Sirs:
I was unable to attend -he most recent Kenai City Council
meeting during which Council granted the Oilers baseball team
a 10 acre lease to develope a ballpark. It is my understanding
that all Councilmen voted yes on this issue except for Council-
man Ambarian, who voted no, and Councilman Sweet, who was absent.
It is also my understanding that the majority of tax -paying
property owners in the general area of the proposed park ex-
pressed negative feelings about same.
Property in the area of the proposed park location is zoned
suburban residential, which, according to the City of Kenai zon-
ing ordinance, is primarily intended to provide for medium den-
sity residential developement and to }prohibit uses which would
violate the residential chaZracter of the environment and generate
heavy traffic in predominantly residential areas.
As the owner of lot 167 (which is adjacent to and immediately
north -up Tinker Lane towards Spur Road from proposed park)• I am
indeed concerned about the impact of this park on the use and
developement of my property. In accordance with the intents of
zoning applicable to property in thin area, I have to date in-
vested over ;18,000 in lot 167 towards purchase and developement
of four spacious, attractive lots for eventual construction of
four duplexes. The location of a baseball park immediately ad-
jacent to my property will obviously adversly affect the here-
to -fore private and tranquil nature of this property and, con-
sequently, seriously jeopardize my investment. I believe this
assumption is justified by the fact that I have yet to see an
attractive residential area around a ball park.

On 3-1?6-76, I made inquiries about the proposed Oilers lease
at City Hall and was informed that the lease had not yet been
signed. further, it was revealed that the lease has nothing in'
it to legally bind the park developers to maintaining a green
belt screen for isolation purposes although supposelly a verbal
commitment had been discussed. Also. a review of the develope-
ment plans presented to and adopted.by council indicated a poor
traffic flow situation in my opinion. Since these two factors
are cardinal to minimizing the adverse impact (namely noise and
traffic) the park will have on adjacent residential property, I
herewith strongly request the city council to insist that the
following terms be incorporated in the Oilers leases
(1) That a green belt screen at least 200 feet in width be
preserved and maintained around the entire perimeter of

the park or at least around those sides adjacent to pri-
vately held property. Screen should be measured from
easement lines rather than lot boundaries.
(2) That an entrance/exit to park from Linwood Street as well
as Tinker Lane be constructed and maintained.
In closing. I wish to state that I am against the park being
located adjacent to my property for reasons stated and due to
the investment I have already made towards developement of same
in accordance with the primary intents of the zoning in this
area. While I recognize the power of City Council to enact.
_ interpret and amend ordinances for whatever reasons they may
deem worthwhile. I also feel that there is a inherent ethical
and legal responsibility assumed to minimize the impact of such
actions where they adversly affect previously established develops-
- meets.
Your aid in seeing that the requirements for green belt screen-
ing and traffic flow noted above are legally incorpated in the
Oilers lease agreement with the city will be sincerely appre-
ciated. I am sure you will agree that these requirements are
minimal when weighed against the negative aspects created by
their omission.

Dear Mr. Lynn:
in response to your request we are pleased to submit a proposal for appointment
as independent accountants to examine the accounts of the City of Kenai for the
year ending June 30, 1976. This letter outlines our audit approach, engagement
timing and basis for fee determination.
AUDIT APPROACH
Our examinations are made in accordance with generally accepted auditing
standards and accordingly include such tests of the accounting records and
such other auditing procedures as we consider necessary in the circumstances.
Basic to the audit program is a review of the internal control, the procedures
for safeguarding the assets and tests of transactions to determine their
effectiveness. Since transaction tests made under generally accepted auditing
standards do not contemplate a detailed check of all day -today transactions,
adequate methods of internal check and control must constitute the principal
safeguard against irregularities.
Management Letters
We are interested in our client's operating efficiency and overall success. A
part of the audit is a current evaluation of internal controls and operating
procedures. It is the practice of our Firm, after appropriate discussion, to
Issue a management letter at the completion of our work summarizing any
weaknesses in internal control or accounting procedures noted and offering
suggestions for improvement.

