F ` I " MINUTES REGULAR MEETING KENAI CITY COUNCIL MARCH 5, 1975 I 8:00 P.M. PUBLIC SAFETY BUILDING The Council gave the Pledge of Allegiance. ROLL CALL: Members present - A. L. Hudson, Edward Ambarian, James Doyle, Richard Dorgan, Oscar Thomas and Mayor James Elson. Members absent - H. J. There being no public participation, the public hearing was closed and brought back to the Council table. There were no objections from Council for the issuance of a liquor license renewal - Katmai Motel. B - 2: Transfer of Retail Liquor Licenses - Oaken Ke #54 and Oaken Kea #58 - from B.J. Councilman Morgan voiced his objection to the transfer of retail liquor license - Oaken Keg NS4 as the license is being held and is not serving the public. Councilman Thomas asked if we had correspondence from the A.B.C. Board concerning this. Mr. Baldwin stated we did have a letter from them and we are rendered helpless by State law as they need only to be open 30 days a year. MI'ETING, MARCH 5, 1975 Page three C: PERSONS PRESENT SCHEDULED TO BE HEARD: C - 1: Ron Malston Mr. Malston stated he is before Council to ask a few questions. His store was broken into this morning and several others including N.C. Auto. We find there is only one officer per shift except when they overlap. This is not enough officers to cover the City. He asked what is the reason for this besides financial?' Councilman Doyle asked if there is a position in the budget that has not been filled. Mayor Elson stated all budgeted positions have been filled. Councilman Doyle stated then we need more money. People should show up more at the budget hearings. Mr. Malston stated then we should raise taxes. Public Safety is important. Ile are not getting our money's worth. There is one car running now and it is not well. Harry Gaines stated he has lost in excess of $10,000 in the past few months. Several businesses have been broken into. The City is a large area to cover end to end. Perhaps the State Troopers can be contracted or lease private cars. Mayor Elson stated he appreciates your coming. We have been aware of this and are trying to fund two additional positions. We have two new vehicles on order but they had a 1.20 day delivery date. The Mayor stated he would appreciate the participation of more interested people showing up at budget time. D: MINUTES 1. G: NEW BUSINESS G - 1: Bills to be paid - bills to be ratified Morgan moved and Doyle seconded to approve payment of bilis to be paid and ratify payment of bills as listed on the memo of 3/5/75. The motion carried unanimously by roll call vote. G - 3: Recreation Director Councilman Morgan stated Gary Davis and Tonja Ahlfors are in the audience and can give you a brief discussion of what a Recreation Director can do in Kenai. Gary Davis stated the recreational facilities have been ran by volunteer organizations over the years, with no input from the _ City. The same members do the work year after year and are getting tired. There is a need for new blood. The youth football barely survived last year. A Recreation Director could coordinate all the activities; baseball, football, volley ball, archery, snow machines, hockey, the operation and maintenance of a civic auditorium. The library could be part of the Recreation Department. The Director could be in charge of a broader area; parks, camp grounds, arts and theatre guild. The community school could be opened year around with the City sponsoring the activities. There are many diversified interests that are not drawing the crowds they should. The delinquency rates would go down. Tqnja Ahlfors stated a Recreation Director could bring in new types of activities such as soft ball, tennis, gymnastics, physical fitness and canoeing. Kenai needs another skating rink. There is also a need for information to get to the public through the news media. E Councilman Thomas asked if they have done any research on the cost of the program. Mrs. Ahlfors stated enough for his salary and a minimum amount to buy equipment. Mayor Elson stated the Council needs for you to submit a budget so we know what we are getting into. There is a need to establish priorities. We are shy $136,000 for a now water well. Our snow removal equipment need attention and sewer lines need maintenance. Councilman Morgan felt we should advertize for a Recreation j Director now and not wait till school is out. Morgan moved we advertize for a Recreation Director in accordance with the job description. The motion died for lack - of a second. j Councilman Doyle stated he is not against a recreation program _._ but we must set priorities. -If we want to pay another mill for recreation, we can have it. MARC11 5, 1975 Page five G - 4: Ordinance 257-75 - Sale of Surplus Property The City Attorney stated the code would be amended to allow certain classes of property to be disposed of without going to competitive bidding. This excludes real property. Thomas moved and Doyle seconded to introduce Ordinance 257-75 - Sale of Surplus Property, amending the first sentence in Section 7-39 to read: "The City Administrator may sell the following, only with notice to and approval of City Council, without giving an opportunity for competitive bidding:" Councilman Hudson asked if this ordinance was made exclusively for the F.A.A. houses. Mr. Baldwin stated that brought it to mind. Councilman Hudson felt we can make more money out of bidding. The motion carried by roll call vote with Hudson and Morgan dissenting. 