Morgan moved and Steiner seconded to direct Administration to write a letter protesting the request for renewal of retail license - Oaken Keg OS4 as they are only open one month out of the year and our ordinance states they must be in operation nine months out of the year. There was no public participation and the public hearing was closed and brought back to Council table. The Council have no objections to the renewal of retail license - Oaken Keg 058. Liquor License Renewal - Pizza Paradisos - Restaurant License Mayor Elson recessed the meeting and opened it to the public. There was no public participation and the public hearing was closed and brought back to the Council table. The Council have no objections to the renewal of restaurant license - Pizza Paradisos. PERSONS PRESENT SCHEDULED TO BE HEARD: None. MINUTES 1. The Minutes of the Regular Meeting of December 4, 1974, were approved as distributed. 2. The Minutes of the Regular Meeting of December 18, 1974, were approved as distributed. CORRESPONDENCE None. OLD BUSINESS Materials for ballpark f Mr. Lynn stated he received correspondence from B.O.R. that they won't reimburse the City of Kenai until after the Oilers are out. He has written a strong letter protesting the bureaucracy tyranny. He has gone over all the bills and recommend we go ahead and pay them. There is a chance we won't be reimbursed until 1976 but hopes to resolve this. There is $S9,483 in the park fund. The bilis total $27,039.32.. The Council previously approved $20,000 for the ball park expansion. After some discussion, Steiner moved and Thomas seconded to pay $1S,000 to City Electric and $5,000 to the retirement of the bilis to the vendors. The City Attorney stated if we pay $S,000 to the Oilers what have we bought. Steiner, with consent of second, (Thomas) withdrew his motion. Mr. Wells stated the material was installed on City property with the knowledge of City Administration. The motion carried unanimously, by roll call vote. Steiner moved and Thomas seconded that the City offer to purchase from the Peninsula Oiler's the constructed ball park facility upon the following terms: $5,000 cash, the balance of $7,039.32 payable upon receipt by the City of the B.O.R. matching funds. The first payment of $5,000 will a used to preferentially retire oblig- ations of Superior Builders, Kenai Supply, Peninsula Builders and Kenai Glass, also, the Peninsula Oilers agree to turn over the constructed facility after the initial $5,000 payment. The j motion carried by roll call vote with Elson dissenting. ' F - 2: Library r Mr. Lynn stated a couple of architects are due to come down and a talk with the Planning $ Zoning Commission and the Library Board. They will bring schematics and artists renderings and discuss how it will sit on the site. The following Council Meeting Administration will make a recommendation for an architect. Councilman steiner asked who would critically'review'the design. Mr. Lynn stated the Engineer would review it. Councilman Hudson asked if they will be submitting a preliminary schematic. Mr. Lynn stated their preliminary schematic will be based on the floor plan drawn up by the Library Board. Council- man Hudson asked how many architects were contacted and Mr. Lynn stated there were six or eight and had two responses. Councilman Morgan felt the engineer should be there. He also stated this will not include the clearing and the clearing contract needs to be readied. F '• 3: Dogs Mr. Lynn stated one of the maintenancemen is responding as dog catcher. A cage is being mounted on a pickup and is reponding to complaints. Mr. Baldwin stated the dog ordinance should be amended so there is the option of tracing the dog to the owner and issuing a citation to the owner. F - 4: Resolution 75-2 - Transferrin $37S6 from Contingency to Legislative for Protessional Services iMr. Lynn stated the Arthur Young Co. bill was a total of $24,576 including $2,976 for per diem and travel costs. The interim payments were $18,000 and less the negotiated reduction of j 52,820 makes a total of $3,756. According to their March 3rd letter Council could refuse to pay the per diem and travel costs but Arthur Young is adamant we should pay it. Mr. Lynn stated it was based on the assumption the Finance Department was able to take care of certain things and they were not able to. Hudson moved and Steiner seconded to adopt Resolution 75-2 - Transferring $3,756 from Contingency to Legislative for Professional Services. Morgan moved to amend the motion to change it from $3,756 be transferred from Department 390.510 (Non -Departmental) Account No. 43 (Contingency) to 330.510 (Finance Dept.). The motion died for lack of a second. The main motion carried by roll call vote with Thomas and Morgan dissenting. NEW BUSINESS Bills to be paid - bills to be ratified None. Re -appointment of Ron Malston - Kenai Plannina 6 Zoning, Mayor Bison asked for confirmation of his re -appointment of Ron Malston to the Kenai Planning 4 Zoning Commission. There were no objections from Council. Games of Chance $ Skill - Kenai Chamber of Commerce The Council had no objection to the issuing of Games of Chance $ Skill - Kenai Chamber of Commerce. Games of Chance 6 Skill - American Legion Post 20 The Council had no objection to the.issuing of Games of Chance $ Skill- American Legion Post 20. Games of Chance 