S. 42.05.711 (b) that notwithstanding my other provisions of this chapter, municipalities providing collection and disposal service of garbage, refuse, trash or other waste material within their corporate boundaries are not subject to regulation by the Alaska Public Utilities Commission unless the munici- i polity elects to be subject to the provisions of this chapter, and WHEREAS, citizens are presently required to utilize the refuse collection service, and i WHEREAS, citizens should be allowed to dispose of their refuse by taking it themselves to a valid waste disposal site. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Kenai, Alaska, as follows: Seotbn b Section 9-5(a) of the Code of the City of Kenai is hereby amended to read in its entirety as follows: Refuse Service to be Provided by a Certified Carrier Section "(a). Refuse collection in the City of Kenai shall be provided by a refuse collection service certificated and regulated by the Alaska Public Utilities Commission. Section 2: Section 9-5 (b) of the Code of the City of Kenai is hereby amended to read in it entirety as follows: 1 v Removal of Refuse to a Local Solid Waste Disoosal Site Required Section 9-50). it is hereby found and determined that periodic collection of garbage from all places in the City of Kenai benefits all occupants of places or promisee in the City; and such occupants or persons in possession, charge or i control of any place in or from which garbage is created, accumulated or produced shall either utilize and pay for the refrase collection service enumerated in Section 9-5(a), above, or shall themselves provide for their own individual collection service by removing their own refuse to a local solid waste disposal site, at those time intervals as is required by Section 9-8 below. 11 ORDINANCE NO. 391.70, Page Two r � Section 3: Section 9-5(c) of the Code of the City of Kenai is hereby added to read in its entirety as follows: i f Burning or Burying of ,Refuse Prohibttea Section "(c) . in no event may occupants or persons in possession, charge -f or ccmtrol of any place in or from which refuse is created: accumulated or produced, bury or burn such refuse. Spoke, State IDeAartment of Hidywevs , Mr. Spoke, Central District Engineer for the State Department of Highways presented the Five Year Highway Construction Pwgram to the Council end i advised that the City of Kenai would be included•iun the Off System Road Contruction Program this year. The tentative contract, award schedule is to reconstruct and pave S.8 miles of the Beaver Loop Road and reconstruct and pave 2.5 smiles of i Homesite Loop (Forest Drive) . Estimated total cost for the heaver Loop project In $500,800 and $375,000 for 11amessite Loop. Also included in this year's - t construction projects is a bicycle path along the Spur ftighway to Tinkor Lane, Mr. Spoke advised that these Projects would riot"have been feasible it it had riot been for the funding from the off System program. Aur. Spake also advised that __..... the 1Conai Spur Highway project should be completed in July or August. Mr. Spoke also requested that Council submit a resolution which should be sent �- to our Congressional delegation to encourage the continuance of the off systom - road project funding] on a yearly basis. Mr. Spoke stated, "this money would ` got some projects off the board which would not got done for many years". Air. Lynn advised that it was the intent of the City to assume maintenance if the construction of these roadways met City standards. N r. Spoke advised that there was not enough money available to construct a primary type road, however, the construction as planned would serve the needs of the area. Mr. Spoke further advised that ilomesite Loop would have a paved sidewall: and combined bicycle path out to the turn. The State will have put in the best approaches they possibly can. Mr. Keith Morberg of the ITighwvy Department advised the Council that Moth projects would have a gr rr-1 overlay. The plats WL;Iudo gaiting the roadway up and will seal with a 2" surface of asphalt. Mr. Phillip Aber, City Public Works Director, explained the feelings of the City which have been expressed in prior meetings in that it was his feeling too that a better way to go would be to do just a portion of the roadway and do a complete job on it as far as the money would go. Mr. Aber stated he would like to sit down with the Highway Department representatives and go over the proposed plan of construction. Mr. Morberg stated that due to traffic counts taken on both Beaver Loop and Homesite Loop, it was determined that traffic load is comparatively light and the proposed type of construction would serve the needs. Mr. Morberg further stated that a proposal such as Mr. Aber suggested would mean dropping 9/10ths of the project. Councilman Ambarian inquired if the City assumed maintenance and after two or three years some problems arise, is there some stipulation wherein the State would take over the maintenance once again? Such zoning would assume that local interests would be respected in any future state disposal of this land. A further consideration to any disposal -program involving school land is the recent suit filed by the Hoard of Education against the State (Division of Land and Water