Sectlon 9-5 thcreof states that a11 city ~ ~'~ occupants in control of ptaces r~herein refuse accumulates sha11 utiilize and pay the collection fees of a refuse ~; ~ ~~ collection service tlh4ch is "authorized by iavr to serve the C1ty oP K~nai." (9-S(b)). ~ ~lhen an ordinance speuks 1n terms of authorizing something "by laai" it is interpreted to mean state 1av~. ( The present applicable state 1aw which regulates refuse ~~ collectiion service is A.S. 4?..05.010-721. (Alaska Pubtic . (~ Uti141:fes Commiss4on Act). ~5,. Paragraph 221(fj of that act brings within the regulatory ~;;~ control of the commission refuse collection services through- ~, out the st•ate, except those refuse collection services Operattng within the limits of an Sncorporated municipality. Hrn~cver, paragraph 711(b) of the same act provldes that a ~ mun~cipAiity may elect to have tfie APUC regulate such refuse ~ collectiton serv9ce. Accord9ng to J. Additfanally, statutory language in the APUC ac~ suggests that municipalities may still impose reasonable permit fees and reasonable terms and conditions upon refuse collectors regulated by the APUC operaLing within the city limits (A.S. 42.05.251j. PUBLIC NEAaIt~GS We have no public hearings scheduled for this particular meeting. PERSONS PRESENT SCHEDULEO TO BE NEARD 1. The Police Oepartment viill present to the Council a proposed constitution for a Police Officers' Association. The City Attorney is revievling the legal documents relative to such associations and the Council's capability of accepting such a constitution. I would prop~se that the Council simply receive the request, ncknov~ledge it and reger it to Administration and the City Attorney for review and comment. This will then be discussed as a personnel matter in a future executive sessian. 2. Ted Carsan is also scheduled under this section. It is my understanding that he desires to speak on several sub~ects. One that was brought Lo my attention is in reference to a differential tax aone. 3. Mrs. Coyle is scheduled to speak regarding berms as a result of snov~ plov~ing, her complaint in essence being that a berm vtithin the street easement is improper blocking of the street. ~ OLO BUSINESS 4. Salamatoff Seafoods Lease: City Dock In addition to the basic cons9deration of the lease itself is their request for a building which was presented to the Planning and Zoning Commission at their last meeting and approved. This v~ill presumably be discusscd by the Attorney relatlve to the basic lease. 5.. Redi-~lectric's Proaosal for Maintenance of Street Lights: Discussion ~ Apparently Redi-Electrlc wishes to withdraw their proposal for this main- tenance. Also included is a propased letter from the~City Attorney permitting them to submit such a request. 6. Refuse Collection Permit Reauested by Burton Carver and Co.: Discusslon The City Attorney's opinion on this matter wi11 presurnably be given at the me~ting. Additional data w111 be furnished to the Councll at the meeting. 7. Ordinance F~o. 389-78 _____ ____ _ ____ __ 3- -f r- ~ _-_ -. _ - -~+..- . This ordinance vrould appropriatQ anti-recessianary monies to the library account to provide for a temporary emplayee to catalog books currently on hand at the library. This was requested by the Librarian and is an appropriaLe expenditure under the anti-recessionary revenue sharing funds program. 9. Ordfnance fJo. 390-7~3 Th1s ordinance would formally declare property vlhich the Council previously reviewed as surplus. 4Je need this farmal action to snable us to properly dispose of the property. 10. Resolution No. 78-24 Based on review of the current iaw. there appears no vray that the State can se11 Section 36 trust tands. Therefore, I have drafted a proposed amendment to Title 38 which I believe vrould, upon adoptiun by the legislature, enable the City to require dis~osal of such lands within the City. This is being reviewed by the City Attorney and it is essentially a concept item. 11. Resolution No. 78-23 This resolution accepts the deed of release from the FAA on a tract listed as 0-5~ which encompasses the Ackerly-0'Connell p1at. Please note that the last provision of the resolution vlhich requ3res the lease to be made available to the publtc at large and to be sold at essentialZy a public auction. For this reason, I recommend that the resolutlon be defeated and negotiatlons be authorixed with the FAA to protect the City's concept lease agreement wlth Ackerly and 0'Connell and other parties where such a concept lease agreenrent is in effect. I believe that in negotiations with the FAA, based on their own requirements, this condition can be modified or waived. 