4 Skill - Kenai Elks Lodge BPOE #2425 The Council had no objection to the issuing of Games of Chance $ Skill - Kenai Elks Lodge BPOE #2425. Games of Chance 6 Skill - Kenai Catholic Mens Club The Council had no objection to the issuing of Games of Chance $ Skill - Kenai Catholic Mens Club. Mr. Lynn had correspondence with the National Leaque of Cities in regard to the Fair Labor Standards Act, special pay forpolicemen. The act is in court. If the act is upheld it will cost $14,000 a year. Mr. Lynn stated there has been alot of problems with the equipment during the cold spell. Some of the equipment is kept in the Armory and some in the shop. There has been alot of breakdowns. t MINUTES, KENAI CITY COUNCIL MEETING, JANUARY 8, 1975 Page five G - 7: Ordinance 254-75 - Amending 1974/75 Annual Budget I Mr. Lynn stated the budget was adopted by Ordinance and it needs an Ordinance to amend it., The Ordinance is not complete but would like to have it introduced for first reading. The total increase will be $77,000. There is an increase in revenue in sales tax, shared revenue, service charges, business licenses, property tax, etc. Councilman Steiner stated any additional sales tax should go to debt retirement. Mr. Lynn stated this will reduce the amount of general fund used for the debt service shortage. Steiner moved and Hudson seconded for the introduction of Ordinance 254-75 - Amending 1974/7S Annual Budget. The motion `. carried unanimously. 3 r G - 8: Resolution 75-1 - Amending Personnel Regulations Mr. Lynn stated that an injunction has been filed in Federal Court concerning the special pay for policemen and thinks that can be omitted. His best estimate would be it would cost $3,600 _ to implement the changes in the personnel manual. The main area where the extra cost would be in the longevity. Basically it, would effect six employees and would cost $2,400 per year. Mayor Elson stated this Resolution cannot be implemented until the passage of the ordinance on -the budget revision. Mr. Lynn felt the personnel manual should be discussed at the work session on the budget revision. G - 9: Resolution 75-3 - Transferring funds from Contingency to Department Personal Services Mr. Lynn withdrew the Resolution as the budget revision ordinance will take, care of it. H: REPORTS H - 1: City Manager's Report Mr. Lynn talked with Quentin Taylor concerning the Airport Manager. They did review and consider this but would cost them in the neighborhood of $77,000. He is now and has been Director of Finance for East Cleveland. He should be here between February 10th and 17th. He asked if there were any objections from Council and there were none. H - 2: City Attorney's Report Mr. Baldwin reported the taxicab commission held their first meeting. They granted Bert Williamson one cab permit and Vi Sullivan two permits. The title plan is coming along fine. Bob Norene has been more than cooperative. We will be able to determine the City's interest in each parcel. The recodification is moving along. The criminal aspects are sticky. The District Attorney and Public Defendor are aiding in this area. He anticipates a•work session soon on the first chapter. Mr. Baldwin is working on clearing out minor suits that have been pending for a few years. The City Attorney reported that with the passage of the Zoning Ordinance, we are left with one case sitting in our laps. Councilman Morgan asked what our percentage was. Councilman Steiner asked the City Attorney to review the case and make a recommendation to Council. Councilman Steiner asked the status of the suit against the City on the assessment district. Mr. Baldwin stated there has been a motion to dismiss and will look into this. H - 3: Mayor's Report Mayor Elson reported on the meeting -with Representative Leo Rhodes. The Mayor and Frank McIlhargey met with the Corps of Engineers on December 20th. Mayor Elson was pleased that the Corps is doing much more study than he anticipated. They are looking at eight different areas for medium draft channels. Their report will be sent to Portland and then back to Alaska for Public Hearings from different agencies. Mayor Elson stated the next Council meeting is scheduled for a week from tonight and so is the Planning $ Zoning meeting. He will see if Planning $ Zoning can meet on Monday or Tuesday. H - 7: Borough Assemblymen's Report Assemblyman Steiner reported on the Assembly Meeting of January 7, 1975. I Ordinance 74-67 - Amending KPC 20.40.0O5(a), a housekeeping ordinance, passed. Ordinance 74-70 - Enacting a Zoning Code for the City of Kenai Municipal District passed unanimously. Ordinance 74-71 - Authorizin the incurring indebtedness for G.O. Bonds in the amount of 13,500,000 to be used for the purpose of constructing and equipping additions to the Kenai Central High School, passed unanimously. Resolution 75-1 - Calling for a special election for bonds for Kenai Central High School passed. Ordinance 75-1 - Repealing KPC 18.05.05 to delete the requirement for 25 day period between introduction and public hearing on Ordinances was introduced. Ordinance 75-2 - Confirming the results of the special election of June 5th concerning the South Kenai Peninsula Hospital Service area, passed. Resolution 74 -SS - Requesting enactment of a Statute abolishing the Alaska ABC Board and returning powers regarding liquor licenses to