Y.ynn ` ^" City Manager City of Kenai Kenai, Alaska Subject: A L Airport Lighting Panel On June 26, 1975 at 10:00 AN a meeting was held in the office of the Kenai Public Work Director for the purpose of negotiating a construction contract with A-lamis Electric for the subject project improvements. The following persons were present: i - Niles W. Dean Dunsmis Electric Contractor _ Ed Carlstrom Duna -is Electric Contractors Estimator ` Phil Aber City of Kenai, Public Works Director Alan Corthell Wince-Corthell, Consulting Engineers Philip Bryson Wince-Corthell, Consulting Engineers Minor clarifications of intent of the Plans and Specifications were made. i Nsjor areas of concern of the Contractor included trench compaction and labor costs. Major areas of concern of the %gineer included bonding costs (lack of - amortization of this item) and total project costs. -= - W Corthell. stated that the technical provisions describe under "backfilling" the intended method of compartion and the plan note regarding 95% compaction vould be deleted. -f When asked by lir. Carstrom under what pay scheduling the engineers estimate vim' d, Mr. Corthell stated that items were not broken dove to hours per man but a varying percentage of the item being performed was used de- pending upon complexity. The proposed annual lease charge to the Care Center by the City would create a financial hardship on the Care Center and it would have to cease operations. Mrs. Hardy asked for the Council's support and assistance in obtaining alternatives to the situation that would be beneficial to the City and allow the Care Center to keep its present facilities. Mr. and Mrs. James Fisher spoke in favor of Council and City support of the Care Center. Mr. Fisher advised the Council that a great deal of labor, materials, and money had gone into the Care Center for improvements to the building. Mr. Fisher also suggested the Council investigate the possibility of obtaining "Congressional Relief" for the Care Center with regard to its lease from the City. Mayor Elson read a letter from the Federal Aviation Administration dated M2Y S, 1975, a4visind that the Citi ifiui,t demand a -;r Market Value" in the leasing of all airport lands and facilities. The FAA further stressed that there would be no exceptions to the requirement as all revenues are to be dedicated to the maintenance, operation, and development of the airport. I£ the City does not adhere strictly to this requirement, the FAA would declare the City in "non-compliance" with the terms of the agree- ment thereby jeopardizing future federal aid to the City. Contact has also been made with the Congressional delegation regarding this matter. Judge James Hanson explained that the money invested by the Care Center had brought the building up to standards as set forth by the Fire Marshall. After considerable discussion by the Council on a solution to the matter, several suggestions were offered. Councilman Steiner suggested the City designate "X" amount of dollars from the General Fund to the Airport --"would this satisfy the FAA?" Also how about Impact Funds?" Perhaps this could be so stated in a Resolution? Councilman Doyle stated he felt that the City should pay the taxes on the land and perhaps purchase the land ^ next year, etc.". J At this time, Mayor Elson brought the meeting back to the Council table. MOTION: Councilman Thomas moved, seconded by Councilman Steiner, that the Kenai City Council request the Congressional Delegation to intervene and obtain anexemption from existing FAA regulations which now prohibits the free use of the Care Center by the Kenai Peninsula Community Care Center. Councilman Ambarian stated he believed the Care Center a worthy cause but the Council had decided in preparation of the 1975-76 budget not to financially carry any organizations outside the City organization and would, therefore, vote against the motion. Councilman Morgan - would like to hear a report from the Police Chief regarding the practical advantages of having a Care Center such as the one in question. Councilman Ambarian suggested that since the Care Center serves the entire Peninsula, the City should not stand the expense alone. Support should come from the entire Kenai Peninsula Borough. Councilman Morgan asked Administration if a Resolution might not carry more weight than a motion and was advised by Mr. Lynn that this may possibly alienate the FAA and it would be better accepted by the FAA if the money was transferred from the General Fund to the Airport Fund. a - - -- - . --. Mr. Lynn advised the Council that there had been no Council approval given for reimbursement on the subject matter. Councilman Doyle stated that this commitment should not have been made without Council approval, however, the road would have been closed if the Port had not taken action. Mr. Lynn advised that this project could come under "Local Service Road and `frail funds" and that he had been advised by Public Works that the City did use the road to tLe small boat harbor. Reverend Aamodt asked for the consideration of the Council in supporting the Care Center so that it will not have to be closed. Mr. Lynn stated he would rather see a dedication of funds than a Resolution which might have serious ramifications. The motion failed by roll call vote. Voting no; Ambarian, Doyle, and Elson. Mayor Elson reiterated that the City was given these lands to help support the airport. Councilman Steiner stated that the City should get the lands self- supporting so that the lands could be sold and the revenues would go back to the airport. Councilman Morgan -- this question will come up every year and representatives from various organizations will have to depend on