Commission Chair Twait called the meeting to order at 7:00 p.m.

6. PUBLIC HEARINGS:
a. PZ17-09 - Application for an Encroachment Permit to recognize an encroachment into the
side yard setback for an existing two story single-family residence. The residence was
constructed at a distance of approximately 13.8 feet from the side property line where 15
feet is required. The property is located at 1300 Channel Way; and further described as
Lot 11, Block 9, Inlet Woods Subdivision Part One. The Application was submitted by
Jason Followell, 1300 Channel Way, Kenai Alaska 99611.
City Planner Kelley reviewed his staff report provided in the packet noting staff found that the
applicant met the criteria for issuance of an Encroachment Permit pursuant to Kenai Municipal
Code and recommended the permit be approved with the following conditions:
• Applicant must comply with all Federal State, and local regulations.
MOTION:
Commissioner Springer MOVED to approve Resolution No. PZ17-09 and Commissioner
Peterson SECONDED the motion.
Commission Chair Twait opened the public hearing.
Jason Followell noted he built the residence himself, was in the process of selling the home, and
noted the former building inspector had measured the footer with a tape measure and didn’t think
the distance between the wall and side yard setback would be a problem; further noted the way
the surveyor measured found the encroachment.
There being no one wishing to speak, public hearing was closed.
It was clarified the Encroachment Permit satisfied financial institutions for lending and title
purposes; code allowed one foot or less to be approved administratively.
Commissioners Springer and Greenberg provided insight on their experiences related to the
difficulty for inspectors to determine distance without surveying as dirt piles and holes prevented
accurate measurement.

Commissioner Askin questioned whether it was good practice to charge people for Encroachment
Permits when they attempted on good faith.
Commissioner Halstead reiterated Commissioner Askin’s concerns.
Commissioner Fikes thanked staff for their work and clarifications on the permit.
Commissioner Chair Twait noted it is the homeowner’s responsibility to comply with the
regulations.

ANALYSIS
The subject plat includes three parcels located within the boundary of Government
Lot 13, Section 33, Township 6 North, Range 11 West. The parcel addressed as
708 Aliak Dr. (Kenai Borough Parcel No. 04503011) is approximately 2.05 acres
in size, hereinafter referred to as Parcel One. The parcel addressed as 409
Cinderella St. (Kenai Borough Parcel No. 04503009) is approximately .22 acres,
hereinafter referred to as Parcel Two. Finally, the parcel addressed as 411
Cinderella St. (Kenai Borough Parcel No. 04503012) is also approximately .22
acres, hereinafter referred to as Parcel Three. The applicant desires to remove the
property lines between Parcel One and Parcel Two, which would result in the
creation of a lot approximately 1.790 acres in size and described as Lot 13A,
Soares Subdivision. The subject property is in the Rural Residential-1 (RR1) zone.
The proposed Lot 13A meets the minimum lot size requirement of 20,000 square
feet. Parcel Three is approximately 9,583 square feet and does not meet the
minimum lot size requirement; therefore, this parcel is considered a non-
conforming lot.