1 i G - 5: Resolution 75-07 - Certain Tax Foreclosure Properties Mr. Baldwin stated cities may select foreclosed land outside the city if they have a public use in mind. These properties aro located near Ninilchik and the Borough requests we pass a . ' resolution if the city has no public use in mind. Morgan moved and Doyle seconded to adopt Resolution 75-07 - finding that certain tax foreclosed properties near Ninilchik are not required for public use and that the same should be placed on a list of properties for sale. The motion carried unanimously by roll call vote with Ambarian temporarily absent. ► G - 6: Special Use Permit - Kenai Air Service I Doyle moved and Thomas seconded to approve the Special Use Permit - Kenai Air Service. Mr. Baldwin stated this is necessary to help clear the title on the old Court House. After some discussion, Hudson moved and Doyle seconded to approve the consent to assignment of lease - Olympic Inc. to Pacific Inc. There were no objections and was so ordered. G - 14: Morgan moved and Doyle seconded to pay R.D. Peterson $6,703. for the Kaknu project. Councilman Morgan stated there was gravel hauled in and the gravel was lost due to further excavation. There is a quest as to why the City should have to pay. Mayor Elson asked if wo have proper certification on thopre,,,.,. to table Doyle moved and Thomas soconded/until we have proper information from the City Manager. The City has sent in a preliminary application. The objective is to combine several agencies under one. Councilman Doyle asked how this would affect the City of Kenai. Mayor Elson stated that hopefully the communications center will have full utilization. The Mayor has a copy of the revised appliciation. The Borough passed a similar resolution last night. Councilman Doyle asked who would be involved and who has'control. Mayor Elson stated Kenai $ North Kenai and maybethe hospital would be involved. Chief Shirnberg stated the Board of Directors as a whole would run it with the communication supervisor employed by the City pretty much as it is now. Councilman Doyle and Councilman Hudson felt if North Kenai wants to utilize our communication system, we should contract with them. After some discussion, Morgan moved to adopt Resolution 75-09 - Emergency Medical Service. The motion died for lack of a second. REPORTS City Manager's Report Mr. Lynn gave his report in written form because he is out of town attending a City Manager's seminar. City Attorney's Report Mr. Baldwin stated stage one of the recodification is complete. The last two chapters have been delivered to you. He is starting on the second stage and asks for criticism and/or direction. Mr. Baldwin reported Alaska Public Utilities Commission has withdrawn the protest against Pacific L.N.G. The cataloging of the lands is coming right along. The map is complete, the pins are in and are color coded. The general public will nominate certain lands for sale or lease. ' Councilman Doyle asked the status of the Tibbots problem. Mr. i Baldwin request, since Council may be sitting as Board of Appeals, to not discuss this even among yourselves. Mayor's Report _, Mayor Bison reported on his trip to Juneau. The revenue sharing will be close to the present 'level, however, it may be a target area for cutting. The Mayor spoke with Bob Palmer about the jail contract. It looks like there will be no money from the State. Our only hope lies with the Federal Government. Bob Palmer suggested we contact the Commissioner of Public Works for surplus snow plows. The results of a survey of the City Mayors revealed they were 100% in favor of a change of title given to the Borough Mayors. The Mayors expressed supporting a bill that would allow disclosure of a juvenile's name after the second felony. The last paragraph of his report is as follows: "On the local scene, I feel the Clarion is doing a disservice to our citizens. The Clarion is criticising the City based on heresay and incomplete information. Under the present Editor, they have refused to print news articles presented to them about the positive programs that we have implemented. In a conversation with the Editor, he claims he has limited available space. I would not object to the criticism if it were valid. However, the Clarion has failed to meet the standards of responsive reporting established by its peers. On this basis, I feel the Council should make the public aware that the Clarion is not fairly roporting the actions of the Council and the operation of the City." City Clerk's Report No report. H - 5: Finance Director's Report Mr. O'Connor stated the monthly financial statements will be out the 14th of each month. He is working on budget procedures and work papers and will have them to the departments heads soon. He is working on the invitation to bid on the upcoming audit. Councilman Thomas asked the status on the exempt municipal water and sewer assessments. The Administration will write to Representative Malone and get the status. They are interested in some land by the college. I - 2: Edward Ambarian Councilman Ambarian stated before any type of Council action is taken concerning itemslike Emergency Medical Services, there should involve a positive or negative report and more work sessions as they come up. I - 3: Oscar Thomas Councilman Thomas stated in the memo to Council concerning the restoration of Fort Kenay, the remaining $3,500 left in the fund will be used to purchase materials for the fence. Will this have to go out to bid. Mr. Baldwin stated it depends on if it is purchased as one unit or more than one unit. It will be purchased from the least expensive source. Councilman Thomas stated he has done some figuring on the new warm storage/City Shop and it occurred to him it was possible to extend the existing shop building. He passed around drawings and cost figures. The building, could be extended between the fence and existing building without interferring with the existing utilities. The extention would be 60' x 90' and add 5,400 sq. ft. There is hereby created the Kenai Port Commission, consisting of five (5) members. Section 11A-2. Port Commission - Geographic Jurisdiction. Subject to the paramount authority of the City Council, the Port Commission shall have jurisdiction, supervision and control of the following areas: i Lot Three (3), Section Nine (9), TSN, R1 1W, SM, all lands within ATS 272; and tidal water within the �.