every Council for a statement on policy of the FAA lands. Chamber of Commerce - lease of City owned lands Mr. Lynn advised that the Chamber of Commerce is requesting a Lease on a portion of the green strip located adjacent to Bookey's. The Chamber of. Commerce will move a cabin on the site to be used as an Informational Center. They wish to lease the land for $1 per year. The Fair Market Value of the land is estimated at $.OS per sq, ft. Councilman Morgan asked verification that the Planning F Zoning Commission had recommended the $1 a year lease rate. Mr. Lynn advised that the Commission had recommended a $1 a year lease rate but it is not in the realm of the Commission to set lease rates. Mr. George Day, President of the Chamber of Commerce, spoke in behalf of the Chamber's request and cited many examples of service to the City performed by the Chamber of Commerce such as sponsoring programs for the benefit of the City, answer mail requests on the City, greet visitors, etc. The Chamber of Commerce needs a site for their Information Center that is very visible and has easy access. Mr. Day pointed out that a gas line ran under the property they are requesting to lease and would, there- fore, limit possible uses of the property. Mr. Day felt that $.OS/sq. ft. was not "Fair Market Value" for that piece of land. Chamber of Commerce - lease of City owned lands Mr. Lynn advised that the Chamber of Commerce is requesting a Lease on a portion of the green strip located adjacent to Bookey's. The Chamber of. Commerce will move a cabin on the site to be used as an Informational Center. They wish to lease the land for $1 per year. The Fair Market Value of the land is estimated at $.OS per sq, ft. Councilman Morgan asked verification that the Planning F Zoning Commission had recommended the $1 a year lease rate. Mr. Lynn advised that the Commission had recommended a $1 a year lease rate but it is not in the realm of the Commission to set lease rates. Mr. George Day, President of the Chamber of Commerce, spoke in behalf of the Chamber's request and cited many examples of service to the City performed by the Chamber of Commerce such as sponsoring programs for the benefit of the City, answer mail requests on the City, greet visitors, etc. The Chamber of Commerce needs a site for their Information Center that is very visible and has easy access. Mr. Day pointed out that a gas line ran under the property they are requesting to lease and would, there- fore, limit possible uses of the property. Mr. Day felt that $.OS/sq. ft. was not "Fair Market Value" for that piece of land. Council policy on City owned lands and City owned facilities Mr. Lynn stated that this policy was drawn up for Council approval to be given to those organizations who request special consideration in leasing City owned lands and City owned facilities. Councilman Thomas stated that the Council approved the budget on June 4, 1975, which made no provisions for special consideration to various groups requesting special lease rates on City owned lands and City owned facilities. Councilman Ambarian agreed with Councilman Thomas in that a decision had already been made at the Budget Hearings. Councilman Morgan felt the Chamber of Commerce is in a different category and should be given some consideration. Mayor Bison stated that should Council approve, the City would have to go to FAA for deed of release and also the land would have to be surveyed for exact location as requested. Councilman Ambarian stated that parking had not been taken into consideration as the Chamber of Commerce was asking for a minimum amount of land. Councilman Morgan stated that he was trying to point out that the green strip should not be considered with all City owned lands and should be kept as a green strip with a compatible use such as a Chamber of Commerce Information Center. Also, would like to see an appraisal of the property. Councilman Doyle stated he would like to see the Chamber of Commerce select another site which would be a better location for their proposed building. Councilman Ambarian stated he felt the Council should agree upon a policy to give direction to the City Manager. The matter regarding Council policy on City owned lands and City owned facilities was not acted upon by the City Council. Carpenter,requested Council reconsideration on their policy that employees of the City were to live within the City limits, Mr. Carpenter stated he felt that perhaps a stipulation could be made as to employees living within a certain response time rather than within the City limits, Mr. Carpenter Presented the Council with a statement of request signed by twenty-nine City employees, Councilman Doyle stated he felt that response time could not be taken into consideration as it does not pertain to the majority of employees. He felt the policy of employees within the City limits had been abused as when people were hired on by the City they were aware of the requirement. Councilman Ambarian stated he agreed with Councilman Doyle and felt that the policy should be enforced. It was the unanimous opinion of the Council that the present policy that all City employees are required to live within the City limits Would be strictly adhered to, G-11: State Jail Contract Mr. Lynn advised that the State did want to enter into an agree- ment with the City to lease the City.jail facilities, The City will provide only utilities and minor up -keep. Council requested Administration to look into the matter further, establish original cost to build, etc, and report back to the Council, G-14: Acceptance of bid for Government Lot 01 The City had received one bid in the amount of $17,968 from Mr. Nick Popp%n for the entire 40 acre