PERSONS PRESENT NOT SCHEDULED TO BE HEARD ADJOURNMENT CITY OF KENAI ORDINANCE NO. 355-77 AN ORDINANCE PLACING ON THE BALLOT FOR TIE NEXT GENEItAI, ELECTION THE QUESTION AS TO 1+7NETHER TILE MUNICIPAL OFFICERS OF THE CITY OF j KENAI SHOULD BE EXEMPT FROM THE PROVISIONS OF TIIE FINANCIAL DISCLOSURE,' STATUTES (AS 39.50) AND FROM THE PROVISIONS OF THE ELECTION CAMPAIGN FUND DISCLOSURE STATUES (AS 15.13) REQUIRING REPORTING OF CONTRIBU'T'IONS AND EXPENDITURES FOR POLITICAL CAMPAIGNS. WHEREAS, the provisions of AS 39.50 require Municipal Officers, including Mayor, City Manager, Council members, and Planning Commission members to file reports concerning finances and also the finances of spouses, dependent children, or nondependent children living with them with respect to the source of all income over $100, including capital gains, identity of each business in which any of them was a stockholder, owner, officer, director, partner, pro- prietor, or employee, the identity and nature of each interest owned by any of them in any business, the identity and nature of each interest in real property, Including an option to buy, any loan or loan guarantee made to any of them, the identity of each trust in which any of them hold a beneficial interest, and other such financial information normally considered of a private and confidential nature; and WHEREAS, AS 39.50.145 provides that a Municipality may exempt its Municipal Officers from the requirements of the chapter if a majority of the voters voting on the question at a general election vote to exempt its Municipal Officers from such requirements; and WHEREAS, the positions covered require a great expenditure of time in the public interest and most persons in these positions receive little or no payment therefor; and WHEREAS, compliance and participation in AS 39.50 discourages and limits the number of parties willing to donate their time to the public service of the City of Kenai; and WHEREAS, the bookkeeping involved, the technicalities of reporting required and the invasion of privacy discourages contributions to local campaigns, expenditures in local campaigns, and makes it difficult to obtain competent candidates willing to run for office in the City of Kenai; and WHEREAS, AS 15.13.010 provides that a Municipality may exempt itself from the requirements of the chapter if a majority of the voters at a general election vote to exempt the Municipality; and f -Z ORDINANCE NO. 355-77, Page Two WHEREAS, the Council of the City of Kenat believes that the voters of the City j of Kenai should again be given the opportunity to decide whether or not either or both of these laws should be applicable to public offices within the City of Kenai, NOW, THEREFORE., BE IT ORDAINED 13Y THE COUNCIL OF THE CITY OF KENAI as follows: Section 1: There shall be placed on the ballot for the regular City election of October 4 4977, with appropriate propositon numbers to be designated by the Clerk, the following question: "Shall the Municipal Officers of the City of Kenai be exempt from the provisions of State law (AS 39.50) relating to conflicts of interest or financial disclosure of candidates and holders of P^unicipal offices?" Section 2: There shall be placed on the ballot for the regular City election of October 4, 1977, with appropriate proposition numbers to be designated by the Clerk, the following question: "Shall the elected Municipal Officer of the City of Kenai be exempt from a the provisions of State law (AS 15.13) relating to election campaign fund disclosure or to reporting of contributions and expenditures in election campaigns?" ELSON, MAYOR FIRST READING: AuRlust 3, 1977 SECOND READING: EFFECTIVE DATE: CITY OF KENAI ORDINANCE NO. 356-77 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, TRANSFERRING FUNDS FOR THIS' PURPOSE OF REMODELING THE AIRPORT TF,RAIINAL BUILDING WHEREAS, the City of Kenai desires to make more leasable space available within the Airport Terminal Building, and WHEREAS, to accomplish this goal the City offices must be moved, and WHEREAS, this move will necessitate the expenditure of funds for electrical iviring and remodoling of the Airport Terminal Building, and WHEREAS, proper accounting practices require that all transfers between funds be made by ordinance. WHEREAS, Redoubt Way from Willow Street to the Kenai Mall is a well traveled access road in need of improvement, and WHEREAS, paving of Redoubt Way with appropriate drainage would provide benefit to all concerned property owners and the public. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA as follows: Section 1: Upon direction of the Council, the City Manager has made a survey and report concerning the need for and estimated cost of paving and installing appropriate drainage for Redoubt Way, Willow Street to Menai Shopping Plan, and has prepared a preliminary assessment roll. Such assessment roll has been on file with the City Clerk at least thirty (30) days prior to the public hearing on the necessity for the improvement. It- Section 2: Public hearing was held on , 1977. Notices of such public hearing were sent and published as required by the Code of the City of Kenai. Section 3: Protests filed with the City Clerk concerning the proposed Improve- ment amount to less than the number required to stop the proposed improvement. ROLL CALL Present: Betty Glick, Richard Morgan, Dan Whelan, Edward Ambarian and James Elson Absent: Tom Ackerly and Walter Sweet AGENDA APPROVAL Council approved the following additions to the agenda: G-1: Addition of bill from Harold Galliett to Bills to be paid - bills to be ratified 1 G-11: Ordinance No. 357-77, Paving of Redoubt Way 13-12: Resolution 77-101, Awarding contract for radio maintenance U-13: Tesoro Alaskan Petroleum Corporation/Lease of Terminal Space Councilman Whelan stated that he would object to additions to the agenda here- after and requested all items be included in the packets distributed on Friday. B. PUBLIC HEARINGS B-1: Ordinance 353-77 - Increasing Revenues/A?prolpriations - Anti -Recession E Revenue Sharing Funds in the amount of $22,002 ( Mayor Elson read Ordinance 353-77 by title only. "An ordinance of the Council of the City of Kenai, Alaska increasing estimated revenues and appropriations in the amount of $22,002 for Title U, Anti -Recession Revenue Sharing Funds." City Manager Wise advised that these funds would be utilized for the increase in