� corporate limits of the City of Kenai, Kenai Recording District, Third Judicial District, State of Alaska. Section 11A-7. Port Director - General Powers and Duties. The Port Director shall be the chief administrator of the Port. He shall, except as otherwise specifically instructed by the City Manager, exercise such powers and perform such duties as may be prescribed by the Port Commission, and shall perform all duties imposed by State or Federal Law upon harbormasters, port directors and administrative heads of harbors and ports. Section 11A-8. Terminal or Transportation Facilities - Permit Required. (a) All lessees, owners or occupants of property within the area defined by Section 11A-2, or elsewhere, within the City, who wish to construct or operate terminal or transportation facilities of any kind, including but not limited to wharves, docks and warehouses, shall apply to the Commission for a permit. Application therefor shall be made in accordance with regulations prescribed by the Commission, and shall be accompanied by a plan of the proposed construction which shall meet all standards and requirements which ,J may be set forth by•the Commission. (b) The Port Commission shall review the plan of the proposed construction in order to detemine whether it is in keeping with the objectives ` of the approved general plan. If the Port Commission concludes that significant conflict exists between the proposed and general plans, a permit will 1 not be issued. E(c) The Port Commission, subject to the conditions of this Section, i may issue permits upon such terms and conditions, and for such duration, as tl ' it may deem proper for the safe and efficient use of the area defined in Subsection ( (a) of this Section, and to insure that adequate terminal and transportation i facilities will be continuously provided in that area. Since this property is located in or near Ninilchik it does not appear ( that your city would have any reason to have an immediate public use for it, however, the statute cited in the resolution seems to give "the city" a chance to utilize properties in the borough and outside of cities, and since the statute isn't clear, it appears to me that every city in the ':. borough must pass such a resolution before the property can be sold. When all of the foreclosure deeds' are straightened up, I would expect a long list of properties, some of which may be near your city and for which you might have an immediate public use; however, this is brought at this time because through mischance a taxpayer failed to pay taxes and if all E ; the governmental entities find no immediate public use for the property, the taxpayer has a right to repurchase the property on payment of all taxes, penalties, costs of foreclosure, and interest due thereon. J1 t r ,I a BE IT ORDAINED by the Council of the City of Kenai, Alaska, The Code of the City of Kenai is hereby amended by adding Chapter 20, Lands, which shall read as follows,, ARTICLE I RULES AND REGULATIONS GOVERNING THE ADMINISTRATION OF CITY -OWNED LANDS Section 1, Lands Available for Leasing, All the lands within the limits of the City to which th© City hold_ title may be leased as hereinafter provided, Section 2, Qualifications of Applicants or Bidderc, An applicant or bidder for a lease Is qualified if the applicant or bidder., (a) Is an Individual at leant nineteen (19) years of age or over; or (b) Is a group, association, or corporation which Is authorized to conduct business under the Laws of Alaska; or (e) Is acting as an agent for another and has qualified by filing with the City Clerk a proper power of Attorney or a Letter of Authorization, creating such agency. The agent shall represent only one principal, to the exclusion of himself, Section 3. Applications, All applications for lease of lands shall` be filed with the City Clerk on forms provided by the City, available at the City Hall Building. Only forms completed In full and accompanied by a $10,00 filing fee will be accepted for filing, Filing fees are not refundable, With every application the applicant shall submit a development plan showing and stating (1) the purpose of the proposed lease (2) the use, value and nature of Improvoments to be constructed (3) the typo of construction (4) the dates construction Is estimated to commence and be completed (5) whether intended use complies with the zoning ordinance and comprehensive plan of the City, Section 4. Deposits for Costs. Rlghts Prior to Lessinq. The filing of an application for a lease shall give the applicant no right to a lease or to the use of the land applied for. Any use not authorized by lease shall constitute a trespass against the City, Section 6. Classification Prior to Lease Required. Before accepting applications to lease lands the area involved shalt have first been classified for permitted land uses and a land use plan of the area prepared and publicly posted In the office of the City Clerk for a period of not less than ten (10) calendar days. Tho land use plan shall be prepaped by the Kenai