Mayor Elson read Ordinence No. 323-76 by title only as copies of the ordinanco were
available for the public prior to the mQeting. "An ordinance of the Council of the
City of Kenai ~ Alaska. appropriating $25,151 to the Capital ~Project Fund entitled
"Publie 3afety Building" from the (3eneral Fund Balanee."
Mayor Elson opened the hearing to the public. There being no input, the hearing
returned to the Council table for action.
MOTION:
Couneilman Ambarian moved, seconded by Couneilwoman Gliclc ~ for adopHon of
Ordinsr-ce No. 323-76~ appropriatin~ $25,151 to the Capital Project Fund enHtled

MOTION:
Couneilwoman Glick moved , seconded by Cnuncilman Ambarian ~ for adoption of
Ordinance 324-76, appropriating 36~250 tc> the Capital Project fund entitled fimall
Boat Harbor from the General Fund halance.
Motion passed unanimously by roll call vote.
B-3: Itenewal of Beverage Dispensary & Retsil License - Fndie's Prontier Club
Cfty Menager. John Wise, advised Council that the ~orough reported that all taxee
were now eurrent for Fadie's Frontier Club and Administration would, thereforp,
__ recommend that th~ ~ity Council not protest the renewal of Bevera~e Dispensary
License and Retail License for Eadie's Prontier Club.
Council unanimously concurred that no protest would be submitted with regard
to renewal of Beverage Dispensary License and R~il Liqqor License for Eadie's
Frontier Club.

~ C-2: Mr. Ray Hayes - Requesting Sewer Aesessment District
Mr. Itoy Hayes eame before Couneil to ask direction for establishing a Sewer
Aesessment District (Linwood Lane erea). Mr. Hayes advised Council that he
had purchased the proper piping for installaHon and would give it to the City if the
City would in turn give him credit tow~rd other costs incurred in the establishin~
of the aesessment district. Mr. Nayes stated that i~ early diseuesions with City
Admiriietration ~ he also proposed to inatell the pipe himself and then as ad~aeent
property owners hooked on to the system, ARr. Hayes would be reimbursed eecordin~ly.
. Mr. Wise explained the computetfon of estimated costs for installetion and stated
thst at $50/ft. the approximate cost would be $45.000 and. therefore, based on an
8" line, the City would hsve to make a eontribution of ~6,000 to install $ 900' line.

Mayor Eleon advised that this resolution, which had been tabled at the last meeting
of Council, would provide that wherein the two persons authorized to sign ~ one
would be from Administration and one from Finance. Mayor Eleon further stated
that the Finanee Director had commented that the bank wonld honor a~ two eignaturee .

Mayor Elson rQad Resolution No. 77-1, "a resolution of the Council of the City
of Konai, Alaska, discontinuing the City of Kenai Police Reserve Pro~ram .
Whereas, the Police Iteaerve Pro~-ram for the City of Kenai is considered to be a
viable asset to crime deterrence within the City of Kenai and, therefore, a program
that this community does wish to eantinue, and Whereas, there is a problem in
.. . procuring insurance eoverage to protect both the City and Poliee Reserviats while
+' they are on duty, and Whereae, there appears to be no resolution to this insurance
problem in the foreseeable fuhuro. Now, therefore, be it resolved by the Couneil
of the City of Kenai, Alaska, that the Police Reserve Program shall be disconHnued
and both the Governor of the State of Alaska and the Legislative delegation of the
Kenai Peninsula be petitioned to resolve the impasse over insurance probleme
to provide reasonable reaugmentation of this valuable program ."
Mayor Elson advised that the Couneil had received a letter from the Chief of
Poliae who reported that both the Police Department and the Police Reserve had a
full understanding of the problem and what action must be taken.

Mayor Llson read Aesolution No. 77-2 by title only. "A re~olution oP the Council
of the City of Kenai, Alaska, authorizing the City Manager to epply for a 100 ~
funded grent for a fuily equipped ambulance to replaee an over-age ambulance."
N[r. Wise aflvised that the Alaska Traffic Safety Bureau had funds available for
100~ funding of traffic saPety equipme»t and the City of Kenai's ambulance was
a 1967 Cadillac and weli beyond ite life of eeonomieal operation .

to finalize a contract with CH2AZ Hill for a Sewage Trea4ment Plant study."

