1 The meeting will open with a_~qenda apj3_roval
of the canvass of ballots for the--'~-e-~ci~on of election and
the oath o£ office to those certified as elected. The Council will
then select their borough assembly representative from among the
Council plus ~lection of a vice mayor.
2 Hearing on Ordinance 429-78 appropriation ordinance for the
$150,0000 CEIP Grant for water and sewage engineering.
3 Hearing on Ordinance 430-78, Amends the Recreation Com~ission
to provide for the youth member.
4 Ordinance 431-78 bars vehicles from the beach except for
fish/beaC~ si~e~ated activity.
5 Ordinance 432-78 amends the snow removal ordinance of the City
concerning no parking on streets during the snow season. This
will also provide for i~pounding. This essentially adds the
· build-up area of the VIP Estates.
Ordinance 433-78 amends the Kenai Fire Code providing for the

9 Oscar Thomas is: scheduled again to s~eak on the KUSCO billings
to %~-~~relocation costs. A meeting with Oscar and the City
will be held by the first of next week; hopefully there will be
an update at that time.
10 Larry Volva representing Union Oil, the agent filing for a
~oin~perm£t that is in.your packet. Note that they are asking
in the joint permit to certain exceptions for the Ordinance the
City.adopted in 1967. He will have additional data with him to
validate .~heir ~equest for relieve, I believe. That particular
item is scheduled on the agenda under new busine~s. You may want
to resolve it now.
11 Legal ad. will appear before the Council relative to the
recent resol~tion of the Council requesting d~rral ~ ~omin~
,hn,,,, prior to the approval of the Co~prehensive Plan that
will-be initiated soon. You will present sketches and maps of
his particular problem which is land immediately adjacent and
surrounded by the City Municipal Park. The zoning of the area
is Conservation which essentially.denise him use of the land. He
will be making the request for Council acknowledgement of what he
feels the special situation to properly overcome the Council's
Hesolut~on.

OLD BUSINESS
12 There are two items that ! believe Councilman t'~elan has
asked for Reconsideration Of. Resoltttion 78-150 and 78-157 on
Capital ~mprovement Pro~ects a,,d ~-i~6~-~6-~~~s-~--~
Information respectiv~ly. The attorney has some information
on Resolution 157. I am unaware of the problems with Resolution
150.
13 Introduction of Ordinance 438 increasing estimated, revenues/
~propriations of th~~r Fun~-p~6~tdin~--~ the .
additional 'i~urance requirement for the water tank which ~.as
approved by the Council at the last meeting.
14 I~troduction of Ordinance 439 is related to the. airport .. ..
runway repa~ing, l~hts~' and f~'~e restoration. We are asking
to rescind Ordinance 422 that was interim funding for the
design. This will complete the appropriations for the entire
runway project. We will also have available the final version
of, the contract with CH2M Hill fo~ this project. However, we
will not ask for approval until the next meeting when this Ordinance
wi1! be adopted and the funds can be appr~priately committed.
15 Introduction of Ordin~ce 440 Amends Personnel Regulations,
part~oular'ly the-Clas's~ficatt~"Plan. This provides for the
positions of correctionallof£icers in the jail dete~a~on fac~lity
operation. '
~6 Ordinance 441 is a proposal the City Attorney has compiled
~onoerning ~he r~lease of'infcwmation. It is a £undamental
. comprehensive ordinance essentially the same as that of Haines and
Anchorage. ...~
~? Ordinance 442 is an appropriation Ordinance for the operation
of the deter{ion facility. We have prorated the legislative sppro-
~'priation fror~ the State for--the time of operation that w~ exDe~t
to accomplish during this fiscal year. ¥ou'w£11 note that we "
have provided for some miscellaneous funds to permit us to pay
reimbursable expenses and to give us an opportunity to meet
expenses that we simply cannot pay now,
18 Resolution 158 ratifies the contract approved by telephone poll
for ~e purchase of the wheel loader and of. the truek~
19 Resolution 159 approves thc contract-wi.th the State for the
deten2~o~ ~aciiity. ! believe the attorney has some comments
in two areas that we are concerned about. One is on three
detention physicals and the second is the hold harmless clause
that we.hope to have some modifications worked out prior to the
Council meeting

