Dus to - this fact, extra er.cavating was done trying to locate it. ~ When it coul~3n't be found,a cesspool had to be put in. --- i When the sewer hook-up became available ,I had to ~o back ~ ~ and hook up 'the facilfties to it. The people ot the North Kenai area have expressed that the Citq ei Henai caaaot offer aay servfces to them tt~at wauld be beneficial and justifq the additlonal tax burde~a. Upon receipt of this Motion I contacted Robert Baker, the attorney for Filler, and explained to him that the City, iP it were required to put up a super- sedeas bond, would, upon a reversal, seek to have the cost oP such a supersedeas bond, whiah I understand ~aould probably require a cash collateral oY some sort, to avoid the payment of the Judgaent. Mr. Baker SnPormed me that he would look 3ntQ the matter in view of the exposure, and if he believed that it would be a cost an appeal and create exposure to his client, he - would not requlre a supersedeas bond. I am in receipt oP a letter dated December 5, 1975, Sn ~hich he stated he intended to go ahead with his Motion to Campel Payment of JudBaent unless the City submits a satisfactory supersedeas bond. 2 discussed this matter with him more fully, and he stated that he had contacted the Clerk of the Supreme Court and Robert Eastaugh, whc does quite a bit oP appellate work, and ao one has heard of the Supreme Court awarding cos~s for~ a supersedeas bond. Of course, no one had heard of a~y- one making such an application for such costs. I have a cammitment from Mr. Baker not to proceed with his Motion until after December 3~, 1975. The City will have until that time in which to post a supersedeas bond. In viera of the magni- tude of the Jud~aent, Z doubt iP the Citq would be interested in posting a cash bond. I know in the past that bonding companies norma.lly do require a cash collateral bePore posting a bond, and I do not know how Ienient the bonding company --~} would be with the City of Kenai. ~ . Could you please advise me as to how qou wish to proceed in respect to the supersedeas bond.