ENGAGEM MIT TIMING
We would anticipate that the audit planning and interim test work would
commence about May 3, 1976 and be completed by June 1, 1976. The final phase
of the examination would start sometime during the period July 26, to August 9,
1976 and be completed by September 30, 1976. Of course the above time frames
are flexible and would be revised in order to coordinate our work with that of
City personnel.
BASIS FOR FEE DETEBMIIQATION
Our fees are based upon the hours and standard fee rates of the personnel
assigned to the engagement plus out-of-pocket expenses. The examination
of the City's accounts required 443-1/2 man hours last year.
If our fee, based on actual man hours for the 1975-76 engagement at our standard
hourly rates plus actual out-of-pocket costs, is less than our estimated fee
we will bill you the lesser amount.
We estimate our fee for the June 30, 1976 examination as follows:

The above estimate is based upon the assumption that the City's records will
be in good order and that the City and its personnel will perform the same
functions as 1975, including drafting and printing of the financial statements.
Should the City find that it cannot provide the same assistance as last year
our fee would be increased based upon the actual hours at the rates and
out-of-pocket costs incurred by us in performing the additional functions.

Sirs:
While in the process of attempting to develope a ten acre tract
now known as DONNYBROOK S/D we were confronted with a problem
that we felt the City should help rectify.
PROBLEM:
The main water and sewer line that follows E Street NE
cuts the middle of this S/D and is at an.Approx. depth
of 20 ft. making it highly infeasible both from a physical
and a financial standpoint to make use of this service
that we are paying assessments on,(not a party to tax
payors suit).
REASON FOR PROBLEM:
Our intentions are to have 20 homes started in this S/D
during this building season and at this point in time
are unable to continue 'because of the exorbitant costs
of the tie-ins to the mains.
SOLUTION TO PROBLEM:
Our proposal is that the cost of installing 2 deep sewer
manholes and 2 water risers at the points noted on plot
plan be reimbursed to the developer by the City in the
form of a credit against the water and sewer permit fees.

Dear Mr. Lynn:
Please refer to our letter of February 13, 1976, in regard to your protest
of the above reissuance application.
There may be some misunderstanding between us as to proper procedure, and
I hope this letter clarifies the issue. AS 04.10.270 states, in part:
"An application for a.transfer, renewal or new license coming from
within a municipality shall be transmitted directly to the board and
need not bear a recommendation of the governing body of the munici-
pality. Upon deciding to approve an application, the board shall
transmit written notice of its intent to approve the transfer, re-
newal or new license requested to the city governing body, if the
application is for premises within an incorporated city-...... If
the local governing body wishes to protest approval, it shall furnish
the board with a notice of protest within 30 days of receipt of the
board notice of intent to approve the application. Upon receipt of
a -protest by the local governing body, the board may not take final
action on the application until it has provided for a hearing on the
protest in accordance with the requirements of the Administrative
Procedures Act."
As you can see, disapproval by a city must mean a protest, and the board
cannot take final action until we provide for a hearing pursuant to the
Admiaistrative Procedures Act. That Act states that a hearing is initiated
by a statement of issues, which must come from Renal, as you are the pro-
testant.
Please confer with your attorney as to the legal basis for your protest
and submit the statement of issues so we can dispose of•this application
expeditiously.

Re: 1973 Borough Foreclosure Parcels
The attached list contains the legal descriptions of parcels of land in the City
of Kenai foreclosed an by the Borough for non-payment of 1973 real property
taxes. The Planning Commission has reviewed the list and made a recommends -
tion. Their minutes are attached.
The Borough, on the advice of their Attorney, has changed the procedure with
respect to foreclosure parcels since the last list of parcel s were considered by
Council. It is no longer necessary for the City to pass f resolution stating
that it has no immediate public use for the properties.
Properties can now be redeemed by the record owner at any thne prior to their
being set aside for immediate public use by the Borough or the City.
Council action on the attached parcels should, therefore, be as follows:
L With regard to parcel number three (3) , the Council should pass a motion
rat Mftg the deeding of the property to the record owner. This parcel was
redeemed before there was any chance for Council action on it. in addition,
the Planning Commission did not find any public use for the parcel.
2. The Council should consider the recommendations of the Planning Commission
as well as their own views and decide if the City has any immediate public
use for any of the parcels.
S. If the Council finds there is an immediate public use for one or more of the
parcels, it should pass a resolution so stating and giving its reasons with
particularity.
4. As to parcels not to be set aside, a motion declaring that the City has no
immediate public use for them is sufficient. The motion should also authorize
the City Manager to deed to the record owners any parcels upon which the
taxes have been paid in full with interest, penalties, costs and attorney's fees,
or will have been paid, prior to sale to the public by the City.

