WHEREAS, by virtue of Sectioii 7--36 of the 1Cenai Code, as
amended thc City of Kenai is required t~ resol-t i:o com~cLiL-ive
bidding when making certain purchases, and
L~H~R~AS, Section 7-37 of the Y.enai Codc, as am~nded sei:s
forth certain exceptions to tlie competitive bidding require-
men~, and
WHER~AS, the purpose and intent of the competi~ive biddiny
ordinance is to secure purchases af. materials or services
that are mosL- advantageous to the City, consider3.ng thc
price, quaJ.ity, date of delivery, etc., and
t9H~R~AS, it v~ould be in line cvi~.h the intent and purpose oL
~ this ordinance for the City to make purchases under the
contracts of o~her qovernmental agencies when those agencies
'-'1 have uL-ilized competitive procedures that insure the most
-.~ advantaqeous price to th~ City for the items or services
~ - purchased, and
WHER~AS, the State of Alaska through its Department of
~ Administrati.on, Division of General Services and Supply, on
~ an annual basis awards contracts for various, sundry supplies
~ . and equipment at highly competitive rates and prices usually
~ far below the best price that the City could obtain if it
~ advertised for bids indep~ndently, and
WHEREAS, the State of A].aska allows municipalities to
~ participate as purchasers under state bid contracts, and
~ WHEREAS, the City can save money and time by taking advantage
of this and other situations cahere governmental entities
~ have secured contractual awards for t}ze purchase of supplies
and equipment and services that are far more advantageous
than what the City could accomplish on its own,

WHEREl~S, on May 17, 197E, the Counci.l, by Resolution No. 78-
80 approved the discontinuance of the policy of the City to
charge for ambulance ca].ls, and
WHEREAS, the majority of. the open accounts receivablc for
ambulance billinqs are primarily of the age ~r type that tl~e
Finance Department consS.ders i:o be uncollectible, and
WHEREAS, it would be to the benefit of the City to write-off
these accounts in the intcrest of proper bookkeeping, and
WHEI2EAS, the City has recently received monies from the sale
of gravel that was unexpected and has not bec~n appropriated,
and
WHEREAS, proper accounti.ng practices requi.re i:hat all
appropriations of City monies be made by Ordinance.
._ NOW, THEREFORE, BE IT ORDAINED THAT:

WHL•'REAS, the State o£ Alaska, Department of Environmente~l
Canservation has a~aarded $1,500.00 (12.5~) and $3,437.50
(12.58), respectively, to fund these same projects, and
WHF.RF.AS, Iocal cantributions for these projects shall he (1)
City of Kenai [9ater and Sewer bond monies for the addi.tional
facilities planning costs, and (2) the Kenai Peninsula
I3orough for the septage disposal study, and
WHEREAS, the Kenai Peninsull Borough has agreed to fund

which were foreclosed by the Kenai Peninsula Borouqh, and
WHEREAS, several of r_hese parcels have been dedicated tor
pub].ic purposes by Ordinaiice No. 456--78, and
WHEREAS, the City of Kenai must pay the ~ar.~s owed on these
parcels in order to gai.n proper title, and
WIiEREAS, there are sufficient moni.es available in the Capital
Improvement 5pecial Revenue k'und from past sales of foreclosed
lands, and these monies have been dedicated for capital
improvements by Ordinance 34].-77, and
WHEREAS, it is deemed that expenditures which will contribute
to the acquisition o~ lands are properly classified as
capiral improvements, and
WHEItEAS, proper accounting practices require ~hat a1J.

Section 3
- The amount of City bond funds used in tha.s project
(estimated at $9~3,500) are to be paid by the Airport
Land System from future revenues of the Airport Land
System, as these revenues become available. The
payment is to be accomplished by appropriations of
revenues in the Land System to transfer monies to the
Debt Service Funds for retirement of water and sewer
bonds. These appropriations shaZl be in amounts as
specified by the Council on an annual or other basis.

Mayor O'Reilly read Ordinance 455-78 by title only. "An ordinance aceepting conveyance
by the State of Alusku to the City of Kenai of tide and submerged lfinds lying seaward
of the City; approving and adopting the officifll subdivision plat of the area conveyed;
~. and establishing procedures by which preference ri~hts mny be exercised."
Mayor O'Reilly opened the meeting fo the public.
Mr. Ray Maehen, local fisherman, stated thAt he had been involved in discussions
with the City Attorney and City A'[ana~er and as a result of these meetings ~ the fisher-
men still did not fecl thst their problems ~vere being addresse@. l~ir. ARachen requested
that Council direct Administration to re-~vrite the Tidelands ordinunce to properly
document the areas of "grandfather rights" and current leaseholder rights.
MOTION -
Councilman Ambarian moved, seconded by rouncilwoman Glick, to brin~ nrdinance
No. 455-78 back to the table.
Counci2man Ambarian stated that the City had been following~ the procedures for
public hearing in order to garner public input, etc.~before final ~doption of the ordinance.
~ Councilman Ambarinn suggested that two members of Council be appointed to sit in on
the next meeting between the fishermen and administration and try to resolve some of
the questions relative to the ordinance.
Mayor Q'Reilly appointed Councilmembers Ambarian and Seaman to the committee to
meet with ndministration and interested ~shermen to discuss areas of adjustment withfn
~ Ordinance 455-78.

suggested that if the li~hting ~vere not to be installed at this time, to ha~*e the State include

