure Parcels
Any real property deeded to the City through tax
foreclosure shall be disposed of by one of the following
I procedures:
A. If the council determines that the property is
needed for immediate public use, the council shall

Magic Numbers: 10-15--111--and 10 again paid off in prizes at the
party given at the Kenai Community Library for Simmer Reading Program
participants an July 17.
The Magic Numbers of 10 and 15 entitled readers of that many books to a
Certificate or a Certificate and book award. Of the 105 children who
enrolled in the program, 62 received certificates and 46 also received

Over-all Best Reader was Sherri Hanson with 111 books read on her level.
Rnaners up were Lorri Booker and Judy Donald. Winner of the Mayor's
Prize for Diversified Reading, with a total of books read in 10 different
categories, vas Melanie Mahuria. Rtmner--up was Cathy Shaw.
A special award for Most Patriotic Reader was given, in this Bicenteantal
Year, to Daryl Morris, who read the most books on the history of our
couatsp.
Other prize vinners were: &-year olds: Sherri Hanson, Diane Harris,
Tram Ana McGraw, Shelley Waldron, and Brad Oldemeyer.
7 year olds: Kathleen Bryson, Eve Barris, DamW Chase, Alaaaa Malone,