12. Resolution No. 78-27 I have drafted thls resolution relative to an appeal of the refusal oF funds for road design under the CEIP program. I have a letter prepared to send to the Oepartment of Communlty and Regtonal Affairs as a notice to protest to insure that we meet the twenty day appeal deadline. In addition, I would 19ke to get a response from the Oepartment of Transportation and Public Facllities' Planning Engineer as to whether or not the OOT/PF really has, as alleged 1n the denial letter, the ability to perform the work that we were requesting. I have been assured through telephone conversations with the OOT/PF that this is not a pro~gram that they can partlclpate in except as a part oP the Loca1 Roads and Trails Program, which 1s certainly not adequately funded for the Cfty. Therefore, I rFCOmmend approval af the resolution so that we may fite a formal appeal of that declsion. -~ r ~• ~+ _ Page 3 13, Lease Request: FAA -~ _ _ __ . . - 7' _,... ~ ~ ~,~ 1 i This lease amendment requcsts lea,e of the old Public lJorks offir.e for• uffice space. There is a prot~lem viith this area in that we will have to relocate all the stored items Nie have in that area outside ~ i of the building t0 another area. Settlement Aqreement: John Inqram This agrcement was drafted by the City Attorney as settl~ment for destruction of a light pole in a motor vehicle accide~it. Regretably, v~e arP unable to proceed on replacing the light pole and determining the cnst of such. 7he individual was being held responsible by the Court as I understand it and must reach an agrccmant with the City before the Court will restore his driving pr3vileyes. Therefore, this agreement ~vill give him the opportunity to regain his license and still protect the City. 15. Proposal for Redemption of Certain Foreclosed Properties Th1s proposal v~as submitted a church simply for the outstanding assessments and I believe it is waiving penalty and interest. One of the reasans L•hat this • appears to be a good course of action is that the land concerned is BLM iand granted ta the ciiurch under a restr9cted public purposes and recreation act and at this moment we do not know v~hether or not we can legally foreclose and take title . ~ to the land. The City Attorney will make contact with BLM in the near future and attempt to determine exactly what our rights are. 16. Lease for Lot 4, lst Addition, Etolin Subdivision: Carr Gottsteln ~ i.~~~' , 7his lease would be for a prarie market. The lease document was drafted i. _. _ by their attorney and has several variances from the standard lease uf the City. It - is being reviewed by the City Attorney and ~inance 0lrector and the Attorney.alill ~~. present a viritten report as to the variances to highlighL• them for the Caunc~l's constderation. I did prepare a note response to Mrs. G1ick relative to her question as to whether or not Burton Carver and Company was current on their speciai use permit fur land on the Old Runway. Rather than xerox that note, I v~ill simply summarize my answer, which was that they have paid their $100 per month lease rate in full, so th~y have a credit to their account. They are being bi11~d on a raut9ne basis for snow removal operations in that area. 23. Defeat of Civic CenL•er: Valdez I was informed by the City Manager of Valclez that the civ~c cenYer bond issue, which was up for referendum in Valdez, was defeated by a 2 tn 1 margin. Mr. Phelps wi11 send a letter to Mayor 0'Rei11y and perhaps he wi11 have some explanation as to v~hy the bond tssue was defeated. 24. Bluff Erosion Problem In the meeting I attended at tihe Borough with representat3ves from the Coastal Energy Impact Program and State representatives, 9t appeared poss9ble that we may be eliglble for some environmental 100% assisbance relal:ive to the bluff. They provided some insights as to ways of tying such damage to coastat energy lmpact. 