MOTION: Couneilman Ambarian moved, seconded by Councilman Morgen ~ for adoption of Ordlitanee No. 297-?6/77(E), establiehing a special revenue fund entitled Title II Anti-recession revenue sharing by increasing estimated revenue and appropriations in the amount of $5, 504 . Mrs. Ituby CoylQ - Mrs. Coy1Q stated she had heard through the news media that a 25$ reduction would be made of the minimum ncceptable bid. Mr. Wise advised that the 28~ reduction is now refleeted in Ordinance No. 325-77. MOTION: Councilman Ambarian moved, seeonded by Couneilwoman Glick. for adoption of Ordinanee No. 325-?7, direeting the ssle of eertain lsnds, as amended. MOTION: Couneilman Morgan moved~ seconded by Councilman Sweet, to amend OrAinanee No. 325-77 by deleting the reference line. "For bids in exeess of $5.000, buyer, at his option. may pay 20g of the bid with remaining balance to be financed by the City at 8$ interest over a period of 10 years." Mr. Wiso advised Council that this partieular item wae included in order to provide an opportunity and the finsncing for those individuals who did not have enough aesets . ete . to secure finaneing . Couneilwoman Gliek stated that it was her opinion that the Council express a stren~ ob~ection to the renewal of Oaken Keg #54 renewal for beverage dispensary lieense ea they were in violation of the Code wherein the establishment did not engege in the aetive selc of alcoholic beverages for the minimum required time. MOTION: Couneilman Ambarian moved. seconded by Councilman Morgan, that the City of Kenai go on record in strong obiection of the renewal of beverage dispens~sry license for Oaken Keg #54 and file a protest under AS O4.10.270 with the Alcholic Beverage Control Board. S-2: Senator 3tevens Mayor Elson also advised that a letter had been reeefved from SenaWr Stevens with regard to the lack oP funding for the City's water storage reservoir . E-3: Governor Hammond Maqor Elson advised that a letter had bee» received from Gavernor Hammond in whieh Governor Hammond reported that he would give Mrs . Donnis Thompson serious consideration for appointment to the Universitq of Alaska Board of Regents. 8-4: Community & Re~ttional Affairs Commissioner McAnernc3y notified the City that she has offieially determined the population of the City of Kenai to be 5.223 as of June 30, 1976. Mayor Elsfln reported that the three various formats otOrdinance No. 320-77 had been drawn up because of a situation on election day (aanuery 25th) whereitt the City advised local liquor establishmenta to close per City Ordinance and the Borough advised that they eould remain open aceording to AS O4.15. 020 (c) . It was now up to the Council to determine whether or not the lawe of the City should be tttiiform with the surrounding areas, MOTION: Councilman Sweet moved, sc:conded by Councilman Ambarian. for ~ntroduction of Ordinance No. 320-77. Borgen ~ Sons Exeavating broke a City water line on Oetober 23~ 1975 and as a result of euch bresk, a second break occurred October 24, 1975, and Whereas, a settlement of $581.B8 has been offerred by Borgen & Son's Insuranee earrier, such amount covering the first water line breakage only . and Whereas ~ it iA i» the best lnterests of tho City to withdraw its elaim for the secend water line break, and Whereas #3,683.95 has been recorded es accounts receivable in tlxe (3eneral Fund for these water line breaka~ and Whereas, Council approval is required to reduce aecounte rec:eivable. PagQ Eight (i-9: Lease of Airport Lunds or Facilities - SeaLand Freight Service~ Inc. Administretion advised 4hat this lease on Lot 6. Rlock 2, Cook Inlet Industrial Air Park was for one year at an annual rental of ~1,575.00. Mr. Wise further advised that an error was made in the amount of assessments as set forth in Schedule A in that they were ~23.99 understated in the lease. MOTION: Councilman 3weet moved, seconded by Councilwoman alick. for approval of lease of Lot 6, Bloek 2, Cook Inlet Air Industrial Air Park, to SeaLand Freight 3ervice. Inc . for a term of one year at sn annual rental rate of $1, 575. 00 and amendment to the lease to reflect the correction oY irtcrease of $23.89 to the assessment amount set uut in Schedule A attached to the lease. Mayor Elson inquired if SeaLand had fulfilled all obligations on their prior lease with the Ciry. RTr. Wise reaponded that there was some question over the assess- mente and SeaLatid felt that they were being charged for assessments an Lots 8. 