20 Resolution 160 provides £or a transfer of fund~ from the
Contiogency to the FAre Department, Police Dooartmont. and tho
convention group to meet shortfalls in approp~iations for tho
Fire Department stationwagon which will appear ]ate, on the agenda.
It wall also provide for the three police, car bidsand the $?50
the Council authorized for the Convention Bureau.
21 Resolution 161 requests a transfe~ of funds within the Warm
Storage Wi~te~iz~ion Project fund to move some motey from
Contingency to En~ineering to cover some additional unprovided-for
22 Resolution 162 rewrites the resolution requesting the release
of th~ bluff land. As I mentioned in the last report, there is
some problem with some of the bluff land in that they are under
the control of the Department of Defense. To obtain release of
the.larger tract would perhaps-be delayed a year if we stayed
with that original request. Therefore, I propose to simply
request those three lots which are platted with access to the
Spur Highway. Incidentally, this was approved by the Planning
Cona~ission this last Wednesday. There will be revised metes
and bounds which will be prepared for us by Malone Surveying.
We will be able to get this back to the FAA for hopefully
almost i~mediate release.
23 Resolution 163 ratifies ct a contract for design work on
the five sewer lift stations. Ao%ually this funding was approved

over the budgeted funds. I would also like to point out that
Hutohings Chevrolet has called p~otesting the pricing on the
police-oafs. They do not understand ho~ this could be offered ·
to the City since .they, as franchised dealers, have not received
the pric~ list from the factory. I believe Mr Hutchings will be
present at the time of this award to comment. ..

Meeting be aware of this data. If ther~ is any question of
how the analysis was d~rived, it can be resolved immediately
within tho FAA offices. We will have~ presumably, to award
the purchase that is concurred with by all parties.

37 Letter concerning_the Senior Citizens and the fact that.the
Title Three Program operated by the City is reachtng'into.~t~e./.
surrroundin~ area. In doing this we do not do as good a job.
I believe this letter should be forwarded to the Borough Assembly
and perhaps the City of Soldotna to enable them to have some
additional support to the program. This might make the program
better able to cover all the seniors in the greater Kenai area.

them appraised and having the 30 acres of park land adjacent to
the Oller's Field also appraised to see if we cannot match value

1977 WATER AND SEWER IMPROVEMENTS
Willow Street water line and McCollum sewer linc have been completed,
and the final pay estimate approved by City Council. The City of
Kenat has received a release of claims for this project. At the
present time, we are finalizing all the paperwork in an effort to
~.-x. clean up and put this project file in storage. There is a question

Construction Company. Thc painling of thc center line stripe has
been completed.
It is my in~ention to have all of these projects completed ;md
finalized for the Oclol,er ]8, 1978 City Co.ncil Netting. At this
time, I hope to finalize all proj¢.cts including pnyment to the
subcontractors of PMA, As of this date, we have still received
no billing for soils analysis, concrete testing, and all work done
by R and bi Engineering. This testing lab is working as a
subcontractor for Projects ~lanagers Alaska, and for some reason
we have never sc;on a formal report on any of tile testing done
by them. We did receive some field notes from Project ~lanagers
Alaska concerning testing, but they were taken back by Project
Managers Alaska with thc comment that they were not ready for
our review. Evidently there has. ~;en close verbal communications
between Project ,~lanagers Alaska and their subcontractor R and M
since immediate or very quick test results are necessary to make
fill decisions. I am hopeful that all the test results wi1! be
submitted to the City of Kenai along with the final one and only
R and M Engineering billing., l~e will also be receiving the bill
from blcLane Surveying. NcLane Surveying sent the City of Kenai
a bill for the month of August ~d~ich we forwarded to PMA.
PMA's contract went from August 15, and their contract stated that
they were to receive five percent over their subcontractors.
Unfortunately, we have not received back from PMA McLane's billing
£or the month of August.