City Councils and Borough Assemblies, was passed. PERSONS PRESENT NOT SCHEDULED TO BE HEARD: Oscar Thomas Councilman Thomas stated he had some questions on Mr. Lynn's memo in regard to the tmergency Medical Service. He is not sure he understands what he is talking about. We will be operating under the hospital umbrella area wide service area. A tax can be levied toward the operation of a communication center estimated at one-sixth of a mill. Is the•City of Kenai personally paying slightly over two mills. Mr. Lynn stated yes, when you figure the cost of operating the comm center. Right now, essentially we have three firemen who are not counted as firemen by the Insurance Services Office: They are counted as dispatchers. So you add their salaries'in plus the two women dispatchers and your cost of maintaining equipment, its right at two mills. Kenai was one of the two areas that did have a plan ready to go. There are'still some details and inequities to be worked out. An Emergency Medical System could be set up within the boundary of the hospital service district with Kenai as the main dispatch because of the facility and the equipment that we have. We are hoping the hospital district will have a line item budget for a communication contract and would negotiate with us. Councilman Thomas asked how long do you think it.will be before this thing is put together or find out if its not going to go together. Mr. Lynn asked Chief Shirnberg to speak. Chief Shirnberg stated this concept originated about three years ago and an E.M.S. Committee was formed through the Greater Anchorage Borough. The Federal Government has available considerable amount of grant money to implement the program. Kenai was one of two areas that was organized out of the entire State of Alaska that has done its homework, met all the require- ments and forwarded all the necessary documents. We received very strong assurance and the opportunity for us to receive the funding is very good. It will probably take anywhere from 30 to 60 days to realize what is going to occur and the grant has to be rewritten at the State level. If we can find the funding sdurce to get this thing off the ground"for one year then we hope to find an umbrella that is large enough service area. The communication cost to all of us is going to be substantially less and the level of service is going to be improved tremendously to all agencies. One other thing they accomplished, they established seven regions to begin with and they had it modified to nine because we were included in the Anchorage region. We managed to isolate the entire Kenai Borough to one region. There is alot of work to be done and some hurdles to cross, but will keep working on it. MEETING ADJOURNED i1:S0 P.M. ALASKA 99501 f� December 19, 1974 Honorable Mayor and Council City of Kenai Kenai, Alaska Gentlemen: Pursuant to -your request regarding clarification of our billing in relation to the estimated fee for the audit of the City's financial statements for the year ended June 30, 1974, we submit the following comments for your considerations: i As stated in our letter of March 7, 1974, the fee of $17,500 was based on estimated hours involved in the audit. The audit time of. -the prior year was the only base available on which to compute an estimate for the current year. When consid- eration is given to the condition of the prior year records and City staff. -then available for assistance, it is obvious that, a reliable estimate was undeterminable on this basis. Therefore, the proposed estimate was compiled on the basis of estimated time required to perform each of the audit functions required for the various departments and Funds of the City and assumed that all bookkeeping functions would be performed by City staff, various schedules and -reconciliations requested from Mr. Chen would be provided, and that our functions would be limited strictly to auditing. During the course of the audit, however, we found that various items had not been completed and that City staff time to perform these items was not available. As these items arose and were accomplished by our staff, their impact on the audit fee was discussed with Mr. Chen. It was our understanding that Council was then informed of the situation. The following items caused additional audit staff time and were detailed on our billing to you: 1) Special assessment funds as recorded on the City's records include deferred interest for future years in the receivables. This treatment is not in accordance with generally accepted accounting principles and required considerable staff time in computing the amounts deferred. The alternative was to qualify the auditor's report. In addition to this, the City changed its treatment of payments made by The General Fund for debt ser- vice for amounts that should have been collected I f ARTHUR YOUNG SL COMPANY Honorable Mayor and Council City of Kenai December 19, 1974 r -2- by special assessments and applied to debt service. This change also cost additional audit time to determine that the amount established as a receivable in The General Fund and a payable in The Special Assessment Fund for the collection deficiencies in the current and prior years was reasonable. 