B 1: Transfer of Beverage Dispensary License for the Pre-Flight Lounge
Mr. Lqnn edvised that the City had contacted the Borough Tax Collector's
oi8ce and had been advised that all taxes were paid and current for
~ the Pre-Fiight Lounge. Administration, therefore, recommended sppravai
oi the tranater of beverage dfspensarq license.
Mayor Elson opened the meeting to a public hearing -- there being no eomment
trom the public. Mayor Elson returned the meeting to the Councii table.
MOTION:
Councilmaa Ambariaa moved ~ seconded by Couneilman 3weet, for the
approval of the transfer oi a beverage dispensary Iieense for the Pre-
Flight Lounge.

B-2s Permission to remodel premises for the Ratmai Motel
Mr. Lynn advised that the Borough Tax Collector's office reported that
there was some diecrepancy in the Katueai's persoaal propertq tazes as
filed and that the matter was atill under investigation . Administration
would theretore recommend that Council request a"hold" be placed on
the Alcoholie Beverage Control Board granting the Katmai's request for
~ , permission to remodel premises.
Maqor Elson opened the meeting to a public hearing -- there being no comment
from the public, Maqor Elson returned the meeting to the Council table.

Councilman Ambarian moved, seconded bq Councilman Hudson, for the
approval of the request for permission to remodel premises for the
Ratmai Motel pending resolution of the investigation of the Iisimai's
personal property taxes as Sled with the Kenai Peniasula Borough.
Motion passed unani~nouslq by roll call vote.
C. PBBSON$ PRESENT SCHEDULED TO BE HEA~iD
C-1: Mr. Robert Peterkin - Peninsula Oil~:rs
- Mr. Peterkin, represenWig the Peninsule Oilers, reported to the Council
that at the present tlme, the Peninsula Oilers did not have a park to open
their 197? season. Mr. Peterkin presented maps and charts to the Council
depicting the area, known as Lot 4, 3ection 3, TSN, R11W, SM, as a
suitable location for the Oflers ball field. Mr. Peterkin further stated that
the proposed plan included building a access road, two parking areas, bleachers,
baseball diamond and future development of Little League fields. The site
location ia close to town and thie parcel of land is also bordering Citq ~
water and sewer . Mr . Peterkin stated that the Oilers would like to get
some type of 2ease from the Citq. preferably long-term, in order that ~

~ permanent ts-pe structures could be constructed tsuch as rest rooms,
...~ enaek bar, club house, etc .). Mr. Peterkin added that it was the intent x
. ot the Oilers to work some tqpe of agreernent with the City so that in the ~
eneat the lease was terminated for one reason or another (the club disbanding, etc.) ~
the facilities could be turned over to the City for the City's use.

Councilman 3weet ssked Mr. Peterkin what the distance was from the main x
road to the bluff and was advised that it was 800' to 1.000' . Councllman 3weet ~
further 3nquired as to the reasoning behind the split parking areas and was ~
edvised that the Oilers were hopeful to cut down on traffic congestion and this ~
tqpe of plan would alleviate the "bottle neck" situation which 3s created bq the ,
large amouat of vehfcles in attendance at the Oiler's garnes. ~.
Mayor Elson thanked Mr. Peterkin for his presentatfon and felt it was well
developed, h~owener, the procedure to follow bq the Oilers would be fill
out an application to lease City owned lands (obtained at Citq Aall) and
present the application and development plan to the I{enai Planning Commission.
Upon recommendatian from the Planning Commission, will be forwarded on to
the Counefl for ~nal review .

"" Mayor ~lson reported that both he and the Citq Attorneq met wfth Borough
Ofifeials and extensively reviewed the matter of the regulation of extrectfon
ot natura~l resources. The area ot digfcultq appeared in the matter of
the guaraatees .
Mayor Elson further rPported that it was discussed that if the Developer
were to file a developrnent plan, the City would monitor the operatton of the
pit and be able to regulate it in that manner. The Borough Maqor did
_ request additional public input and Mayor Elson stated he would like to
faeilitate the matter so that the orditiance eould be introduced at the next
meetitig of the Borough Assembly. This would mean the amended resolution
would be presented to the Renai Planning Commission at their meeting of
denuarsr 28th end then the proposed ordiuance introduced at the meeting
of the Borough end then the Citq Council hold a public hearing on the
~ regulatlon oYNatural Itesources at their meetiag on February 4th.
~ Councilraan 114organ asked the Citq Attorneq as to the reason that the
, guarantees ha8 been dropped and was advised that the Borough officfats
were not in tavor of the guarantees as proposed and stated that if the
City were to monitor the extraction ot naturai resources closelq theq would
~ be able to catch the violatfons end levy the fines against the operators and/or
revoke their permits to operate.
Couttcilman Morgan also inqvired as to what would protect the City in the
matter of sltort term operations such as an operator work the pit for
six weeks and then leave the area. City Attorney Williams advised that
the City would require that the bovndaries of the proposed excavation at
it greatest dimensions, irtcluding back siopes, would be at least 200 teet
irom any road or any publfc right-of-way and at leaet 150 feet from other
surrounding propertq lines. The butfer strips between the excavation
site aud roadways and propertq lines would be required to contain sufficient
aatural screening to obscure the entire excavation from sight of roadwaqs and
inhabited areas. Also, the Ordinance required certain reclamation as the
operator proceeds with the extrscHon of the natural resources.
Maqor Elson stated that in a one shot situation such as Councilnian Morgan
inquired about. the Planning ~ Zoning Commission, upon receipt ot the
application, could be verq stringent concernfng the requirements -- the
Cammissfon would be able to f udge how long theq will be monitoring at the
time the development plan is submitted bq the operator.
Maqor Elson stated that in his opinion, if the guarantees remain in the
~ proposed resolution, the Citq will not get a recommendatlon from the
Borough Adininietration as they feel the guarantees are not legat.