Planning Commission and approved by the Council prior to posting. Section 7. Public Use. The lease of any City lands may be made to any State or Federal agency or political subdivision of the State for less than appraised value, as may be determined by the City Managor with the approval of the Council to bo In the best Interests of the public, Section 8. Review. No leased bend may bo changed in use, nor may any renewal lease be Issued until the proposed use or renewal has been reviewed by the Planning Commission and approved by the Council. Section 9, Terms of Lease, All losses shall be approved by the City Council before the same shall become effective. The term of any given lease shall depend upon the durability of the proposed use, the amount of Investment In Improvement proposed and made, and tho nature of the Improvement proposed with respect to durability and time required to amortize the proposed Investment. Section 10. Appraisal. No land shall be leased, or a renewal lease issued, unless the same has been appraised within a reasonable period prior to tho date fixed for beginning of the term of the lease or renewal lease. No land shall be leased for less than the approved, appraised annual rental, except as sat out In Section 7. Annual minimum rentals shall be computed from the approved appraised market value, and shall be the lowest acceptable bid in the event of an auction. Section 12. Responsibility to Properly Locate on Leased Premises. It shall be the responsibility of the lessee to properly locate himself and his Improvements on the leased land. It shall be unlawful to encroach on other lands of the City, or on lands owned or leased by another, and violation shall constitute a misdemeanor. Section 13. Lease Utilization. Leased lands shall be utilized for purposes within the scope of the application, the terms of the lease, and in conformity with the ordinances of the City, including the zoning ordinance, and in substantial conformity with its comprehensive plan. Utilization or development for other than the allowed uses shall constitute a violation of the lease and ;. " subject the lease to cancellation at any time. Failure to make substantial use i of the land, consistent with the proposed use, within one (1) year shall, in the discretion of the City Manager with the approval of the Council, constitute grounds for cancellation. Section 14. Adiustment of Rental. AJI leases shall contain the agreement of the lessee to an adjustment of the annual rental payment by the City Manager with consent of the Council, every fifth year. Section 15. Subleasing. No lessee may sublease lands or any part thereof leased to him hereunder, without prior Council approval. Subleases shall be in writing, and be subject to the terms and conditions of the original lease. Section 16. Assignments. No lessee may assign the lands leased to him without prior Council approval. The assignee shall be subject to all of the provisions of the lease. Any attempted assignment made in violation of this Section shall be void. i Section 17. Modification. No lease may be modified orally or in any manner other than by an agreement in writing, signed by all parties in interest or their successors in interest. Section 1S. Cancellation - Forfeiture. (a) Leases in good standing may be cancelled in whole or In part, at any time, upon mutual written agreement by lessee and the City Council. (b) Any lease used for unlawful purpose may be cancelled. (c) If the lessee shall default in the performance or observance Page Five, ORDINANCE NO. 256-75 7 of any of the lease terms, covenants or stipulations thereto, or of the regulations now or hereafter in force, or any of the ordinances of the City, and should said default continue for thirty (30) calendar days after service of written notice by the City without remedy by lessee of the conditions warranting default, the City shall subject lessee to appropriate legal action, Including, but not limited to, forfeiture of the lease. No improvements may be removed by lessee or other person during any time the lessee is in default. This provision shall not be construed to prohibit the City from taking any appropriate legal action, Including, but not limited to, forfeiture of the lease, Immediately upon the occurrence of a default. Section 19. Notice or Demand, Any notice or demand, which under the 4 terms of a lease or under any statute must be given or made by the parties t thereto, shall be In writing, and be given or made by registered or certified i mail, addressed to the other party at the address of record. However, either party may designate In writing such new or other address to which such notice or demand shall thereafter be so given; made or mailed. A notice given hereunder shall be deemed delivered when deposited In a U. S. general or branch post office, enclosed In a registered or certified mail prepaid wrapper or envelope, addressed as hereinabove provided. t` Section 20. Riqhts of Mortgagee or Lienholder. In the event of � cancellation or forfelture.of a lease for cause, the holder of a properly recorded fir mortgage, conditional assignment or collateral assignment will have the option <t ' to acquire the lease for the unexpired term thereof, subject to the same terms ! and conditions as In the original lease. k� Section 21. Entry and Re-entry. In the event that the lease should be i, terminated as hereinbefore provided; or by summery proceedings or otherwise, or in the event that the demised lands, or any part thereof, should be abandoned by the lessee during the said term, the lessor or its agents, servants, }{ or representative, may, immediately