A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA AWARDING
A CONTRACT FOR THE CONSTRUCTION OF KENAI MUNICIPAL AIRPORT 1980
IMPROVEMENTS, TAXIWAY LIGHTING, AND STANDBY GENERATION FACILITY,
ADAP 6-02-0142096'TO COASTAL, INC.
WHEREAS, the following bids were received for the above mentioned
project:

WHEREAS, the recommendation from Wince, Corthell, Bryson, and
Freas, the project design engineers, is to award the contract
to Coastal', Inc. for a total project construction cost of
$631,49S.00, and
WHEREAS, Coastal, Inc. total bid of $631,495.00 is the lowest
responsible bid and award to this bidder would be to the best
interest of the City, and
WHEREAS, FAA approval will be given prior to signing of;the
contract documents, and
WHEREAS, Notice to Proceed will not be given until FAA has awarded
a grant to the City of Kenai and sufficient funds are appropriated.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA that the contract for the construction of KENAI MUNICIPAL
AIRPORT 2980 IMPROVEMENTS, TAXIWAY LIGHTING AND STANDBY GENERATION
FACILITY, ADAP 6-02-0142-06 be awarded to Coastal, Inc. in the
amount of $6310495.00 for the total project construction costs.
PASSED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA this 16th day
of July 1980.

Dear Mr. Delahay:
To confirm our telephone conversation this:date, we have
been contacted by our client, Coastal, Inc., concerning the
recent bid protest filed by the IBEW in connection with the
award of the referenced contract to Coastal.
It is our understanding that the substance of the Union's
protest is that Coastal, Inc. may not be able to.meet the fifty-
one percent (51%) clause of the General Contract Provisions,.
Section $0. That clause states in part:
"The Contractor shall perform with his own
organization not less than fifty-one (51)
percent of all work embraced in the contract."
Further, the General Contract Provisions, Section 40-01
provide that the contractor ". . . shall furnish all labor,
materials, equipment, tools, transportation, and supplies re-
quired to complete the work . . .11 pursuant to the plans
and specifications. "Work" is further defined in the GCP,
Section 10-45 as follows:
"The furnishing of all labor, materials, tools,
equipment, and incidentals necessary or con-
venient to the contractor's performance of all
duties and obligations imposed by the contract,
plans and specifications."

Clearly, Section 80-01 requires the contractor to per-
form the "work", as defined above, in the form of furnishing
labor and materials to complete the project. That is the
tradit onal function of the general contractor on any con-
struction project. It is the role that Coastal, Inc., with
its subcontractor, fully intends to fulfill on this project.
The Owner has been advised by Coastal, Inc. that the
electrical subcontract7work amounts only to approximately
390 of the total dollar volume of the project. This can be
verified from the contractor's bid proposal and should need
no further supplementation. Any release of additional in-
formation concerning cost or breakdowns for labor, materials,
etc. is proprietary information the contractor has used to
assemble his bid proposal. Coastal, Inc. could be seriously
harmed by being required to reveal this proprietary informa-
tion, Mr. Dreka would be happy to confirm the 39$ figure
by an Affidavit, and will furnish the City with the sub-
contract,,- when issued.
We would also point out that IBEW is not an interested
bidder on the project and has no standing to assert the
protest. I suggest that the Union's protest is simply a
means of attempting to frustrate competitive bidding by a
non -union contractor. Certainly, that is not the intent of
the bidding process, particularly in a federally -funded
project. The City should not yield to this type of pressure
particularly if the integrity of the competitive bidding
procedure is to be maintained.
We have reviewed this matter carefully with our client
and reviewed the applicable legal authorities. In light
of that review, and given the factors stated, we strongly
believe that the contract should be immediately awarded to
Coastal, Inc., as the low responsible bidder for the
project.
