Ordtna,ce 421-78, Declaring a public nuisance exists on certain parcels within the City. This relates to Jahrtg properties (the old Armory Building and adjacent lot). 2. Ordinance423-78, increasing estimated revenues and appropriations in the Airport Land System. This is to provide monies that will be eligibl# for use as a pick-up truck so that we may purchase it and have it on order once we have assured that we are in a position to hire an Operations Manager for the Airport. 3. Ordtnancb 424-78, which amends Ordinance 400-78 on poltctes and procedures relattve to the lease of Airport lands. There are certain modifications and corrections relative to subleasing on termination of lease disposition of any structures thereon. 4. Kenat Municipal Airport Master Plan. There wtll be no publlc presentation by the coflsultants, however, it ts desirable that we hear from the publtc any questions or comments that they may have and apparently there wtll be some input in that Peninsula Att Servtce (Gerald Stbley)has run an ad tn the paper maktng sene comments to the Master Plan. The consultants wtll be available at the publlc heartng and wtll answer any questions and make any comments required.' A copy of the ftnal draft of the Master Plan ts available at the Ltbrary. ! belleve that certatn other people have co~tes -- we do not at this moment have a copy here tn the offtce. 5. Consideration of Resolution 78-121 which dealt wtth the sale of surplus tanks in the old shallow well buildings whtch was not acted upon at the last Counct1 meeting due to the ~estton of abtltty to dispose, of such property. ! have Office of Management.and Budget '.=Jd~certatn-regulatton.A 102 has ~he-information has'to-what.can be done. The Attar,my will research this and, hopefully, have an answer for us on this as to what we must do to dispose of the property. 6. We have ltsted under Old Business the protest by Mr, Thompson relative change in lease rate on his lot which is the site of the Post Office facility. We have a letter from Mr. Thompson re-clarifying his position, however, it wtll not be presented at this time to the Counctl because a committee wtll meet at a work session Monday evening at 6 p.m. and wtll discuss all three leases which are due for renegottatton with the appraiser and hopefully establish a poltcy relattve to these three leases. 7. We are asking for approval of Resolution 78-123 which accepts the $50,400 grant from EOA for the Arctic Doors for the Airport Temtnal. We wtll have data on the Arctic Doors relattve to Councilman Ambartan's question as to the posstble infringement on the gas pits in.the front of the Terminal. 8. Ordinance 425-78, which again relates to the Arctic Doors and this will be a funding ordinance to actually accomplish the work of the winterization of the Installation of tile Arctt¢ Doors. --9.-' Resolution 78-122,.which is a resolution recommending to the Borough Assembly that the Planning and Zoning Commission's recommendations embodied tn Resolutions ~21 and ~g4 to amend the Otstrtct Code relative to the City of Kenat. I will point out here that these basically go back to the changes proposed last year by the Plannino Commission. They have k en slightly rewritten and the reason for the separation of the two is to put housekeeping ms in Resolution #21 and the major changes in Resolution #24. 10. Resolution 78-1~5, this is the resolution to set the rate of retur, relative to Ordinance 400,78 for Airport lease lands. This is mandated by that ordinance v~o have not done it to-date. The rate is set at 6[ and I understand that this is the desires of the Counctl. REPORT, Page 11. Resolution 78-126, this relates to ~atSve claims to lands located tn the Chugach ~tional Forest. We have been asked by the Forest Service to cenamnt. We have preliminary .nvtronmental survey of the area and while we have no direct concern, it ts my interest here to move settlement of the Native clatms and get lands from the Federal government un,er private ownership and for development which is, ! feel, in the best interest of the State. And, if we can support movement of Federal lands to private ownership ! think we should do so. There is an objection from the Forest Service simply stated tn that they do not want to give up any lands which ! think ts a bad thing to do. The problem ! see is that this ts the answer to any particular question these days in that no one wants to give anything up. ! feel a position by the City will not be of tremendous significance but will support really the rational D-2 legislation tn the settlement of both the State's claims and the Native's claims. 12. Resolution 78-127, Police Officer ¢ordle has been tnvtted to attend the Drug Enforcement Training Program sponsored through the Office of Crtmtnal Justice. ~e must apply f6r a grant to fund the training session per diem, travel and so forth which is the basic element of thts resolution. However, Officer ¢ordle has not been in the Oepartment for five years and we must approve a walver or exception to that policy to peemtt him to go. Both the Chief and myself recommend approval. ~t is a training programwhtch is worthwhile for the C1ty and for Officer Cordle and there wtll be a normal contract for retention following completion of this particular course. 