Mr. Wise advised that this agreement between the City of Kenai and the
Churoh of Jesus Chriat of T,atter nay 8sints-Kenai Branch was for the imple-
mentation of the Title VII Nutrition Program .

Councilman Morgan moved~ seconded by Couneilman Ambarien. for approval
of contraet between the City of Kenai and the Church of Jeaus Christ of Latter
Day Seints-Kenai Braneh for the implementation of the Title VII Nutrition Program .

Mr. Wise reiterated areas of his report (City Msnager's Aeport #8 attached
hereto and part of the official proceedings of thie meetin~) and requseted
Couneil authorization to proceed with the eurveying of the FAA lands south
of the $pur Highway which have been proposed for re-zoning.
MOTION:
Couneilman Ambarian moved~ seeonded by Councilman Sweet. for authorization
for the City Manager to proceed with the surveying of the FAA lends south of
the Spur Highway. ,
Motion passed unanimously.
Mr. Wise eleo reporteci that there were 90 building permits issued in 18?4
Yor a value of $3, 800, 000; 130 permite iesued in 1975 for a value of $4, 000, 000;
and in 1978~ 163 building permite were iseued for a total value of $6,000,000.
QUESTIONS & COMMENTS
Couneilman Ambarian suggested that Council be provided a map of the City
at eaeh meeting.

City Attorney Williams reported that the State had recarded the plat of the
tidelnnds and are now filling in the blanks on the patent and have assured the
City that it wfll Le signed soon.

Mayor Elson roported that the City of Kenai Christmas Party was well attended
and successful.
H-4: City Clerk's Report

H-S: Finance Director's Report
Finanee Director, Roas Kinney, advised Council that his department is in the
process of recalculating the reassessments and have collected $B, 000 to date.
Also e letter had been received by the Department of Community & Regional
Affairs regarding State Revenue Sharing Notice of Grant Entitlement to the
City of Kensi in the amount of $230, 5?7. The City will file an appeal on the
Road Maintenanee mileage as it was lesa than in the pust .

H• 7: Kensi Penineula Borough Assembly's Aeport
Mayor Elson reported on the Assembly meeHn~ of January 9. 1977, an~i
action taken by the Assembly. Mr. John Crawford, City of Seldovia, was
seated as a new member of the Aesembly and the following ordinanees were
approved: Ord. 76-66~ establishin~ a Department of Publie Worka; Ord. 76-67,
estsblishing s budget appropriation and providing funds for the Dept. of Public
Works; Ord. 76-68, amending code with rogard to probationary period of
Horough employeos and Ord. 78-69, apprapriating $52,000 from the South
Penitisula Hospital Service Area Surplus to Capital F.quipment (X-ray equip-
ment) . The following ordinancea were passed for hearing - Ord . 77-1,
amending code with regard to change of date, time and plaee of Assembly
meetings: Ord. 77-2, eoncering rezoning within the City of Homer, Ord. 77-3
coneernin~ rezonin~ within the City of Kenai and Ord. 77-4, providing authority
to the Mayor to deaignate the Planning Director~ an Administrative Assistant,
or other Designee to si~n land subdivision plata after final approval by
Planning Commission . Mayor Elson advised that a Sales Tax Commlttee meeting
. has been scheduled for January 18th.

I-l: Lt. Craig Fanning - Salvation Army
Lt. Fanning thanked the Council for their support and for the use of the old
Lfbrary Building during the Christmas holidays for the preparation of food
baskets. Lt. Fanning reported that the Salvation Army was able to help
150 families in the area .

~!~ Mrs. Coyle inquired if the matter of sales tax on rentals had been brought
~~ up at the 3ales Tax meetinga at the Borough and was advised by Mr. Kinney
~ that the subject had not been diecusaed.

~ These ordinances both relate to deficits on the Small Boat
.ilarbor and thn Public Safety Building. These Ordin~nces
are to correct a funding deficiency identified in the audit.