I-.have received all the change~orders from llarold Gal.tiet on. the
renovation and work inside the underground pump house, and also
thmc:rolocation of the po,e~,-line~ to the .fhci:lity.:. Th~s'e change~
orders involve a new generator and switch gear that is necessary
to make the pumps automatic and reliable. Unfortunately, both
..off these.change orders came in considerably higher than anticipated.. :.
They'wi11 bo on the agenda for Council-approval or disapproval ....
on this upcoming October 4 Council meeting. It is very important
that action is taken at this meeting one way or the other since
the contractor has stated that these change orders are only good
£or $0 days. Evidently there is going to be a price increase
--on--some-o£'-the-materials,and the vendors' have told'the ~ontractor ....
that their offer is for a limited time only.
PUBLIC WORKS CAPITAL Ib~ROVEMBNTS PRIORITY LIST
In my'last ~o reports, I included a priority list which I felt
was.necessary for providing adequgte services to the citizens of'
the City of Kenai. At our last City Council Meeting, the Public
~orks Department was authorized to go out for bid for one Motor
Grader. This is a step in the right direction, but as I mentioned
in my last two reports, there is a real need for more Capital
Improvements.

Last we. ok vm had tile salt, maid go oul. ill our only grader. This left
Us with no grader for the City. I.'ortunately, we do not have a
snow removal problem at this time, and the grader has been fixed
and is back into operation.

WINTERIZATION OF IVARM STORAGE BUILDING
The bid date for the ltinterizatJon o£ tho Warm Storage Building is
October 12, 1978, at 2:00 p.m. ~her~. is a pre-bid conference on
October 3 to discuss this project in more detail. This ~,'ill be
quite an improvement to our Warm Storage BuJldJl}g.
Our water and setoer cre~, has completed the se~¢er line break in
Woodland Subdivision. They have also worked on the well house 8nd
lift stations in an effort to keep them running until the renovation
that is being engineered at this time is completed. They are making
the rounds reading the water meters. As the City continues to grow
and more water meters are installed, this job of working and reading
water meters is taking more and more time.
The' street crew has been working on finishing btcCo't'lum Drive
which has been a very bad problem in the spring time with a
large water hole. They have also been working on the drainage
on Fireweed and Primrose in Thompson Park. We have added some
culvert in this area in an effort to solve this drainage problem.
The shop has worked on the generator truck this last. week replacing
the master cylinder and all wheel cyli,ders on this generator
truck. We are also working on the snow blower in an effort to
get .it ready for this winter.." As mentioned earlier,-: we have'..:,,
worked .on placing the stwrter solenoid on the Cat ,Gt-ader~:, ....'.:
There is a bid date of Ootober 11 at 2:00 p.m. for grave], for the
City o'f Kenai. The funds for this. gravel,~ere furnished from.
anti-recession~ry,~oney. There is also a bid date of October'12 ' '

of October 15 at 2:00 p.m.'for'the new grader for the City of
Kenai. Thoro is a deadline of October 10 roy proposals from
Engineers/Architects on the $150,000 C~IP funds for Water and Sower

TOPOGRAPHIC STUDY FOR THE CITY OF KENAI
.... , ..... This-topographic work for, the Cigy of Kenai.looks as though it is not
going to become the reality this year. This is unfortunate in that
.... we have gone out for bid many times for this work, and yet w~ have
not awarded any contract. One of the firms that bid on this
project.has stated that they will not again bid since it looks as
though we have no intention on doing the job. This is rather
unfortunate ~ecause we are very anxious to got the job done, and
it seems to be a problem of bureaucracy and trying, to get the
proper funding straightened out and an adequate analysis of what ,

this project really will cost. Thc ,~o,¢,y that was allocated
for th(: job by CEIP is in no way sufficient to cover thi~ t~'ork.
One of thc bidder~ on the project has stated that if we place
the final points for them, they.will fly the ~rc.a, take pictures,
aha that they will not hold us ]n any way liable for the cost.
Then at a later date if and when th~ project is approved by
C~IP they will continue on ~dth the work. This is the only way
that this can be done in ti~,a to meet this year~s schedule. ~c
are running short on time not only because of the snow but
because of the anglo of the su,. In order to get the proper
phot6graphy, the angle of the sun is very critical. I don't
know what the answer is, Since you have been handling thc grant
~ork, 1 am certain that you are a~'are of this problem and its
different possible solutions.
At this time, all our crews are doing the necessary ite~ns to
get our equipment and operations intact for winter operation.
It is very hopeful that we will have the new grader within
~0 days after th~ bid award on October 18~ 1978.

