The City Council reconvened at 12s45 A M on August 17, 1978.
Malstonmade a motion, seconded by Whelan author~zing ..
the City Attorney to send a letter to the attorney for the
leaseswhichare subject to renegotiation. The letter
will state that the Council will meet with the lessees and
their attorney at a special meeting on August 24, 1978
at 7s00 P M at the Public Safety Building. The Council
will expect to hear the individual lessees objections to
the appraisal.
The Council was polled with Ackerly absent and the vote
was unanimous.
There was a motion at this time made by Ambarian and
seconded by Glick authorizing the attorney to respond to
EPAes most recent settlement essentially proposing the
terms most recently submitted by the City. The settlement
offer was adjusted in the dollar amount of five thousand
dollars (.$5000), however.
Again the Council was polled and the vote was unanimous
with Ackerly absent.
The Council then adjourned at approximately ls15 A M
on August 17~ 1978

Thio letter is Jn response to a letter to me by the City Attorney, dated
Aufust 9, 1978, which I understand you have authorized to be sent. I assume
from the letter that tho Council requests that I respond on behalf of my clients
to the proposed rent tnoFease on the property they have leased from the City.
I further understand tl~t the Counoil has adopted ss its initial proposal
'for e new lease rate an amount equal to the sum of six percent of the appraised
value of the reapeotive pa~oels.

Under the usual type of commercial negotiation the negotiator generally
expects to provide the opposer with certain confidential business information.
This information is provided in order to enable the oppo.ser to better understand
the position of the negotiator. In the usual commercial context there is generally
little risk of the information exohenged bet~veen negotiators being mede public.
'In the present case, my clients, tn order to adequately end fairly present
their positions to the City Council will be required to lay open their finances
es regard their lease rates, before the public eye, and more importantly, before
the eyes or their competitors and potential competitors. I would request that the
Council odopt some minimum safe831ards to alleviate a potential unwarranted
lntmmion into the business affairs of my clients.

Before we address the merits of the lease increases I would request that
the Council advise me as to the foluflat it intends to follow in the negotiations,
specifically:
Whether the Council intends to conduct the negotiations as a body, ox* to

on behalf of the Council, what will be the limits of authority plaoad on such

If the Council itself acts as the negotiator, I would request that the Council

PUBLIC HEARZNGS
1 Ordinance 425-78 provides for increasing estimated revenues and
pro~iding appropiia'tions for the winterization of the Airport Terminal
Buildin~ in the amount of $50,400.
2 Mr Dayton Childs will present to the Council his plea for ob~aining
part o£ th~eCtion 36 lands for which the City ts actively pursuing
release. These lands lie, of course, between Larry's Club and Superior
Builders. The State wishes to acquire some of Mr Childs' land at
Clam Gulch to expand a wayside and is trying to trade some of Section
36 lands to him. Mr Childs'is very interested in this trade and hopes
by his presentation to obtain the support of the Council for this trade.
The position I have made in the past is that these Section 36 lands
are the most valuable in the City. We need to settle our entitlement on
them, keeping as much of them as is possible, especially those lands which
are of prime value. Any remaining lands could then be swapped by the State
as the State deems appropriate. I believe Mr Childs will propose that
we waive rights to certain Section 36 lands, or surrender our entitlement
to him, for a cash settlement.
Relative to these Section 36 lands,.we have Just received from the State
Notification of Entitlement of.Public Lands. Regrettably, it reads
~0 a0res. ! have alread~ w~itten a prote~ to the Division of Lands
objecting t o this 30 acre entitlement, pointing out that we have been
informed previously that we have a 350 acre entitlement and stating that
we cannot understand this sharp reduction.
3 Mr Ed Selby will request a private extension of sewer lines on Princess
street to pro~ide a private sewer line to service both the Assembly of
God Church and its parsonage. There is a water problem in that area and
the line does cross the spur there. The line probably should be extended
down the street in the right-of-way before it is tapped by either the
church or the parsonage. I see no basic problem in permitting the
Assembly of God Church to do this provided there is an agreement that
this permission does not exempt them from assessments in the event the
line is extended later. The church would then have to disconnect their
line and tie in properly.
4 We will have to begin the lease of space in the Terminal to Tesoro-Alaska
Petroleum Company. Tesoro-Alaska had inappropriatel~sttuck o~t sales
tax from their lease. We will have contacted Tesoro by the Wednesday
meeting and pointed thie,,out.
5 On Wednesday, August 9 at t~e work session, ~ diseuss~d~the'let~er