Mr. Moody~ representing the American Legion~ is scheduled to
be heard by the Cot,mcil. It is understood tt-at he will request
tbat the building thaC they are occupying in the FAA Reserve
area be sold to the Amexican L~egion and they be perndtted ~o
relocate to, as I tmderstand it, a Light Industrial Zone in
the general port area off the bridge road.
4. ResoluCian 76-94, 76-95 - Airport Plarnling ~Yant
We have received the third input from the consulr.ants and it has been
reviewed by the FAA. The FAA representative, Jim Perham, feels
that it can be ~ustified and will be accepted by ~he FAA. For this
reason, I recamier-d that the Council adopt the resolution to apply
for a grant in the amrnmt of $123,000.00.
5. Resolution 76-100
This ie the resolution requested by Coua~cilman Whelan to is~s~e that
an administrative and finance persormel signat-ures appear on every
ci~eck d3.spersement. This will add the City Clerk signature to the
autharized signature list and also set langua~e requiring an
ac~adaistrative type and firance type to sign each check.
6. The Montessori Yre-School ~
The Crnmcil received a copy of the letCer f~rom Mrs. Nictro~l, relaeive
to the M~ntessvri Pre-School and while I personally feel that the
pre-sctwol operatian is a valuable camnmity project, the fact
that its fosm is a profit making corporaCion or corporate
~ entity son~~hat puts it in an awlcward circ~tanstance to be sited in
a puUU~.ic facilit,y. For apparent tax reasons. Mrs. Nichol has
decided not to apply for a non-profit status. Because of the profit
~;~ malcing status~ I feel that I must recanmend to the Cotmcil that we
take action to cease that operation in a public facility.

7. Resolution - Q3~4 Hill
This is a resolution authorizing the City Manager to enter into
negotiation wLth CH~n Hill., relative to the Sewer Treatment Plant
Study. This tk-~~: been requested for some time. We've had 8 or 9
'~ submiesions. 't • other day, Phil and I sat dawn and w+ent over
• these in detail.•~nd it is felt that this fiYm appears to offer us;
the best apport~i.ty for study fram both an actual plant engineeririg
as w~ell as obtaining the ma~dnann financi.al assistanca £rom the State
m~d Federal govercIInents. Therefore, we request the authority to
ft~ther detail the scope of study and to devise a ccmtract for that
. scape of study setting various fees and anticipated outside revenue.
8. Resolutian - Police Reserve
qs is in this resolution, we ttave stated that the Police Reserve
is a viable and w~arthwhile operation; how~.yver. the legal liability
. prob].ems, both for the City a~nd the individuals cancerned, present
vs wlth an untenable situation. Therefore. ~Je are forced to ask
for its discontinu~ance. Additionally, we have asked the Governor
~ and our legislative delegatian fran the Peninsula to try to renedy
--' the insurance angle so that we can reinstitute the progr~n as soon
ae possible.
9. • ResoluCion - Seniar Citizens Nutrition Progran
~is is a resoluCion to affect a cantract with the Nbnt~on Church~
relative to th~ir bid for the operation of the kitchen end related
facilities in the Seniar Citizens Nutritional Program.
10. R~solution Transferring Police Ftmds
This action is necessary to provide ftaids to purchase additional
tepes for the tape recording systan as cur Caue collection system
~row has been reuaed so many times that we are losing the quality
so Chief Ross would like to purchase an additional set of tapes
(tpedical retainer quality) for smne time in the fut~e. '
11. Resolution - Ambulance Grmit '
11-ese grant ftmds are prcyvided by the Alaska Traffic Safety
B~eau and is 100% funding We imderstand trat there are f~mds
• currently available and ~conmitted wlthin tr.e Bureau and we feel
that there is a.need for these m~nies~ as rna 1967 Cadillac
ambulance is over-aged and not economical to operate. Therefore~
we feel tt~at we have a very good chance of obtainin~ the necessary
~anC monies to include noC only ttue basic ~bulance but
atadiiary equipment as well.