Management) asking for a preliminary inJunction to prevent us from converting lasses on school land or leasing school land mtdsr our leasing authority, particularly Alaska Statute MASALA. she Soars of Education feels that this Saw as amended by the last legislative session severely limits the ability of the state to maximize revenues through the leasing process. The purpose of trust lands as stated in AS 38.05.032 is to generate revenue. The zoning change request was initiated by our land management people to comply with our agreement with the 4t9to on the esebange of this land for property in Boldotna, The land management original request was for a change to industrial use. Because the Kenai zoning ordinance has heavy industrial and light industrial zones, the request and subsequent Assembly ordinance were not clear and were incorrect. The action at the Assembly to insert light In- dustrial in the zoning amendment ordinance was to correct a mistake. The act of correction of the ordinance has no correlation to the outcome of the amendment and to the vote of individual members. Wise, City Manager PROM: Mayor & Council DATE: March 14, 1978 1 The recent tour of City facilities was most educational and we should take pride in the work done and the dedication of City employees. Also impressive was the amount of City facilities. The thrust of this memo is two -fold -- first appreciation of all that has been and is being done and second, pointing out some items which should perhaps have a higher priority of action. Comments and follow-up reports would be appreciated. Such items would include: (1) A general clean up of the inside of the pump house for Well A. (2) A general clean up of the outside entrance to the Airport Terminal. (3) Changing the usage of some of the jail cells from their present use as store- rooms. Such present usage appears to be a high fire hazard. (4) Establishment of some system for snow removal from the sidewalks and entrance ways to the Public Safety Building. We appear to have an unused tractor with snow blower. if someone acts beyond a strict interpretation of a job description, such initiative and pride in the City's appearance -will be remembered. Thank you. VOR: sp a CITY MANAGER'S REPORT #6-78 (March 15, 1978) PUBLIC HEARINGS 1. Ordinance No. 391-78 This ordinance amends the Code of the City concerning refuse collection and we have placed the responsibility for refuse collection control in the Alaska Public Utilities Commission. 2. Ordinance No. 392-78 This ordinance amends the library budget by adding $400 which has been received in donations. 3. Ordinance No. 393-78 This is the ordinance which receives and appropriates anti recessionary revenue sharing funds in the amount of $39,000. There are, at this moment, no proposed adjustments in the utilization of those funds. 1 4. Renewal of Beverage Dispensary License - Katmai Motel 5. Renewal of Club License - Eagles OLD BUSINESS 6. Resolution No. 78-23 This resolution concerns the deed of release on tract D-5. Again, this resolution should be left on the table unless we receive a new deed of release from the FAA. Councilman Ambarian, the City Attorney and I visited with the FAA on last Tuesday and reviewed the series of events which have occurred regarding the Kenai Municipal Airport. The meeting was congenial and, when we discussed the conflict between the deed of release and concept lease provision that the Council had been adopting, I had the impression that they would review the language of that deed of release and presumably change it so that it will not require, in this case, a public auction for the lease. 7. Salamatof Seafoods Lease - Discussion The Attorney will report on this regarding the recent letter received from the Bureau of Land Management stating no objection to the lease and Mr. Smith will also be in attendance and will be requesting at this time approval of a second building on the tract, which will be a 40 by 60 steel building. Resolution Requesting Transfer of Funds A. .. .IIA. k1loc 11 =11 IIN This resolution concerns a transfer of funds within the library budget in that during Emily's proposed vacation , we need to be able to cover her position and insufficient funds are in the budget. Therefore, we are asking for this transfer to cover that item. You will note that we are not using any of the accounts for this transfer that relate to anti -recessionary funding, so there is no abuse of the anti -recessionary monies. 10. Resolution Authorizing Transfer of Funds This resolution concerns a transfer of funds in the Legis- lative and City Clerk budgets relative to the City Clerk's discussic of coffee pot replacement. 11. Resolution Authorizing Retention of Audit Firm This resolution concerns audit of the capital project of building the Kenai Community Library. We need to have this audit completed as soon as possible to clean up the project and get the final State monies authorized the City. 12. Resolution Authorizing Sallv's Auction to Conduct City Auction This auction deals with our surplus equipment and is scheduled for March 18th. This was suggested by a member of the Council in that, hopefully, using professional auctioneering person: we will be able to maximize the return to the City inasmuch as Keitt and I are not qualified auctioneers and may not be able to maximize the return. The request of commission for Sally's would be ten per( which may well be worthwhile to the City. I recommend serious consideration of the resolution. 