13. Resolution 78-128, ts a transfer resolution to move funds wtthtn the Legal Budget to provtde for a s11ghtly tmproved Mag Card machine. 14. Resolution 78-129, is a transfeewtthtn the Fire Department budget to properly pay for ~-~he repatntt~ which wa~ authorized for the tanker and the crash truck at the last Council '.~_jeet4ng. -Ii ts's~mply to.movemoney f~om one account.to another, account .to properly meet the line item. 15. Resolution 78-130, ts a transfer within the LPW funds to provide for the additional expenditure of surveying which is included under item #17, PMA's bt11. 16. Approval of a continuing lease for Tesoro here in the Airport Terminal. 17. Approval of a continuing lease for Kenai Air Service, Inc. here in the Terminal. 18. A bill from tteinrtch's Electric relative to a cable cut that occurred some time ago (n the Cart's Mall when the storm sewer was being relocated in.that area. A memorand~m has been prepared for Council relative to this. I feel that the btll must be paid and it falls to the project. 19. CH2M Hill btlls for Faciltty Hans on the Sewage system. 20. Project Manager Alaska, Inc. bills for basic inspection service and for surveying. 21. Payment request for Rockford Corporation for work completed to-date on the tank project. 2~. Authorization for reimbursement to the Bureau of Outdoor Recreation for overpayments on two audited projects. ~m~13. Architectural proposal to do the architecture work relative t:o the Arctic Doors so that we may move this project. The proposal is attached and in your packet with a standard architect contract for such project. I will point out that ~r. Gintoli is the only architect which resides within the City and has done some work for the Civic Center* R£PO~T, Pag~ 3 24. I have been Informed by the FAA that a letter has been prepared authorizing us Lo proceed with the snow removal equipment purchase. He would like to ask at this trine authortzattorJ to proceed with advertising for receipt of bids and ~e would expect to have all the documentation finalized and a fonnal grant request authorization received so that we may appropriate the money at the next regular Council mbeLtng. 26. ~e are trytng to get the several cl~nge orders fo~ the Hater Reservoir Storage Tank so that we can present them to the Council for final approval. ~t ts destreable for us to have them before Council so that we may show ?SO who will be here soon, that we actually have a rim commitment to puttlng some appropriate pumping and emergency power tn that .partlcular area. 27. ! have prepared a public nuisances letter and memorandum relative to properyon the Spur, Mr. ~ahrtg's house and two lots relatJve to Vozar's alleged public nuisances. ! wtll he asking that you set a publJc hearlng on August 1Gth for this request. 28. ~e agatn have antt-recesstonary funds available to the Ctty and they are very substantlal Jn excess of $50,000. ~e are looUng for nomination of projects which we can properly use these funds. To point out again that they are not eligible for use for CapJtal !mprovements and, therefore, cannot be used for any major slgntftcant items. ~e are considering asktng for Council approval of some special funding to put up barricades on the bluff - steel posts embedded tn concrete wtth chain, or wire, also at the bluff across from the Church and also at Forest OrJve where 1t overlooks the Sewage Treatment Plant. "Ballpark estlmate" of the cost would probably be $10,000+. Another Jtem would .-~be to buy s~e chemicals for the "crash f~ghttng ftre truck". Another 1rem would be to -~ouy culvert - we are running into a situation ~here addJtJonal culver~ Js required where we must put culverts Jn to correct drainage problems which are occurrJng more and more frequently. One area we are again trying to investigate ts whether or not we can use these funds to buy the non-perforated sewer manhole lids so that we can correct the problem that the perforated lids permlttJng water to enter the system. Certainly we are interested tn any nominations any member of Council cares to make and we will try to have something worked up for the CouncJl for Introduction on the 16th of August. 2g. CEIP Program - There was a meeting Thursda~of last week relative to minor certain modifications to the program which I attended, There are no major changes as best I can see, however~ there will be another round of applications to be submitted to the State for fundtng in the very near future. The type of projects which are covered by tMs proSect area plannlng, architectural engineering activities, etc. which relate to Coastal Energy. At the moment I simply cannot think of' anything that is worth,Mir at this time. If there are any thoughts from Council, please let me kno~ that I shall be more than happy to discuss it with you. There w~11 again be considerable amount of money available and if we have worthwhile projects of course, we should put'sue it. 30. This means that we will then be able to get bet~een Federal and State support, 87-1/P-% for the co,utructton for that project, ~That will be tn addition to the central by~pass and the actual renovation of ~he Plm~t %~itself. So, therefore, we can ant~cipate the project co.