On 9-21-78 contact was made in Anchorage with t/~ Traffic :..
F~afety Engin~er's office.. As a xesult'of this contact the -
data from the rec~t traffic flow survey in tl~e Kenai area
was obtain¢~. Preliminary analysis of ~ data. in relation-
ship to t}mt obtained in 1977 has taken place. This is be. lng
c~)rrelated with frequency of acc./dent occurence for enforcem~..nt
PuzToses.
The data for 1978 was collected by use of unmanned counters
during t~ m0~th of August. ~t~ from 1977 {~s collected
d~ing the I~onth of October. I~l add./t.~on the cot~lter's
were not, with three exceptions, plac~d in the ~ locations.
This has made cfm~parative analysis extremely diffic%flt.
Willow Street intersection, while mechanically counted, did
not reoeive the flow dfagr/mml/ng in 197S that it d/d tz~ 1977.
A personal contact was sought and obtained w£th Mr. Jim Edwards
the Regional Traffic Safety Enginee~ on 9-26-78. At this
t/m~ Mr. Edwards advised, that in spite of probl~mls/nvolved
· in ~g a (X~tive analysis, tf~t he agreed that traffic
flow /n the area ~rdS increasing at a significant rate. This
~s pa~t~cularily true of the Kenai Spur and the Kenai River
crossing road between the Spur and F~lifons~;y ~each. ?~ile
the co~h~t data for Wil]mw Street was lo~.r in 1978 tha~ 1977,
th~s ~a~ ~e attributed to the co~struc~foll on ~.;illow dttr]ng
the t~ of the count and possibly to motorist frustration
with the intersection resulting in alternate routing of
travel to the area. This ~s subsb~ntiat~d, in that the 1978
ootmt for traffic south of the 'Spur o~to Main Street was
significantly higher than in 1977.
~. F~%wards advi~ that the State is still pro~ with
p].m~h~g for redesign and widening of Willow Stze~t a~d the
Willow Street and Kenai ~ intersec~ion. ~e state~ that
Publio hearings would be held on this rotter in the Kenai area ·
dur/ng the ~dnter months, with ad.equate not/ce once a da~e is
set. Mr. Edwards advised that initial planning, as a result of
o~r request, d/d /ncl~de i~tallation of conduit for future
installation of traffic control lights. ~. Edwards concurred
that ~ntinued significant traffic growth hT~act wott%d result

would alleviate the Willow Street hltersection problem, as

Re: Grant #069510
It was a privilege to meet you personally on September 20, 1978, and
discuss mutual concerns of the elderly in your area. Our discussion
along wtth the comments from ~. Patrtcia Porter, Project Director for
Title III, indicates so,vices to the elderly extend considerably beyond
the city limits of lienai. A revinvof the program activities verify
this observation. ! personally noticed services provided to senior
citizens in the Soldotna area which Ism sure must be in another city
complex or borough.
The grant application indicates no local Einancial contribu~ions from
any sources other than the City of Kenat, volunteers end limited per-
eonal contributions. Therefore, it is suggested other areas being
served be invited to participate in the financial support of the pre-
sent and future elderly programs since some living in ~hose areas
also bene£it from the elderly programs currently financed through city

The ordinance was read by title only as suf~icient ~opies
were available £or tho public. Public hearing was declared

Mr. Sam Best, representing Alaska Society o£ Professional Land
Surveyors testi£ied the borough surveyors have ~orked with the
Planning Commission during the past year on Ord. 78-37. _
Although not any one surveyor is totally happy ~ith all the
provisions, overall they £ind tho ordinance a workable com-
promise. Mr. Best requested Atty. Sarisky explain hog tho
enactment date will e££ect plats already being processed.
Atty. Sarisky reported those plats filed under the old ordinance
would meet the.requirements of that particular ordinance and
those filed after enactment o£ the now ordinance would come
under its provisions.
Mr. Mennin8 Johnson, Registered Surveyor, suggested deZetion
of the wordy certifications off tho plats, particularly the
"Certificate of Survey" and "Plat Approval". He believed the
survoyorOs signature, registration number and seal to bo
su££i~ient on the Certi£icato. Plat approval should c, ontain
only the £act the plat was approved by the Planning Commission
at the mooting of (date). Mr. Johnson £urther recom-
mended inclusion of small 'sheets £or plats. The smaller plat
sizes have been deleted £rom Soc. 20.1§.040 and the 8 1/2" x
14" and 12" x 18" should be reinstated in order to save the
subdivider money.