We have reviewed the area twice across the s~rtp and have an attachment
for a number o£ possibities for improvements,
1 Use of the grass strip the FAA concurred with when here Monday
2 Use of the grass strip proposed by Jerry Sibley that would require
brushing,, rolling, marking and survey
3 Use o£ the existing borrow pit - The diagram has a fan drawn
from the tower to either end of the borrow pit indicating the
areas that must be cleared so that the tower can have complete
visibility of the aircraft on the water.
4 Item number four, ~ B and C, are various tie down or PBS areas.

believe the FAA may well object to it, inasmuch, as tie down
aircraft would obstruct vision of the float plane basi~ if
recognize~ and would encourage vehicle traffic between the grass
strap and the float plane basin. This would obviously obstruct
vision of the float plane basin itself.
The Adm~nistration proposes area four B for a float plane FBO
ares~ ~tem four ¢ for a ski or tundra-6ired tie down.
5 The lane drawn on number fiv~gives the length from the proposed
grass strip to the runway and the Access Taxiway B so that aircraft
can be converted from skiis to wheels or tundra-tired aircraft
could get to the FBO area on the Terminal side of the a~rfield.
We propose ~i'lling in a low spot and opening the gate to Fifth
Avenue. By closing.or: other earthwork, putting in basic access
roads to keep the vehicular tied to that area.
A~other improvement which I feel ~s necessary ~e? to put an overflow
cap on the float pond which, by opening the drains between the float
pond and the old reservoir area~ could provide for overflow to keep the
danger of flooding, particularly in the spr~ng from being such. a
problem.
This memorandum and the schedule will be sent to the FAA, Mr Paterson,
for has review. I believe tha~ once it has been reviewed by Mr Paterson,
Jerry Sibley w~11 ask that he come down to the Council meeting on Wednesday,
giving him an opportunity to see these areas before the Council meeting
and discuss their viability.
I have pointed out to Mr Sibley that ~t ks doubtful that, even with the
onsets .i~speotion, Mr-Paterson representing the FAA would make any definitive
statements as to the acceptability of these plans.
~Carr's Mall cable cut. There ks no change as to the liab£1tty for the
cable cut on airport lands, but we need to take action to refer the bill
either to the City or the contractor for payment~

n the Vicinity of the taxiways A and ~3. There is a requirement for
a sur~ey, platting and appraisal.
8 Resolution 78-133, asks for rejection of vehicle bids. No one was
able to give us ~tean bids since we were presumably too early in our
request and the price lists have not been published.. Assuming rejection,
we will be prepared to readvertise and receive bids as soon as we are
sure th~ prices are available.

10 Resolution 78-135, which, as a result of the work session, is a
wit draws1 of Cty airport ~an4s from lease status and reserving ~hem
for an interim period ~or the proposed Kenai Civic Center. If this is
not done, we would have to entertain lease applications for these lands.
Such is provided for in the Ordinance 400 governing airport lands.
11 Resolution 78-136 is a transfer of funds from LPW funds for basic
en~neer~n~_~os~s. These costs were originall~' anticipated to'be
ineLtgible for reimbursement by fDA. However, they are not such' Since
they are eligible, so we should properly count for them under this section.

of money if we have the funds to buy this equipment.