or any time thereafter, re-enter and resume possession of said lands or such part thereof, and remove all persons and property therefrom, either by summary proceedings or by a suitable action or proceeding at law without being liable for any damages therefor. No re-entry by the lessor shall be deemed an acceptance of a surrender of the lease. Section 22. Re -lease. in the event that a lease should be terminated as herein provided, or by summary proceedings, or otherwise, the City Manager may offer said lands for lease or other appropriate disposal, pursuant to the provisions of this Ordinance. y Section 23. forfeiture of Rental. Written Waiver. The receipt of rent by the lessor with knowledge of any breach of the lease by the lessee, or any default on the part of the lessee in observance or performance of any of the conditions or covenants of the lease, shall not be deemed to be a waiver of any provision of the lease. No failure on the part of the lessor to enforce any covenant or provision therein contained, nor any waiver of any right thereunder by the lessor, unless in . writing, shall discharge or invalidate such covenants or provisions, or affect the right of the lessor to enforce the same in the event of any subsequent breach or default. The receipt, by the lessor, of any rent or any other sum of money after the termination, in any manner, of the term therein demised, or after the giving by the lessor of any notice thereunder to effect such termination, {! shall not reinstate, continue, or exte,id the resultant term therein demised, or destroy, or in any manner impair the efficacy of any such notice or termination as may have been given thereunder by the lessor to the lessee prior to the receipt of any such sum of money or other consideration, unless so agreed to In writing and signed by the lessor. I Section 25. Expiration of Lease. Unless the lease Is renewed or sooner terminated as provided herein, the lessee shall peaceably and quietly leave, surrender and yield up unto the lessor all of the leased land, on or before the last day of the term of the lease. Section 26. Removal or Reversion of Improvements Upon Termination of Lease. Improvements owned by a lessee shall within sixty (60) calendar days after the termination of the lease be removed by him; provided, such removal will not cause Injury or damage to the lands; and further provided, that the City Manager may extend the time for removing such improvements in cases where hardship Is proven. The retiring lessee may, with the consent of the Official, sell his improvements to the succeeding lessee. All periods of time granted lessees to remove Improvements are subject to said lessees paying to the City pro -rata lease rentals for said period. If any improvements and/or chattels having appraised value in excess of $10,000.00 as determined by the Assessor, are not removed within the time allowed, such Improvements and/or chattels shall upon due notice to the lessee, be sold at public sale under the direction of the City Manager. The proceeds of the sale shall inure to the lessee preceding, If he placed such Improvements and/or chattels on the lands, after deducting for the City all rents due and owing and expenses Incurred in making such sale. In case there are no other bidders at any such sale, the City Manager is authorized to bid, in the name of the City, on such Improvements, and/or chattels. The bid money shall be taken from the fund to which said lands belong and the said fund shall receive all monies or other value subsequently derived from the sale or leasing of such improvements and/or chattels. If any improvements and/or chattels having appraised value of $10, 000.00 or less, as determined by the Assessor, are not removed within the time allowed, such improvements and/or chattels shall revert to, and absolute title shall vest In, the City. Section 27. Rental of Improvements or Chattels Not Removed. Any Improvements and/or chattels belonging to the lessee or placed on the lease during the lessee's tenure with or without his permission and remaining upon .the premises after the termination date of the lease, shall entitle the lessor to charge a reasonable rent therefor. Section 28. Sanitation. The lessee shall comply with all regulations or ordinances of the City which are promulgated for the promotion of sanitation. The premises of the lease shall be kept in a neat, clean and sanitary condition and every effort shall be made to prevent the pollution of water. Section 29. Buildfnc) and Zoninq Codes. Leased lands shall be utilized In accordance with the building and zoning ordinances and rules and regulations of said authority. Failure to do so shall constitute a violation of the lease. Section 30. Fire Protection. The lessee will take all reasonable precaution to prevent, and take all necessary action to suppress, destructive or uncontrolled grass, brush or other fires on leased lands, and comply withal I laws, regulations and rules promulgated and enforced by the City for fire protection within the area wherein the leased premises are located. Section 31. Inspection. The lessee shall allow authorized representative of the City to enter the leased land for inspection at any reasonable time. Section 32. Personal Use of Materials. All coal, oil, gas and other minerals and all deposits of stone or gravel valuable for extraction or utilization and all materials subject to Title II, Division 1, Chapters A, 5 and 6 of the Alaska Administrative Code, are excepted from the operation of a surface lease. Specifically, the lessee of the surface rights shal I not sell or remove for use elsewhere any