Mr. Fields stated tho reason he ran for an assembly seat was
because he opposed tho planning and zoning ordinances proposed
for the borough. Bureaucracy continues to creep forward and
ho did not believe the assembly should vote on this type of
ordinance which would effect all the people until tho assembly
is reapportioned. Inside city people loan toward planning
and zoning regulations while those outside cities want less
restriction.
Mr. Cooper reported the committee studied tho ordinance and
found that It merely clarifies and amends certain port~ons
of the ordinance already in existence, It is a much moro
concise document than the one now in effect and ho urged
passage of the ordinance.
Mr. ~avis commented the document as a whole has too many restric-
tions on tho landowner and involves too much rod tape and paper
work.

blayor Gilman cited Soc. 29.25.020 Composition, apportionment
and reapportionment. Section (b) which states, '~lthln §

issuance of any supplementary data to the report necessary to
establish population distribution within the borough, tho
assembly shall (1) determine and declare by resolution whether
tho existing apportionment meets the standards designated under
(a); (2) if the existing apportiomnent does not ~noot tho
standards, provide by ordi,ance for reapportionment and, l~
it chooses, changes in assembly composition; (I) submit the
ordinance to borough voters for approval or rejection.
C. Tho vote shall bo tabulated in l separate classificati~ns.
One shall consist of all votes cast in first class and home
rule cities and the other all votes cast in the remaining
area of tho borough. In order for the ordinance to be approved
it must receive majority approval in each classi£ication.
If no'ordinance has been approved the Dept. o~ Community and
Regional Affairs shall provide for reapportionment."
Mr. Arnoss reported in 1971 tho assembly apportioned itself
and then in 1975 reaffirmed its apportionment, lie was at a
loss to understand why it is now necessary to go to a vote
of the people. Mr. Davis agreed with ~r. Arnoss.
Mr. Long stated the assembly needs to address the apportionment
problem but wondered if .the .assembly was not premature at this
point as tho official corti£iod census £igures have not boon
received.
In response to questions from assemblymombers, Mayor Gilman
stated tho question is whether the change in tho weighted
vote system is a reapportionment, lie also called ass0mbl~
attention to the fact that tho weighted vote systems in the
Kodiak and Fairbanks boroughs have boon thrown out. This may
have been because of tho makeup of their particular ordinances
or the fact that weighted vote systems are not in con£ornanco
with the standards set out by tho U. S. Constitution. Tho
Kodiak borough ~as reapportioned by the Community and Regional
Affairs office in 197§.

She reported eno of the biggest problems tho committee has
faced in trying to amend tho ordinance is the effect any changes
will have on tho cities. Solutions might work very will outside
cities~ but since tho city ordinances are tied to the borough
ordinance tho situation becomes almost impossible. The cities
rely heavily on the sales tax for revenue and an? amendments
would reduce that revenue. She further commented she resents
the fact that the people living outside the cities have-to cope
with tho problems that could well be done away with outside.
It seems the major consideration of loss of revenue to cities
is over and above what the problems in the ordinance are doing
to tho people. She believed the cities should have their own
sales tax.
Pres. Elson commended Mrs. Douglas for her excellent job on
tho committee.

(a) Census Results
Noted for tho record, the preliminary population count for
tho borough is 25,281 as of July 31, 1978. The final tabula-
tion will be available about December 1, 1978.
(b) Port Chatham Logging Co.
Tho memo reports 71 persons living in the B i F Logging camp
of which 11 are school age children. Tho School District is
providing a correspondence program with a supervisor hired
from the camp.
(c) P~yments-in-Lieu of Taxes and Refuge Revenue
Sharing act (llR 8~94)
Tho memo reports HR &~94 calls for 25% of the oil and gas
revenue from wildli£o re£uges be distributed to the county
in which it is derived. Tho bill has been amended for the
oil and ~as revenue distribution to apply only to acquired
lands and not reserve lands until the Konai Peninsula Borough/
State of Alaska vs. Andrus case is ruled on by tho 9th Circuit
Court of Appeals. I£ fir 8594 passed in the £orm approved by
tho House o[ Representatives, tho State of Alaska would lose
all future oil and gas revenue from wildlife refuges. ~e
have recommended to Congress a l-way split o£ the revenue
among Local and State and Fish'and ~ildlife. Tho payments
in lieu protest filed by the borough £or underpayment for
FY 1977 has not been resolved. A meeting of county officials
and Interior of£1cials is scheduled in ~ashington, D.C.
Sept. 1~ and 15 to try to resolve all di££erences.
(d) State Land Selections
The State Division of Lands has issued new re8ulatio,~s
governing tho procedures for the boroughs to select lands from
tho State. These regulations have met with severe reaction
from the boroughs and a meeting o£ the major land holding
boroughs will bo held soon.
Tho Mayor reported the meeting referred to in the memo will
bo held tomorrow. September 6 lit Anchorage'with the Division
of Lands beginning at 9 a.m.