7he problero I have 1s that the report by Woodward-C1yde states that revegitation should be done carefully and wlth thorough analysis. Yet, this is the only course of action which I see as being viable at this time vrlth the possibility of funds available. It 1s possible to apply on the presumption that we could use any funds we are able to receive to do the actual research necessary to determine what type of revegitation program should be conducted. For the past taro years the Oepartment of Natural Resources has been engaged in a proJect designed to identify lands throughout Alaska which may be suitable for state selection. The department has developed and used a comprehensive resource assessment to put together a"pool" of 45 million acres for possible selection and plans to further refine this pool to determine the best posslble lands for selection. The state hopes to receive conveyance to a targe ortion of its remaining Statehood Act tand entitlement (about 30 mi111on acres~ as part of a final d-2 lands bi11. As part of tNe land selection pro~ect, the department wi11 be holding some nineteen public meetings throughout the state. The meetings wi11 serve several purposes. First of all, it is important to explaln to Alaskans the compllcated issue of land selectlons. The meetings wi11 be an opportunity to telk about the potential state selections, what the signif~cance of the selections may be and how the state lands witl fit in with federat and native lands in Alaska. Secondly. the meetings wi11 give the public a chance to review the state's work thus far. The 45 m111io~ acre pool of lands vihich the Department of Natur•al Resources has identified does not represent selections. Rather, 1t 1s a tentstive package of general interest areas. The lands in the pool heve been chosen for various values which represent potentiai for settle- ment, agriculture, forestry, coal. oil and gas, recreatlon, access, end others. Why is the State of Alaska setecting land now? The Alaska Statehood Act The Alaska Statehood Act grants the State of Alaska the right to choose and gain title to 104 mitlion acres of federal land in Alaska. The maforlty of this entittement, 102.5 million acres, is to provide for present and future settlement including residerttial, industrfal, commercial and reereational land needs. To date the state has selecteA nearly 75 million acres of this general grant lands entittement. leaving 25-30 million acres remaining to be selected. Section 1? (d)(2~of The Alaska Native Claims Settlement Act Section 17(d)(2) of the Alaska Native Ciaims Settlement Act directed the Secretary of the Interior to classify up to 80 million acr~s of Federal tand in Alaska for inclusion 1n the National Park, 4111d1ife Refuge, forest and Wild and Scenic River Systems. Congress gave itself until Oecember 31, 1978 to act on the Secretary's recomnendations, and over the past six years a number of (d)(2j bi11s have been tntroduced. Congress is now considering final (d)(2) legislation. . • The State of Alaska is urging Congress to address state land selection rights within the context of (d~(2) legislatlon. The ultlmate goal is to gain Congressional assurrance for land conveyance to the State of Alaska of the ma3ority of our remaining land entitlement as part of any final (d)(2) bill. II. Wh~r are General Grant Lands_so imaortant to Alaskans? Most of Alaska's 367 mi111on acres of land w111 contlnue to be owned and m~naged by the federal government even after completion of land selectlons. The federal government will retain ownership of approximately 218 millton acres. As a resutt of the Alaska Native Claims Settlement Act, a large portlon of additional lands (44 mtllton ecres) w111 be owned by private native corporattons. After ail selections are completed~ the state wt11 own approxlmately 29% of the land area, the natlves 12~ and the federal government 59~. Although it fs certaln that both the native and federal lands w111 play a ma~or role 1n fu1ft111ng many of Alaska's land related needs, 1t is the state's land that can best be managed through our state and 1oca1 govern- ments in a way to ~ssure that Alaskans' land needs are met. iii. Now does the state decide whlch lands to choose? Land and Resource inventory and Evaluation ~ To tnsure the wisest selection af Alaska's remalning land entlttement = Governor Hanmond inltlated a process to ldenttfy federal and natlve over- - selected lands wlthln Alaska suitable for state ownershlp. The Oepartment of Natural Resources is responsibte for this process. Ouring the past two F yedrs the department has studlea dnd evaluated Alaska's land and natural - resources. Federal-State Land Use Planning Commission data. and the collective expertise of state land managers and resource experts. Based on thls assessment, the Department of Naturat Resources chose 71 separate "state interest" areas to create a selection pool of 45 million acres including