timber, stone, gravel, peat -moss, topsoil, or any other material valuable for building or commercial purposes; provided, however, that material required for the development of the leasehold may be used, if Its use is first approved by the City Manager. Section 33. Rights of Way. The lessor expressly reserves the right to grant easements or rights of way across leased land if it is determined in the best interest of the City to do so. The lessee whose lands such easements or rights of way shall cross shall be entitled to damages for all Improvements Page Eight, ORDINANCE NO. 258-75 destroyed or damaged. Damages shall be limited to improvements only, and P1 loss shall be determined by fair market value. Annual rentals may be adjusted to compensate lessee for loss of use. Section 34. Restrictions and Reservations. The lease shall contain such restrictions and reservations as are necessary to protect the public interest. Section 35. Waste and Injury to Land. If any person shall commit waste, or trespass or other injury upon City land, the person so offending, In addition to being civilly liable for any damages caused, shall be deemed guilty of a misdemeanor. Section 36. Warranty. The City does not warrant by its classification or leasing of land that the land is ideally suited for the use authorized under said classification or lease, and no guaranty is given or implied that it shall be profitable to employ land to said use. Section 37. Lease Rental Credit. When authorized in writing by the City Manager with approval of the City Council, prior to the commencement of any work, the lessee may be granted credit against current or future rent, provided, said work, accomplished on or off the leased area, results in increased valuation of other City owned lands. Said authorization may stipulate type of work, standards of construction and the maximum allowable credit for the specific project. Section 38. Approval of Other Authorities. The Issuance by the City of deeds or leases under the provisions of this Ordinance does not relieve the grantee or lessee of responsibility of obtaining licenses or permits as may be required by duly authorized Borough, State or Federal Agencies. Section 39. Title Restrictions. All leases or sales of property shall be made subject to restrictions and reservations in the patent, deed or other Instrument under which the City holds. ARTICLE II USE AND DISPOSAL OF MATERIALS ON CITY LANDS Section 1. Any person, firm or corporation who without written authority from the City removes rock, gravel or other material from the lands owned by the City without the express consent of the City Manager shall be deemed guilty of a misdemeanor. Any criminal action taken against such person shall not preclude the institutuion of civil proceedings by the City. Section 2. Such applications shall be consistent with the Comprehensive Plan of the City and referred to the _I City Planning Commission for its recommendations. One from Brown Const.,the other from R. L. Borgen Excavating of which 250 yds, of gravel was put on the roads of the construction area last spring. We lost this gravel as we excavated to inspect the water mains. This gravel remains in the streets but not to be considered gravel as it was contaminated with sand. Consequintly Item #715 ( bid item for sand fill ) in- cludes this gravel quanity as sand. After all the experiments, inspections, and speculations we (contractor, engineers, and pipe manufactor) have not deter- mined the cause for these leaks. At the time of water line testing I couldn't believe it was leaking as we had taken extreme measures to_insure a good installation. Which the engineer's inspection records show. Also the Kenai Cas Utility Co. wrote a letter to the city praising the expertise of our construction crews and procedures. I truly regret this unforunate experience, and believe we should pay any direct costs that the city of Kenai may have encountered as a result. We have almost a $30,000.00 deficit direct loss. Not to mention the loss of reputation, unable to do any other jobs during this time, and uncountable hours of anxiety. I don't think the City of Kenai would purpose to add to this sit- uation unjustly. What I'm really asking for is a show of mercy from you as you consider the time penalty of this project. Animal Control I have assigned one of the Maintenance Men to full-time Animal Control except when he is badly needed for snow removal. We are presently handicapped by the lack of an effective Ordinance, consequently, I have asked the City Attorney to assist in preparing an Ordinance which will designate areas where animals must be on a leash or otherwise restrained. This will be presented to the Council at the second meeting in March. 4. Library Schematics Mike Plunkett, Architect, met with members from the Library Board and myself on February 27th to review the preliminary schematics. After discussion, suggested changes were made and completed schematics should be available to the City Council for review at your meeting on March Sth. Land Management Program Advertisements notifying people that the City of Kenai is accepting nominations for land to be leased and/or sold will be in the newspapers during the week of March 3rd with a map located at City Hall available for public inspection. Once the nominations are submitted, we will I then go to the Planning Commission for review and recommendation to the City Council. Procedures to be followed will be as ' outlined in my memo to you dated February 26th. 4 - 6. Well Project Phil Aber and I will be working closely with Harold Galliett to try and fit the scope of the project into