parcel, This amount would cover just the water and sewer assessments on the property, The City had set an acceptable minimum bid of $40,000. Mr. Nick Poppin advised the Council that he felt the entire 40 acre parcel was not usable as some of it was swamp, etc. plus a certain portion of it would be in right-of-ways, etc. Councilman Ambarian stated he felt the land was worth more than the minimum bid. Administration has met with the Kenai Peninsula Borough Planning Department for information that may be helpful in preparing the plan. The auction on FAA houses 103 and 104 will be at 12:00 noon, Friday, July 11, 1975. An auction on the surplus furnishings will be held following the auction on the houses. The City has received verbal approval from the State for 60% funding on the Kenai Community Library project. Mr. Lynn requested Council set a work session day to review the plan prepared by the U. S. Civil Service Commission. The work session will be held in the City Manager's office at 7:30 p.m., Thursday, July 10. The City has received impact funds in the amount of $123,000. H•2: City Attorney's Report No report H-3: Mayor's Report Mayor Elson reported that he had attended the stock holders meeting of the Kenai Development Corporation and there being no quorum, the meeting was postponed. The second meeting date was also cancelled due to no quorum. Mayor Elson requested that John O'Connor be given the books of the Kenai Development Corporation to review them. Mayor Elson also indicated that the City would like to redeem stocks held. Also, it appears from calculations done by the City Attorney, the City could have at least three representatives on the Board of Directors. ARTS CENTER LEASES The FAA has directed the City to charge the fair market value for leases of airport properties. At the last Council meeting the decision was made to appropriate $9,000 or so to the Care Center and they ii: turn pay the Airport Fund. (The appropriation is actually part of the City's contribution to the Airport.) My question is how do you want the American Legion lease (on airport land) and Fine Arts Center lease (non -airport land) to be handled? The calculation of the. lease rates for the two buildings are attached. As you can see, the lease payment for the American Legion would be $4,361 and the payment for the Fine Arts Center would be $11,315 per year. A decision by the Council on how to calculate the lease payments should be made soon since the City is in non-compliance with the Federal Government until the fair market value is paid by the American Legion. Also, the lease for the Fine Arts Center has expired. Your guidance would be appreciated. Alaska: BE IT ORDAINED by the Council of the City of Kenai, That a new Article be enacted, numbered 5, said Article to read as follows: LICENSE REQUIRED Section 5-22. It shall be unlawful for a transient or itinerant -merchant, as defined in section 5-23 of this Article, to engage in business within the City of Kenai withnut first nb-- taining a license therefor in compliance with the provisions of this chapter. TRANSIENT OR ITINERANT MERCHANT DEFINED Section 5-23. Transient or itinerant merchant is defined as any person, firm or corporation, whether as owner, agent, consignee or employee, whether a resident of the city or not, who engages in a temporary business of selling and delivering goods, and/or services, wares and merchandise within this city, and who, in furtherance of such purpose, peddles from door to door or uses any building or structure, or any street, alley, or other place within the city, for the exhibition and sale of such goods, wares and merchandise, and/or the performance of services, either pri- vately or publicly. The person, firm, or corporation so engaged shall not be relieved from complying with the provisions of this ordinance merely by reason of associating temporarily with any local dealer, trader, merchant or auctioneer, or by conducting such transient business in connection with, as a part of, or in the name of any local dealer, trader, merchant or auctioneer. As used in this chapter, "temporary" means for a period contemplated to be less than one hundred twenty days duration. j PRESUMPTION AS TO TP.ANSIENT MERCHANT STATUS Section 5-24. Applicants for license under this chapter, wFe—ffe- a person, firm or corporation, shall file a written sworn application signed by the applicant, if an individual, uy all partners if a partnership, and by the president if a corporation, with the City Clerk, showing: (1) The name or names of the person or persons having the management or supervision of applicant's business during the time that it is proposed that it will be carried on in the City of Kenai; the local address or addresses of such person or persons while engaged in such business; the permanent address or addresses of such person or persons; the capacity in which such person or persons will act (that is, whether as propri- etor, agent or otherwise); the name and address of the person, firm or corporation for whose account the bus- iness will be carried on, if any; and if a corporation, under the laws of what state the same is incorporated; (2) The fingerprints of the person or persons having the management or supervision of applicant's business or in lieu thereof a copy of the applicant's annual report, bank statements, credit report, or similar proof of financial responsibility satisfactory to the City Clerk. (3) The place or places in the City of Kenai where it is proposed to carry on applicant's business, and the length of time during which it is proposed that said business shall be conducted; (4) The place or places, other than the permanent place of business of the applicant where