There is, in this packet, the leeter to the DepartrnenCs, Mayor
end Coimcil explaining my request far a stannary budget submittal
by all departaiients. I feel that this is necessary to identify
eritical itans in particular changes in the programs far the
cani.ng budget year. One of my particular problems has been
wrn:ktt~g on detail budgets lmowtng full well that they will have
~o be revised at least ance and pexhaps t~ao and three times.
I prefer to get budget guidance and budget desires so Chat we
can malce minimal revisions to the budget as we rt~ve into the
budget process. This data w1.11 be presented to the Caunci]. as
specified in the letter, hopefully for the first meeting in February.
15. R~ezoning FAA Re.serve Lands ,
This relates to the letter to ~he Co~cil on the rezoning of the
~ FAA lands and the subsequent actions follawing or concurrent with
the rezonin$. As I stated in the letter, I have contacted Don
Wilcox fram the FAA~ Anchorage, and I received a call from him the
other day which implied at this time that they will not release
tt~e landa north of the Kenai Spur. I am waiting for that letter
to arrive and I shauld have it by Wednesday night. Nevertheless,
I feel that w~ stx~uld proceed with those lands Sout~: o~ ~he Spur
and should make ttiem available as I have outlined in this letter
as soon as poasible.
16. Fareclosed Lands Sale
I mn proposing tt~at we have the foreclosed lands and other lands
• up for sale acCually in the middle of March. Our time frame
cta7rently is to go to the Plarming Canmission vn the 12th of
Jmroary for their legal review of the lands ~hat w~ are offering
for eale and approval and then we will introduce the appropriate
legislatian on the 19Ch of January to the Cotulcil and sCart the
process of publicaticm and advertf sement so that wie can canstamiate
a sale. I believe the schedule required by ardi~nce wou].d be in
~ early March. At this mancmt~ the estimated value of the properties
far eale is s little over $400,000.00. The net r.o the City.

EDA Water t9e11 Project
There has been no £urther progress.on the installation of
the remafninq twelve inch water main duo to the lack of
frost penetration through~the~swampy portion of tlse
right-of-way. The groutinq has been aompleted around the
outside of the sixteen inch casing for the water well and
the dxiller is proceeding with the installation of the
twelve inch casing, ~vhich will probably go.to a depth of
approximately 250~feet and will terminate in the artesian
aquifer. The building contractors have completed the
3.neulatfng and .rewiring of the building at ~9ater '9e11 No. 2
nnd they are now instaliing the heating system and some

i~n the last report. .The epeoial pulleys which were required
bave been recefveds however, due..to some ma9or equipment
problems the mechanics have not been able to leave the
Shop to finish the installation of the motors at the
sewer plant. • ~
Notes The last two weeks, as you are aware, have been
s ort weeks due to the holidays. The mechanics have spent
the past two v~eeks makinq some major repairs on our motor
. qraders, which has handicapped the street department in the
maintanance of our streets. The break-down of these two
machines were due to use and the number of hours on this
-~ equipment. The avaflabilft,y of parts has severel,y hampered
~he quic)c repair of this equfpment and as of today, both
blades are still inoperat3ve. The street crew has been
etripping the pack off o:E some of the downtown streets and
spending a considerabie amount of time on the Airporti

WHEAEAS ~ the City owns certain lands which are not neeclsA by the
Cfty for publie purpoae, and
WHEItEAB, sueh lands have been reviewed by the Kenai Acivisory
Planning and Zonin~ Commiseion and it hqs recommende~] that the~r
be sold for private development, and
WHEItEAS ~ the City Mana~er has recammended that sueh lands be solci
at public auctian to the hi~hest bidder; terms to be 10~ af the lanA or