2) During the audit for June 30, 1973, information concerning the cash activity of various amounts of The Fire Department were not available for inclusion in the City's Fire Department revenues and expenditures. We requested that City staff prepare an analysis this year to the date of closing these various accounts. The result was, that we were presented with a large volume of invoices, bank statements, etc., and requested by the City Manager to prepare such analysis ourselves because of a dispute in progress at the time. We advised that this would result in an increase in the fees. 3) We requested that the Trust and Agency Fund accounts be analyzed and &-reconciliation of year-end balances be furnished us. This was not done and resulted in analysis by our staff of all the trans- actions for the entire year to determine the errors made during the year and included in the year-end balances. 4) Consultation time with City personnel regarding P• accounting treatment and financial presentation of How- bond refunding transactions was anticipated. ever, several lengthy discussions regarding a City ��L►��•� payment to the sinking fund for refunded bonds and treated as a General Fund asset for a prepayment were not anticipated. The treatment we suggested had a direct effect on The General Fund balance and was repeatedly met with strong opposition. Again, the only alternative was a qualification to the auditor's opinion. This treatment increased the finan- cial recordings considerably and required additional audit time in examining numerous adjusting journal entries that were somewhat difficult to interpret. 2) The three Airport Funds were treated as one fund in the budget, General Fund charges for services, and in the accounts receivable analysis furnished us. These three funds are established as separate entities by ordinance and require separate financial reporting. City staff was not available to segregate this activity for us and thus required additional audit staff time. j 3) We requested an analysis be furnished us that 1 provided the source of authority and the amounts for budget re- visions and appropriations. Instead, we were presented with the final revised budget and were required to research authorizations / ourselves. Most of the above items indicating areas where improve- meats are deeded were mentioned in ot4r.managemeat letter and/or discussed with Council. We recognize the improvement in the accounting records accomplished by Mr. Chen and the initiation of control over budget and various asset and liability accounts i of the various funds. However, the excess of the audio, fee over the estimate should indicate to Council the need and feasibility of additional trained staff in the accounting department and the need for increased control and efficiencies in accounting procedures. Situations such as this are usually unavoidable and always undesireable, not only because of the effects on your budgets and expenditures but also because they tend to damage client/auditor relationships, and because they hinder effective r scheduling of audit staff, cause missed target completion dates on yours and other engagements, and audit staff time accomplishing r_ bookkeeping functions which could be better utilized on productive audit engagements elsewhere. r t -I I" r. 1� It 1 f f. The greatest portion of the increase is for salary adjustments which will place employees at the range and step called for by the Position Classification Plan and the employee's length of service. This increase would amount to $19,902. Another area of increase amounting to approximately $16,836 would result from adoption of the revised Personnel Manual with the largest portion of the increase going toward Police overtime which I believe will go into effect in the near future with a court decision upholding the Fair Labor Standards Act for Public Safety personnel. A third area of increase would result from payment of the Arthur Young and Company invoice in the amount of $3,756 for auditing services. A final area of increase amounting to $37,000 would be distributed to various departments, particularly Public Works and to the Contingency Fund. This increase is necessary because of the increased cost of materials, the low original estimate in the budget for parts and materials, and the lack of maintenance in the past. Altogether, the requested increases for the current fiscal year amount to $77,494. As a matter of timing, I would suggest that the Council withhold passage of resolutions 75-1 and 75-3 until a decision is made as to whether or not Ordinance No. 2S4 -7S is passed. The City feels that area developments contemplated over the next several years poses strong prospect for the development of City river front lands. Additionally, the State funds to be made available to the City for harbor facilities development needs to be phased in with a basic area development plan. Aside from the conclusions that the Corps will make relative to the feasibility for medium draft and small boat harbor facilitiev at the Mouth of the Kenai River, Elson noted that the City was hopeful that the Corps study could be a source for: r' 1. Basic economic information to determine the present value of river activities to the economy of the community and area, data needed as basis for further private and public -- investments. 