~t go'ing from $4~0,()00, as previously presented to i~erhaps $5?.5,000+ or there-.abouts, CITY ATTOI1NEY'.~ IU';PORT AUGUST 2, 1978 ORDINANCE 210-72 (USE OF TRAILERS I'IlOHIBITI:,D) The question has arisbn az to why tho foUowing paragraph of Ordinance 210-72 cannot be enforced: Section 14-82. No trailers may be installed for use in the City of Kenai for public, commercial or assembly purposes after the 1st day of January, 1973. Those trailers in use for the prohibited purposes on the effective date of this enactment shall terminate such use on or before the 1st day of January, 1978, and such existing non-conforming uses as presently exist may not bo altered, enhanced, or improved in any fashion after the 1st day of January, 1973. ANSWER: In my opinion, the above provision of Ordinance 210-72 (effective Januat~y l, 1973) cannot be enforced because it has been supplanted by Kenal Peninsula Borough Code of Ordinance Chapter 21.76, (the Kenal Municipal District Zoning Code) Specifically, 21.'/6.180 thereof reads: 21. ?$.180 Mobile Homos. A. No mobile homes may be installed ~or t~e in the city of Kenai for public, commercial or assembly purposes alta:' the effective date of the ordinRnce codified in this chapter. B. Areas delineating permitted and prohibited trailer use loeaflon: 1. For regulation purposes, the city shall be divided into two re, ess, with the common boundm, y being Main Street and Main Street extended to the northern boundary of the city limits as shown on the official zoning map of the city of Kenai~ 2. Mobile homes for residential use may be pa~ked anywhere within the rural residential zone east of tho boundary line described in CB)(1) of this section and south of the Kenai River, unless such mobile homes are prohibited by restrictive covenants, health standards or other regulations. Mobile homes may be pranked only in "mobile home pa~ks" (sometimes also known as "trailer courts*') in the a~ea west of the boundary line described in CB) (1) of this section. 3. Mobile homes which were installed prior to the effective date of the ordinance codified herein, in eonformonee with applte~tble buildinff code regulations in areas where now prohibited and used for residential purposes, may have such use continued indefinitely, except that sueh trailers shall not be replflc~,d if d~.stroyed or l'emoved. 4. Mobile homes utilized on bona fide construction sites for offiees, sto~'age, or other such purposes may be so used anywhere within the city limits on the construction Job they seFve but shall be removed immediately upon completion of said construction. The parties hereto agree as fo11~s: 1. City hereby grants to Peninsula Four Wheelers the privilege to use the area kflo~n as the Kenat Beach between high and lo~ tide lines for purpose of conducting a drag race for four wheel drive vehicles. 2. Peninsula Four~eelers agrees to save City hamless from all actions, suits, liabilities or damages resulting from or artstng out of any acts of co=~tsston or omisston by Pentnsula Four Wheelers,-. 1ts agents, employees, spectators, tnvttees, or artstng from or out of 1ts occupation or use of the premtses or privileges or out of 1ts activities at the stte, and to pay all costs tn connection therewith. 3. NHEREAS, the City ganager has submitted to the Council a list of parcels of real property upon which he believes that public nuisances exist, and NHEREAS, the Council has held a public hearing on the existence of public nuisances on these parceis, and WHEREAS, all property owners were notified by certified mail and all parcels were advertised In a local newspaper of general circulation that the publtc hearing would be held and given an opportunity to be heard and, in addition, were given the opportunity to abate the alleged publtc nuisances prior to the date of the hearing, and NHEREAS, the Council wtshes to dtrect the abatement of those public nuisances. WHEREAS, Ordinance No. 400-78 relattve to establishing poltctes and procedures 'for the lease of Airport lands was recently adopted by the Counctl of tile City of Kenat, and WHEREAS, satd ordinance revised the leastng pollcy of the Ctty relattve to Atrport lands so that Ctty leases mtght be more attractive to potential lessees and thereby the financial.position of the Ctty, more particularly the Ctty Atrport, would be enhanced, and WHEREAS, certatn other mtnor revisions tn the leastng pollcy are needed to further perfect the revtsed Ctty leases. NOW, THEREFORE, BE IT OROAINEDby the Counct1 of the Ctty of Kenat, Alaska, as follows: Section 1: Secttons 150 and 160, Chapter 10 of Tttle 21 of Ordinance No. 400-76 {~rovtslons Requtred to be Included tn all Atrport Land Leases) are hereby