or input from the Council.
Councilman 3weet inquired as to why this matter required public hearing
before the Borough and Citq and Mayor Elson advised that as there had been
so much public interest, the Borough felt it best to get as much input as
possible.
Counciunan 3weet asked what time factor would be im-olved and Mayor
Blson etated he felt the matter should be finalized by the last ta~g in
Mareh.
Ca~uncilman Ambarian stated in hia opinion as this matter had been on-going
tor almost one year and there has been much involvement irom the public
(public heariugs, etc. ) Councflman Ambarian felt all that was needed was ;
to schedule a work session and work on the proposed resolutfosi to be `
preseated to the Bosough. +

j Councilman Hudson suggested that perhaps the Ordinance could be
, introduced at the next meeting of the Borough Assembly and the City
could hold a public heariag the following evening at the Council in order
to expedite the matter.

~ Mayor Elscn asked for Council wishes regarding holding a public heariag
~ and added that he felt this would be necessarq in order to comply with
Boraugh wishea. Councilman Hudson agreed in that the resolution would
receive a better reception at the Sorough for passage as an ordiaance.
Co+uacilman Sweet inquired as to the process -- Mayor Elson advised tlsat
the City is merely suggesting that the Aorough consider the resolution
when writing up the Ordineuce for e~ctraction of nah~ral resouraes.

Councilraaa Morgan moved, seconded by Councilman Ambarian, that the
Henai Citq Council hold a public hearing on the extraction of natural
resources at the Council meeting of February 4. 1976.

At this tlme. Mr. Jarnes E. Fisher, represetrting ~14r. Chester Cone, asked
for periaisaion to speak beYore the CounMl. With Co~ncil oonsent, Maqor
Elson granted the request. Mr. Fisher stated in that Mr. Cane hae a pendiag
application for the extraction of natural resources and in tha2 the
proposed amendments to Resolut~on No. ?5-54 do not appear to be much
di~erent~ is there a poasibilitq that the Council will act upun Mr. Cone's
~ application now ~vhile they ~tre consfdering the subject. Maqor E2son
advised Mr. Fisher that he personaUq would like to see Yhe Borough
enact the Ordinance first. however, if Mr. Cone wished riis application

Mr. Lqnn advised the Council that these were the routine bills for
Ca~ncil consideration and recomtaended approval -- all items are budgeted.
Couruilman Ambarien inquired with regard to the bill from Anchorage
Chrysler if these were impact funde and was advised that they were.

Mayor Elsau read Ordinance No. 287-?6 -"that the 1975-?6 budget for the
Ai~port Land Fund be amended to reflect the following increases in revenues
ead eapenditures: Itevenue: Ssle of Laad - 542.90D, Expense: Warm 3torage
Building -~42,800. The purpose of this Ordinanee is to dedicate the proceeds
tront the sale of sirport iands to the Canstruction Fund, tor the purpose oi
construeting a warm storage building.
Mr. Lqnn advised that this was a"geaeral housekeeping" ordinafice to reflect
the renenue from the sale oi the laad aad expenditure to buildiug a warm
storage tacility.

Mr. Lynn stated that in conjunctfon with the request that Administration review
the rentel rates to permit a more palatable amount. Resolution No. 76-2 was
prepared, however. Adminfstration did recommend one additional amendment
in tbat the resolution should read.. .. ." not to exceed twa hcurs, ... .." as one
hour does not allow enough time.

shall levy the following planning aad zoning tees which are to be considered
independeat oi aay tees levied by the Borough for p]a~nning and zoning chanqee.