federal and native overseterted lands. From this pool the state v~ill choose much of 1ts remaining general grant land entitlement. Public Review The 45 mittion acre land pool does not represent state land selections. ~ Rather it is a first step which aii11 alert Congress to our basic desires and provlde the basis for public discussion. In an announcement last November, Governor Jay Hamnond sa1d, "It is our intention to press aggressively for , conveyance of 25 to 30 mitiion acres from this pool and other lands through the (d)(2) legislation. Our decision of which lands shoul~ ultimately be selected r~it] only take place after an extensive process of public meetings, ~ and revtew. Identification of these tentative state interest lands initiates this process of public review and input to our eventual selection action." ~ Tbe Department of Natural Resources is now in the process of scheduling ~ public meetings in some 19 conmunities throughout the state. The Oepartment ; is interested in gathering more 1oca1 knowledge about lands within the ~ selection pool,as well as hearing people's thoughts concerning the types of ~ lands and the location of lands which the state is considering. Sinc~ the , tentative pool must be reflned~ publlc lnput gained from these meetings can : play a s~gniflcant role in shaping the eventual selection package. ~ ; IV. How can 1nd1v1dual Alaskan citizens particlaate? A large map of the State of Alaska should be on dlsplay in your city ha11 or ~ communtty center. Th1s map will show lands which the state has prevlously selected and the new interest areas which comprise the 45 mtllion acre pool. Conslder both the statewtde plcture as we11 as the lands in your speclflc area. Come and discuss your opinions of the state interest areas at the publlc meeting 1n your communlty. SE7TLEMENT LANOS: The state should select land around regional centers such as Kotzebue, Nome, Bethel anQ 01111ngham as we11 as eddittonet potentlal settlement areas for the future tn regfans such as the Yukon and Kuskokwim River valleys~ the uplands of the Yukon F1a~ts and the Brtstol Bay drainage. 2. AGRICULTURE: The state should aLtempt to select all lands made available rated in the top half of Alaska's agricultural land. Any remaining agricultural tands should be selected if other vatuable resource capabilities are specifically identified. 4. F4RES7RY: Future selections should attempt to acquire forest lands from the best half of Alaska's forest potential areas. 5. COMMERCIAL FISHERIES: Selections should consist of key parcels of limited acreage and prime tocations for parposes of fishery enfianr,ement, hatchery sites, research faciiities, and access sites. 6. TOURISM: Recreation lands icientified in the 4lhite Mountain area, Tangle Lakes area, and near the Alaska Yukon border should be selected, if possible, as r~ell as additions to the highv~ay campground system and noted recreation sites along ma~or tvaterways. 7. HARD ROCK MINERAL LANOS: The state should balance out existing mineral holdings with very selective acquisitions in mineral areas of known potential, and areas which may became mining activity centers, such as on the Seward Peninsula and the southv~est portion of the Brooks Range. to facilitate provision of state services. 8. COAL LANDS: The state should acquire appropriate coal iands which rank tn the best third of coal potential lands in the state. 9. OIL AND GAS LANOS: The state's goal should be to refine and augment existing oi1 and gas holdings or setect new areas of extremely high resource potential including consideration of heretofore unava11ab1e areas such as the National Petroleum Reserve - Alaska on the North S1ope. 10. WIIOLIFE HABITAT AND USE AREAS: The state should select strategic sma11 parcels which w111 provide access for various wildlife user groups and also key areas to insure continuation of the state's resource manage- ment options for wildlife. 11. HIGH USE RECREATION AREAS AND PARKS: The state should select 750~000 acres of potential park lands which are needed to fu1fi11 tt~e state's recreatlonal development plan as we11 as prime areas for recreatlon factlltiea along ma~or roads and waterways. 12. LANO QUALITII: The state should select stable and useable lands of hlgh quallty and multiple use value throughout the state. 13. RIVERS AND COASTS: The state shoutd select land for settlement, recreatlon use, and access values along the Yukon and Kuskokwim Rlvers as welt as appropriate locations along the coastline of Alaska. 