Mr. Raymond moved, seconded by Mr. Evans, that the Commission recommend
{ to the City Council that the City reserve only Borough Tax Parcel No.
-- 047-082-0100, Lot 1, Block 10, of the Kenai Original Townsite, Kenai
Recording District, foreclosed on by the Kenai Borough for non-payment
of 1973 taxes, as described in Civil Case No. 74-15043.
Motion passed unanimously.
B. A plication for Lease of Lot 2, Block 2, General Aviation Apron:
rald Wasson
Mr. Wasson stated that he is working in conjunction with Jerry Sibley
of Peninsula Aircraft. They plan to place a large hangar approximately
80 feet by 60 feet, to be constructed of steel and a small building at
the northeast corner of the lot to serve as an aircraft related retail
--- - shop for pilot accessories. They plan to construct the hangar this
year and the lot will have on-site water and sewer.
Councilman Ambarian asked if they planned to include fueling facilities
on their lot. Mr. Wasson replied that they did not at this time, but
would like to leave this open in the event that their business required
fueling facilities at a later time.
Mrs. Daisy stated that the Administration recommended approval of
the lease and that there were no assessments due on the property.
She further stated that Jim Bishop asked her to advise the Commission
that he had submitted an application for lease of this lot shortly
after Mr. Wasson and wished for his lease application to be considered.
Mrs. Daisy stated that she had informed Mr. Bishop that the applications
were considered on a first come, first serve basis but that she would
advise the Commission of this for their consideration.
1 The Commission determined that leases were considered on a first come
first serve basis and that if for some reason Mr. Wasson's application
was denied, Mr. Bishop's application would be considered -second.
MOTION:
1 Mrs. Glick moved, seconded by Mr. Hamrick, that the Commission recommend
to the City Council approval of Mr. Wasson's lease of Lot 2, Block 2,
General Aviation Apron.
Motion passed unanimously by roll call vote.
C.Application for Lease of Lot 8, Block 2, Fidalgo Subdivision:
.F Alaska industrial Hardware, Inc.:
Mr. Joseph Boehm, President of Alaska Industrial Hardware, Inc.,
_-_-- stated that he would like to lease this lot for the purpose of

and stated that the building plans had been approved by the State
Fire Marshal. His business would be catering to approximately 2S

A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI OPPOSING GOVERNOR
HAMOND'S ACTION IN REGARD TO KACHEMAK BAY OIL LEASES.

WHEREAS, areas adjacent to the City of Kenai have been involved with oil development
for a number of years; and
WHEREAS, because of the foregoing, the citizens of the rity of Renal have a great deal
of knowledge of the oil industry; and
WHEREAS, the City of Kenai hes found in its years of experience that the oil industry
has been of great benefit to the community.

NOW. THEREFORE, BE IT RESOLVED by the Council of the City of Kenai, Alaska, that:
It opposes the action of Governor Hammond in regard to Rachemak Bay oil
leases and recommends that the existing oil leases be honored.

On January 19, 1976, you were convicted of keeping a bawdy house at the
above establishment. This is a -violation of 15 AAC 20.010(4) and (5).
Suspension and Revocation of Licenses, which states, in part:
"The following are the grounds which constitute a basis for the
possible suspension or revocation of licenses:
(4) The plea, verdict, or judgment of guilty to any public offense
involving moral turpitude....:
(5) Where the portion of the premises of the licensee upon which
the activities permitted by the license are conducted are a resort
for illegal possessors or users of narcotics, prostitutes, pimps,
panderers or sexual perverts....."
At its meeting of March 10, 1976, the Alcoholic Beverage Control Board
reviewed the above conviction. As a consequence, the Board moved that a
anspension/revocation hearing under AS 04.15.100 would be held. Yqu are
therefore requested to appear on April 21, 1976, in Kenai, Alaska at 10 a.m.
In the Fort Kenay Building for the purposes of the hearing. You may be
represented by counsel, and bring with you any information you wish for
presentation to the Board.
The possible penalty for this conviction is that the license of the premises
Involved may be suspended for not less than 10 nor more than 45 days.
Please do not hesitate to contact us if there are any questions.

This exemption would appear to cover auditors services; therefore, legally