14 Resolution 78-139, transfer of funds to encumber estimated ~opying

15 Resolution 78-140 is a transfer of funds to purchase small tools for
the'P~rks Department since there is not enough fUnds in that account
to purchase the supplies they need. ·
16 Resolution 78-141 is an award of petroleum products t0 various comp~gie,~.
We h~e five bids and the spread sheet is attached to the resolution.
17 Discussion of openin~ to entry of Beaver Creek subdvision relative
to the request by the Alaska Division of Lands andby the Borough Planing
Department as to whether or no~ the State's, Beaver Creek Subdivision in
the vicinity of Beaver Creek and the Spur, including Calvin 0uandt~s house,
Luke's Welding, Peninsula Motor Homes, and the Beaver House, .... :. -
should be sold by the State. My position as of this moment is that~ before
the State should move any land on the private market, we should get our
entitlement to the State lands settled. This would insure that the land
we desire would not be sold out from under us.
15 Discussion concerning the claim by the Sheffield house for damages
Incurred-by water,sewer problem~ as we'll a~-~e~charging fl0r Wat0r ~d
sewer. The allegatiOn has existed from s~me time that we have overcharged
or~.ater and sewer but have not been able to properly evaluate it with
Public Works and Finance. ! have assured Mr Sheffield by letter that
we would have an analysts of such presented to the Council on or before
September 20.
There is also apparently a claim for damage due to discoloration for
laundry, problems and lost linen.
19 Discussion of renegottation requests by Cason, Peninsula Clarion
and_Thompso~.~The attorney's recent letter to Baldwin and Rogers'-
will be attached and hopefully we will have some response from Baldwin
and Rogers to present to the Counc£1 Wednesday night.
20 Z am sure the Council is aware that the Borough Comptroller has
~eslgned and that the Borough Mayor has been seeking a new one. Some
time ago there was an offer to Ross Kinney, the City Finance Director,
for that position. However, apparently the salary was inadequate and
the position was turned down. The Borough mayor has apparently raised
the anti and M_r Ki~ney has accepted the offer and has resigne~.
21 Notice of appeal hearing relative to the bluff erosion problem
which Will be held at 1~O0 Tuesday at the-Borough. It' ~s my inte~tion
to Pursue the request for fu~d~ng,'PerhaPs ~t a slightly reduced scale..
This will be to run at least a pilot program to try to control the erosion.

doo~ents to court. He ~y well be out of the City Mo~ay and Tuesday.
Incidentally, they provided a one-way ticket to Anchorage for th~s
and we wXll have to recover all of our costs.
There appears to be some additional problems relative to the people
tn the area. Mrs Coyle was tn complaining of additional sand tn their
well.. I understand the Loftstead~s well, also o~Beaver Loop, has
~'6-~head. There ts an allegation that some wells in Thompson Park
are being affected. I would like the Director of Public Works to
monitor these activities of these various wells as well ~s s~me of the
others that we have done testing on to see what actually occurs once
we begin using well number two again.

Z would vezy strongly recom~nd that the City of Kena[ pursue
aoguisition of a building or adequate office and as~embly space to
~onduct their ever increasing administrative responsibilities.
The over crowded situation that occured oll 6-21-78 an~ aga.~n on 8-2-78

WHEREAS, the City of Kenai solicited bids for 1979 vehicles with

RECEIPT OF A RECOMMENDATION BY THE CITY MANAGER THAT CERTAIN ALLEGED PUBLIC
NUISANCES BE ABATED AND SETTING A DATE FOR PUBLIC HEARING IN THE MATTER.
W~EREAS, the City Manager has recommended to the Council that certain alleged
public nuisances be abated, and
WHEREAS,' the Code of the City of Kenai requires that the Council hold a
public hearing in the matter.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Kenai, Alaska,
as £ollows.
Section 1 The Council of the City of Kenai hereby acknowledges
receipt Of a-memorandum from the City Manager identifying certain materials
existing on certain parcels within the City of Kenai as public nuisances
and requesting that they be abated. A copy of such memorandum is attached
hereto and incorporated herein by reference.
Section 2 The Council hereby directs that a public hearing on the
existence of those public nuisances listed in the memorandum incorporated
in Section I be held September 6, 1978, at 7=00 p m at the Kenai Public
Safety Building.
Section 3 The Council hereby directs that the City Manager notify
all owners of those parcels listed in Section 1 and/or any other persons
responsible for or causing ~he alleged public nuisances of the date and
thus of hearing. Such notice shall also include an enumeration of those
steps which must be taken to abate the nuisance existing on the parcel and
a statement that no hearing will be held on the parcel if the public nuisance
le abated to the satisfaction of the City prior to the date set for hearing.
Section 4 Notice of the public hearing directed to be held by Section
2 her~of%h~ll be published at least once in a newspaper of general
oirculatton within the City of Kenai.
Section 5 The Council hereby directs that the City Manager be
prepared to n~ke a presentation at the public hearing as to the existence
of a public nuisance on each parcel, including photographs and statements
of investigating City personnel.