the Fire Department/Salary and Wages. Mayor Elson opened the hearing to the public. There was no public comment. MOTION: Councilman Whelan moved, seconded by Councilman Morgan, for adoption of Ordinance No. 353-77, increasing estimated revenues and appropriations in the amount of $22,002 for Title 11, Anti -recession revenue sharing funds. Motion passed unanimously by roll call vote. L.. Ma11,loll 1, 1111 In V 11 i f KENAI CITY COUNCIL, REGULAR MEETING, AUGUST 3, 1977 C. PERSONS PRESENT SCHEDULED TO BE BEARD Page 2 C -l: Theodore L. Carson, Jr. Representing Yoshi & Ruth Shiohira Mr. Carson came before Council requesting Council consideration to extend L Mr. and Mrs. Shiohira's lease from the original 55 years (with approximately 48 years remaining) to a 99 year lease on the property. Air. Carson further advised that this extension would aid the Shiohira's in financing at the bank and would assist in future development and possible sale of the business. Councilman Ambarian inquired if the City would be extending the Shiohira's lease or Mr. Ferguson's lease as Mr. Ferguson had assigned lease of Lot 3, Gusty Subdivision to the Shiohiras which was approved by Council on August 13, 1976. City Attorney Williams advised that in order to extend the lease, approval would have to be obtained from Mr. Ferguson who has the ultimate responsibility for the property. Mayor Elson stated that any Council action would be premature and directed that . the matter be resolved by Administration with Mr. Ferguson and the Shiohira's and terms be set, etc. and final agreement be brought back to Council for consideration. D. MINUTES D-1: Minutes of the regular meeting of July 20, 1977 Councilman Whelan requested that the following addition on page six be Included: "Council instructed the City Attorney to notify Mr. Vadan contacting him IM night wire that if he has not responded ......." There being no further additions or corrections, the minutes stood approved as corrected. D-2: Minutes of the Special Meeting of July 29, 1977 The minutes of the Special Meeting of July 29, 1977 were approved as distributed. E. CORRESPONDENCE None F. OLD BUSINESS F -l: Periodic Estimate No. 8 - Brown Construction Company City Manager Wise advised that the work as requested at the prior meeting of restoring the construction sites had been completed. by the contractor and recommended final payment. 0 1 I KENAI CITY COUNCIL, REGULAR MEETING. AUGUST 3.1877 Page 3 Councilman Whelan inquired if the problem of restoring the areas to an acceptable manner had been resolved and was advised by Mr. Wise that for the privilege of tying onto the line. the property owners involved waived the right of restoration. Mr. Wise further advised that as the line was not the property of the City of Kenai at the time of tie-in, there was no cost involved to the City. Councilman Ambarian inquired if the property owners would be required to pay assessments? After considerable discussion with regard to assessments, etc., the following action was taken. I. MOTION: Councilman Ambarian moved, seconded by Councilwoman Glick, to table Periodic Estimate No. 8, Brown Construction Company, until the question of assessments and the tie-in to the line has been satisfied. Motion passed unanimously by roll call vote with Councilman Morgan abstaining. F-2: Lease of Airport Bar & Cafe Mr. Wise advised that Lynn Gillis and Don Krueger had taken the lease to their attorney for review and were reluctant to sign the lease until the question of the liquor license being available is resolved. Mr. Wise further reported that ' the ABC Board would not consider issuance of the license until the Board received a commitment to lease the facilities. City Attorney Williams advised that she talked with the attorney from Anchorage representing Gillis/Krueger and he saw the situation with the liquor license as a potential problem and advised his clients ' not to enter into the lease with the City until the matter was resolved. City Attorney Williams suggested that Council approve an "Agreement to lease" and advise the ABC Board of the transaction hereby enabling the process for the transfer of the liquor license to begin. MOTION: Councilman' Morgan moved, seconded by Councilman Whelan, that the City of Kenai notify the Alcoholic Beverage Control Board advising that the City of Kenai is in basic agreement with the terms of the lease as proposed and will execute the lease as soon as the issue of the liquor license is resolved and the Council further directs the City Manager to enter into an Agreement to Lease with Lynn Gillis and Don Krueger for the Airport Bar and Cafe facilities. After review of the lease form itself, Councilman Morgan, with consent of second, withdrew his motion. _ N: 1 MOTIOCouncilman Whelan moved, seconded by Councilman Morgan, to authorize the City Manager to enter into a lease with Gillis/Krueger for the Airport Bar and Cafe facilities as proposed. Motion passed unanimously by roll call vote. ! KENAI CITY COUNCIL, REGULAR MEETING, AUGUST 3, 1977 Page 4 F-3: Request for Repurchase of Lot 3, Block H. Beaver Creek Alaska Subdivision :s City Attorney Williams advised that Council had taken action in July of 1976 setting aside Lot 3, Block H, Beaver Creek Alaska Subdivision. Tax Parcel j 041-080-0300 for immediate public use by the City of Kenai. The owner of record has requested repurchase and as the City of Kenai has not yet paid the taxes perhaps consideration could be given for repurchase. The owner of record will have to pay all back taxes, costs of foreclosure, penalties and interest and any other costs incurred in the transaction . ' MOTION: Councilman Morgan moved, seconded by Councilman Whelan, to direct the City Attorney to prepare a resolution rescinding Resolution 76-35. Motion passed unanimously. G. NEW BUSINESS 0-1: Bills to be paid - bills to be ratified MOTION: Councilman Morgan moved, seconded by Councilman Whelan, for approval of bills to be paid and approval of those items listed for ratification. Motion passed unanimously by roll call vote. MOTION: Councilman Morgan moved, seconded by Councilman Ambarian, for approval of payment in the amount of $6,834.28 to Harold H. Galliett, Jr. for professional engineering services rendered in connection with EDA Water Project 07-01-01684 '1 for the period from February 20, 1977 through May 14, 1977. Motion passed unanimously by roll call vote. G-2: Ordinance No. 354-77 - Installation of water line is General Aviation Apron, 1 Mayor Elson read Ordinance 354-77 by title only. "An ordinance of the Council of the City of Kenai, Alaska, finding that the installation of a water line in the General Aviation Apron of the Kenai Municipal Airport is necessary and will benefit the lessees affected and directing that the City proceed with construction of the improvement." Mayor Elson inquired if the procedure as outlined in The ordinance would follow the guidelines set forth by the Code and was advised by City Attorney Williams that the City Manager must submit an actual survey and report and all property owners concerned must be contacted and the matter advertised four times consecutively -- all requirements of the Code would then be met. EM nn i_ i.!!. --"-LM KENAI CITY COUNCIL, REGULAR M-M.TING, AUGUST 3, 1977 Page 5 MOTION: Councilman Morgan moved, seconded by Councilman Ambarian, for introduction of Ordinance 354-77, installation of a water line in the General Aviation Apron of the Kenai A"unicipal Airport and amending such ordinance under Section 5 deleting "of the remainder" from 500 - Funded by Local Public 11'orks monies...." and inserting "Of the Remainder: 50% - Funded by Local Public Works monies....." 1 Motion passed unanimously by roll call vote. G-3: Ordinance No. 355-77 - Providing for question to appear on ballot Financial/Campaign Disclosures Mayor Elson read Ordinance 355-77 by title only. "An ordinance placing on the ballot for the next General Flection the question as to whether the municipal officers of the City of Kenai should be exempt from the provision of the financial disclosure statutes (AS 39.50) and from the provisions of the election campaign fund disclosure statutes (AS 15.13) requiring reporting of contributions and expenditures for political campaign." Councilman Whelan stated he felt that under Section 1 the issue of municipal officers and appointed officers should be two separate items and the City should prepare an ordinance requiring that appointed officers of the City (City Manager Finance Director, etc.) file financial disclosures. MOTION: Councilman Morgan moved, seconded by Councilwoman Glick, for introduction of Ordinance 355-77, placing on the ballot of the next general election the question of whether or not municipal officers of the City should be exempt from financial/ campaign disclosure requirements. MOTION: Councilman Morgan moved, seconded by Councilman Whelan, to amend the ordinance to include in the body the follow: "Whereas, the Council believes that financial disclosure should be made pursuant to local regulation rather than by the State regulation in order that the disclosure serve legitimate community purposes within the City of Kenai, and Whereas, it is the Council's intention to pass a local ordinance regulating financial and campaign disclosures of municipal officials of the City of Kenai." Whereas, proposals were solicited for City radio maintenance, and Whereas, the most economical proposal was Motorola at $500 per month versus Advance Controls, Inc. (a more extensive coverage) at $1,072.90 per month. Now, therefore, be it resolved by the Council of the City of Kenai. Alaska, that the maintenance agreement with Motorola Communications & Electronics, Inc. in the amount of $500/month be hereby approved." REPORTS H-1: City Manager's Report Page 9 —..+ � {;-;.syr .^' _ -- �" -• � ��iJlllly II Id (a) Traffic Survey - Chief Ross is in contact with State and will be answering questions posed on traffic light requirements, etc. and will report back to Council at determination of aurvey . (b) Civic Center - joint funding would be available, perhaps, as an addition to the library and on a 60/40 basis. (c) Boat ramp - request for lease of land south of the access to the landing ramp. Councilman Morgan requested that the matter be investigated as he felt the land had been dedicated for recreational purposes. (d) Survey of lands between Locko Building and Elks Club -- two very different surverying cost estimates received and Administration will clarify before proceeding with the matter. (e) The Telephone Company - submitted a proposal to provide equipment to the City at a cost to the City of $7,000. Mr. Wise stated that the City would then just pay a monthly service he and telephone call charge to Glacier State. However, it was the City Manager's recommendation not to consider the Telephone Company proposal any further as the City will be moving to other quarters within the next five years and the cost would not be feasible. Councilman Whelan stated that the Council had not reviewed the proposal from The Telephone Company and would, therefore, not be able to take action on the matter. Council requested that the proposal be made available to them for their review. MAYOR & COUNCIL - QUESTIONS & COMMENTS Councilman' Whelan inquired if Administration had started preparing policy procedures for the purchase or lease of City owned lands and was advised by Mr. Wise that his Department had not actually started the actual preparation. Councilman Whelan inquired as to the repair of the street lights that had been knocked down and Mr. 1011se reported that the City was in the process of determining the cost of repair and have contacted the individuals responsible and advised them of their liability. Councilman Whelan asked when the new Well would be an line and Mr. Wise advised that it would not be until the pumps are installed and the City did not have word on the pumps as of this date. Councilman Whelan also stated that the Bond issue would be before the voters in October and Administration has not researched cost and what $300, 000 would build with regard to a Civic Center. Mr. Wise advised that the State had offered $94,000 in matching funds for the Reservoir project but the City had not received word from EDA. Mr. Wise stated that he would request a Special Meeting called to accept the grant offer when received. Mr. Wise reported that he was awaiting endorsement from the Borough with regard to paving the Terminal Loop. ■ Y_ KENAI CITY COUNCIL, REGULAR MEETING, AUGUST 3. 