I In consideration of the mutual promises contained herein. the parties fhereto agree as follows: -I li j 1. CONTRACTOR shall provide janitorial services for the entire Kenai Air Terminal Building, with the exception of: I) the Pre-Flight Room (bar); 2) the Wien office area; o I 3) the Fan Room; 4) the Boiler Room; 5) the Freight and Baggage Room; 6) the Kitchen; 7) the Map Room; 8) and the offices formerly occupied by City Attorney. Routine janitorial service will be scheduled during those hours that the tenant organizations are not conducting business in the building. Provision may be made for limited services to be performed during normal working hours. These services shall be limited to those which may be performed without disrupting the tenant .• : operation or customer traffic in the building. • 2. The contract may be cancelled for just cause on seven (7) days written notice. Contract may be terminated by mutual consent with seven (7) days written notice. f 3. This contract shall be for the. shaded areas on the attached sketch. This to approximately 9,075 square feet. The contractor shall be responsible to assure himself of the square footage included in this contract. The City furnished figures are for reference only and are not binding upon the City. The City reserves the right to add or delete portions of the building as required by City operations, in which • = case an equitable adjustment will be made with the contractor prior to commencement or deletion of work. :'4. Janitorial supplies and equipment may be stored in room 07 and in a portion = of room 421 (on building sketch) . The contractor will keep these rooms clean and . orderly. Supplies and equipment may also be stored in room #11 (fan room) . The contractor would not be responsible for cleaning this room, but it must be kept orderly, and empty cartons removed. Nothing shall be stored in room #12 (boiler room) . . 5. The City will furnish light bulbs and fluorescent tubes for the contractor. The contractor will notify the City as these items become depleted. 6. When cleaning room #27 (19ince-Corthell office) do not stack anything on the desks or drafting tables. 7. The contractor's employees are to be thoroughly familiar with the specifications. S. The City Manager will designate an official to act as Contract Administrator on his behalf. The contractor will be responsible for prompt attention to any defective work called to his attention by the Administrator. If complaints, regarding janitorial services are sent to the contractor by mail, the contractor shall act on the complaint within twenty-four (24) hours. If the complaint regarding janitorial services is delivered to the contractor by telephone or verbally by the Administrator, the contractor shall act on the complaint on the same day the complaint is delivered.. If the deficiencies are not corrected in the allotted time, the City will arrange to have the work done and all charges will be deducted from the contractor's monthly payment. 9. . The contractor shall arrange to have'a telephone, or an answering service, whereby he can be contacted at any time. This number shall be given to the Admini- strator prior to award of contract. Should the contractor be away from the City or otherwise is not able to respond, he shall designate another person of authority who shall be empowered to aci for hifa . I 10. The contractor's employees shall be capable and experienced in janitorial work.. They shall be free from communicable disease. The City may require removal i from the work of employees whom the City deems incompetent, insubordinance or otherwise objectionable, or whose continued employment on the premises is deemed contrary to the public interest or inconsistent with the best interest of the City. The contractor shall furnish to the Administrator, the names, addresses and telephone numbers of employees working under this contract. The list shall be kept current at all times. U. The contractor may be required to meet with the Administrator at least twice each month to conduct an inspection of the premises and to discuss performance of the work. 12. There will be no children, friends or other unauthorized persons allowed to - accompany the janitors while the building is being cleaned: 13. The contractor and his employees shall not disturb papers on desks, open . { drawers or cabinets or use telephones in the offices. 14. The contractor shall obtain a State Contractor's License and a Kenai Peninsula I Borough Sales Tax number. f 15. The contractor shall not commence work until he has obtained the following i . insurance. The contractor shall maintain insurance throughout the life of this Oontract . A. Workmen's Compensation Insurance as required by the State of Alaska. F B. Public Liability and Property Damage Insurance as shall protect the City and the contractor against losses which may result for claims for damages for bodily injury, including accidental death, as well as claims for property damages, which may arise from any operations under this contract, whether such operations be those of the contractor, a sub -contractor or anyone directly or indirectly employed by either of them and the amount ' of suoh insurance shall be as follows: :.. The two companies submitting are: The Paul Timmerman Company and the Yukon Office Supply, Inc. To supplement the costs of the awarded contract, the Library Board is seeming permission to use the Restricted Library Fund as a matching fund with the State of Alaska. The amount of the restricted fund is $8,542.00 and should be in- creased to an even $10,000.00 to make a $20,000.00 matching grant. The Paul Timmerman Company has prepared a bid on the entire furnishings pro- posal, amounting.to $72,054.91 that includes some metal and some oak shelving, and an alternate bid of an additional $15,975.00 for complete oak shelving. S. Economic Development Administration for grant financing of ' the project resulting from said engineering services, the City of Kenai (hereinafter called the "City") by and through its City Council; and Harold H. EMPLOYMENT OF THE EHGI+LEER i The following requirements are added to Paragraph I, EMPLOY14ENT OF THE ENGINEER: B. flecessary professional services shall include, but are not limited to the following: 1. Design the project in accordance with the intent of the Loan and/or Grant Agreement between the City of Kenai and the EDA. - 2. Redesign the project in the event the g p prel irain•�ry cost estimate, the final cost estimate, or the louast responsive bid less deductive alternates exceeds the EISA- � approved construction and project improvenent estimate of $939,200 plus twenty-five percent (25%) thereof. 3. Design the project to conform to Federal, State and local standards regarding air and grater pollution. 4.. Use EDA forms for instructions to bidders, general conditions, contract, bid bond, performance bond and payment bond. S. Submit all contract documents for EDA approval. 6. The time for performance of engineering services shall be as -follows: a. Completing of preliminary plans, associated ` cost estimate and engineer's report - March 15, 1976. b. Completing of final plans, associated cost estimate and revisions to engineers report - May 30, 1976. c. Submitting contract documents for required state and local approvals - Flay 30, 1976. d. Completing contract documents in a form sufficient for soliciting bids for construction of the project - May 30, 1976. n e 7. Submit a monthly report to the City, with a copy of the report to the EUA regional office, covering the general progress of the job.and describing any problems or factors contributing to delay. 14. Review and approve the contractor's schei:ule of amounts for contract payments, and certify partial payinants to contractors. 15: Assure that a ten percent• retainage is withheld from all payments on construction contracts until final acceptance by the City and approval by the EDA regional office. 16. Prepare "as -built" drawings after completion of the project. Furnish reproducible copies of "as -built" drawings to the City, and furnish one copy of "as -built" drawings to the EDA regional office within 60 days after construction has been completed and final inspection has been performed. 17. Review and approve the contractor's submission of samples and shop drawings. 18. Comply with regulations of the U. S. Department of Commerce (Part 8, Subtitle 15, CFR) regarding nondiscrimination in employment because of race,'religion, color, sex and national origin. IV. COMPENSATION FOR ENGINEER'S SERVICES B.