Homer ~lectric Association claims for reimbursement of costs incurred in repairin~ d~mages
to their system duxing construction ~rojects -- Councilm~n Ambarian reported it was the
fee2in~ of the committee th.at the Cits~ tvas not res~on~ible for the claims and it was IiTsA's
responsibility for the operation of their system, not the City's.
~9arm storage and City yard facility -- Councilm~n Amharian stated it was the feeling of
the Committee that Council should prepare a pl~n for future stornge of equipment fvr the
Airport~ present facilities and stntus of same, etc.
Councilman Ambariun also reported that the Committee diseussed development of a source
for gravel for the City rand also discussed a City ~iall camplex which include offices
and Council meeting rooms.
Councilman Ambarian stated that on the items discussed, the City has $30d,000+ in funds
to expend for some of the projects and it vlas the Committee's feelin~; that a priority Iist
should be prepared. Al.l but one member of the Committee felt that eauipment wnrm storage
had top priority with the remaining member feeling that a City ~I~11 comple3: ha~~ top priority.

available regarding passenger enplanement and freight
handled through the Kenai Municipal Airport. It is my
impression that these figures, although kept by the airlines
on transportation rnatters, are not presently available to
the public. Inasmuch as these statistics would provide
another indicator of activity on the Peninsula and also
indicate levels of service, we would appreciate very much
having them made available to us by the City. •

AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA
RESCINDING ORDINANCE 360-77 ESTABLISHING A CAPITAL PROJECT
FUND ENTITLED "FIRE RESERVOIR" AND ESTABLISHING A CAPITAL
PROJECT FUND ENTITLED "FIRE RESERVOIR AND OTHER WATER SYSTEM
IMPROVEMENTS."
WHEREAS, the City by Ordinance 360-77 authorized the
construction of a three million gallon water reservoir,
and
WHEREAS, favorable bids have enabled the City to expand
the project to provide for other water system improvements
at no additional cost to the City or the State.
NOW, THEREFORE, BE IT ORDAZNED BY THE COUNCIL OF THE CITY
OF KENAI AS FOLLOWS:
3ection 1: Ordinance 360-77 is hereby rescinded.
Section 2: The following increases in estimated
revenues and appropriations are hereby made:

INCREASING ESTIMATEA REVENUES AND APPROPRIATIONS IN THE
1978/79 AIRPORT TERMINAL ENTERPRISE FUND BUDGET BY $2,500.
WHEREAS, the Council of the City of Kenai has determined the
need for preliminary architectural engineering in the
Airport Terminal to provide information regarding redesign
of the airport operations area, and
WHEREAS, it is estimated that this service can be provided
for $2,500, and

AN ORDINANCE OF THE COUNCIL OF TFIE CITY OF KENAI, ALASKA
AMENDING THE KENAI CODE OF 1963 AS AMENDED AS IT PERTAINS TO
THE LEASSNG OF AIRPORT LANDS. '
WHEREAS, on June 7, 1978, the City of Kenai enacted Ordinance
No. 400-78 establishinq policies and procedures relative to
the lease of City-airport lands, and
WHEREAS, said ordinance has been revised per. Ordinance No.
424-78 passed August 2, 1978; Ordinance No. 434-78 passed
October 4, 1978; and Ordinance No. 435-78 passed September 21,
1978, in order to perfect the City's leasing policy as it
pertains to the lease of airpor~ lands, and
WHEREAS, it would be beneficial to the City to further
perfect its airport leases by amending a certain provision
thereto as it pertains to the ownership of improvements made
upon airport lands, and
WHEREAS, presently the leases are so structured it is not
explicitly clear that the City of Kenai is to own all improve-
ments placed upon airport lands, and
WHEREAS, it is a more common practice that long-term leases
contain the provision that all improvements made thereon
should be owned by the land owner rather than the tenant,
and
wherefore, it would be desirable that the City af Kenai's
lease follow the norm as it concerns this provision,
NOW, TIiEREFORE, $E IT ENACTED BY THE COUNCIL OF TFiE CITY OF
KENAI, ALASIiA as follows:
Section 1:
That Sections 21.10.150 and 160 af the 1963 Kenai Code
as amended (Ord. 400-78) are hereby rescinded and
repealed in their entirety.
Section 2:
A new section 21.10.150 is hereby added to read as
follows:

(a) That no alterations, additions or improvements
shall be made in or to the premises without the
~consent of the City in writing, under penalty of
:"~,~ damages and forfeiture, and all additions and
`'~ improvements taade by the ~essee shall belong to
the City.

' ~ (b) Said Lessee shall take good care of the premises
and fixtures, make good any injury or breakaqe
done by Lessee, servants or visitors of the
~- Lessee, and any damage caused by the overflow or
~ escape of water, steam or gas resulting from the
IR negligence of the Lessee, or visitors or servants
of the Lessee. The Lessee shall quit and surrender
said premises at the end of said term in as gnod
~ condition as the reasonable use thereof will
permit, and shall not make any alterations,
additions or improvements in said premises without
~ the written consent of the City, and all alterations,
additions or improvements which may be made by
either or the parties hereto upon the premises,
except movable furniture put in at the expense of
the Lessee, shall be the property of the City, and
~. shall remain upon and be surrendered with the
3 premises, as a part thereof, at the termir~ation of
this lease, without disturbance, molestation, or
injury, but injury caused by moving said movable
furniture in and out shall be repaired by the
Lessee. That any and all shelves, locks, plumbing
fixtures, or any other improvements that the
~ • Lessee may place or cause to be placed in said
~ premises shall immediately become a part of the
--~ premises and property of the City.