1977 Page 10 Councilman Whelan requested that Council be kept abreast of the well project now that the City did not have a Public Works Director overseeing the project. F f ' Council directed the City Manager to use the Recreation Department maintenance j personnel in doing some clean-up work at the cemetery. i Councilman Morgan inquired as to the situation on the bluff erosion and its relation to the sewer system as reported to the local newspaper by the former Public Works Director. Mr. Wise advised that he had not heard of a direct relation between the s sewer line and the erosion problem until he read the newspaper article. -� Councilwoman Glick reported to Council that River Bend Sand and Gravel were draining their gravel pit and great amounts of water were draining on to the property owners land across the road. Councilwoman Glick reported that the culvert was not adequate and further stated that the private property owners in the area were having j difficulties with their sewer systems and their lands were being damaged to a point j where it was affecting the value of the property. Councilwoman Glick stated it was her opinion that the Council make some provision to protect these private property owners. Mr. Wise advised that River Bend Sand and Gravel did submit their develop- ment plan to the Planning Commission, which included the drainage, and the plan had been accepted. Councilwoman Glick stated that she did not feel that the Planning and Zoning Commission realized the great amount of water that would be flowing. Mayor Elson stated that River Bend Sand and Gravel were to only excavate to their water table. Councilman Ambarian stated that the City had required excavation would not exceed the water table and Mr. Bergen had agreed (see Planning & Zoning Minutes dated May 12, 1976) . Mr. Lofstedt, an adjoining property owner, advised Council that the draining onto his land was creating a swamp and also the gravel pit was visible from the roadway and he was under the impression that the excavators were to leave a natural tree screen. Mr. Lofstedt requested that Council take immediate action and suggested that the pit could be drained to the east into the natural creek bed. Mayor Elson stated that Administration should investigate the matter immediately and determine if River Bend Sand & Gravel had violated their extraction of natural resources permit and if so, advise River Bend Sand & Gravel that their permit is going to be revoked immediately and order Mr. Bergen to stop development. j Administration was directed to proceed and bring the matter back to Council at their { next regular meeting. Councilwoman Glick stated that with regard to the commercial business operating out of a mobile home in Old Kenai Townsite, she had called the telephone number and found the business to still be in operation. Councilwoman Glick stated that this was a direct violation of our ordinances and requested that Administration proceed on the matter immediately. H-2: City Attorney's Report City Attorney Williams reported that the Supreme Court had ruled to pay in favor of Mr. Filler. Karl Walter, representing the City, was filing a peition for reconsideration y as a number of items were not addressed in the Opinion. City Attorney Williams advised that she would send copies of the Opinion to the Council. KENAI CITY COUNCIL, REGULAR MEETING, AUGUST 3, 1977 Page 11 Councilwoman Glick inquired as to the status of recodification and was advised by City Attorney Williams that there remained a tremendous amount of re -typing and legal time before it was in the final stages and ready for printing. �4 j City Attorney Williams advised that with regard to the Kenai Baptist Temple, their buyer still had earnest money down and the sale was imminent and that no further ' action would be taken on the case until the Judge has reviewed the matter which is set for September. H-3: Mayor's Report Mayor Elson requested an Executive Session regarding personnel matters immediately following the last item on the agenda. H-4: City Clerk's Report None H-5: Finance Director's Report Finance Director Ross Kinney advised Council that the auditors would be back in the office the next week and they were awaiting confirmations that had been sent out previously. H -B: Planning a Zoning Commission's Report Councilwoman Glick reported that the Committion meeting of July 27, 1977 had been cancelled due to lack of a quorum. H-7: Kenai Peninsula Borough Assembly's Report Mayor Elson reported on the meeting of August 2nd in which the Assembly approved rezoning in Valhalla Heights but denied rezoning in Highland Subdivision. Also among the business discussed, the Borough had allocated $50, 000 to the City of Kenai for use in paving the Airport Loop Road. With regard to financial/campaign disclosures, there will be three different propositions - financial and campaign disclosures for the Borough and campaign disclosure for the Service Area Boards. I. It is our position that the interests of the taxpayers and the airport would be best served by offering the land for lease by bid, using the appraisal as the lowest acceptable amount. We can offer no objection under our regulations, however, if the city were to, on the basis of two independent appraisals, negotiate with one party for the land in question. " S2.51 Airport NO " 40.98 CITY OF KENAI ORDINANCE NO. 358-77 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI AMENDING THE 1976 KENAI MUNICIPAL AIRPORT REGULATIONS WHEREAS, the Kenai Municipal Airport is becoming a training area for commercial aircraft, and WHEREAS, some of these commercial air carriers are not certified for service to the Kenai Airport and, therefore, pay no landing fees or otherwise contribute to the operational expenses of the Airport. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Kenai, Alaska, that: The 1976 Kenai Municipal Airport Regulations, as amended, are hereby further amended as follows: Section 13: Section 13.040 is hereby amended to read in its entirety as follows: 13.040: All commercial operators operating aircraft with a certified gross take -off weight of 4,000 pounds or over shall submit a report showing the total number of take -offs of different types of aircraft made on the Airport each month. This report shall be accompanied by the above use fees for that month and must be received no later than the 15th day of the following month. This report and fee does not apply to landing for testing of aircraft or training of personnel of aircraft operated by a firm serving the Kenai Municipal Airport by authority of the Civil Aeronautics Board or the Alaska Transportation Commission. Also, there are no provisions in this ordinance for any kind of disclosure of campaign expenditures which is the other area which Ordinance 355-77 puts on the ballot for exemption. B. Each municipal officer shall file a statement under oath with the City Clerk, within thirty (30) days after appointment to office specifying his business interests and income sources. C. Each municipal officer shall file a similar statement of income sources and business interests with the City Clerk not later than April 15 of each year that he holds office. Section 1-61: Contents of Statement A. The statement filed by a municipal officer or candidate under this chapter shall be an accurate representation of the financial affairs of the municipal officer or candidate and shall also reflect the business interests and sources of income for the officer's or candidate's spouse, dependent children and nondependent children residing with the officer or candidate, to the extent those sources of income or business interests are ascertainable by the officer or candidate. The statement filed shall include the following information relating to the municipal officer or candidate and the officer's or candidate's spouse, dependent children 1 and nondependent children residing with the officer or candidate. 1 1. The source of all income of $1, 000.00 or more received as dividends or interest; 2. The source of all other income over $5,000.00 including capital gains, received during the preceding calendar year; 3. The name and address of each business entity owned or in which an interest was held during the preceding calendar year, including a statement of the nature of the interest owned or held; 4. The name and address of each business in which he is an officer, director, manager, or employee during the preceding calendar year; S. A description of each interest in real property and a statement of the nature of the interest owned; 6. Each loan, loan guarantee or other indebtedness of $5, 000.00 or more, including the identity of the maker of the loan and each creditor and the nature and terms of the transaction; 7. A list of all contracts, bids or offers to contract with the City of Kenai during the preceding year, including those made through a proprietorship, partner- ship, or corporation in which he or a member of his family, or a combination of them, hold a controlling interest; S. A list of each mineral, timber, oil or other natural resource lease held, or lease offer made during the preceding calendar year, including those held or made by a partnership or professional corporation, or a corporation in which the officer or candidate or his spouse or children, or a combination of them, hold a controlling interest; and 9. A description of each business or financial dealings, transactions or arrangements entered into with any other municipal officer of the City of Kenai. C . The statement shall be filed on a form prescribed by the City Clerk. Section 1-62: - Modified Requirements for Professionals Notwithstanding other provisions of this chapter, medical doctors, dentists, psychologists, certified public accountants, and attorneys are not required to disclose, as sources of income, the names of individual patients or clients who receive professional services. This exemption shall not apply to the identity of any corporation or other business entity having a contract with the professional producing income of $5, 000.00 or more for services to its members or a defined group, nor to the identity of clients receiving services that do not fall within the candidate's or official's field of professional expertise. t 1 ORDINANCE 359-77, Page Three Section 1-63: Records Public 1 All statements required to be filed by this chapter are public records. Section 1-64: Refusal or Failure to Disclose A. If a candidate fails or refuses to file the statement required by Sections 1-60 of this Article, his filing shall be refused or, if previously accepted, shall be returned and his name shall be withheld or removed from the filing records of candidates. B. A person failing or refusing to comply with the requirements of this Chapter shall forfeit his nomination and, shall not be seated or sworn to the office for which he is a candidate. C. A person who refuses or knowingly fails to make a required disclosure of information as provided in this chapter or who files a statement containing false or mis- leading information knowing it to be false or misleading shall be guilty of a misdemeanor and upon conviction is punishable by a fine of not more than $300. Section 1-65: - Conflicts of Interest Prohibited A. A municipal officer, appointed commission member or employee of the City of Kenai may not solicit or receive money for advice or assistance given in the course of the officer's or employee's official duties for the City of Kenai. B . A municipal officer, appointed commission member or employee of the City of Kenai may not represent a client before the City Council for a fee. C . A municipal officer, appointed commission member or employee of the City of Kenai may not accept a gift, loan, gratuity or other valuable consideration, or a promise of any of them, with the understanding or agreement, expressed or implied, that the officer will cast a vote or give an opinion, decision or judgment in a particular manner, in a matter, question, cause or proceeding which then is or may by law come or be brought before him, or with the understanding or agreement that the officer or employee will, in his official capacity, act in a particular manner to produce or prevent a particular result. D. No Council person may vote on any question in which he has a direct or indirect pecuniary interest. Direct or indirect pecuniary interests shall be disclosed to the presiding officer prior to a vote on the question and the presiding officer shall determine whether the financial interest exists and whether the prohibition from voting is applicable. A decision by the presiding officer may be overridden by a unanimous vote of the members present, exclusive of the member presenting the possible conflict. Section 1-66: Definitions - as used in the Chapter A. If the income being reported is derived from employment by a sole pro - j prietorship, partnership or corporation in which the reporting person, the spouse or children, or a combination of them hold a controlling interest, that proprietorship, partnership or