for our lxat Mental Health ('.enter. We need yaur help and support in the fonn of a
letter to Governor Jay Hanmand, Pouch AA, Juneau Alaska, with copies to our i~egislators:
Senator Clem Tfllion, Representative Hugh Malone, and Representative Leo Rhodes, all of
Pouch V, Juneau, Alaska. We would like these letters tA arrive in Juneau during the
week of Januaiy 17, if p~ssible.
Tf you, your agency or business uses our serviaes in any way, we would appreciate you
telling the governor of this, not personal pervi.oes, but those which tell him of our
~dirtg population and the acac~npanying problc~ns 3.n the m2ntal healtl3 field.
In OctaUer of 1976 rhe Central Peni.nsula Mental Hea].th Association, Inc officially
opened a Mental Health Cen~er in two offices c?onated by the Kenai Native Association.
we s~eoeived a$30,000 grant froQn the Statet we made nearly $2,000 on an Arts and Trade
Fair which was used to pay for m~].practice and liability insuranae, and manY People
have donated their t3n~e, efforts and money for the Cent~r. By December we had out
gx+akm the donated off3,cc~s, ~d v~e have entered into a lease aqreanent for the building
next deor wPitch was the al.d Air Force Library at Wildwood. It ia exactly suited tor aur
needs with a variety of offioes and a large roan for meetings, workshops, and vounseling
grot~. ~he rent is vezy reasonable, but the rent was not included in aur grant for t]v.s
year so we are u~ing our funds vexy carefully to manage this.
A c7.i~nica7.-psychologist, Dr. Lee Maxwell, has been hired to be fihe ritrector and
clinidan. Another full-ti~ elnployee, Marc3.a Ward, is our executive assistant who
keeps track of epople, tiheir appoinbnents, daea miles of recl tape~ 'LYp~g, filing and
same incic'~enta7. caunsel3.ng. She also mvnt:ains a vigilanoe on ~he buds~et. We have
been us9ng the seYVi.aes of Dr. Hal 5exton, the psychiatrist fran Hoaner. In addition,
one aaunselor, Jean McDvwell, is paid both by thQ eer-ter anri by the University of
Alaska on a Year for Action stipend. She has also donatPC~ a wnsid~rable amount of
tima. As presic~ent of the associatton T have dot~e s~ ~-~i.n..istrati.ve duties as
needed, worked with tho I.R.S. to achievQ tax exe~t ~Y~ztns, and in addition, ~ a¢n the
Cent~r's representative to the schools, and do soir~e oounsel3ng. Most oE tliis has been
aonated time.
We extend sezviaes to the follc~aing agencies, either in testing, ootimseling or other
setviees: The Y~n scho~].s that malce up tho Central Pe~insula area, Division of Corrections,
Offioe of Vocational Rehabilitation, Public Defenc~c3r, Division of Fa~ni.ly and Children
S~vioes, Kenai Peninsula Cu~munity Care Center, Kenai. Hea].th Centc3r, Cook Inlet Council
on Alaoholisan, K.N.A., Cook In].et Na~.i.ve Association, and Alaska Nattve He~7.th servioes.
We are able to provide seYViaes for srnie of these agencies that has previously been done
in Anchorage. We are capable of serving these agea~cies in this area, but we need
tihe funcling to provide the testing ma~rials, offire equipment, and secretarial
assistanoe tA sustain and in~rove these sexvives. We operate on a siic33ng feQ scale
of pay-mx~t for our sexvioes, which makes tihem available to everyone who needs them.

tee at approximate atation 337 + 70.00. Thia twelve inch line is
the only uctivo and available watQr aourco to the City o£ Kenai.
Therefore, it would be unwieo to uncnver the line entiroly while it
is still under preesurQ. Tho ~ossibility of a joint blow-out or a
major lino break by digging eqaipment exists. eoth possibilities
would be expensive to repair and would deprive tho City of its water
suppiy. Efforts wero made to locate the tie-in tee. One hundred
fee~ (100') of the twelve inch line was uncovered until only four
feet (4') of cavor w~e~ left. A probe ~ras uasd at one {1! foot
intervals checking the aides of the line for si2e and the interccspting
"bullhead" of the tee. The probe was metal~ the twelve inch too
shoald be metalt tha line is asbestos-concrete. No metal to metal
sound was encountered. Inyuiries indicated previous line leaks and
sepaire at this area and there is a aubstantiai possibility that the
tie-in tee has been removed. Tho equipment requested is a contingency
based on a weil-founded aseumption that the original tie-in tee, as
ehown on the print.s, does not exist. This is the feasible tie-in
asea for the new twelvo inch transmission line.

8ection 1-44 of the Code of the City of Kenai provides ae~ follows:
"A vacsney in the poaition of Elected RepresentaNve shell be
filled by Council appointment determined by a vote of a majorfty
of the Council memberehip. and the appointee shall serve unHl
the next regularly held generai election, at which time a
euccessor shall be elected to serve for the balance of the anexpired
term."
~herefore, a nominee needs at least four votes to be chosen. Naminees must
be at leagt 21 years of age and must heve resided in the City for throe yeare, one
year of which must be immediately prior to hfs nomination.