14. PYK LINE: The state should contlnue past pollcies of generally not encouraging large residentlal establishments away from maln reglonal centers north of the Porcupine-Yukon-Kuskokwlm R1ver line. ~ 15. We at long last have obtained data from Soldotna relative to thelr Kasllof Boat Ramp franchlse agreement and have forwarded that to the Harbor Comnission. i have not askeG the Harbor Commtssion to meet at this time because I am sti11 waiting for the plat survey to be made of the boat ramp area, the access road and the land that was initially requested for purchase by Dennis Carlson. At this moment, we cannot define the boat ramp ~rea and/or the possibility of development. The request for survey has been in for some tline and hopefully will be received by the City in the not too distant future. At that time, as I see 1t, it would appear appropriate to proceed with discussing franchtse operattons. i wou14 also like to point out that another party is interested 1n the land that Carlson was requesting, at least a portlon of it, and has also expressed interest 4n the franchise. However, as i see it we are unable to proceed with much of anything until we can get a survey to ldentify the lands 1n questlon. i woula encourage a11 parties inv~lved to urge the surveyor, Sam Best, to complete this particular work whicb was specifically authorized by the Council 1n the Fai1 of 1917. In addltion, the Planntng Commission as well as the Council has raised several questions relative to the signs wtthln the City. Because I do not know the answer, 1 have requested the Attorney and Bu11d1ng Inspector to sit down and review the governing ordtoances and determine whlch governs - the Borough Ordinance or the C1ty ordfnance adopting the Uniform Bu11d1ng Code, which has a particular sectlon relatlve to signs. This went to the attorney sane tlme ago. As you are aware, he has been away and has other matters before him. As soon as I receive a response from him as to the applicable 1aw, I w111 then make definitlve contact with the Bu11d1ng Inspector to determine what enforcement actton we can take. You wt11 be advlsed as soon as we are able to give ~ more deflnitive report. The firs~ application is essentially a backup tease appllcation for part of I.ot 3, Spur Subdlvtsion No. 1(the Serendipity Mote1 property). IL relates, hqMever, to onty one acre, more or 1ess, of tha~t 6.5 acre tract. it is predicated on the inabillty of Serendipity to consumate thetr lease with the C1ty. As a backup to thet lease. they have f11ed an addltlonal applicatlon for one acre, more or less, dd~acent to thet land requested by First Federal Savings and loan. Supporting data as to the motel canplex Lhe~r sre proposing is apparently canplete, wftb a~ set of plans and speci~lcatlons. At this time, both lease applicetions wou14 have to be eonsidered as con~eptual dppltcsttons: the first because it relates to only a portlon of Lot 3 and the second because 1t 1s unplstted land at thls time. Of interest to the Council, and particulariy t•o the Civic Center Comrnittee, is that apparently the Alaska Bond Bank wi11 be able to loan funds guaranteed by the Coastal Energy Impact Program to municipalit9es. in addition, the Bond aank is goiny to seek legislation authorizing it to issue or support revenue bonds. This means that the Civic Ceater would then be able to 3ustify a federally guaranteed loan through the Alaska [iond Bank for revenue bonds at a rate of betv~een five and six percent. I mention guarantees because, in the evcnt the anticipated grow~h of the City from coastat energy impact fa'i1s to materialize, provisions of the Coastal Eneryy Impa~t Program would provide for a laan forgivene~s. Presumably, this would be a payment by the Federal Government to tihe Qond Bank for poss4bly the prlnciple and interest that the C1tiy could not afford to pay, based on the shortfall in revenue receipts. The ~ustiffcatlon for a coastal energy impact guaranteed ioan vrouid be that the requirement for the Civic CentEr is based on population additions to the C1ty and the demand for such fac9lities by these nevi people 1n the are~. To answer a question raised by the Finance Dlrector as to our bondability, this program provldes for loans even when vre are othenvise not bondable. Therefore, there app~ars the possib911ty of a progrram that the Civic Center could use, provlded that the Alaska State Legislature permits the Bond Bank to 9ssue or handle revenue bonds.
