The Adn~aistrative Officfal shall plaee the applicatian for conditional use permit on the agenda of the Kenai Advisory Planning and Zoning Commission (hereinafter caUed "Kenaf Planning Commissfon") for the first meeting of the Commission for which it is eligible based oa the date of filiag with the 3ecretary aitd the applicable rules of the Commission at that time. At that niesting the Comm~ssion shaU review the application and accompanying information and ahall detern-ine if it meets the requirements of Section 20.30.151 hereof. If the reqyireraents have not been met the Commiesio}~ shell specify the de~cien- cies therein and shall request that a supplement to the application be filed. The Commiesion maq, in ita dfscretfon, request additional ittformation per- tlnent to the particular site to be supplied bq the applicant. Such additional intormatfon sheli not be requested unless it can be obtained bq the epplicant at a reasonable cost. The issue of reasonable cost maq be appealed bq the - applicant directlq to the Board of Adjustment before further proceeding by the Keaai Plarming Commissfon . Of#icia2 notice of the date of hearirig ahall be tnailed to the applicant not less than 10 days before the date of the hesring. In additfon the Kenai Planning Commission shall eause to be sent to ¢ach owner of propertq within a distsnce oi 300 feet of the exterior boundary at the lot or parcel described in such application notice ot the time and place oi the public hearing. 3uch notice shall contain a deseription of the prop~rty; ~'map showing the approxi~aate location of the proposed surface extractfon, and a statement as to the nature ot the proposed esctract~on operation. For the purpose oi this section, "property awner" meaus that owner shown on the latest tex assessment roll. 3ection 21.7.6.144 Iasusuce oi Conditional Use Permit for 3urface E~draction ot Natural Besourees A. On the basis of the application with aecompanying intormatioa, ariy eupplemental information filed, and sueh iaformation as maq be ~ presented at ttie public heariiig provided for in 3ection 21.76.143, the Kenai Planning Cammiesion shali make a determiaation as to whether each of the following requirements has been met: i. The application ia in substantial compliance with the • ~ requirements of 3ection 21.76.141 of thie chapter. 2. If the Renai Plauning Comtaissfon detersnines that all requirements have been met, the Cmnmission sha21 direct the Administrative Official to issue a condi- tional use permit to the applicant. The permit shall be issued for an indefinite period and shall be subject to the provisions of Sectfons 21.76.145 through 21.76.148 hereot and sbaU so state. B. The permit may be expresslq conditioned bq the Commission upon the erectfon of artificiel screening. Seatioa 21.76.145 Operatfon by gur&+~e pxtracHon Permit Aolders During the period of the conditional use permit the permit holder shall comply with the following provisions: , 1. The pit shall be operated substantiaUy in accordeace with the site plan and statements that accompanied the application for conditfonal use permit, as such may be amended from ti~ae tA time in accordeuce with 3ection 21.76.158 of this chapter. ~ 2. The permit holder shall submit a yearlq report to tl~e Adtainistratfve Afficiai w3thin thfrtq daqs ot the annivereary of .~ the issuance of the condiHonal use permit. Sueh report shall show the area which has been eleared during the previous year, the current working area and any area which has beeu reclaimed or partiallq reclaimed, and shall state the quantlty of material wl~h was actually removed duriug the preceding work year . The report shall also contaia projections of the same information ' for the aext work qear. 3. No part of the extraction operatfan is viaible from public ~ roadways or inhabited areas. S¢ctlan 21.76.146 Yearly Review of SurPace Extraction nperation The Administrative Officiai shall review the operations of the permit holder each year within sixty days of the anniversarq ef the issuance ot the conditional use permit to determine whether such permit ho2der ia in compliance with the provisfone of 3ection 21.76.145. He shall compile a report based on his revfew and shall submit his report alang with the report of the permit holder under S¢ction 21.76.145 to the Renai Planning Commission. Sectloa 21.?6.147 Terminatfon of 3urface F.ictraction Permit ~ ~ A.