13. Resolution - Award of Gravel Bid The funds for the purchase of gravel and stockpiling the gravel were authorized during the first anti -recessionary fund alloy There were approximately $23,000 allocated between street sign mates and gravel. There are adequate funds to complete this particular purchase: 14. Resolution - Rescinding Street Light Maintenance Arareei This resolution would rescind the street light maintenance agreement with Redi-Electric due to their recent request for withdr`_-__ We need this resolution for the purpose of housekeeping. Upon receiving approval of the resolution, we willproceed in securing another firm to to our Spur Highway street light maintenance. Lease of City -owned Lands - Philip Bryson and Craig Frear This lease has a concern in that it is one of the Fidalgo lots. It is the lot which has access off of Fidalgo Street which right now is only used as a driveway to the Public Safety Building parking lot. There would also be a requirement to extend water and sewer from Willow Street down Fidalgo to the vicinity of this particular lot. The water can easily be extended by a minor change order to the contract awarded to Doyle`s Construction for the waterline that will be installed in the very near future. The sewer is another problem and certainly an item which the Council should consider. 16. Approval of Assignment of Lease - Peninsula Enterprises to Alaska Chrvsler This is the hangar building in the Old Runway area. 17. Preapplication for Federal Assistance to Resurface Airport Runway - Discussion The preapplication is simply a letter of intent to the FAA ` that indicates our desire to proceed with this project. It does ' not require and does not commit the City to provide a local share. The reason for filing a preapplication is that this then will give the FAA in Anchorage a documented justification for asking for funds in our behalf. I recommend approval of this preapplication. 18. Application for Permit for Games of Chance and Skill 6�atlonal Federation of the Blind 19. Request for Authorization for the Librarian to Attend State Library Association Conference in Ketchikan, This item includes request for authorization for annual leave for a following period. 20. EDA Surplus Funds Proiect We are working on the EDA surplus funds project and will presumably have the letters submitted to EDA by Wednesday proposing adjusted budgets and identifying the additional projects the Council hasapproved and, hopefully, this will enable us to get definitive EDA approval and enable us then to retain engineers to proceed with the projects. ` 21• Inspection for Contracted EDA Proiects " We will be presenting to the Council in the very near future our plans for inspection of the already contracted EDA projects. We are having a meeting with the two engineering firms to determine exactly the type of inspection needed and to see if we can consolidate the inspection effort to minimize the cost of the projects. Serendipity Enterprises Concept Lease I would like to point out that Mrs. Lashley of Serendipity Enterprises has formally applied to the Planning Commission for lease of the 6.2 acre lot at Beaverloop and the Spur Highway with an annual lease rate of something in excess of $32,000. The concept was a six story motel with ballroom, conference roon and a plan for another tower addition at a future time. 23. Status of Airport Lands It is significant that as of this date we have essentially all of the available platted Airport lands under lease or under lease application. The lands on Willow Street are all under application except for one lot across from the Public Safety Building. Within the Cook Inlet Industrial Air Park, all land has been applied for with the exception of one lot lying between the Clarion and the new'Arness office building. Previously, I mentioned the Craig Freas and Phil Bryson application which is now edging into the undeveloped area of Fidalgo. At this moment, we have very little land which is platted and available for lease whose revenue is dedicated to the Airport. I am expecting to receive momentarily the platting of the land between the Spur and the Elks and, hopefully, we will be able to move on that subdivision and lease. As of this moment, I have received no word from First Federal relative to exactly what they want on the FAA reserve across from the Katmai Motel. That plat has been furnished by Malone Surveying and is in the hands of the First Federal people now. As of the moment, I would like to point out that revenue from leases last budget year was approximately $96,000. Mr. Harold Galliet was instructed to review, i,,vestigate and design as necessary the completion of pump equipment planned for use at the water storage facility tank so that such equipment is automatically activated irf'an event of a power outage. On March 13, 1978, Harold Galliet sent down a survey crew to start on '': staking the clearing limits for the 3M gallon storage tank and the chain link fence. Works Department. It has been found that funding is not -available for this