Water Problem
July 28, 1978
During the month of September, the City of Kenai started
supplying the She£Eield llouse*s domestic valet supply with a
new well, This was ~._~m~ediately apparent at the hotel because
there vas a good amount of debris and sand present in the hotel*s
valor lines.
Because of the debris, all the hotel ~oilet asse~bliee had
to be replaced. The bathtub end sink assemblies also had to be
replaced and then eon~inually ~leaned. The hotel linens were
badly stained from this debris.
This problem is a consis~nt one and not one occurring
onXya few hours every so o£~en,
The nev~ater.supplytms eventually switched back ~o the
old city well, This eliminated ~he debris problem, but the
water pressure vas not suf[icient o~ou§h,
At the close of Nay or the first part o£ June, a rater
line was broken by a contractor. ASain, the sand and Zravel
problem started, Then at the end of June a conc~accor tore up
a 12-inch wa~er main, and the pressure has ranfled from 12 to 22
pou~d~ since.

Mayor O'Reilly opened the heating to the public for comment:
Will Jali~Jg - rated that he was the owner of the property in question end the materials
stored on the lots. Mr. Jain'ifg reported that he had hauled approximately 15 ton of
materials away fi*om the lets to date and was in the process of selling a 8Teat deal of
the t'emaining materials to an individual from Anchorage. Mr. JahFiig stated that he
felt they had made considerable improvements to the property and was in the process
of adding on to the building and at completion of construction would utilize one lot
fo~ packing. Mr. Jahrig repo~ted that he had hoped to eompleto the remedelinf~ project
this summer priot' to t'eturning to school, however, his business eommitmant8 have eanaed
oonsiderable delays. Mr. Jahrtg stated that he would retain the saleable merchandise
but would have the debris and miscellaneous item8 Off the lot by the abatement date
Of September 2, 1978.
M~O. 8ar~d~,a Vozar - rated that she lived across the street from the propez~ in question
and did oumment that Mt,. Jahrig h~d cleared the lot eonstderobly, however, was
concerned about the machinery pa~to and debris that was t,ematning. Mt,s. Vozar
stated that all she was eskine: was to cleat, an "eye sore'* and plaeo the materials
in the building mid build a site obscuring fence.

Mrs, Kathy Tomrdle - stated that she lived across the street from the subject property
and did not find the materials contained on the lot were offensive to look at.
Mr** Tomrdle - stated that he felt Mr. Jahrig had made a substantial effort to clear
up his property.

MOTION:
Counollman AmbaFien moved, seconded by Councilwoman Gliek, for adoption of
Ordinance 4~1-78, deelertng public nuisances exist on cemln parcels and setting
such date for abatement as September 2, 1978.
Councilwomen Gliok stated that she had made a tour about the City and noted many
areas of concern and requested that Administration proceed with abatement hearings
as necessary. Cotmoilwoman Gliok also noted that there had been improvement to the
lots in question by Mr. Jahrig. Councilman Aekerly stated he felt the definition of

st~ation making this determination. Mr._ Wise reported that he would detemine
what constituted #Junk~, eta. depending upon how the items were stored and whether or

Mr, Wise advised that that this would provide for an additional mini-pick-up
equipped with local government and FAA radios for Airport use.

new Section 150 **Surrender of Termination** as well as a new Section 160 which would
read **Any assignment requiring Council approval will not be unreasonably denied
and leases may provide for subleasing without prior Council approval.'

B-4** Kenai Municipal Ah*port Master Plan
Mx*. Jim Monger of TAPP, Ina. reported on the draft master plan for the Kenai Airport
which had been present~l to the City last month by the consultants along with a detailed
report on the economic feasibility of proposed developments .for the Airport,
Mr, Monf~et, pE*esentod a brief outline of the proposed plan whioh included Phase I -
1980--85s Phase II - 1985 and Phase III in 1995, Mr. Monger advised that the most costly
phase would scour in 1980 to 1985 in which it is proposed that the City aequh*e lands
edJaeent to the Airport for float plane basin exeavation and eonstru~ion, repaying of
the runway (whteh is now underway), additional tie-down8 near the Terminal, access
to the BLM proposed area and extend Willow Street, Mx*. Monger reported that
in 1985 the plan proposed for the paving of parallel taxiways, remodel present Terminal,
· pave'apron'by'the'Control' Tower, 'etc. Mr. 'Monger also'presented 'the Terminal plan
for development ef additional lots for lease north of the Terminal, additional parking
area8, eM, Mr, Monger further commented that the financial analysis as presented
for reeommendstton of certain improvements end developments was feasible. Mr. Monger
suggested alternatives for revenues to aid in the proposed development and also to
provide a euahton, The consultants as a whole strongly recommended a full time
Ah, port Manager and stated a position of this nature would save money for the City
In the long-run.