applicant within the six months next preceding the date of said application conducted a transient business, stating the nature + thereof and giving the post office and street address of any building or office in which such business was conducted; ORDINANCI; NO. 268-75 - continued Section 5-25. continued: page 3 (5) A statement of the nature, character and quality of the goods, wares or merchandise to be sold or offered for slae by applicant in the City of Kenai, the invoice value and quantity of such goods, wares and merchandise, whether the same are proposed to be sold from stock in possession, or from stock in possession and by sample, at auction, by direct sale, or by taking orders for future delivery; where the goods or property proposed to be sold are manufactured or produced and where such goods or products are located at the -time said application is filed. (6) A brief statement of the nature and character of the advertising done or proposed to be done in order to attract customers, and copies of all said advertising whether by handbills, circular, newspaper advertising, or otherwise, shall be attached to said application as exhibits; (7) IMether or not the person or persons having the management or supervision of the applicant's business have been convicted of a crime, mis- demeanor or the violation of any municipal or- dinance, the nature of such offense and the punishment assessed therefor, excluding minor traffic offenses; (8) Credentials from the person, firm or corporation for which the applicant proposes to do business, authorizing the applicant to act as such repre- sentative. (9) Statement as to whether the goods or services are to be accompanied by any warrenty. BOND REQUIRED Section 5-26. The application shall be accompanied by a surety bond in the amount of $5,000.00 running to the City of Kenai or a cash bond in the amount of $5,000.00, conditioned upon the applicant's: (1) Delivering the goods, wares, merchandise or per- forming services as may have been paid for, either in •hole or upon partial deposit, to the purchaser thereof, or alternatively to refund the purchase price or deposit, within 30 days from demand of delivery; and owl 1 ORDINIUNCE. Before any license shall be issued for r engaging in business as an itinerant merchant the applicant shall file with the City Clerk an instru- ment nominating and appointing the City Clerk, or the person performing the duties of such position, his true and lavrful agent with full potrer and authority n to acknowledge service of notice or process for and on r behalf of the applicant in respect to any matters connected with or arising out of the business trans- ' - acted under the license and the bond given as required by section 5-26 of this Article, or for the performance of the conditions of said bond or for any breach 1 thereof, which said instrument shall also contain recitals to the effect that the applicant for the j license consents and agrees that service of any notice k or process may be made upon the agent, and when so R made shall be taken and held to be as valid as if personally served upon the person or persons applying for the said license under this ordinance, according to y = the law of this or any other state, and waiving all -claim or right of error by reason of such acknowledge- ment of service or manner of service. ISSWICE OF LTCEt.SE Secti_ori 6-30 The City Clerk shall issue a license to an applicant where (1) An application containing all information required in Section 5-25 has been filed. (2) The bond required by Section 5-26 has been delivered except where such bond is not required as provided in Section 5-32, (3) The appointment of the City Clerk as agent for service of process has been filed in accord- ance with Section 5-2.7, (4) The fee provided in Section 5-28 has been paid, and (5) The investigation provided for in Section 5-29 reveals no information that applicant is being sought by any jurisdiction in the United States !�. for any criminal offense or action invelvinn cone -� sumer misrepresentation or has been convicted or enjoined from similar activities. The City Clerk shall deny the application where any of the requirements enumerated in this section are not complied with. The applicant may appeal such denial as provided in Section 5-38, SPECIAL REQUIREMENTS AS TO ADVERTISING SALES Section 5-31 Before a license may be issued to any i transiant merchant who intends to sell advertising space in any publication, such merchant shall file with the City Clerk an affidavit of circulation of such publication. The affidavit shall state the name of such publication, the place where it is published, the names and addresses of the publisher and editor, the method of distribution of the publication, the number of regular- subscriber, and the approximate number of copies of each issue purchased, or if such publication is distributed free, the approximate number of persons receiving it. The transient merchant shall along with the affidavit, file a copy of the most recent issue of such publication. The affidavit and sample publication shall be a matter of public record and shall be available for public inspection. EXCEPTION TO BONDING REQUIREMENTS Section 5-33 The bonding requirements as contained in this chapter shall not be applicable to transient or 'itinerant merchants who engage in the business of selling items that, by their nature, have intrinsic value based solely on artistic, visual or decorative appeal. Examples of such items include, but are not limited to, art work, ^ art reproduction, Christmas trees and flowers. DISPLAY OF LICENSE Section 5-34 The license issued under this chapter shall be posted onsipicuously in the place of business named