AN ORAINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA
AMENDING THE 1963 KENAI CODE AS AMENDED AS IT CONCERNS TFiE
PENALTIES PROVISION UNDER THE FIRE CODE.
WHEREAS, the Council of the City of Kenai adopted a Uniform
Fire Code on August 5, 1978, and
WHEREAS, it would enable more efficient operation and
encourage the compliance of the fire codes and regulations
if a civil penalty provision were added to this ordinance as
an additional and alternative means of enforcement, and
~ WHEREAS, said provision would give the City o£ Kenai Fire
Department and the Legal Department immediate access to the
Superior Court in order to obtain the abeyance of fire
( hazards which may cause jeopardy to life and property,

I NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
~ KENAI, ALASKA that Ordinance 411-78 be amended to read as
I follows:
To Section 8.05.144 Penalties add the following sentences:
In addition to, or as an alternative to the criminal
penalty aforementioned, or the penalties and compliance
provisions of the Uniform Codes adopted by this ordinance,
any person violating any provisions of this ordinance,
the uniform codes that it adopts, or any written order
of the Fire Chief or his desiqnee based on the above,
to correct a fire hazard, shall be subject to a civil
penalty of not more than $100. Each and every day that
such violation continues sha1Z be deemed a separate and
distinct violation. In addition, a civil injunction or
temporary restraining order may be obtained in order to
obtain immediate compliance with the provisions of this
ordinance or the uniform codes that it adopts in order
to abate a fire hazard.

19.10.010 Creation, Members, Chairman, Ex-Officio Members
There is hereby created a Kenai Advisory Harbor
Commission, which shall consist of seven members
who shall be nominated by the Mayor and confirmed
by the City Council. A chairman and a vice-chair-
man of tL.e Commission shall be selected annually
and shall be elected from and by the appointive
members. The Mayor and one Council member elected
by the Council as ex-officio members of the Com-
mission and, as consultants, may attend all meetings,
but they shall have no vote.
19.10.020 Duties and Powers, Plans, Recommendations, and Re ulations
The Commission shall be required to do the followinq:
1. Develop, adopt, alter or revise, subject to
approval by ~he City Council, a master plan
for the physical development of harbor or
port facilities for the City. Such master
plan with accompanying maps, plats, charts,
descrip~ive and explanatory matter, shall
show the Commission's recommendations for
the development of the City Harbor facilities
may include, among other things:
a. Development of the type, location and
sequence of all public harbor facilities.

b. The relocation, removal, extension or
change of use of exis~ing harbor facil.ities.
2. Subm9.t annually to the City Manager and Council,
not less than ninety (90) days prior to the
beginning of the budget year, a list of recommended
capita]. improvements which in the ~pinion of
the Commission are necessazy or desirable to
be constructed during the forthcoming three-yeaz
period. Such list shall be arranged in order
of preference, with recommendations as to which
projects shal]. be constructed in which year.

3. Make investigations regarding any matter
related to City harbor facilities, tide or
submerged lands. Make recommendations to the
Council relative to the care, control, and
development of tide and submerged lands.
4. Act in the capacity as directed and authorized
by a Tidelands Ordinance adopted by the City.
5. Review all City leases of City owned tide,
submerged, and lands or navigable waters
within the City, and as to the planned im-
provements proposed and make recommendations
to the City Council.
6. Make and prepare reports and plans for approval
by the City Counci3..

7. Coordinate public efforts, individual and
group, to the effectuation of approved plans.
8. Shall act in advisory capacity in the selection
of a Harbor Director should such a position
be created by the City Council.
19.10.030 Terms and Appointments to Vacancies of Commission
Members
1. The term~of each appointed member of the Com-
mission shal]. be three years, except initial
appointments shall be for abbreviated terms
so that terms in three years shall be stag-
gered. The terms shall be staggered so that
three members shall be appoi.nted every ~hird
year and two members shall be appointed in
each of the other years of every such three-
year period.
2. Terms shall commence on March 7th of each
year. Vacancies shall be filled by appoint-
ment by the Mayor and confirmation of the
City Council as set out in the Charter of the
City of Kenai.
19.10.040 Qualifications of Commission Members
No person may serve on the Commissi.on for the City
of Kenai who is not a resident of the City of
Kenai; and if any member so appoirited shall miss
three (3) consecutive unexcused regular meetings
of the Commission or shall move his residence from

the corporate limits of the City of Kenai, then
such members shall ceaae and said appointment
shall be null and void.