2. Physical characteristics of the River for the purpose of local planning and engineering considerations toward new development. The Corps representatives advised Mayor Elson that the Corps study would not be a source for such planning information. In its economic analysis, the Corps has considered only those James Elson, Mayor,`- City of Kenai. Alaska January 8, 1975 '~4.7 Page 2 economic activities to be influenced by the development of such harbor facilities and therefore does not need to conduct a coinplete audit of the total influence of the river on the community's economy= nor would this study by the Corps provide any details relative to the physical char- acteristics of the river other than the review necessary to establish cost estimates. Corps representatives advised that the draft report is now being written and following its review by the Corps Division Office in Portland, Oregon, would be given review at a public hearing in Kenai early in the year. As insight to the study and considerations appearing, at that point in time, as potential conclusions, Corps repre- sentatives noted Small Boat Harbor Consideration: Eight alternate small boat harbor proposals considered ranging in cost from $3.4 -million to $10 -million. On the other side of the cost/benefit comparison, the Corps finding indicated that annual benefits to be derived fall far below that needed to qualify even the lowest estimated project. Benefits considered were primarily related to established dollar savings for boat damages to a fleet of 400 commercial fishing boats. The estimate of annual damages was given as $44,000. Medium Draft Harbor. - The Corps current estimate for developing a medium draft harbor in the Mouth of the Kenai River is $40 -million. Such would provide 15 ft. depth and accommodate the average 12 -ft. draft tug and barge plying Cook Inlet waters. The dollar value for annual benefits needed to qualify the project on a 1/1 cost -benefit ratio is $2,850,000. Benefits considered by the Corps were essentially in potential freight savings should tonnages be moved from Anchorage by barge rather than truck. Benefits measured were considerably less than the minimum to be required. In further discussion, Mayor Elson: 1. Reviewed the erosion problem of the river and potential means for combatting those problems. 2. Asked for Corps assistance as a technical advisor in City water front planning. Lynn, City Manager December 31, 1974 EMERGENCY MEDICAL SERVICES COMMUNICATIONS For the past few months, Administration has been looking at various ways in which we can save the City money. One of the ways we considered was to contract with other agencies to provide communi- cation services. The State has enacted an Emergency Medical Service Program to be implemented state wide. The pro- gram is quite broad. One part deals with communi- cations. After a series of meetings, we have been able to get North Kenai Fire Department, the Central Hospital District Administrator and tentatively the State Police and the Soldotna Fire and Police to concur with the idea of the City of Kenai providing dispatch services. In order to bring the various agencies together and get them to agree, certain points had to be negotiated. These are: 1. The City of Kenai will operate the Emergency Medical Services Communications for all of the various agencies. 2. Each agency will have a person appointed to the Communications Board which will be responsi- ble for determining the operating procedures to be followed by the Communications Center. This is necessary so that each of the agencies involved would be assured that the vital communications link in operating procedures to be followed would permit them to carry on their responsibilities. I do not anticipate that this will create any problems for the City of Kenai. I M EMERGENCY M UICAL SERVICES COMMUNICATIONS December 31, 1974 - Page Two 3. The City of Kenai would then contract with the Central Peninsula Hospital Service District for Emergency Medical Services communication. This would be carried as a line item expenditure in the hospital budget and a line item revenue item in the City of Kenai Budget along with a new communications budget. By operating under the Hospital umbrella, an area -wide tax can be levied toward the operation of the communications for Emergency Medical Services. I estimate that the area -wide tax for Emergency Medical Services Communication will be one-sixth of one mill. The City of Kenai is personally paying slightly over 2 mills. Consequently, there will be a considerable reduction in the cost for communication services to the City of Kenai as well as to all the other participating agencies. 4. The City of Kenai will send a representative to the' Emergency Medical Services Planning Conference in Anchorage on January 6, 7, and 8. At that time Grant proposals will be accepted. The EMS Director for the Kenai Peninsula has assured me that we will receive a Grant which will pay for the complete operation of the Communications Center. I am very pleased with the way this project appears to be turning out. Not only will it enable local government agencies within the Central Peninsula Hospital Service District to provide better Emergency Medical Services but it will also reduce the communications costs for Kenai, Soldotna and the North Kenai Fire District. Once all of the details have been ironed out, I will prepare a complete re ort to you with recommendations for necessary action to be taken.