We of The Sa].vation Army are expressing interest in the
old Kenai library buildin~, and would appreciate consideration
for eaid building when it ia brou~ht up for diaposition. 4Je
are aware of the lease restriction (must be used for community
aervice), and we beli.eve that we qualify under this restriction.
We do not want the building for our church or meetin~; space,
we would like to re-locate our Thrift Store to that location.
We believe the thrift atore aerves ss a community service pro-
gram and has served thia community for approx. 10 ,years. Now
The Salvation Army alao provides the aervices of two trained
Officer~g in counseling, pastorial services, and a 24 hour
welfare program, all Pree of charge, and has already been used
by the Police Department, Mental Health, Welfare Department,
Ohurchee~ and approx. 100 Community Reaidence all since Au~est.
The thrift store provides us with the fund's with which to
operate these programa. The Kenai-Soldotna area has now out-
grown our present facilities and we have no funde to expand,
nor do we for-aee any in the next few years. But our community
and it~e needa are growing (we to need to grow to meet these
needa). Already this year we have given approx. ~400.00 worth
oY r~ ocery ordere, $500.00 worth of clothing ordere, $120.00
of em_ er~ency housin~, ~520.00 worth of other side, We have

helped a11 types of community residence from those waiting for
Food atamps or Unemployment Chrcks to a teen-a~;e ~irl who would
have had her horn repossesd, had someone not been there to help.
These statistfcs do not include any Christmas or Seasonal Aide,
yet to be calculated.
; This buildfng would give us the needed space to expand our
services and handle furniture and appliances, which is desper-
ately needed by our commu»ity and at present, not t~ein~; met. We,
have aided four Yami].ies that have been burned out since I~r-
~ rived in August. Providing Clothing for 15 children, and 8
adults in the amount of 96500.00. Food in the amount of m100.00,
and small a~pliances and dishes in the amount of ~175.00. Al1
free of charge to these four families and had we furniture that
to would have been provided free of charge. The need is here,
we would like to be able to meet it. The communit,y has Purniture
to donate, but we have no place to etore it, and must refuae
' their donation.
The store has alp•ead,y proven itself, and ie recognized by
thie community as a~ervice. A couple of years ago we were
thinking about cloain~ the Thrift Store and we were swamped
with letters of protest, telling us of the community import-
enee of the etore. 2he location of the library buildin~ would
make our services even more available, it would be with in walk-
ing dietance to even more people and especially the elderly ot
' that area who could benefi.t very much from our extremely low
prices.

Dear Members of the Council,
Shortly before Christmas my mother was participating
in a Senior Citizen proqram. During the travel involved,
she suffered chest pains. Mrs. Pat Porter, the Director,
took most promp~t and proper action in offering aid. This
is o»ly one specific instance, and I know of many more
where Pat has done an outstanding job. She has recefved
our thanks and we thank you for having her in that position.

minutes of November 10, 1976 as distributed.

A. Holt Wflliams Subdiviaion Preliminarv Plat: John Williams
r7r..John Williams stated that he planned to place multi-family
~wellings on these lots rather than single-family dwellings.
His purpose in coming before the commissfon was to discuss the
possibility of applying for a variance to allow for a 36 unit
apartment building on the lots. He statecl that if this was
not acceptable to the commission, he would revert to six-plexea .
on Lote 1, 2, 4 and 5 and request a variance to allow an eight- ~'
plox on Lot 3. Mr. Williams stated that since Fores~ Drive was
a heavily-trafficed street, single family dwellings were not
suitable and the property could be better utilized for multi-
famfly housing. This type of hous3ng would come under Farm
Home low-income housing. '

Mr. Raymond asked if Mr. Williams had considered parking space
for the multi-family dwellings. Mr. Williams stated that HUD
required 1 1/2 parking spaces per dwelling and there was
sufficYent area to meet this requirement.
Mr. Hamrick asked what the percentage of lot coverage would be
with the multi-family dwellings. Mr. Williams stated that
they would be allowing 2,OOQ square feet per dwelling unit, whfch
is what the ordinance requires. The ordinance does not list a
maximum lot coverage.
After further discussion, Mr. Willfams asked for preliminary
approval of this plat.
The Commission advised Mr. Williams that they could not grant
approval on this plat until it had been submitted to the Borough.
The City Commission only acts in an advisory capacity to the
Borough. Therefore, it was suggasted that Mr. Wflliams submit
his p].at to the Borough, who would then forward it to the City
for their comments.
B. A lication for Lease of Lot 6, Block 2, CIIAP: ~Sealand
Fre ght Servi ce, Inc. -
NJr. Malston asked if this was the normal lease rate for this
property. Mr. Wise stated that it was.
Mr. Charlie Ogle of Sealand stated that Sealand was presently
under lease with Beluga Development for Lot 5 for both the
building and land. They are considering buflding a terminal
and this is why they do not want a long term lease at this
time. ~
Mrs. Glick asked if they woulcl use this land for the new terminal.
Mr. Ogle stated that they would consider this property but would
aleo consider other property. The cost is a major factor.
Mr. Miller asked for explanatfon of Schedule "A•' of the lease.
Mr. Wise stated that this part of the agreement was that Sealand
would pay tihe water and sewer assessments on this lot. Mr. Ogle
stated that Sealand would more than likely renew the lease next
year and understood that the assessment payment would be a one-
time paymenti. Mr. Wise stated that this was correct.
Mr. Hamrick asked how much longer Sealand's lease of Lot 5 was
in effect. Mr. Ogle stated that it expired next year with the
option to renew.
MOTIONs
Mr. Heus moved, seconded by Mr. Malston, that the Commission recommend
'• approval of the lease of Lot'6, Block 2, CIIAP, to Sealand Freight
Service, Inc.