The Commission shall establish rules of proc~dure,
provided there shall be regularly scheduled monthly
meetings of the Commission, which shall be open to
the public. Permanent records or minutes shall be
kept of the Commission's proceedings and such
minutes shall recoxd th~ vote of each member upon
every question. Every decision or finding shall
immediately be filed in the office of the City
Clerk, and shall be a public record open to inspec-
tion by any person.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA
DEDICATING INTEREST REVENUES FROM CITY INVESTN'iEI~ITS TO THE
RETIREMENT OF 1967 GENERAL OBLIGATION BONDS.
WHEREAS, the 1967 General Obligation Bond Issue has some
$1,700,000 of principal and interest remaining to be paid,
and
WHEREAS, the present funding sources for these future debt
payments are primarily (1) the 1957 Water, Sewer and Streets
Special Assessment Fund, and (2) the 1967 Water, Sewer and
Streets Debt Service Fund, and
WHEREAS, these funding sources are insuf£icient to meet the
total debt obligations of the 1367 General Obligation Bond
Issue, and
WF:EFi^sAS, it is estimated that interest earnings on City
investments will be sufficient to meet these debt obliga-
tions.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
" KENAI, ALASKA that interest revenues earned from City
~ investments be dedicated to retire the 1967 GeneraZ Obligation
Bonds authorized at that certain special election held in the
City o£ Kenai on February 28, 1967, except for those interest
revenues required by Federal or State statute or other authority
to be allocated otherwise. It is intended that this dedication i
be accomplished by allocating interest revenues to the 1967
Water, Sewer and Streets Debt Service Fund, beginning with ,
fiscal year 1978-79.

sessions on Monday preceeding the regularly scheduled
~ public meeting on Wednesday commencing at 7:30 p.m. and
adjourning at 10:30 p.m. at the Public Safety Building.

ACCEPTING A GRANT OFFER FRQM THE STATE OF ALASKA, DEPARTMENT OF
ENVIRONMENTAL CONSERVATION FOR $16,150.
` I WHEREAS, the State of Alaska has offered a grant to the City of
Kenai in the amaunt of $16,150, or 50 percent of the eligible
costs not covered by the federal government, of ~he modification
of five sewer lift stations, and
: WHEREAS, these modifications will be constructive to the City of

by the federal government. Total project costs are estimated at $95,250.

Adjustment of expenditures within the budgeted.cost items is allowed,
however, if actual project costs exceed the total estimated eligible
costs, a r~vised grant application must be submitted before additional
funding can be committed. If actua2 project casts are less than the
estimated costs, the grant will be reduced to the extent necessary to
comply with the percentage limitation set £orth in this offer. Grant
payments will be made in accordance with the enclosed payment schedule.
All rec~uests for pa~~nent must be submitted on the enclosed "Request for
Payment" form. ~
By accepting this grant offer the City of Kenai agrees to comply with
the procedures and requirements contained in the Construction Grants
Regulations (18 AAC 73, appcmded) as well as the £ollowing general and
special grant conditions.
General Grant Conditions
1) Contract Award & Contractor Bonding Requirements
a. The grantee agrees that adverttsement, bidding and award of
construction con~::acts exceeding $20,000 shall be in accordance
with proce~ti:ts .:ontained in Alaska Statutes 35.15. Adequate
time, not less than 30 days, ahall be allowed between the date
of formal advertisement and the date the bids must be submitted.
The grantee agreea that any contract awarded will be to the
lowest responsive responsible bidder.
b. The grantee agrees to submit procedures for award of construction
contracts of less than $20,000, to the Department for prior
approval when means other than the competitive bidding process
are proposed.
c. The grantee must require the contractor to furnish performance
and paymenC bonds in accordance w3th AS 36.25.010.
d. If local or federal ordinances or regulations also apply to
the contract award or coatractor bonding requirements for this
project, the most etringent requirements shall apply.
2) Project Completion
The grantee agrees to provide sufficient local funding to match
State and federal grant assistance and to ensure the completion of
a properly functioning project.

e 5) Inspection

and audit of related records and data for which this grant is
~~ offered at any reasonable time.

The grantee agrees to maintain projecC accounts and recorda which
~ verify the grant eligibility of pro~ect expenditures. These accounts
and records shall be kept apart from non-grant-e23gible loca2
recorda and from those records maintained for the purpose of other
State or federal grant progzams i.nvolved in the pro~ect.

proposed project as required by the Staee.
8) Change Orders
The grantee agrees that all project change orders will be submitted
to the Department for approval in accordance with 18 AAC 73.020(d).

We are dealers for one of the Iargest manufacturers n
of sound equipment, Grommes - Precision, who over the ;x`
past thirty years, has turned out well over a millfon

The proposed system wi12 pick up and amplify each
Council members voice. This will allow the public

Dear Ms. Peter:
Here is our interpretation of your council chambers sound
reinforcement requirement. After talking with Chief Winston
abou~ the room parameters, I understand that the room is
not a standard council chamber room. I understand that the
main room is approximately 18 feet wide by 50 feet deep
with kind of an overflow area beyond that. From the wdy
that the Chief described the room, it is a rather dead room
• so we shouldn't have a reverberation problem and we have
reached the conclusion that a sfngle, good quality sound
column placed as high as it will go on a speaker stand will
-~~ cover the audience in the main room. Single source sound
_ is always desireable from an articulation standpoin compared
to multiple source sounds. It might be nece~sary to add
^,. one additional speaker in the overflow area, but that
~~ remains to be seen. That speaker could be purchased later
if it fs required. If we place speakers more than 20 or 25
feet apart, we run into time delay problems which cause
loss of arttculation because sound is arriving from two
sources at 20 or mare milliseconds apart. The possibility
exists that if you do require a second speaker in the
overflaw room and it is not sufficiently sound isolated
from the main roon, we may be required to put in a time
delay unit with an additional power amplifier to drive
this second speaker. This would only be necessary if we
have articulation loss sufficient that people in the overflow
room cannot understand what is being sa~d. 41e mention
these because they are options to the basic system and due
to factors that we may not be aware of at this time, the
need for these options may extst.
We elected to go with the Industrial Research automatic
mic mixer for three good reasons: 1.) It is the best unit
on the market at this tfine, 2.) because of your 11 mic
input requirements, it turns out to be the least expens~ve
un#t on the market, and 3.) it provides a separate output
~ to drive a tape recorder. We have incorporated a limiter
and equalizer into this system. The limiter will automaticaliy
-~a ad3ust the level of various talkers regardless of how loud they