Gerald SJbley - stated that the original plan provided for a buffer zone adjacent to the
?erminai and the latest Master Plan Indicates that this area will he available for lease
and utllf_~,~tion. Mr. Monger advised that Kenai Air Service had submitted a request
for lease of this area and thus the reason for inclusion in the plan. Councilman
Amberian stated that at the last meeting between the consultants and interested persons.

Councilman Amberian stated he felt additional perking was direly needed.
Craig Freas stated that he agreed w~th Councilman Ambarlan ss the perktnff areas
now being utilized were full.
Ed Gannett - stated that he felt not reserving the areas adjacent to the Terminal
was not providing for future expansion and in addition, Mi*. Garnett stated that the
lessee of that area would have the airport re.lated business **tied up** bain6 so
accessible and would, therefore, request that this area be reserved for futura expansion
and parking.

Carmen Glntoli stated that the City should take into consideration that it should
not limit to linear expansion or the City ~vould end up with a long nat, row building.
Kensi Ah* Service (Mr. Johnson) - advised that his firm needed the additional aircraft
parking and thus the reason for requestin{f lease of the area adjacent to the Airport
Terminal Building which would tie into their present leased area.
Gerald Sibley stated that it was his understanding that KAS had been given the
opportunity on several occasions to lease lots adjacent to their present facility .~
but repeatedly refused the offer and now thc two lots have been leased. Mr. ~/~ ~/.
stated he was still opposed to lea~inl~ the area adjacent to the Terminal and~e, tmln ! ~-_..
the area aa a buffer zone. ~. .~~'
Bob Btelefeld of Kensi Aviation stated that the buffer strip was included in the
original Airport development plan and the intent was for future expansion of the
Terminal. Mr. Blelefeld suggested that the area be used for 'transient parking
which would garner revenues for the airport.
Gerald Siblay requested a east break-down of the proposed improvements, otc.
and was advised by Mr. Monger they were as follows: Phase I - $7,354,092 -
Kensi share's would be $457,200+; Phase I! - $2,561,000 - Kenai share's - $220,000;
and Phase III - $7,851,045 with Kensi share's of $378,790.
Butch Kin~ stated that the plan allows for no provisions for a cross wind runway

of risk for small aircraft. Mr. Monger stated that during the study it was determined
the situation did not warrant inclusion of a cross wind runway.
Ed Oarnett inquired as to e extensive expansion of the Float Plane Basin and
was advised by Mr. Monget~tTn, ouglt research it was found that the need was appax-ent
for the number of aircraft which would utilize such a facility. Mr. Monger farther
stated that ho did not feel the present Float Plane Basin was adequate as it was not
long enough nor visible from the Control Tower.
Ed Garner stated that he would request Council consideration to set a policy relative
to the Float Plane Basin and either designate it as such cr prohibit use. Mr. Garnett
further commented that he would like Council consideration with regard to the grass
strip parallel to the runway aa a directive has come down from FAA in whteh atreraft
will no longer be allowed to land in this particular area. Mr. Garner advised that
use of the grgss landing strip enabled aircraft with tundra tires to land on the grass
· . '. Strip. Councilman Ambaz;lan stated that Council has been made aware of the situation
and would address it at tho meeting after the public hearing.
Phtilip Bryson stated that as a resi~iant living near the airport he would request
access to the Float Plane Basin in another area rather than through a residential area
as presently planned.

Steve Wldner presented e petition requesting Council consideration relative to thc
pilots not being allowed to land on the grass strip, l%fr. WJdnor stated that 44 persons
had sifpted the petition and advised that he too had tundra t~ef~ on his aircraft and
being able to land on the grass strip was safer plus alleviated additional wear and
tear on the tires. Ed Garnett also emphasized that thee area ~ question was also ideally
suited for winter-time use of skiis ~.o~d.. !;.z.::i~, ~-~.. ~' ~ ~ ~/~-~--~ .
Councilman Ambarlan recommended that a meeting be scheduled between the Airport
Committee, Administration and FAA Control Tower Chief and return to Council with
a report of that meeting. Mr, Wise stated that the City needs to be made aware of
the ramifications of use of these areas in question and a meeting with FAA officials
would enable the Council to make a decision on use of the area. Councilwoman Oltek
inquired as to why a decision, without prio~ notification, relative to restriction of use
of the gl'ass strip had been made by the FAA when the ax, es had been used for some time
and suggested that Council consider allowing use of the area until such time the matter
has been resolved.