upcoming construction season and that we will be lucky if we get anything by the next construction season. Yet, some kind of reply is appropriate to these engineering firms that have spent some time in preparing their proposals. If the Council wants to ho off any type of committment to these engineering firms until we are closer to a time when funding will be available, then we should so inform them. Construction Specifications I am still reading and studying Anchorage's procedures at this time. Those materials include: (1) Standard Specifications, The Municipality of Anchorage, May 1976; (2) Title 21 of the Anchorage Municipal Code, Land Use Regulations; (3) Land Subdivision Regulations for the Municipality of Anchorage,.', June 1977; 44) Official Streets and Highways Plan, Policies and Standards (5) Anchorage's Subdivision Agreement. Their procedures are quite involved and look like they are designed to give the City the maximum amount of protection needed. Equipment Auction The auction*.•has been set up -and is ready to go for Saturday, March 18, 1978 at 10:00 a.m. There has been some discussion as to whether the City.employees should handle the auction or if it should be -sub- . contracted out to Sally's Auction Company. The Public Works Department really has no preference,in the way this is handled. 0 r- Mr. John Wise t - March 15, 1978 Page Three Sewer Treatment Plant I have worked the past week quite extensively with our City Attorney in answering a letter sent by Mr. Michael Garcia of EPA concerning the interim modifications to the Sewer Treatment -- Plant. I have also worked extensively with our City Attorney in answering the interrogatories sent to the City of Kenai by - the U. S. Attorney. ; Sewer Treatment Plant operators have commented that there is a striking improvement in the quality of sewage reaching the sewer treatment plant since the March 8th banning of septic dumping into the City sewer system. At this time, we have had no septic tank dumpers dumping at the Sewage Treatment Plant. :- Items of Interest At the present time, I am working on lining up some projects for ` the Young Adult Conservation Corps, a service provided by the ' U. S. Department of Agriculture Forest Service, Alaska Region. CH2M Hill has sent to the City of Kenai some information that they hope to incorporate into their Sewage Facility Plant. The information, - they sent is a draft of the infiltration in-flow-analysis, future r �- population projections and new City maps of the sewage system and - -_ the instructions on their use. I will have these items available _ at the Council meeting. They have stated that they would like to .1E11 set a date of May 3rd as their public hearing for this sewage - facilities plan. They have a 30--day requirement for advertising and are therefore required to start their advertising campaign at c: ;= this time. �- -"""- I have spent some time working with Mr. Loren Leaman of CH2M Hill �- ;'�:;:.;-_ gathering data and investigating some of their questions they have - asked of us. II ' R --w_— Mr. John Wise i March 15, 1978 f Page Four F I I sent a letter to Carr -Gottstein in response to their request for City of Kenai to accept improvements for their lots on the bluff in Redoubt Terrace. The letter stated that the City of Kenai would accept the water and sewer improvements for the remaining of this winter's snow removal on the street. The letter also mentioned that this would in no way relieve the construction contractor of his obligations under his warranty. I understand that the paving contractor has been requested to return to do some corrective action on the paving. We will take a closer look at this road this summer. I have had to do some more work on our recent application for funding for winterization of our warm storage equipment building. EDA has required a complete breakdown on material and labor cost to be spent on this project. On Saturday, March 11, 1978, there was a tour given through many of the City of Kenai facilities. Please feel free to contact me at any time if anyone desires to take a closer look or a first look at any of the City facilities. Public works Weekly Foremen's Meeting The City of Kenai Department of Public Works is now having a weekly foremen's meeting. The main purpose of this meeting is to increase the communications not only within our department but with the administration and the City Council. The foremen turn in a short weekly report at this time and we discuss anything and everything that Concerns our department. The form containss (1) What was accomplished this past week and if there was any unscheduled overtime; - (2) What is planned for the upcoming weeks (3) what are our future goals and the dates we hope to accomplish them; and (4) What are some of the problems, solutions, questions, answers, discussion or any comments. I have found this type of meeting very useful in getting everybody to work together, to communicate, to set up goals and actually get something accomplished. These reports are available for review. The Shoe has replaced the rollers and idlers on one side of the HD11 Dozer, rebuilt an engine for Unit f-550 replaced the hydraulic valve for the wring on the Gallion GradQ r, repaired some exhaust systems, did some Mane --ups, and