corporation may be designated as the source of income without specifying clients or customers if the business is one that is normally conducted on a cash basis and typically does not keep records or individual customers. In all other cases, the clients or customers of the proprietorship, partnership or corporation shall be listed as sources of income of the person whose income is being reported, the spouse, children or a combination of them holding a controlling interest. The City of Kenai hereby applies, in accordance with provisions of the Regulations for Financial Assistance to Coastal States, (CEIP), for preliminary engineering grant (308b) in the amount of $90,000, specified to develop a topographical map of the City of Kenai with a two foot contour interval. This grant application project directly relates to the provisions of public Acilities and services required as a direct result of new OCS energy activity. ( continued) ►'tl it•A CO.2�t tlz•rtt I F— i PART III (continued) New development planned and under construction in the City of Kenai as a direct result of OCS energy activity lies in the fringes of the existing developed area of the City. As these areas are developed they will impact the existing inner area by creating down stream drainage problems, problems relative to f upgrading the water distribution system and sanitary sewer trunk system, upgrading the water supply and the sewer treatment facilities. The City, with a land mass of some 5,000 acres and ` a 5,000 plus population, has a variety of capital improvement projects programmed for the next several years to alleviate the impact of this OCS related growth upon the City. One specific major project under consideration is to provide a loop to our rater distribution system. Currently, our source of supply, several wells, is at one end of the City, with the majority of our residences at the other end, some four miles distant, joined by a single water transmission line. A line failure within the first three miles of this line would deprive the City of water. A loopline is urgently needed to protect the health and welfare of current and future residents. The proposed ongi.nccri.ng study, leading to the development of a topographic map would enable the City to proceed with this water loopline, adequately balance the economic: and environ- mental impact, and preclude potential damn -e to the natural habitat for fish and wildlife now found in the Kenai area. The specific project to be funded by this grant application is a topographic study developing a topographic map with to o foot contour lines. Current plans call for controlled aerial photography within the City and translation therefrom to a topographic map. Justification for designation as an OCS related population impact area is as follows: 1. Announcement of sale of federal leases in Lower Cook Inlet scheduled for October 23, 1977 per Secretary of the Interior Andrus. . 2. Statement made by U. S. Senator Gravel on May 2S, 1977 to the Kenai. Chamber of Commerce to the effect that the Grouter Kenai Area (North Kenai, Kenai and Soldotna) will have the greatest impact of any area in the Cook Inlet. 3. The current oil and gas base of Central Alaska for exploration, development, servicing, utilization and processing is in the North Kenai area. ,�- 4. The City of Kenai is situated astride the only road to E the North Kenai area and is now and will be a mai-or r residential and commercial center for the Greater Kenai Econonic Region. With the expansion of oil and gas activity in the North Kenai arca, there will be a significant population impact on, the City of Kenai. The following amounts shall be contributed to cover all of the cost of the necessary field and office work directly related to this program, but excluding any general administrative or accounting work in the office of either party and excluding the cost of publication by either party of the results of the program. During the progress of the work all operations of either party pertaining to this program shall be open to the inspection of the other party, and if the work is not being carried on in a mutually satisfactory manlier, either party may terminate this agreement upon 60 days written notice to the other party. 7. The original records resulting from this program shall be deposited ultimately in the office of the party of the first part and shall become part of the records of that office. Copies shall be furnished to the party of the second part upon request. 8. The maps, records or reports resulting from this program shall be made available to the public as promptly as possible. The maps, records or reports normally will be published by the party of the first part. Public Hearing - Ordinance 355-77 This is the financial/campaign disclosure ordinance. The Council introduced it as prepared and, of course, did direct the Administration that we prepare a local financial disclosure ordinance which will be introduced under "New Business". 2. Ordinance 356-77 A public hearing on remodeling of the Airport Terminal to include moving both the City offices and alterations for the new lessee of the restaurant/lounge. 3. Old Business —Periodic Estimate #8 - Brown Construction I do not have the data from the Inspector on this but hopefully I will ,have some data for the Council and we shall then be able to act on this particular pay estimate. 4. Lease of Airport Bar & Cafe Again we list the lease of the Airport Bar and Cafe. The reason for this is to discuss the status of the termination of the bar and cafe and clearance of same and if we actually have the signed lease available from Krueger/Gillis, we would like to have it properly ratified by the Council. 5. Resolution 77-100 This amends the Local Roads & Trails Program for 1977-78. This relates to the five roads that the City authorized engineering on and we have now applied for use of Federal funds, LR&T funds and City bond funds for this $442,000 project: The appendices have been prepared from the data received from the engineer and we have discussed it with Department of Transportation i representative and we will apparently have no problem getting assurance of State funding. it is simply basically a matter of cancelling by this resolution the two previous resolutions that committed the monies and properly define projects to be done. - 1 6. This is a report on River Bend Sand and Gravel. The Administration has prepared a letter to River Bend Sand and Gravel in draft stating that they have 60 days from time of receipt to correct their down -stream flooding s problem. In the event it is not corrected, I will revoke their permit. I have drafted this letter and sent it to the City Attorney for her review. I hope that she can find that it is legally acceptable and we will be able to dispatch it prior to the Council meeting. 