7, and 8 in the emount of r4 ~ 800 which wae unfair on a lease of only a term of one year. This amount doos not include penalty and intereat. Ma~ror Elson stated that he was not in agreement with the approval of the proposed lease until such time SeaLand had met all commitments of the prior lease. QUESTION: Motion failed by roll eall vote. Voting no; Ciliek. Ambarian, end Elson. Voting yea; Morgan and Sweet . Mayor Elson etated he believed there was still an area open for negoHation between the City end SeaLand to define what is an acceptable terminatio» of the prior lease before entering into a new lease. At this point in time, SeeLand was still not desirous in entering into long-term agreements with the City. N~ayor Elgon adviaed Mr. Oglo that the City had broken policy to enter into a one year agree- ment and on the previous lease, SeaLand had sgreed to pay the asseasments in ordQr to obtain this shorter tQrm . Mayor Elson ststed he felt it was time that the City invited proposals for new insurance as the City has an obligation to see if Cfty is getting value for the money spent on insuranee. Councilman Ambarian stated it was his opinion thQt Mr. Simma of I80 should personally travel to Kenai and point out the deficiencies to the City 114anager and to the Fire Chief. Johnson tendered his resignation from the Borough Assembly as Kenai's Representative diie to the f~ct that Mr. Johnson had aceepted the position of City Manager of the City of Seward. Mayor Elson advised tbat Mr. Johnson's resignation had been formaily aceepted at the Kenei Peninsula Borough Assembly meeting on January 18, 1977, and it was now neceesary for Kenai to appoint an individual to fill out the unexpired term . Mayor Elson read a memorandum from City Attorney WiUiams in which the following proeedure must be followed with regard to fillin~ a vacancy of an elected Borough Assembly Aepresentative: "Seetion 1-44 of the Code of the City of Kenai provides that a vaeancy in the position of Elected Representative ehall be filled by Council appointment determined by a vote of a majority of the Couneil memberahip, and the appointee shall serve until the next regularly held generai election ~ at which time a suaeeaeor ehall be elected to serve for the balanee of the unexpired term" . City Attorney Williams elso advised that a nominse needs at leaet four votes to be ohoeen aad nominees muet be at least 21 years of age and must have resided in the City for three yeare. one year of whieh must be immediately priar to his nomination. MAYOR & COUNCIL - QUE5TION3 AND DISCUSSION Councilman Ackerly inyuired if the City was eligible for any Neighborhood [mprovement Grant funds? Mr. Wise responded that he belieeed this type oP funding was under the HUD program and he has not reviewed this program . Councilman Ambarian stated that with regard to the Mall Parking Lot, he felt that the City should not be involved with this problem. Mr. Wise advised that it would be the respvnsibilfty of the msll but the City was eneouraging that some- thing be done as the situation was hazardous. Councilman Ambarian also questioned the status of the Kenai Torminal Enterprise and l3eaLand leases? Mr. Wise stated he felt that the lease rate in the terminal bld~. was too high and perhaps a more equitable lease rate could be establ~shed dependin~ upon spaco leased. A4r. Wise further etated that he was hopeful that the Planning Study would present information so that the City eould develop a more viable lease rate for the Terminal. Councilman i~Thelan stated that perhsps the lease rate should be coneidered during the up-eomin~ budget work sessions as many people have stated to him that they don't want to leese in the terminal whan the rate would change annua.lly. Finance Direetor, Ross Kinney, stated that the present leaso «~ rate ratio wae adopted by Council and and this formula would have to be used until -~~ such time the resolutfon was repealed and. therefore, the City must proceed with current negotiations. Resolution - Tranafer Funds in Palice Deparbnent Budget This resolution will tranefer funds from Salary & Wagea in the Poliee Depertment to Cepital Expenditures it~ the Police Department. The f~irst eheek that we reeefved from the Federal anti-recessionary revenue s6ariag wae placed in the Police Depertinent so that we could properly expend the moaies on selaries . We have expended approximately $13, 000.00 on ealaries. almost exactly what we recteived. Since we added it to the salary and wage account, we now have approximately the same amount of money in exeeas to the needa of ealary and wage a~count in the Police Department. we bave met the Federal obligation for expenditure of these funda . Nle would like to now take part oi these excees funde from the reguler appropriation and move them to oapital equipment account in the Poliee Department. T1ee reason for thie ie thet we hsve aevere problems in regard to poliee care; age, extreme costs ot operations and, !n fact, an inability at the time of eda~tion of the budget to fund the