some misce .laneou:i repair work. They plan on repairing the br•aYes on the generator truck, finishing up the 111)11 Dozer, and continue general regular maintenance. IQ 0 I li II II II Mr. John Wise March 15, 1978 Page Five The Street Crew has been working on storm sewer drains, ice build-ups, stripping back snow and ice off of the streets, repair of airport lights. They have finished working on the sign storage rack, moved all the old City Hall records to the new storage area, and hauled garbage from the shop, scenic parks, and on the beach near the bluff. They plan on continuing to strip the streets as the weather warms up and thawing begins. The Water and Sewer Crew have been working continuously on a problem we have at the No. 2 lift station. It is very apparent that this lift station is being over worked. It maintains all of the waste water sewage from the East side of town including the industrial park area from the airport. They have been checking the water wells, the lift stations and they cleaned the meter at Wildwood. They plan to continue working on the lift stations this coming week. Part of their future goals and accomplishments is to get Well House }#2 going, put a new water well line into the ball park (which froze this winter) and to work on some of the fire hydrants around town. The Animal Control Officer worked this week answering animal com- plaints, taking care of the animals, animal disposal, and patrolling the areas around town. He plans on putting in the new nitrogen chamber when it arrives. i The Wastewater Treatment Plant foreman mentioned that both the `• Sewer Treatment Plant operators completed an eight day work shop for operation training in proper laboratory procedures. They plan - on cleaning up the plant, repairing the sand filter, and continuing the regularly scheduled testing and maintenance of the plant. tie „t mentioned that future goals would include any interim modifications that are approved. Box 580 � _A ev Kenai, AK 99611 GRADING RESULTS Dear Mr. Wises We have completed the in -office review for fire insurance purposes of the fire protection provided to Kenai. We want to thank you for the cooperation given us. We are pleased to inform you that the grading improvements made results in Protection Class 6 for areas protected by mains and hydrants and Class 9 (with Class 8 for dwellings) for other than dwellings, for areas without recognizable water supplies and within five miles of a fire station. A Class 9 has been set up for those areas over five miles from a fire station. Formerly a Class 7 applied to areas protected by water systems. This change should result in a decrease in the total premium developed from many classes of properties insured under Insurance Services Office programs. In Alaska, however, in - companies are permitted to deviate from I80 developed rate levels and they may not follow our rates for all lines of Insurance. With respect to ISO developed rates, the change from Class 7 to Class 6 will lower the premium on non-sprinklered commer- cial and institutional properties insured under a commercial fire policy to a degree depending on the type of building con- structuion, the hazard of occupancy and other rating factors. The overall effect is usually about minus 107.; however, speci- fic hazards may cause increases or decreased from this average. While there may also be a premium reduction for commercial properties insured under "package policies" no percentage can be quoted due to the many variables involved. The change makes considerable change in rates for sprinklered properties and some other special schedule rated properties. The change will effect dwelling property insured under a dwelling fire policy or home- owners type policy. Examples of premium reduction under a dwell- ing fire policy are: 1) $108 per year for a typical $50,000 dwelling and 2) $278 per year for a $100,000 four -family dwel- ling. For a typical $50,000 homeowners policy, a reduction of $36 per year would result. Mr. John E. For your information, we are enclosing a copy of the grading sheet. ISO personnel are available for conferences in our office to discuss the grading results, to evaluate any proposed changes and to respond to specific inquiries concerning special fire pro- tection problems which may affect the grading. Oilman, Knight, Morgan, Soldotna Chamber, Chenault, press and radio. ALPETCO officials had nothing really new -- did point out State Legislative hearings are scheduled monday 3/13. Mayor oilmen will attend. Next event for ALPETCO that i know of is Chamber luncheon in North Kenai. Suggestion was made to ALPETCO to use Borough OEDP, Frank Mcrihergey 0 as a coordinator so that we, for example, can find out what are ALPETCO travel plans, who will be in group, eto. and arrange a meeting with Council. 2) Bob Yesaft of. Foster a Marshall, investment bankers, was in City office. Foster i Marshall are getting very interested in acting as advisor for City in regard to ALPETCO. Background -- Foster a Marshall will absorb out-oi-pocket expenses, we pay ` fee of =3-=5,000. Foster a Marshall will get their major fee out of proceeds of ALPETCO/City financings. Dean Witter proposal -- we pick up oat -of -pocket, small binding fee and then major fee out of future financings.