repealed. Sectton 2: Sectton 150 of Chapter 10 of Tttle 21 of Ordinance No. 400-78 hereby enacted to read: "21.10.160 Surrender of Termination. A. However, with the President's approval of the Northwest Pipeline Company's application for construction of a gas pipeline to transport n~tural gas from the North Slope of Alaska to markets in the lower 48 states, it is expected that natural gas (and perhaps natural gas liquids) will be available for ~ale in Alaska and the lower 48 states by the early or mid 1980's. Up to one-eighth of the gas which will be produced and available for sales could be taken in-kind by the State of Alaska and marketed directly by the State. In the first 6 months of 1978 the increase in number 'of requests for services over the corresponding period of 1977 a~ounted to 4%, and 27%' over the sam~ period of 1976. This is a very significant increase of 51% over the 1008 requests for services reported for this sam~ 6 month period of 1975. They do not include arrests made as a result of K.P.D. investigations in which warrants were served in other jurisdictions, or as previously discussed cz/mina1 warrants and process served by the Judicial Services branch of the Alaska Stat~ Troopers. January - June 1978 Traffic Enforcement During the last several years with the incr. e~se in service requests, and more particu/arily the significant increase in the Part 1 Crime category and the manhou~s regui~ed in this cate~omy, there has been fewer available to the Department for traffic enforcement. This has resulted in a 23% decr~_~e in traffic violator contacts between the first 6 months of 1975 and 1976. In 1977 a 27% increase over 1976 was noted which is prima~ily attributmble to the acquisition of a more versatile radar unit that is capable of operation while the petrol ~nit is m~ving. With the sigllif~ca~t increase in Part 1 prc~ crimes in the first 6 months of 1978 fewer traffic enforcement manhours have been a%ruilable ~lich has ~es~tlted in a 15% decrease in violator contacts. With the additional manpower, once trained and familiarized ~o the area, and the anticipated_ acc~sition of additional radar equil~nt for which grant funding has ~ requested the present sittmtion should be im~oved on. During the period 1975 through 1978 there vms stg~ificant economic and population growth and activity in the local area. As a result priorities of service provision, i.e. a~ctdent i~vestigation and property crime investigations, had to be raise~. With the significant i~crease in Part I llrop~rty crin~s in the first 6 mo~ths of 1978 fewer traffic cnforcemant manhours have been a~r-~ilable which has resulted tn a 15% ~Mcrease in violator con,_acts. With the a~ditional mar~, once trained and familiarized to the area, and the anticipated acxluisitio~ of ~itior~l radar equi~m~nt for which grant funding has been requested th~ ~-~sent situation should be i.~=oved on. Langston inquired as to the problem with tho City w~ter in that it was very discolored and ruining laundry, etc. City Manager Wise advised that tho City has been attempting to pump the debris and othet' matter, out of the lines as that is the suspected problem causing tho disooloration, l~Ir. Wise further reported that the City is hopeful that within 90 days tho water will clear up. C-S: Mr. Jaelc Thompson Mr. Thompson camo before Council to protest tho increase in the yearly Lease rate on Lot 10, Alyeska Subdivision (Post Office location). Mr. Thompson stated that the new rate was a §00% increase over the old and, in addition, Mr. Thompson advised that he had a cont~aet with the United States Government which did not expire for two additional yem's and the increase in t, ate could not be absorbed by his tenant. M~. Thompson requested, pax* his lease asTeement with the City, to negothte a rate that would be fait, and equitable for all concerned. Counetlman Malston questioned the increase in l~Ir. Thompson*s rate in that parcels of pt,opet'ty adjacent to the lot in question were recently leased by the City at $ .06 sq. ft. and the City was levying a charge of $ .14+ for Mr. Thompson*s property. City Manager Wise advised that the property Just recently leased had been re-appraised last year and thus the fac*tot, rot' determining the Fate -- Mr. Thompsen*s property was Just recently -'apprised. -Councilman flmbarisn l'eminded'Comioil'that'theCity 'does not negotiate leases and if the City should start doing se below appt'aisal, the City would have to supplement the Aieport fund. Councilman Aber sui~l~estod obtaining another appraisal and Mayor O*Rellly advised that this option was also open to Mr. Thompson. Councilman Malston stated in his opinion the Council should take into consideration the fact that Mr. Thompson has been leasing the subject pFopex~y for 10 years and that he is willing to pay an increased rate within reason. Councilwoman Gliek pointed out that in the 10 years Mr. Thompson has been leasing the pt,operty from the City, his lease rate has never been increased from its o~letnal mount. MOTION: Councilwoman Oltck moved, seconded by Councilmen Malston that the City of Kenal set the lease t,ate for lot 10, Alyeska Subdivision, at $ .08/sq. ft. for a two (2) year period et, until oxpieatlon of lease aBl'eement between Mr. Thompson and his tenant (the U. S. Government) at which time the City Lease rate will increase to $ .149/sq. ft.. Councilwoman Glfek stated that the speeisl circumstances existed due TO the fact that Mt,. Thompson has been a lessee since 1968 and, in addition, he has a locked- in tenant rot* two mot'e years. Mt,. Thompson stated that he would not bo interested in the proposed motion as in two yeats the City would again increase the Fate to an amount l~fr. Oenter ,.