eecond car that the Police Oepartment aeked ior. We would now itke to transfer sufficient funds to purehase a second pdice cer ~ to purehese tbe auxiliary equipment that is required to support tha~ car and we've added eome additionsl funde to enable us to replaee ~ on a trade-in~ bAsis, two ehotguns . Iiesolution - Professional Service Contraet In accordanee with mq requeat to the Council, the Couneil authoriaed the retention of a surveqor to do the eurveying of tbe FAA lande whieh the City is rezoning. These lands lie south of the 3pur Hi~hwaq. This ettrvey is to be~basic, elemental surveying in applying easements, natural drainage, establiehi~tg bench marks and appropriate monumente. Thia will give us a basic means of identifying poesible subdivision of the lends that are ~ available. I was surprised on the quotes received and I am also extremely disappoirited on the time frames received, whieh run into May and .Tune -. of thle year . However ~ this work etili must be done and we do heve •the funds evailable in the Airport Land Fund , i would recommend the adoption of the resolution ae proposed . 9. Aeeolution - Write-Off Claim This resoluHon is to, in essence~ write aff a claim which we are now carryin~ on our booka as an Accounts Reeeivabie. This relatea to a water-break Qroblem on Tinker Lene that ocourred l~st year . Tbia break was followed by another bresk, also caused by the same contractor. The City filed a ctlaim against the contractor~ through his insursnce eompsny~ hoping that they wouid aover the eost of repairs. The previoue break was aovered by his inauranae. This break, which we were asking for a eleim on, was disQOVered and determined thF~~ installation of the water line was inproper. We eould press ouc claim agsinst the contractor and his inauranee ~ompanys however, chsnees of reaovery are not too g~ood and more signifiasntly ~ we would have to be prepared to go to eourt, even to get a seltlement. The eost of pjoing to court may ~a more than we oat- reaeonably expeet to recover. !n that we would have to line up, examine end obtain expert teetimonq to suppc:rt our eeae. Therefore, it i,~ my recommendation thet we drop this claim end write ot~ this amount in aoaount receivable. 10. Aesignmeat of Leaee - Katmai Motel ~ This ie s standard action. Senior Citizene Nutritional Prog-ram To date. the program has been what I must consider to be a resoundin~ success . We've had, in the excess. of twenty-two to twenty-three people at the luncheon at Fort Kenay every day this week. They are not necessarily the same individuals. Therefore. our exposure hss been perhape forty to sixty different individuals which I am very pleased with and I think that the Couneil ean be gratified at the suceess of the program . You are all, of eourse. invited to attend the program and lunah with the Senior Citizens, though I muet ask that individuelly, you make your own reservations end be prepared for a$3.00 tab. 12. Ameriean Legion Buiiding ~ We have reviewed, within the AdministraHon, the proeese for providing a publie esle of the building. yet having some assurance that the American Legion would be able to obtain the buflding. The problem that we have at the moment is to establish the value of the building and the value of the American Legion's modifications of the building. we have aeked Mr. Hanaoak for the American Legioa's estimation of the value of the building ar~d the improvementa which they have made. nnee we put these figures together and feel that we have a viable and legitimate market value, we will present the program to the Council. 13. Horough arant Prc~poeal The Borough has prepared a grant proposel for OCS Coastal Management Plan»ing. The grant essentially asks for a Federal grant of roughly ;65, 000. 00. Within the grant, the bulk of the monies are to be epent for additional staYYing in the 8orough Planning office. My comments have been preparefl and sent to the Borough. My main comment is that this additional staittng shouid not be paid from grant monies, in that t~is is esse»tislly a baok door epproaeh to inereasing the staff of the Borough planairig department. If a etaffitsg increase is needed, it should be outwardly and forthrightly funded through the Borough Assembly and the appropriate budget activities. 