Access to the proposed lot will be from Cinderella St. which is a City maintained
gravel road. The east half of Cinderella St. was dedicated in 1981 when the plat of
Sonberg Subdivision was finalized. The City will require that the west half of
Cinderella St. be dedicated by the plat of Soares Subdivision. East Aliak Drive lies
to the North of subject property. Half of the right-of-way of East Aliak Drive was
dedicated in 1987 when the plat of Thumblina Subdivision was finalized. The City
will require that the North fifty feet (50’) of the proposed Lot 13A be dedicated for
the right-of-way of East Aliak Dr. by the plat of Soares Subdivision.
The connections for City water and sewer lines lie within Parcel Two. The applicant
would like to connect to those services; however, the water and sewer lines would
cross the existing property line between Parcel One and Two. The vacation of the
property lines between the two parcels will alleviate a potential problem of having
the water and sewer lines on Parcel Two providing service to Parcel One. An
installation agreement is not required.
Planning Administration has spoken to the surveyor, Johnson Surveying,
regarding Parcel Three. The surveyor has indicated that Parcel Three is not a part
of the plat of Soares Subdivision; however, it is the opinion of the Planning
Administration that the plat encompasses all of Government Lot 13, including
Parcel Three and the rights-of-way for Cinderella St. and East Aliak Dr.
The North fifty feet (50’) and East thirty-three feet (33’) of Government Lot 13, were
reserved for rights-of-way for roadway and public utilities purposes by Patent
Number 1224517. Accordingly, the plat should reflect that the entire North fifty feet
(50’) is being dedicated as right-of-way for East Aliak Dr. and the East thirty-three
(33’) feet is being dedicated as right-of-way for Cinderella Street. The solid lines
encompassing the notation “50’ BLM ROW easement” should be removed from
the plat, as it appears that this would not be a property line. The Northern property
line of proposed lot 13A should be shown along the Southern dashed line of the
fifty foot (50’) BLM right-of-way easement.
RECOMMENDATIONS
Staff recommends that the Planning and Zoning Commission approve Resolution
PZ17-11, with the following conditions:
a. Further development of the property shall conform to all Federal, State and
local regulations.
b. Signature lines and notary acknowledgements should be added to the plat
for the signatures of Frank and Sherian Soares; and Ernest H. and Rhonda
L. Hunt.
c. Notations should be added to the plat to indicate that the right-of ways for
East Aliak Drive and Cinderella Street are being dedicated by the plat.
d. The utility easements as referenced in the plat notes should be delineated
on the plat.

e. Remove solid lines encompassing the notation “50’ BLM ROW easement”
from the plat, as it appears that this would not be a property line. The
Northern property line of proposed lot 13A should be shown along the

f. Parcel Two is included in the plat and should be labeled accordingly (i.e.
Lot 13B).
g. The Certificate of Survey block should be added to the plat.
h. The name of Cinderella Lane should be changed to Cinderella Street.
i. A building permit will not be issued until such time as the plat is recorded
vacating the property lines between Parcel One and Two.
j. A water and sewer permit will not be issued until such time as the plat is
recorded vacating the property lines between Parcel One and Two.

SUBDIVISION PLAT
A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI RECOMMENDING THAT THE ATTACHED SUBDIVISION PLAT BE APPROVED
SUBJECT TO THE FOLLOWING CONDITIONS:
WHEREAS, the attached plat of SOARES SUBDIVISION was referred to the City of Kenai
Planning and Zoning Commission on May 10, 2017, and received from Johnson
Surveying; and,
WHEREAS, the City of Kenai Planning and Zoning Commission finds:
1. Plat area is zoned Suburban Residential and therefore subject to said zone conditions.
2. Plat does not subdivide property within a public improvement district subject to special
assessments. There is not a delinquency amount owed to the City of Kenai for the
referenced property.
3. Installation agreement or construction of improvements is not required.
4. Status of surrounding land is shown.
5. Utility easements, if required, shall be shown.
6. Surveyor shall verify that no encroachments exist. If an encroachment exists; the plat
does not create nor increase the encroachment.
7. Street names designated on the plat are not correct; Cinderella Lane should be
changed to Cinderella Street.
8. CONDITIONS:

SUBJECT: Kee’s Tern Subdivision Time Extension
The surveyor for Kee’s Tern Subdivsion has requested a two-year time extension for the subject
subdivision. The preliminary plat was approved by Planning and Zoning Commission in 2013
and subsequenlty approved by the Kenai Peninsula Borough (KPB) in 2014 with an expiration
date of February 10, 2015. On February 2, 2015 a one-year time extension was approved by
the KPB extending preliminary approval to May 12, 2016. On May 9, 2016 the surveryor
submitted a request to the KPB for an additional one-year time extension and that the subdivsion
would be recorded in phases. On April 24, 2017 the surveryor submitted a two-year time
extension request which would extend preliminary approval until June 12, 2019.
Due to the extension request being two-years, the Kenai Peninsula Brough has requested
concurrence from the City of Kenai Planning and Zoning Commission that the extension be
granted. Staff would like to request approval from the Planning and Zoning Commission to send
a letter to Kenai Penisnula Borough of a non-objection to the two-year time extension request.