of America on December 1, 1963 for the Kenai Airport which contains 0 among
other property, a parcel of land described on the attached Exhibit A, and
WHEREAS, the City wishes to lease or sell this land for commercial development,

WHEREAS, the City can, by leasing or selling this land, encourage develop-
ment which will contribute revenue to the airport, and .,

~amage which may arise from the negligent performance by the ENGI[4EER or

under this Agreement.
SECTION B - COMPENSATION FOR ENGINEERING SERVICES

Rockford Corporation will not warrant any existing material
incorporated into the Cllm)ged work.

Chapter 13, Penslties and Offenses of the Kenai Code, and

WHEREAS. it would be desirous to prohibit night parking in additional

OF TIlE KENAI CODE, AS AMENDED, IN OI~DEIt TO UPDATE THE REFERENCE
TO NATIONAL FIRE CODES MADE PART OF THE ORDINANCE.
WHEREAS, Title 8, Fire Code of the Renal Code, ns smersded, was recently
enaeted by the Council of the City of Kenat, and
WIIEIIEAS, said Code incorporated the National Fire Codes of 1977, and
WHEREAS, since that time a new National Fire Code has been published for
1978, and
WHEREAS, it would be moat beneficial and in the best interest of the City
that the latest Code be adopted espeoially since the City Fire Department
can secure espies of the latest Code mere readily than the outdated one,
and .-
WHEREAS. the outdated Code has not yet been purchased by the City of
Kenai FiFe Department,
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF I~NAI,

WHEREAS, Ordinance No. 400-?8 relative to establishing policies and procedures
for the lease of airport lands was recently adopted by the Council of the
City of Kenai, and
WHEREAS, said ordinance revised the leasing policy of the City relative
to airport lands so that City leases might be more attractive to potential lessees
and thereby the financial position of the City, more particularly the City airport,
would be enhanced, and . .
WHEREAS, certain revisions in the leasing policy are needed so that the City's
present lessees mtght take advents(lc of the provisions of this new ordinance,
ain~ it is the intent of the City Council that thc ordinance apply to all lessees
equally, and

AN ORDINANCE OF TIIE COUNCIL OF THE CITY OF KENAI, ALASKA INCREASING
ESTIMATED REVENUES AND APPROPRIATIONS IN THE AMOUNT OF $286,000 IN
THE AIRPORT LAND SYSTEM, AND IN TtlE AMOUNT OF $17,875 IN THE FEDERAL
REVENUE SHARING FUND FOR FY 1978/79.
WHEREAS, the US Department .of Transportation, Federal Aviation
.Administration has tendered a grant offer of $268,125 (which
represents 93.75% of the project) to purchase snow removal equipment,
and
WHEREAS, the Council of the City of Kenai has accepted this grant offer
by resolution, and
WHEREAS, of the remaining $17,875 of project funds, $8,937 (which
represents 3.125% 6f the project) is expected to be provided by the
State of Alaska, and
WHEREAS, the City of Kenai has not formally received notice from the
State of Alaska offering to provide these funds, and
WHEREAS, it is desirable to expedite the e~tablishment, of this

WHEREAS, it is in the best interest of the City of Kenai to have accurate and factual information
released arid sines all personnel do not always have all the fasts at hand, and
WHEREAS, City personnel need to have 8~idelines from the City Council to releasb such inforo
marion, and
WHEREAS, it is the intent of the Council of the City of Kensi to keep news media and tlie
public at large informed on a factual and accurate basis.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI to hereby