7. Ordinance 358-77, which I am asking to amend the Airport Regulations. 0 I CITY MANAGER"S REPORT, Page Two I believe that this ordinance is self-explanatory. Some major commercial ,airlines have been using the airport for training and they are not now entified for this airport and, therefore, I believe should contribute to the operation and up -keep of the Airport. Currently, all training k or instructional flights are exempt from landing fees. I have asked by my proposed amendment that only those authorized to serve the air j field by the CAB or the Alaska Transportation Commission be exempt from j landing fees. S. Ordinance 389-77, the City's financial disclosure requirements. I believe this will based on Kodiak ordinance and hopefully will meet the City's requirements and will be able to have it adopted prior to the : referendum on the recession of application of State law relative to Financial Disclosure. 9. This is the resolution requested by the Council to formally rescind the dedication of certain lands as a future fire substation. 10. This is a in -part payment to Malone Surveying for their work on the FAA complex south of the Spur Highway. 11. Resolution prepared for 1978,79, and 80 LR&T program and these are my concepts and my estimates. The consideration I have here is that we can use Local Roads & Trails programs with local monies to develop a sizable project. I feel that Tinker Lane should be paved not only because of the Jr. High School traffic but also because of the oiler's traffic and by properly forming an assessment district we can minimize ("'he cost to the individual property owners and provide an adequate facility. i6 second program is the paving of Highland -- that again is an estimate and it appears to me that this area is beginning to move on re -development and that it would be desirable if we would complete some of the shorter segments in that area to make the area more attractive than it is at this moment. k 12. A resolution as the Statement of Assurances required by the Federal Revenue Sharing. 13. Resolution 77-104 authorizes submission of some five CEIP grant applications. These are 100% funded grants by the Federal Government through the State. Considerable monies have been allocated by the State for use in the CEIP program. I know of no one who has formally submitted an application for these funds. The actual distribution of funds is currently in a "hold" status due to what they call a "G-2" process for inter -state allocation formula which the Federal Government must approve. There is a request by the State that we submit applications prior to the first of September for the first fiscal year's allocation. The applications I have submitted here essentially are in the priorities I feel are necessary for the City. Number one is a topographical study which will be aerial photographs and from that develop a contour map of the City and actually more than that it will develop a drainage pattern, it will give us the data we need for location for location of water and sewer lines and hopefully be a major tool in the development of major land use concepts for the City nd identify some of the problems we have with River Bend Sand and Gravel. `R-ihe second item is a $125,000 for engineering money. This is preliminary engineering money to design some additional streets for up -grading some existing streets and push some new streets through. You will find the list included in the application. The next item is monies for water and Im l CITY MANAGER'S REPORT, Page Three sewer lines. These are extensive projects -- some of which I do not see teeing done perhaps in three to five years or even longer. However, angineering that we can get done and put on the shelf will give us the opportunity when the situation warrants, we can go to bid and to make realistic estimates of the cost of the project at the current rate of activity. The next item perhaps should be moved earlier. Here I am requesting $35,000 engineering study for developing a plan for the 30+ acres that the City has ! adjacent to the Oiler's ball field. A development plan has been a "bone of contention" with the Oilers relative to their commitment to do some work in our behalf. Additionally, we do need more lots for football, baseball, softball, etc -- perhaps even tennis courts. If we obtain through referendum some additional Civic Center monies for recreational facilities, that means we will have roughly $325,000 plus the possibility of BOR funds. We ought to be able to really develop that 30 acres into a very meaningful and worthwhile project. I would prefer, however, to use Federal funds as much as possible to come up with the basic architectural work for the area. The last item (E) is a $200,000 for funds in developing a performing arts facility. This could well be the auditorium we desire. I considered here a major project and at 6% architectural fee, you had a multi-million dollar auditorium, however, we can design what we want and we can modify this sum to something less in concept. The total grant request if $735,000. I have serious doubts that we will get all of it but I think that we should get in there and try and get some of the monies available. Such it is a 1008 grant monies, I see no problem in asking. 14. This is discussion of three corners (unoccupied corners) of the Spur -and Beaver Loop. Number one being the Ackerly/O'Connell plat which we _.have had developed and available for the Council's review. It has been reviewed by the Planning Commission and there were some comments made by the Commission as to the access drives to Beaver Loop which will be presented in detail.at the public meeting. Item B is the platting of the next corner or the•29 acres which was received from FAA recently. The intention here is to plat a buffer strip to protect the Walker Lane area, a right-of-way on the south, to provide access to the remaining large unsubdivided tract, to establish dedication of easements and vacate a right-of-way. Item C is a lease concept application by First Federal Savings & Loan Association for the third corner - the irregular area of approximately 184,000 square feet. The Planning Commission was presented with a blueprint and artists sketch of the proposed 2 -story building and they recommended approval of the concept. 