therin or if no fixed location, the license shall be carried on the person of the licensee at all times while he is actually engaged in the activity for which the license is granted. Such license must be shown to each person with whom the licensee deals. In the event that such person or persons applying for the license desire to do business in more than one place within the City, seperate licenses may be issued for each place of business. ADVERTISEMENTS OF TRANSIENT MERCHANTS Section 5-35 Every advertisement, notice, flier, commercial, phamphlet or other advertising device utilized within the City of Kenai to attract attent- ion to the business, location, presence, or arrival in the City of Kenai, of a "Transient or intinerant merchant", shall contain the following statement, which shall be conspicuously presented to the attention of any person whose attention is attracted by such advertising device: 'V "(name of merchant) has posted the surety bond and been issued busienss license no. as required by the Code of the City of Kenai, Alaska." Notice of hearing for revocation of a license shall be given in writing, setting forth specifically the grounds of the complaint and the time and place of the hearing. Such notice shall be mailed, postage prepaid, to the licensee, at his last known address, at least five (5) days prior to the date set for the hearing. Hearing shall be before the City Manager. MINE. The City Clerk shall deposit the record of fingerprints of licensee, together with a license number, with the Chief of ,. Police; the Chief of Police shall report to the - City Clerk any complaints against any person licensed . under the provisions of this chapter and any con- viction for violation of laws or ordinances; the — -- City Clerk shall keep a record of all such licenses and of such complaints and violations. ` i EXPERATION OF LICENSE Section 5-37 All licenses issued under the provisions of his ordinance shall expire one hundred twenty - . (120) days after the date of issuance thereof unless �. a prior date is fixed therein. REVOCATION OF LICENSE } Section 5-38 The licenses issued pursuant to this ordinance may be revoked by the City Manager after � notice and hearing, for any of the following causes: ' (1) Any fraud, misrepresentation or false statement ' contained in the application for license; (2) Any fraud, misrepresentation or false statement made in connection with the selling of goods, wares, merchandise or providing of service; (3) Any violation of this article. (4) Conviction of the licensee of any felony; (5) Conducting the business licensed under this chapter in a manner which violates municipal, . state or federal law. Notice of hearing for revocation of a license shall be given in writing, setting forth specifically the grounds of the complaint and the time and place of the hearing. Such notice shall be mailed, postage prepaid, to the licensee, at his last known address, at least five (5) days prior to the date set for the hearing. Hearing shall be before the City Manager. MINE. ME Ell ORDINANCE 140. 268-75- continued Page 8 n APPEAL TO CITY COUNC1!_ Section -5-39 Any person aggrieved by the decision of t -Tie City C_1erk in regard to the denial of application for license or in connection with the revocation of a license shall have the right to appeal to the Council by the City Manager of the City of Kenai. Such appeal shall be taken by filing with the City Manager within fourteen (14) days after notice of the decision by the City Manager has been mailed to such person's last knot -in address, a written statement setting forth the grounds for the appeal. The appeal and notice of such hearing shall be given to such person in the same manner as pro- vided in section 5-37 of this chapter. The order of the Council on such appeal shall be final . J CLAIMS AGAINST LICENSEE Section 5-40 A person having a claim against a licensee for any of the items referred to in section 5-26 of this Article may bring suit upon bond in a court of com- petent jurisdiction of the judicial district where the goods, wares or merchandise were delivered or the services were performed or in any judicial district in which jurisdiction of the licensee may be obtained. A copy of the complaint shall be served by personal service, registered or certified mail upon the City Clerk at the time suit is filed and the City Clerk shall maintain a record, available for public inspection, of all suits commenced. This service shall constitute service on the surety and the City Clerk shall transmit complaint or a copy of it to the surety within 72 hours after it has been received. The surety on the bond is not liable in an aggregate amount in excess of that named in the bond, but in case claims pending at any one time exceed the amount of the bond, priority of payment to the claimant from the surety or security pledged shall be determined by date of filing of the claim with the City Clerk. If a judgment is entered against the cash deposit, the City Clerk, upon receipt of a certified copy of a final judgment shall pay the judgment" rom the amount of the deposit according to the priorities established in this section. LIMITATION ON BOND CLAIM Section 5-41 A claim against the bond provided for in this chapter shall be made within ninety (90) days of the date of delivery of goods, wares, merchandise, or within thirty (30) days from demand of refund as provided for in Section 5-41 or within one hundred twenty (120) days of completion of services contracted or paid for. Section 5-45 This section may not be construed to authorize a person to solicit for sales or sell services, goods, wares or merchandise in a residential area in violation of other provisions of this code.