talk or how close to the microphone they are. The equalizer
~', will shape the audio spectrum for best articulation in
your particular room. The power amplifier is a standard

type loudspeakers in our installations, but this is a
situation where it is appropriate. The advantage to a
column loudspeaker is that the vertical beam at 2000 Nz
is approximately 2Q degrees. Thus, when the unit is placed
up near the ceiling, it will give a reiatively uniform
listening 1eve1 to the entire audience area regardless
if a person is sitting up near a speaker or in the back
row. The equipment is housed in a 6" high equipment cabinet
on casters. It has front and rear iocking doors.
The system is a very good quality system without being
gold plated. With the exception, perhaps, of the loudspeaker
it is a system that could ]ater be moved to a permanent
council chambers. You may wish at that time to have a
different speaker system installed.
As given in aur telegraphtc quotation, the price for the
system is $8,972.00. This price includes a trip down to
Kenaf to attend a counci] meeting and make any ad3ustments
necessary at that time.

This letter fs to provide you with information regarding our Bid
Proposal for the Souad Reineforcement System for the City Council
Meeting Room.
We are submitting three Proposals for the above-mentioned System. Our
Proposal ~il, I belfeve, is adequate for the Council Room. It containe
alI features delineated ia our 3 proposals, and is expandable. .
Proposal ~i2 contains all features of Proposal ~I1, with the addition of
having the capability of recording several people speaking at the same
time, al~l would be recorded on tape, and will also pick-up applause and
various other souads. This is a more sophisticated sqstem.
Proposal O1 has a manual coatrol for noise level, and may have to be
raised or lowered, depending on the sound level. Proposal ~2 has an
automatic level control for all microphones.
Proposal ~i3 has a21 of the features of Yroposal 1i2, with added designs
to be used in alI environments,iacluding areas of bad accoustical design,
or anqwhere where sound would create reverberation or echo. Ail syatems
are portable.
Ia aumiaary, proposal ~/1 would be adequate for your needs, Proposal l~2
would include loud sound Ievels from the audience, aad Proposal #3 would
include all of the aforemeationed requirements, in addition to alleviating
problema of bad accoustics and enviroamental noise.

We propose several systems for your consideration; All sqstems wi21
have permanently-mounted apeakers and a small wheeled cabiaet containing
the souad recordiag and reirnforcemeat system. This compact package will
promote coavenience, order aad ease of operation, in addition to facilitat-
ing set-up of the equipmeat.
The microphones may be left open with no degradation to the sqatem or
maq be individuallq shut off for a private conversation. The tape recorder
will Yecord 6 hours on ane eide and then automatically reverse itself for
aaother 6'hours of recording. This is the type of recorder currently
being used in court sessions.
All proposals are composed of quality equipment of solid state, trouble-
free, modera desiga, manufactured bq the ].eading compaaiea of sound systems.

Altec System:
The same system as above with the addition of an automatic mixer to
allow any number o£ microphones to be used at the same time without
affecting the intelligibility or the overall volume of the syatem.
Each person speaking will be heard distinctly, in each area of the
room, including the back of the room. If only one microphone is in
use, it receives the maximum system attention, while the remainder of
the microphones are automatically silenced.
CO1~AtEIST; The Altec System ~il allows a great latitude in microphone
mismanagement or misuse and continues to give a faultless control of
the volvme and intelligibility.

Since the last amendment to our contract, which was dated 21st
July 1977, engineering work in connection wtth Change Order 3(Pumphause
Electrification) and Change Order 4(Install Skid-mounted Generator)
- has been requested by the City and performed by me.
The need for electrification of the pumphouse and for an emergency
generator was not contemplated at the time of our last contract amendment.
Nor could the engineering time and costs involved in this ma~or extra
work have been foreseen at that tin~e. At the time of our iast contract
amendment, the Cit,~ had recently had wiring, controls and engines in the
pumphouse worked on, and it was generally thought that the pumps were
~ready to use. The requirements for safety, reliability and ease of
operation were finally determined after many months of trying to avoid
the ma3or extra work involved in correctfng deficiencies of the pumphouse.
On the other hand, the situat~on with Change Order 1(Tank Knuckle
Welds), 2(Move HEA Cable Out Of Way) amd 5(Retnsulate Tank Hatch) was
different from Change Order 3 and 4. Change Order 1, 2 and 5 were directly
reiated to the original tank design and construction. An allowance had
been made in the contract to cover engineering time and cast for such
directly-related and normally-occurring change order work. Therefore,
engineering time and cost for Change Order 1, 2 and 5 has been paid for
out of the $12,300 provided in Paragraph IV.- B: of the "Second Amendment
To Contract For Engineering Services Dated 2nd October 1975," a copy which
fs attached.