*and 8paso -~equ~.ements. ~h'o..Glad .stated that two possible locations bein~ considered were at Airport Way and the Spur (approximately 6 acres) and F!d_~!go Subdivision (approximately 4 acres). Mrs. Glad requested that Council review the proposal and consider authorizing the Committee to proceed with a ~rant request to have an architectural concept/drawings prepared, City Manager Wise l. eported that an area (known as the Well Site #1) was available fronting on the Spur behind the Locke Building. Mrs. Glad and architect Carmen Gintolli will look into the location suggested by Administration. Couneihaan Moisten inquired as to a dollar figure at this time and Mr. Glntolli advised that based on a $0,000 square foot building and because of the multi- use of tho building, the cost would be approximately $3 million. Mayor O*Reilly thanked Mrs. Glad and Mr. Gtntolli for coming before Council and advised that they and there Committee had done a commendable Job in putting the report together and further commented that Council would review the pl'oposal for the project. Page 14 - under comments on "Change of Zoning", Councilwoman Click stated that the minutes should be corrected to reflect her comments as follows:" ....... and there is also some question with regard to a frontage road required for eommeretal uso. As there is not enough room on this parcel for a frontage road and would question it being allowed in the road ROW and in a similar instance there was a developer on Kaltfonsky Bench Road who desired to use the State ROW for a frontage road and it was denied him and his ROW width was 200'+.'" ISO - Mr. Wise advised that the lnsuratwe Servteos Office will be in Kenai to conduct their inspection tho first of August relative to the flz. e rating. Billboard - KIqA ~ Mr. Wise reported that at the last meeting of the Commission, gNA requested a variance in order to place a billboard and business directory for the Wildwood site. The Commission, however, was unalJle to determit~e whether o~' not the request would require a variance, conditional uso, etc. and Mr. Wise requested Council consideration on the matter in order to prevent any further delays for I41~A. Councilwoman Olick advised that the request for rczoning the area to general commercial will allow signs as a compatible use and the signs can be erected under a conditional use. Administration was instructed to poll the Commission with the request for granting a conditional use to KNA for erection of the proposed sign. BOR - City Parks - Mr. Wise requested Finance Director fleas Kilmey to give a resume of the recent field audit of the City parks conducted by Federal Inspectors. Mr. Kinney reported that he accompanied two inspectors around to the various City parks that had been funded by the Bureau of Outdoor Recreation grants. Mr. Kinney expressed ooncern in that thc City did not have proper documentation of various expenditures and work that had be~n charged off to the grants and the BOR inspectors indicated that the City would be required to provide the equipment, improvements, etc. aa outlined in tho grants, Mr. Kinney further stated that tho government would not be acceptable to reimbursement of the monies extended to the City but would demand that the City comply with the grants and also thc City would bo responsible for maintenance on the parks for 25 years in accordance with stipulations contained in the grants. Mr. Kinney 'listed various areas and specific parks irt which the City was deficient. Councilman Abet requested that Mr. Kinney research City x*ccords as Mr. Abet stated when ho was Public Works Director, ho and the then eting Finance Director had spent 8evaral days in compiling records, corresponding with various agencies to resolve some of the questioned areas, ere. and Councilman Abet stated that perhaps the City could furnish BOR with updated information. Councilmaff Ambarfan suggested that the City proceed immediately with a counter-report based on some of the information that the City may have that BOll docs not have on record, Councilman Malsten stated that apparently a great deal of the work as required in the grants had been done, however, the City still has not maintained the parks to the standards that they should be. City Attorneyes Report City Attorney 8cMoreth stated that he had included a proposed lease form in the pockets and in reviewing the form