H-2: City Attorney's Report
(a) Citq Attorneq, Janis Williams, advised the Council that it would be ne~easary
to tile "Financiel Disclosure" forms again. These must be filed no later than
Apri115th or within l5 daqs from filing income tax return .
(b) Litigation - no ch~nge in status. ~
(c) Tidelands - the Citq has been trying to get the tittes to the Tidelands. It has been
advertised in order that protests could be filed prior to the closing date. One
protest was tiled ivith the Division of Lands who must respond to the p:~otest.
The Citq can protest the validitq of that protest. Mayor Elson added thet the person
who had submitted the protest is from Anchorage and this person had pratested
the titles to Tidelands all over the State.
H-3: Mayor's Report
(a) Mayor Elson advised the Council that he would be meeting at the Rorough next
week with regard to the "Outer Continental Sheif" . There will be E150, 000
to be made available in planniag monies and the Borough will be appiqfng for some
ot that funding. It is the hope to do planning for the public works prof ects
that will be requi~red because of OC3 impact. There is verq little time to get
tbe applieatioa for the plaaniag funds in to the State .
(6) Mayor Elson state~i that a concept that has beea discussed off and on -- and
perhaps it was tiuielq to start to proceed riow . The Maqor reported that first of
811 he would like to see monfes used from the aele of City owsed lands for such
thinge as building a warm storage facilitq for the Tanker Truck to be located in the
vieinity ot Beaver Loop. The 11'taqor further siated that it wae his personal
pbilosophp that the sale of assets should be put back into other assets (such as
buildings. etc .) in the communitq . A Fire Sub-Station in the Beaver Loop area
eovld provide tinancial relief b3r reduction ot fire insurance rates. The Citq
eould 81eo perhaps hold a meeting with people from that area in order to form
a volunteer unit which could mea the Rub-Station with back-up from the Kenai
Fire Department. ' .
Councilman Morgan asked sbout the insurance savings -- does the Citq have a
doUar tigure on reclassificatfon . N-aqor Elson advised that there was no dollar
tigure but reclassification from 8 to 8 was anticipated. The Mayor further stated
tbat perhaps location ot the Sub-Station could be near the new Water Well.
Couacilman Morgan inquired if the Sub-3tatfon would heve to be manned all the
time and was advised by Mayor Elson that it would not have to be manned ell the
time but through volunteers who would be "on call" .
(c) Mayor Elson asked the Citq Attorney the status of the report on non-litigation
matters and was advised that she would have it for presentation to the Couneil
at their next regular meeting.

(d) Couuicilman Morgan asked when Mr. Spake of the Highway Depart~nent would be
meeting with the Council and Air. Lqnn reported that he had talked with Mr. Spake
who advised that he had not received the 5-year plan for the Highway Departrnent
but upon receipt would eome before Council -- hopefully. Air. Spake will be in
attettdance at the first meeting in February. Mr. Spake did indicate that as far
as he was concerned the Beaver Loop and Forrest Drive projects would be
completed this year.

permit aad Penittsula Trailer Sales will also be applying for re-zoning of thst area. ~

had been appro~ved in total amount requested and Mr. Lqnn advised that it had not
as there was approximately $50 ~ 000 less grented . Councilman Morgau also asked
the City Manager to what elctent metering would be required and Mr. Lynn advised
it was required but now that the grant had been reeeived, he would send letters
to our congressional delegation asking their assistance in obtafniag a waiver.

Dear Sir:
The following recommendations are made in reference to
the Kenai. Library.
Change Order Number 2.
An additional fire extinguisher is required by the
State Fire Marshal's Office.
Recommend appraval.
Change Order Number 3.
Item 1. The plans call for a deadbolt type lock on the
rear door from the main section of the library.
This door will not ordinarily be used. However,
it would have to be unlocked during the day for
an exit. The library people were concerned that
someone wauld forget to unlock it in the morning
or would forget to lock it at night. Changing
to this type of lock will leave it always locked
on the outside for security and always unlocked
. on the inside for an exit.
Recommend approval. ' .
Item 2. This is the only fixture of this type in the
building and requires a"U" shaped florescent
tube. It seemed it would be more efficient to
have a fixture similar to the others that would
use the same straight four foot tube. The change
order proposes to replace it with two incandescent
fixtures. This is really not what we intended.
Recommend it not be approved.
Item 3. The plans call for the lights in the main section
of the library to be switched from the breaker box
in the storeroom. This cpuld be done but would be
inconvenient. Mr. Engen, the Director of the State
Libraries. has requested that a switch be installed

Mayor Elson further stated that the tact that Cotmcil is in a atalemate situation it
puts the Mayor in a posftfan of conductitig business and ft is not one he particularly
relished. As there is just six Couurii members, in most cases it gives the Mayor the
autltority oY veto. As the Mayor stated, he did aot relish it but if the Conaefl renisiaed
stalemated. he would certainly use it it he telt it was in the best iaterest ot the City.
Councilmaa Sweet asked the Mayor to explain the power of veto. Mayor Elson stated
as there are siz people oa Coundl now, it takes 4 votes to pass. If there is a
8 to 2 or S to 3 vote, it fails. If there are 7 members and if the Mayor had veto power,
it wot~id sti]1 require 4 votes or less litaa 4 votes for a veto to be upheld. Mathetically,
3t worke out to the seme thing.