The $14 000 estimated above, fo r engineering time and costs expended
and yet to be expended on Change Order 3 and 4, works out to about 10.4
percent of the Contractor`s price far t~iese c~iange orders. This fs
reasonabie for a small rehabilitation ~ob involving civil, e]ectrical,
mechanical and control design and supervision.
Change Order 3 and 4 added $134,Q31 or about 20 percen t to the
contractor's price, whereas the ~3~30~'-estimated `a6ove for engineerfng
time and casts in connection with Change Order 3 and 4 will add aboux 21
percent to the englneer compensation.**
~The aistribution of costs between Change Qrder 3 and Change Order 4
is based on the contractor's price.
** Basic contract dated 2nd October 1975, had about 530,000 in engineering
costs attrfbutable to the reservoir-tank pro3ect. The Second Amendment
dated 21st July 1977, had about $36,900 in engineering costs attributable

B HEARINGS
1 ORDINANCE 455 TIDELANDS Our problem in resolving the Tidelands
i.ssue relates to the provision of the Statc Constitution providing
for unrestricted fishing in natura2 waters. The State and the Attorney
General's opinion which we are trying to obtain for authorization
of Tideland leases for set-net fishing do not appear to be reconcilable
to me. I have written the State for information,and, regrettably, our
first response has been negative, "do your own thing." We are now asking
for the Attorney General's precise opinion so that we know what we can
actually provide with the "set-net lease." Mr Machen, one of the lessees,
will meet with the Council committee Saturday, February 3, 1979 at
I0:00 a m here in the City offices. I believe that the meeting's
result will probably be to ask for the Ordinance to be tabled until
the last meeting in March. At that time we simply must resolve the
issue and come up with an Ordinance to be ready for the 1979 fishing
season.
2 ORDINANCE 462 TELEPHONE POLL PROCEDURES This is a rewritten Ordinance
that incorporates the comments the Council made at the last meeting. We
hope that it will be satisfactory.
. 3 ORDINANCE 464 PURCHASING PROCEDURES The key is to enable the City
to piggyback appropriate Sta~e or other municipal purchasing agreements
which have been entered into in accordance with normal bidding procedures.
--~ This would enable us to use these contracts for purchases in excess of
$25Q0 without having to actually go through public bidding. It would
. greatly assist us in meeting the legalities af public bidding requiremen~s
fn the Charter, but not require that every purchase be formally bid
by the City.
4 ORDINANCE 465 UNCOLLECTABLE AMBULANCE ACCOUNT RECEIVABLES These
. old accounts should be written off. We propose appropriating unexpected
revenue to cover ~hese particular item for write off. T feel obliged
to bring Paul Burlingham's comments as a representative of a local credit
firm that he wauld be willing to pursue collection at a percentage basis.
5 ORDINANCE 466 PROVIDES FUNDS FOR STATE SEPTIC STUDY The local shaxe
of this would be provided by the Borough. '
6 CRDINANCE 467 APPROPRIATES FUNDS AND AUTHORIZES ~AYMENT OF TAXES
FOR FORECLOSED LANDS CLEANLY DEDICATED TO PUBLIC USE. We are asking ~or
an amendment since one of the properties has been redeemed. We are
substituting one o£ the bluff lots which has been deeded to the City and
has taxes owing. This would also clear up the Beayer Loo~ sfte as a
possible fire substation.
--%--~~ 7 ORDINANCE 468 LTBRARY DONATIONS This appropziates $522 donated to the

The club did have a building on the FAA site when they purchased foreclosed
party in the old town site an3 built a basement clubhouse which they
are currently occupying before building the upper floor. At this time they
would like a club license for their post.
C PERSONS SCHEDULED TO BE HEARD
1 MRS DORIS LASHLEY representing Sea Catch which is ~he new corporate
name for R Lee Seafood. You will note that later on the agenda we have
the Sea Catch Iease. This is a new lease for the R Lee 12.1 acres to
Sea Catch. Currently Mrs Lashley is having some financial problems with
the bank concerning the acceptability of the lease. Rather than amending
our leasing policy, she is suggesting that we sell the land to her firm
since this may be the most expeditious method of handling this problem
dealing with the expansion of her plant. She does have the basic approval
for the almost two million dollar expansion of her facility. The land
will be a siqnificant security on that loan. Our problem with selling
Cfty lands is that our ordinance prescribes an auction and procedures
whieh are relatively time consuming. If the Council considers this sale,
the only expeditious manner of liandling it would be by emergency ordinance
which would waiver our formal sale policy.

to the standard lease to protect the rights of the gublic. The City
Attorney desires to perfect this addendum and it will be presented at the