with attorneys for Serendipity and Carr-Gottstein Just a few minor changes wore requested. Councilman Moisten inquired as to why the use of tho lot and not Just tho raw land itself was taken into consideration during tho appraisal and City Attorney Schleroth reported that the best use of the land was considered. Councilman Malston stated that ho did not believe .ir~ this concept as the Otty of Kenai was not ready to sot such stipulations and requirements on the appraisal. City Attorney aehloreth discussed various areas of question in tho lease form relative to improvements to the lots being taken into consideration (water/sewer, etc.) in appraisal, etc., however, Mr. $ohleroth stated that 'most of tho changes would be minor and would incorporate tlioso which did not affect the language or tho intent and return the form to tho Council for review prior to drafting' of final lease document. o 13 - fo) Councilwoman (]lick stated timt she had inquired as to thc continued use of trailers as offices in Old Kenai Townsitc and had been informed by the City Clerk that the City had passed an ordinance requiring that all such use be terminated as of J~nuary, 1978. However, the City Clerk had asked the City Attorney for sn opinion on the matter and he indicated that with the passage of the soning ordinance the former requirement would now be null and void. City Attorney Sehlereth advised Council tilat he would prepare a written opinion on the matter for pre~entation at the next Council meeting. H-3: Mayor*~ Report Mayor O*Rellly requested Council confirmation on the appotntaient of Mrs. garan Mahurin to the Planning Commission. Councilwoman Glick reiterated discussions on the KNA request for variance to erect a sil01.enda public hearing was held .on resolutions PZ 78-21 and ?$-24 recommending amendments to the Kenai Municipal District Zoning Code, Chapter 21.75, Borough Code of Ordinances. Lease application from Mr. McCubbins for Lot 2, Spur SubdivisimJ #1 was tabled as Mr. MeCubbins was not present and the Commission approved a petition to vacate a portion of the 50 foot ROW known as 25th Ave, NR adjacent to the Rasmussen Subdivision. Also, the Commission approved the prellmtnaw/final plat for Spruce Grove S/D. H-7: Borough Assembly's Report Ma~or O'Reilly reported that among the items discussed, Tommy Corr introduced an m'dinanoe asking for exemption of the second $I0,000 of real property and the matter was tabled until fro'that review. This is important because of the fact that these proposals - in some instances ~ conflict with pending State selections. Also, the fact that the State and local communities have authority-for up to 100,.000 acres of additional selections to make from the National Forests, selection needs for community establishment, expansion~ development and recreation- it may be desirable to reexamine these needs at this time. l~orest Supervisor Clay Beal has already mailed to your office and all communities the proposals by Chugach Natives~ Inc. and Kontag Natives, Inc. 'to have their land selection authorities extended to the Chugach National Forest by legislation and/or existing exchange authorities. The proposal by Chugach Natives, Inc. total approxi- mately 234~ 000 acres~ mostly in the Prince William Sound and Bering River Coal Field areas. The Koniag Natives, Inc., although initially proposing selections of 5B, 000 acres, now propose selection of approximately 320, 000 acres which would be the remaining acreage et the Afognak Unit of the Chugach National Forest. We have now received word that Cook Inlet~ Inc. are proposing approximately 87, 000 acres of the Chugach National Forest, but do not have the maps covering the specific proposals. Chugach Forest Supervisor Clay Beal and this office will make these available to you and local communities as soon as these maps are available. It is essential to know tho position of the State and local commu- nities within and adjacent to the Chugach Nvtional Forest on these new selection]exchange proposals. In doing so, Homer Electrtc was requested to locate thetr lines to avoid damage. No Homer Electric lines v~ere damaged. However, unknown to Brown, there was a cable tn condutt from the front of tho grocery store to the parking lot 11ghts. Thts cable locatton was unknown. It appears that reasonable caution ,as exercised by Bro~n. Never the less, the line was cut and the damage had to be repaired. It ts my feellng that the project must assr,me the cost. Assumtn9 approval by the Council, thts ~tll be a charge to the construction account. He have a stmtlar situation on Atrport May. In thts case several 1tries were located by Homer Electrtc and hand excavated. The Homer Electrtc representative then satd that all was clear - at the next moment a Homer Electrtc cable was cut. Homer Electrtc repatred thts cut at no cost. Excavation proceeded and the emergency cable to the termtnal was cut. Thts betng a City 11ne, Homer Electrtc ~ould not repatr tt and Glenn Kipp of Kena~ Electrtc was called to accomplish the repatr. Tie are awatttng ht~ bt11.