the available money. At present the project as proposed by Mr. Galliett would be almost more than the City could afford. However, I am certain that a project can be put together because of the serious need. 7. Grant Preapplications filed --- — The following Grant Applications have been filed in the last three weeks: a. Economic Development Administration - application for Labor Intensive Projects. Some of the projects included are ` construction of new water well and transmission line, con- struction of new City shop, landscape parks and public areas, make repairs to the Airport, install street signs, repair water storage area, restore Ft. City Shop Buildin& I am still looking at ways in which this project can be.financed. The banks are assisting Mr. Baldwin in trying to find a legal way in which they can finance the project. The Farm Home Administration has indicated that it would be willing to loan the City the money to construct the shop, however, the loan would have to be secured by General Obligation Bond which could be purchased by Farm Home Administration at 5% with a 40 year pay -back. Elson, Mayor March 4, 1975 MAYOR'S REPORT Since the last Council meeting, I have been to Juneau and while there I attended a meeting of the Alaskan Conference of Mayors, Board of Directors meeting of the Municipal League and a meeting of the Legislative Committee of the Municipal League. However, the primary purpose of my trip was to familiar- ize myself with the new administration, and how their policies and attitudes would affect our revenues. Primarily, Revenue Sharing, Impact Funds, EMS Grant and to explor every possibility of additional funding for the new water well we need so desperately. On Revenue Sharing -- generally the attitude was that every effort would be made to keep the level of funding at least at the present rate. However, it should be realized that at this time no general trends have developed in the Legislature and everyone is extremely aware of the States' financial problems and the Revenue Sharing could become a target for cuts during the final days of the session. As of last Friday, there was approximately 3.8 million dollars left in discretionary funds for Impact Funding. I managed to get one area clarified. The Commissioner of Community and Regional Affairs who has jurisdiction over Impact Funding was following a criteria of the Legislation stating "Pipeline Impact" when in fact the Legislation states "Oil Related Impact". There are applications pending for many millions of dollars, however, most of them do not have the necessary bdocu- hLnweveot,keIourlatmenistrataonttolg�ve itnpriority and enlist the help of Frank McIlhargey to put it together quickly and thoroughly. L-1 .!, l� ' KENAI CITY COUNCIL March 4, 1975 Page 2 f' On the EMS Grant, I met with the local Committee prior to my departure and their attitude was one of despair and "washing their hands" of the program. First of all, this is a Federal Program to improve the delivery of Emergency Medical Services to the rural areas, with the effort in the first year being focused on communications and with a general plan for fire, police and medical services over a three year period. The Committee's frustrations came about from the dwindling amount of dollars; i originally from a million plus for the State with $300,000 for j our region (being the Kenai Peninsula Borough) and $500,000 for the State, but primarily by the adverse comments made by letter and in person by the Mayor of Soldotna. I met with Mr. Madden, who administers the program in the "State, and he indicated that as long as there is adverse comment from only one elected official that it would carry considerable impact but it could be offset by letters of affirmative nature by other elected officials. Also, only the applications from the Tanana Indians, Sitka, and our local Committees were prepared adequately and that he hoped to use them as models. • Therefore, our application is viable if we overcome the local adversity and cut some of the excesses from the application. So -- what does this mean to the City of Kenai? Instead of the City funding five positions for communication dispatchers, the City of Soldotna and the State sharing five and North Kenai establishing its own communications center with five dispatchers, ► ; that could all be brought into our existing communications center, if willing, and experience proportionate economies. As of my Juneau visit, it is still a viable program. I explored every possibility to increase the funding for our new well. I had hopes, up until 6 p.m. Friday night, of getting ' Impact Funding for the well. However, it was determined that r Impact Funds could only be used for operations due to impact from oil development and not capital improvements. It was determined that the content of arsenic in our water was not a critical factor as the standards are set at a 100 units per liter instead of 10 for a new well and 50 for an existing well. Our only hope for additional funding lies with the Fcderal Government. In talking to Bob Palmer, the Governor's Executive Assistant, I explored the possibility of Jail and Police Contracts with the State. He indicated the State's policies would take a reasonable view of any program that would deliver service, that would pro- vide economies to all levels of service, and not increase the State's present cost unless required by impact. 