WETLANDS. I think it is important to monitor the approach of the
State and Corps of Engineers to these problems for the City, State
and Peninsula.
2 TUESDAY, FEBRUARY 6, the join~ consideration meeting with the
AZaska Division of Lar,ds, th~ Kenai Peninsula Borough, the Department
of Transportation and the CIR for their request for 307 acres of section
36. I believe the State DOT will withdraw their objection if the Borough
will withdraw their claim. Our biq question is with the Cook Inlet
Reqion's objection.
3 THURSIIAY FEBRUARY 8 we will have a meeting at the Public Safety
Building with CH2M Hill's airport engineers, the FAA, the City and
Wien to discuss the specific proposal for the renovation of runway
drainage and fence work. In particular this will include the schediiling
of the runway renovation. Additionally, we will discuss possible other
improvements resulting from Wien's use of Kenai enroute to Seattle. There
may be projects which would be required in future years that could better
be done as quickly as possible. We could even now coordinate this work
with the runway work.
4 Don Gilr.ian has proposed a PUBLIC HEARING for the allocation of
$15,000 in revenue sharing funds for the support of th~ senior citizens
program in Kenai. After the public hearing on the allocation, then
the appropriate ordinances will have to be introduced in the Borough
Assembly to provide the funds. I believe the intent is to provide
funding for Seward and Homer.
5 The Recreation Commission Directar's position from 35 to five applicants.
I have requested a Ietter to the appl.icants verifying the salary figure
in proportion with the Alaskan economy, the scope of the program currently
undertaken. Dick Morgan and Mayor O'Reilly reviewed it and it has been
dispatched. We have asked for VERIFICATION OF THE LETTER FROM THE REC
DIRECTOR APPLICANTS. This should prevent misconceptions on the part
~ of the applicants.
6 The Clarion story concerning the lawsuit for the taxation of LEASEHOLD
INTERESTS. Rick is challenging the evaluation of his leasehold la:~d.
The Borough denied the request for adjustmen~ and Rogers and Baldwin
have filed a lawsuit with the Superior Court. We did not even know of
the suit until Rick called me to appear on their behalf. I asked ~rnie
to review the situation••~with the Borough Attorney. We decided the best

Such effort was made by the City Attorncy on behalf of the City last week.
We are very much concerned with the suit since 1) we do not really
know what they are asking for and 2) this coald be a breaking of the lease
with the City and 3) this could set the stage for a devaluation of
leasehold interest thoughout the State. The major significance is
the relationship of the contract between the City and lessee and the
relationship of the taxing authority of the City for that particular
assessed value. If these values are diminished as a result of the lawsuit,
the rateable valuation within the City will drop. We wi7.1 keep the
Council informed as this case develops.
7 CASON LEASEHOLD on the Spur Highway, the Golden Hairpin has blossomed
with a muffler repair sign. The addition to the building was presumably
for the storage of equipment for Mr Cason's oil fuel service. This was
specifically discussed at the time. IJow it appears this is a muffler
shop instead. At my request, the City Attorney has written Mr Cason that
this is improper use of the lease. Apparently Mr Cason will challenge
this and has requested Rick Baldwin represent him and discuss this
with the City Attorney and myself. We did point out that Mr Cason is
also delinquint on taxes on this property as well as his other airport
property. In the event we were forced to file suit, this will be
a cellatoral issue.
8 COUNCIL WORK SESSION A review of construction plans £or the projects
now zeady for bid and summer construction occurred. The question of
borrow pits and additional estimates of making relatively minor changes
to the drawings. This data will be provided for you Wednesday. Essentially
. however, there were no significant changes or problems with the plans.
The other major item of interest was Chief W~.nston's presentation for
fire protection within the City. With his diagrams he pointed out ~he
desirability of a substation at Beaver Loop. This would be composed of
. a building and be equipped by a fire vehicle currently in the Public
Safety Building. The primary would use off duty personnel to establish
the staff at the station initially. This is one of the reasons we are
asking for paymen~ of the Beaver Loop lot taxes so we can have clear
title and could implement such a program. This appears to involve
minimal investment and utilization of existing equipment and personnel
to save those I.iving in the east end of tiown a tremendous amount.
PERMIT SYSTEM for work in and around the City streets. Time did not
permit detailed analysis and we are hoping we can get some additional
input from Council as a whole so we can enforce good procedures for
street work. . '
INFORMAL DISCUSSIONS BETWEEN SOLDOTNA AND CITY FOR COMMUNICATIONS
ASSISTANCE. We have had two meetings with Soldotna Mayor Bearup and
their police and fire chiefs. This was discussed at the work session
, and we are preparing some cost estimates now.

THREE MII.LION GALLON WATER STORAGE TANK
City Blectric, subcontractor for Rockford, is presently working
. in the Underground Pumphouse with installation of electrical
gear. HEA has a transformer to put in next to the pumphouse.
City Electric is waiting for a transfer switch and the generator
which should be arriving at any time.
AIRPORT ~VAY STREET, ~VATER AND SEWER IMPROVEAIENTS
{Vince, Corthell, Bryson, and Freas are presently engaged in
realignment of Airport Way in an ef£ort to meet everyone's
requirements.
MISCBLLANEOUS ITEDiS
T am continuing to work with Glacier State Telephone Company in
~ • developing a system for assigning house numbers to lots throughout
the City. I have recently received a copy of the Borough of Kenai's
map that has been revised of the City of Kenai. Unfortunately, this
map is at a re2atively small scale, 1" eQuals 800 feet.
I have talked with John Horn of Alaska Department of Transportation
Maintenance and Operation concerning changing over from Mercury
Vapor lights to Pressure Sodium on the highway. Unfortunately,
it looks as though there is absolutely no money available from the
State or Federal Agencies for this improvement. The cost for
changing the lights over would be approximately $22,000 and would
have to be completely from City funds. It is therefore questionable
whether the City of Kenai wants to engage in such a project without
assistance from the State. This pro}ect would result in a reduction
in power costs.
I have been working quite extensively with Equipment Services
concerning problems that we have been having with the Clark/
Michigan Loader. They have assured me that our problems ~aill be
solved and that ~re wzll be ~rell satisfied with the piece of
equipment.
The Public iVorks Department is anxiously aw:~iting the arrival
of the Chevy Luv from the Car Co. which was due on January 10, 1979.
There 90 day delivery date is therefore expired.
I have asked Ted Forsi and Wince, Corthell, Bryson, and Freas to
include a progress statement with their next billing on their
CEIP engineering projects.