14. ISO As you have been previously called by the office here. thore is a problem over our inaurance rating with the reting ~oing. perhaps, from a Class V to a Class VII. This was, of course, picked up and announced over the radio and I commented then, as I comment now, that we have only rumors but no reai doeumentation that we can react to in regard to our deficiencies in going from a Class V to a Class VII. We did call San Francisco to trq to obtain dsta on thie. The inplication that we reeeived wae that yes, we were going from a Clase V to V[I but that they would not release the information at that Hme. Further~ tho rating ch~nge would not be effective for another 60 days. Since that time. I have written a letter to the supervisor complaining. ~n effect, of the premature rslease of the information and secondly, of the non-receipt of th~ report which was prepared last August. I feel that we ehould tske no aetion nor make eommenta as to what we can or should do until we have received the report and ean respond to it direetly . 16. East Side Painting of Terminal N-aii I've discuseed the project with Mre. Larsen of the Kenai High Sehool, and ehe hae agreed to have her claes do the proiect. I promised to inform her lmmediately Pollowing the meeting on Thursday as to whether or not we oan iseue a g~o-ahead sign on it. The basic question which we have is to determine the cost of the project. We will have to put a base aoat on the build~ng and then provide paint, bruehes, ecaffolding and miscelleneous matters for the students to aetually do the work . In the event that we can Rtnd it, we would have to complete the undereoQt prior to the 15th of April and the school would then work on it from that time to the end of the schoel year !n May. I will have information as to the cost Por the meeting on We~nesday and ask for your aomments at that time. 17. We are starting to penetrate the top portion of.our confined aquifer and the porosity of the material is becoming increasingly larger and our artosian water pressure is becoming somewhat greater. Work is continuing on the installation j of pumps and valves and work on the water tank inside of Well ~ House #2. ._ . ,- ~ . ~f " '` ^h `':, ~ ` • . tr :. , . Note: For the last two weeks the street crew has spent their time sandfng streets and tryinq to remove the ice pack and slush build- up on the city streets. The water and sewer department have been installing and repairing some of the commercial water meters in ~ the aity and are in the process of digginq up and replacing tv~o ' inoperative fire hydrants in th~ Mommsen 3ubdivision. They have also apent a considerable amount of their time on trying to locate in-flow to the city's sewage collection system. Theee large ~ in-flow probleme from the rain and the thawing weather have resulted i in extreraely high flows of over 1 MGD into the sewer plant. These ~ high flows, besides putting ue in a noncompliance status with EPA i on our discharge permit, have aiso flooded the sewer treatment plant several times throughout this wintier. This has created a very severe operation and maintenanoe problem in our sewer treatment ; plant besides causing us a number of problems in our monthly reports ' to LPA and DEC. The purpose of the meeting Is to provide informetion to representatives of Alaska's coastal villages, so they can plan tor and manage the on-shore Impact of impending Outer Continental Shelf oil and gas development. While the conterence is malnly for villagers, we welcome your attendence, though some session will be closed Lo non-villagers. The aonference will be held at the Ramada Inn, 598 West Northern Lights Blvd. in Anchorage, a~d will begin at one p.m. Frfday. Registration will be open from 11 a.m. Friday through noon Seturday; registration fee is $5.00. The meetings end at noon Sunday. The general conference schedule includes panel background discussions and group meetings Friday efternoon and at dinnertime; flims and slide presentations will take place that evening. Saturday morning witl feature speakers from federal and state government agencies and the oil and gas industry, and small group dfscussions; there wiil b~ a luncheon and speaker at nonn. Saturday afternoon will focus on the experiences ot Yakutat and Kodlek with OCS development, exemination of specific areas, and methods of protecting Native cultural and property rights. Mr. Wise responded that he believecl this type of funding was under the HUD program and ho has not reviewed this program . Councilman Ambarian stated that with regard to. the Mall Parkiag Lot. he felt that the City should not be involved with this probleni . Mr. Wise advised that it would be the responsibility of the mall but the Cfty was encouraging that some- thing be done as the situation was hszardous. Counoilman Ambarian also questioned the status of the Renai Terminal Enterprise end SeaLand leeaes? Mr. Wise atated he felt that the lease rate in the terminal bldg. was too high and perhaps a more equitable lease rate could be establiehed depending upon space leased. Mr. Wiae further atated that he wae hopePul that the Planning Study would present information eo that the City could develop a more viable lease rate for the Terminal.