Rural Resfdent al to Suburban Residential
trlr. Wise explained that this resolution would begin action to
aacomplish this rezoning. The ordfnance states that rural
residential areas will automatically be rezoned to suburban
resfdential when served by an approved community water and
sewer system. Woodland has been served by Gity water and
sewer for yuite some time. The Borough Attorney needs some-
tbing in writing ErQm the City requesting the rezoning.
MOTION:
Mr. Malston moved, seconded by Mr. Miller, that the Commission
adopt Resolution No. PZ 76-4, recommending that Woodland Sub-
dfvisfon be rezoned from rural residential to suburban residential.
Motion passed unanimously.
6. Other Bu$iness
A. City Council Report: Betty Glick
Councilwoman Glick stated that the City Council had met twice
since the Commission's last meetinq. They had A publi.c hearing
on the ordinance for the street lighting agreement with the
State, as well as the amendments to the 1976 Airport Requlations.
They also had a public hearing on the "old library building" and
surrounding lancls to obtain public input as to how.the land and
buflding should be disposed of by the City. The Kenai Historical
Society is interested in the building and the Salvation Army is
using it for their food drive during the month of December. The
Council would welcomQ any suggestions from the Planning Commission
reqardinq the "old library building".
Councilwoman Glick further stated that the City is gofng to reassess
property in certain areas. There will be a work session on this
tomorrow night. The City Council also approved the lease of the
old Wien countar to AAI and voiced a non-objection to the Collier
Water ltights Applfcation.
B. Borcugh Planning and Zoning Commission Reports Betty Giiak
Mrs. Glick stated that the Borough Commission had discussed the
c~ouble frontage of Northgate Subdivision. They had also sworn
in tt~oo new members and had two public hearings. .
C. Harbor Commission Re~orti: Betity Glick
The ~larbor Commission had not met since the last meeting of the
Planning and Zoning Commission.

Mr. Hamrick stated that the Airport Advfsory Commfttee had met
artd discussed the information pertaining to the plannfng grant
~horoughly. The initial cost of the study was thought to be in
the area of $60,000.00. FAA applied for $80,000.00 and the
revised cost is now $123,000.00. Jim Perham of FAA believes
that this amount is feasible, but would have to be spread over
s two year period. At the last two meetfngs, the Commit~ee
has discussed what they would like to see included in the study.
E. Administrative Renort
Mr. Wise stated that two developers of auditoriums and skating
rinks in Anchorage approached him regarding the construction of
aa auditorium in Kenai with a 2,000 person seating capacity
and a stage and the capacity to include a restaurant, hockey
rink and bowling alley.
Viee-Chairman Raymond asked if the Commission had any recommendations
regaraing disposal of the "old library building". There were none.

A RESOLUTZON OF THE ADVISORY PLANNING AND ZONING COrfMISSION OF
THE CITY OF KENAI RECOMMENDING DISPOSITION OF CERTAIN CITY
FORECLOSURE PARCE~S AND BOROUCt~ FORECLOSURE PARCELS.
WHEREAS, Ordinance 312-76 provides that this Commission must '
review any City-owned or foreclosure parcels prior to disposition,
and
WHEREAS, this Commission has reviewed the parcels attached hereto
and has determined that there is no present or future recreational
or other public use for these parcels, and
WHEREAS, thfs Commfssion feels that development of these parcels
by private inclividuals is in accordance with the•City concept
of development and is in the best interest of the City.