I have been working on the Excavatio~i Permits for work ~vithin
the public right-of-way in the City of Kenai. I have discovered
that many of the pcrmits and reqtiirements t}iat ha~Je been placed
on contractors in the past are not covered in th~ City Code.
' T have therefore worked closely with t}~e City Attorney, City
Dtanager, and the City insurance agency in an efiort to include
past practices into our present Code. The actual permit forms
were the combination of many sources - past Public Works Forms,
City Attorney, City of Los Angeles £orms, and from the Director
of Public tiVorks. During the Council work session on January 31,
~ one of the Council members presented a possibility of contracting
work within the public right-of-way to one individual contractor
, not allowing others to excavate within the public right-of-way.
- This approach would meet our needs. However, it is possible that
some of our local contractors might be upset and object. Regardless
of the method selected, we do need to address this problem so what-
ever course of action can be in effect before the construction
season which means,at a minimum, a 60-day period for processing
the appropriate Ordinance. The present Code requires
a yearly excavation permit that is only good until December 31.
Since no contractor has renewed his permit at t}iis time, ive
have no one legally licensed to excavate on public property
within the City.
I have spent some time with Robert tV. Thorpe and Associates
this past week in discussion of the Comprehensive Plan for the
City of Kenai. I have received word from Evans Engine and
Equipment that the Champion Grader that was ordered for the
Airport is in Anchorage and will be shipped tomorrow. Today
was the deadline for delivery.
As you kno~a, we have a considerable amount of snow in the City
of Kenai this year. It looks very possible that we are going
to have to remove snow from the City of Kenai's streets. I have
located some rental equipment that would be needed to accomplish
this. Ideally; we should rent one sno~a blower and three trucks
for approximately two weeks. The snotiu blower runs $600/~aeek
and the trucks at $38/hour. Therefore, the breakdown for two
weeks: blower and three trucks $10,320
blower and two trucks $ 7,280
blower and one truck $ 4,240
Our roads are continually getting smaller with the large amount
of snow and if tiae get much more snow we will have no choice but
to try to haul.

The Street Crew worked on stockpiling sand, repairing roller on
the Mukluk door, working snow back beliind Airport lights,
sanding Airport, scarifying streets, sanding and -vorking the
snow back on the streets, stripping interse~tionS~ collecting
garbage, repairing the waterline in the bathrooms oF the hiukluk
Building, repairing Airport Lighting, svpervising YACC employees
in cleaning snow away from Airport Lights, and general winter
maintenance of Streets and Airport.
The Shop replaced U-joints and transmission seal on the966 Loader,
checked out the Fire Dept.'s new car {installed the red light and
bumper, worked on the shop exhaust fan, tuned up and replaced
front bearings and muffler and heater on Fire Dept. pickup,
completely overhau2ed the starting unit on the Shop pickup,
checked the charging system and replaced the alternator in a~
Police Car, worked on the hydraulic valve ov~:rhaul for the
HD-11 Dozer, repaired an electrical short on a Police Car,
tuned the engine and repaired the exhaust on No. 11 Fire Engine,
replaced the front brake hoses on tlie Senior Citizen's Van,
installed a new check va1vA for the wing on the 14G grader,
replaced the ~ransmission pressure gauge line on the AC Loader,
~and continued with the regular maintenance and operation of the
City owned equipment.
The {Yater and Sewer Crew worked on watex and sewer equipment,
welded brackets in their pickups for holding shovels and tools,
repaired fire hydrants, worked on Well tiouse No. 2, cleared
snow to tYell Houses, worked on Lift Stations, worked on the
chlorine system at the jYell House No. 2, turned on water for
various developers around torrn, read c~ater meters, cleaned the
sewer line in ~9oodland that had been plugged, cleaned out some
fire hydrants with the Fire Dept. and continued with maintenance
and operation checks of the t4e11 Houses and Lift Stations.

To Chapter ?, Aztic].e 5 of the Kenai Code as amended, dE~aJ.ing
with Purchases and 5ales, add the following:

Section 7-40.1(A? Authoritiy: Th~ City ldanac,~r may
obtain authorization from Council by telephone poll to (1)
purchase budgeted supplies, materials or services in excess
of $500 if the need is critical in his estimation, and (2)
execute qrant applications, accept bids and transfer funds
for the budgeted items to accomplish the foregoing.

(B) Procedure: All questions for telephone polls shall be
in writing and approved by the Manager or his designee for
submittal to the City Clerk. These polls will be approved
by the Finance Director to determine whether the proper
appropriation is made by ordinance. The City Clerk may
designate which City employees shall conduct the poll. No
more than one question shall be conducted per tclephone poll
except in aases of extreme emerqency where more than one
question may be presented and except that the question
concerni.ng transference of funds may be presented along with
the main question. Whenever possible, the questions shall
eliciti a"yes" or "no" respnnse. In all cases the designated
employees shall make a reasonable att~mpt to contiact a].1
Council members. A 2/3 majority of all Council members
polled shall be required for telephone poll authorization.
If the telephone poll fails, the matter shall be considered
as an agenda item at the next reqular Counci2. meeting. ,