15. City land sale request by Dennis Carlson -- which was mentioned at the last Council meeting. The Planning Commission has agreed with the concept. I need Council approval to move on finalizing the lot size desired by Mr. Carlson and having it platted. At this time we would desire to move on with our platting to plat properly and dedicate properly the boat ramp road as well as the boat ramp area including parking facilities that we have in that area as they should not be just a part of a larger area but properly identified. 16. In your packet is a proposed agreement with USGS and the program is for funds that the City has used to test or develop a well shall be applied to matching funds for Federal activities. This in essence provides that some $10,000 can be easily identified as being spent for testing and development of Well 2 and be matched by USGS and they will, therefore, spend some money of their own in doing further tests in this immediate area. I recommend approval of the agreement. F� CITY MANAGER'S REPORT, Page Four el -11 7. The Council has asked for a lease policy relative to City real estate particularly the airport system lands. I have not yet been able to prepare anything on this. I feel, however, that it is tied to the real estate broker proposal which is still being discussed by the Planning Commission 3 and I will try to prepare a working paper for both the Planning Commission and the Council in the next few weeks. 18. There was a request at the last Council meeting referencing cost of a Civic Center shell as I understand it. I have no data at this moment but I will do my best to have some data for the Council next Wednesday. 19. Our Parks Maintenance Crews has worked on the cemetery and I feel it has improved considerably. However, I would point out that all our parks and the cemetery still could use considerably more effort. 20. In reference to the question as to the curbs on the access/frontage road in front of Glacier State and Kenai Elementary, the sand area was removed and we used the last of the gravel we had to replace it to make that road area viable. 21. The street crew has basically been working on oiling programs. We have oiled in Thompson Park and other parts of the Crew have been working on blading streets throughout the City. One part started in VIP and has a worked that area over and as I said we are blading in Thompson Park as well as oiling there. The crew has been working and accomplishing considerable i amount of maintenance to our City streets. 22. Water and sewer activities have been relatively routine except for the major connection we had Wednesday night Thursday morning, which in spite of all of our efforts turned into a minor catastrophe, major, I guess in some people's I guess. ALMUSTRATOR Honorable Ted Steveno United States Senate Washington, D.C. 20510 oear Senator stevenot Thank you for your letter of June 30, 1977, inquiring about our lawsuit against the City of Kenai, Alaska. The case was referred to the U.S. Attorney in Anchorage by the Seattle Regional Office on December 30, 1976. The Regional Office has been working toward a settlement of the ones since that time. The complaint drafted by the Region X staff and forwarded to the O.S. Attorney does not, per se, allege 55 violations, although it can be broken down in that manner. The complaint alleges a recurring series of violations of the City's National Pollutant Discharge Elimination System (NPDES) permit, ranging from June of 1976 until October of 1976 (the permit was effective in June of 1973). The Regional technical staff has deteswiAa that most of the violations are the direct result of inappropriate attention to the operation and maintenance of the selvage treatment plant. The violations consist of failure by the City over a number of months to met several effluent limitations set forth in the permit (biochentcal ouygen demand, suspended solids, flow, and fecal coliform) and in addition, failure by the City to take representative samples and submit a number of reports. If one were to count as one violation + each nonsubmitted report, and as one violation each effluent limitation for every month it was exceeded, there would be a total of 55 violations. Even given the terms of the permit modification presently being processed (which should be effective about the first of September if no objections are received from the State of Alaska), the City will still be liable for some 25 violations of its permit. ! 1 f� I 2 Your lattor sugge©ts that the fines that may he levied against the City aro unfair. rneloned is a lint of those municipalities which have been penalized under the federal Water Pollution Control Act (FWPCA), as you requested. The VWPCA (33 U. S.C.A. noction 1319(x)) authorizes the United States Environmental Protection Agency (EPA) to seek civil penalties not to exceed $10,000 "per day of such violation." IPA thus has the authority to Book a civil penalty of $350,000 (25 violations x $10,000), or certainly a higher penalty than $13,750 or $5,000, in view of the continuing nature of the above violations. Pursuant to 40 C.F.R. Part 125, the City could have challenged the terms of its permit at issuance. Since it chose not to do so, Kenai cannot now be heard to complain that the terms of its permit are unfair. EPA feels that the City is able to meet the permit torma and limitations which it has accepted, if only it will commit th000 resources necessary to do so. In their settlement negotiations, the Region x staff have been seeking a compromise civil penalty figure. The figure must be low enough so as not to bankrupt the City or be unduly harsh upon the citizenry at large, and yet high enough to maintain the integrity of the VWPCA and the credibility of the EPA in en- forcing the Act. It must also be a figure that will put the City of Kenai on notice that any future operations which disregard the mandates of the PWPCA will have serious financial repercussions. It is in light of all of these factors, that Region X feels that the $5,000 amount is a reasonable eompromiuo civil penalty figure.