Councilman Malston moved, seconded by Councilwoman Gliok, that the Administralton
notify the Control Towm' tomorrow morning (8-3-78) advising that the City requests
the green strip remain open for landings for the next thirty days and during this
period of time the City will meet with FAA officials to resolve the question of
whethe~ or not to restrict use of the green strip landing area.

the Float Plane Basin remain open for the next thirty days during which time the City
Adminiotration will enter into discussions with the FAA and should such discussions
result in continued use of the Basin at the Piiot*s own risk, the matter will revert
back to the status it had prior to this directive.
Motion passed by roll call vote with Councilman Aekerly voting no.

City Attorney Schlereth advised that as requested at the last meeting, he had
contaoted the EDA Regional Office in Seattle and determined that there wes no problem
in selling the surplus materials, however, the City may be found in non-compliance
by not observing the bid requirement ordinance. Mr. Wise stated that the City
had previously gone to bid but bids were rejected.. Councilman Malston inquired
if the parties were still interested in purchasing the items listed in the resolution and
was advised by Councilman Aekerly that he was employed during the summer by the
interested parties and they still wished to pm, chase the tanks.
MOTION:
Couneliman .Ambaeian moved, seconded by Councilman Molston, for adoption of
Resolution 78-121, authorizing ~dmintstretton to sell to the Port of Kenai tanks that
are in the shallow well buildings that have been declared surplus.
Counoilman Ambarian stated that he would vote against the motion as he felt an
appraisal was needed to determine actual value of the items in question. Councilman Aber
a~,eed with Councilman Ambarian and further commented that the tanks, et al were
of far more value than $400 rash.

Councilman Ackorly moved, seconded by Councilwoman (]lick, for approval of lease
of Terminal space to Tesoro Alaska for office space No. 10, for a term of one year
at an annual rental of $1,778.40.
Counoil questioned the reasoning for items (a) and (b) concerning taxes having been
mossed through by the lessee and l~ir. Wise advised that he had no knowledge as to
why this action was taken.

Mr. Wise advised that an unknown cable in conduit in front of the Carts Grocery store

be coming out of the project fund.

for reimbursables in tho amount of $5,035.80.
Councilwoman Gliek inquired as to the note on the bottom of the billing relative to
a comment from the Public Works Director that he has still not received field notes,
cross-sections, and computations and felt Counoil should address this problem.
MOTION:
Councilwoman Slick moved, seoonded by Councilman Malston, to amend the motion
for approval of payment contingent upon receipt of proper documentation required by
the City from Project Managers Alaska, Inc,
Mr, Raymond reported that the data had been presented to tho Public Works Director,
however, Mr. Kornelis required additional infm'mation. Counoflman Ambarian inquired
a8 to why the Public Works Director was asking for data over and above what is required.
City Manager Wise stated that he did not know the intent of the Public Works Director.
Councilman Ambarian stated that it would be helpful for Counoil to have a running total'
of expenditures on tho projects to-date and a current status report of each project.
City Attorne~ ScMereth commented that the above amendment relative to the payment of
invoice would have to show a specific objection or the City may be found in non-compliance
with the requirements of the contrast with PMA.

appeared that the City is not spending sufficient time in running and coordinating
the project as the engineers, inspectors, ~ontraetors et al are working for the City and
further that the vacation scheduled by the Public Works Director was done so at an
inconvenient time with so many projects underway.

City Manager*s Report
City Manager Wise reported that thc City had received official notification from FAA that
we had received a grant for the purchase of snow removal equipment for tho afrport
and Mr. Wise requested Council authorization to proceed 'to advertise fox' bids subject
to written approval received from the FAA.

Councilman Aekerly moved, seconded by Councilman Abet, for authorization for the
City Manager to advertise for bid for the subject snow removal equipment contingent
upon written receipt of grant from the Federal Aviation Administration.

(b) Peninsula 4-Wheelers
Mr. Wise advised, that as in the past, the Club was requesting specisl permission to
hold drag races on the beach August 12th. Mr. Wise stated that the Police Chief was
in aseeement and the Club would do the necessary patrolling and clean-up of the area.