1 KENAI CITY COUNCIL March 4, 1975 Page 3 Representative Malone indicated that he felt that the Legislature would probably fund the feasibility studies required for the communities benefited by the bond issue for Harbor Development. Representative Malone was hopeful that the State may fund the assessments that are due against State lands for one year, how- ever, it is very early in the session to determine whether there is a good chance for this. Bob Palmer suggested that we contact the Commissioner of Public Works for surplus equipment or a reasonable lease for idle equipment. At the Conference of Alaskan Mayors, it was reported that in response to our request for equal treatment under the Federal Regulations that secondary treatment into coastal waters had resulted in a postponement of the regulation and possibly modi- fication of the regulations. The results of a survey were revealed that was made of City Mayors concerning the title now given to the Borough Mayor. 801 chose Borough Chairman, 10% Borough Executive Director and 10% Borough Manager -- which meant a 1004 for a change. We will re- quest enabling Legislation. I was elected First Vice -President to replace Lee McAnerney who accepted the position of Commissioner of Community $ Regional Affairs. The Mayors agreed to accept an invitation to meet in Haines in the middle of August prior to the Board Meeting of the Municipal League in Kodiak. The Mayors felt they should lend their weight to the new programs of the Department of Tourism. This includes establishment of a Tourist Center in Anchorage and the State developing brochures of each community in a standard format. The Mayors felt it was premature to exert any influence concerning revenue sharing. It was felt the present attitude of the Legislature was to maintain the present level. It was felt too much attention to the program may make it a target for cuts later. The time to make an effort would be later in the session. The Mayyors passed a Resolution requesting the Corps of Engineers 107 Funds be increased from $1 million to $2 million. The Mayors also expressed support for a bill that would allow disclosure of a juvenile's name after the second felony. There was a lengthy discussion on Labor Relations, particularly in regards to Budget Approval and School Board negotiations. On the local scene, I feel the Clarion is doing a disservice to our citizens, The Clarion is criticising the City based on heresay and incomplete information. Under the present Editor, they have refused to print news articles presented to them about the positive programs that we have implemented. In a conversation with the Editor, he claims he has limited available space. I would not object to the criticism if it were valid. However, the Clarion has failed to meet the standards of responsive reporting established by its peers. After considerable research, I found that on September 20, 1972, the City Council authorized the setting aside of $8,000 in accordance with the bond issue for con- tinuous restoration project and that the expenditure of money be contingent upon a plan from the Mayor's Committee on History $ Tradition. Under this authorization, $4,508..55 was spent for some restoration work. -The remaining $3,491.45 is to be used to construct the fence. Therefore, in accordance with the authorization given I will purchase the required material from the least expensive source so that the fence project can be completed. Labor for this project will be donated by the 813th Engineer Battalion from Ft. Richardson. Three or four men will be sent to Kenai for one week. They will be assisted by volunteers. Mrs. Peterson reported that the gross amount of $500 plus some additional donations were received as a result of the dinner held by the American Association of Retired Persons; the Kenai Senior Citizens, the American Legion Post No. 20 and the Legion Auxiliary. All reports were that the dinner was a success and the food was- delicious. The Committee extends its thanks to the people in the organizations involved. Civic and Cultural Center - A letter was received iron the City Manager, Mr. Lynn, dated 19 FL'b. 1975, in which hn indicated that the City of Kenai submitted an applicalon for funding in the amount of $350,000 under the housing and Community Development Act for civic and cultural center and -for $50,000 for a new artesian water well. However, he advised that the State of Alaska is receiving only $750,000 whereas over $12 1/2 million has been submitted to the Anchorage office. However, it seems to occur frequently enough that I think it merits the attention of the Legislative Branch of the City so that adequate support can be provided to the Administration. The request, actually requests, are as follows: 1. For a repair and renovation of the trash cans located on the Urban Section, which were initially installed by the Kenai Lions Chapter. 11 2. For a systematic collection of the trash in those refuse ` = receptacles so they are available for service at all times to the public. Anticipating the objections that will, or might be raised by the Department of Highways, I would comment as follows: 1. Even though the refuse receptacles might be in the right-of- way of the highway, it assists the highway with one of its own responsibilities, that of making certain that the right-of-way is kept clean. 2. I think that the Highway Department, itself, should have some- thing of the nature that has been provided as a civic and community benefit by the Kenai Lions Club. While it is possible that damage to such refuse receptacles could occur with snow removal, I think it inexcusable to permit them &Q remain damaged and unrepaired. I think the City should ask that they/Y6paired by the Department of highways. If it is impossible to have that service accomplished, then I think the City should make the repairs itself.