Bluff barricades - Mr. Wise reported that the barricades being installed by the City
crews were continually being removed by persons unknown. Mr, Wise stated that
he acknowledges that the posts are not deep enough nor eneassed tn cement but the
intent was to try to make the public aware of the potential danger. Mr. Wise stated
that additional funds are needed and would request authorization to provide funds out
of the steeet budget which would be reimbursed out of anti-reeessionary funds later.
Council discussion included various ways to accomplish the installation of barricades,
fenotnl~, ate. and CounellmanMalston stated he .would like to see a permanent Lmard
raft-type construction and further stated that something must be done immediately.

Councilman Mfllston stated that there wes a continuing problem with the bluff at
the end of Forest Drive and requested that the City proceed with installtnf~ some type
of bleckades and turn-around area for the public. · Couneiiman Aekerty. stated that
the Port of Kenai should be contacted fox, possibility of the City utilizing their excess
concrete pilings. Councilman Mslston requested Administration prepare a plan for
Council review.
Craig Freas and Philltp Bryson of Wtnce-Corthell and architect Carmen Gintoli
volunteered their services in the preparation of a plan.
City Attorney's Report
Mr. SeMereth reported on thc matter of mobile homes being utilized ss offices in
Old Kenat Townstte end stated it appeared that the Borough ordinance did not address
itself to this particular matter when Introduced and the reference to termination of such
use as of January 1, 1978 was deleted. Councilwoman Gliek stated that the Little Ski Mo
and Cherts Real Estate Offices were now in compliance and had been urged to teeminate
use of a trailer and it would, therefere, appear that the City should require all to comply.
Council instructed the City Attorney to further research the matter and return with
a legal opinion,
Mayor*s Report
Mayor O*Reflly reported that he would present the list of appointees for the Recreation
Commission at the next meeting of Council.
Civic Centex* - Councilwoman Gliok tnquh'ed as to when the Council would be meeting
with members of the committee in that when the report was presented the Mayor had
indicated such discussions would bo held.
Work Session - Council set a work session for Wednesday, Auffnst 9th at 7:00 p .m.
in the Public Safety Building relative to the Civic Center, discussion of. leases and
protest of renegotistion rates.
City Clerk's Report
City Clerk Sue Peta~ stated that she had been asked to contact both newspapers in the
area and seek prices for advertising of the agenda. Clerk Petm, advised that one
publication would not acme out in sufficient time and the other publication will cost
at least $90 per issue for such advertising. Councilwoman Gliek stated that she felt
the cost in advertising the agenda was excessive end it did not appear that attendance

at the meetings had increased sines the agenda had begun being advertised. Councilman
Ambarian suggested that a quarterly newsletter or some similar means of communication
be sent to the local citizenry. Councilman Ambarian also suggested that It would be
very beneficial for the Council, Planning Commission, Kenai representatives to the
Assembly and the Chamber Board to plan a luncheon or dinner to discuss matters of intet'e6t
to all.
Clerk Sue Peter also requested Council permission to take 56 hours of annual leave
from August 21st through AuLmst 29th as there would not be a Council meeting du~ing
that week. Also, Clerk Peter requested permission to destroy the official ballots of
the October 1977 election -- Council so concurred.
City Manager Wise also reported that Fire Chief Walter Winston had requested
permission to send a man to Fairbanks to receive training in handling dangerous ·
chomioals, etc. for five days. Chief Winston stated that costs would not exceed $160
as the trainee would be housed in the Fairbanks Fire House.
MOTION:
Councilman Malston moved, seconded by Councilman Ambarlan, for approval of
a member of the Kenai Fire Department to attend a training seminar in Fairbanks
oommeneing August 14th for a period of five days.

Mayor O'Reilly stated that one item of particular interest to the at. ca would be the
Assembly adoption of a policy relative to roads, which is being presented to the
City Manager for review, and if the Borough assumed such responsibility, they would
also assume maintenance.

Mr. Gintoli inquired if a citizen had any recourse to Council action as Mr. Gintoli
stated he 81rongly opposes use of the beach area for drag races and would request
Counoil reeonsid~ation of their decision. Councilman Ambarian stated that the
request by the Peninsula 4-Wheelers was g~anted in that in the past they have
conducted a well controlled event and it is the Council feeling that a once-a-year
request will not be detrimental. Councilman Malston stated that it is unsafe to
walk on the beach because of the 4-wheel drive vehicles, dh, t bikes, etc. that are
racing up and down the beach.
