MOTION: Councilman Whelan moved, seconded by Councilman Ackerly, to amend the motion to remove the residency requirement restrietion but those emploqees so wiahing to reside outside the City limits must live wfthin an appropriate response time as set forttt bq Department Heads and reviewed bq Council. Amendment also to include . that applicants seeking emploqment with the City of Renai and who reside within the Citq of Renai shall be given preferential hire consideration . Councilman Ambarian stated that he felt the referenece to giving preferential treabnent to applicants who reside within the Cfty limits is as discriminatory as requiring employees to reside within the C ity . Ordinance No. 336-77 - Personnel Ordinance The hearing on the Personnel Ordinance No. 336-?7 -- it must be painted out that we discovered that some sections had b een not corrected in accordance with Council instructions and we actually left off some three pages in preparing the ordinatice. We, therefore, ask that it be amended on adoption. 2. Recreation Site - Twin Ci Racewa I This is a hearing on recreation site license for Twin City Raceway -- data ,; will be fn the packet. 3. Persons Present Scheduled to be Heard Mr. Floyd Thomas. representing Snoshoe Gun Club, I believe, will ask the Citq Council for support in delivering some ravel t th i ' ~ g o e s te of the firing range in that they will have arranged to purchase some gravel and will simply ask for use of City trucks to transport the gravel from the pit to the range. ~ ~ Also scheduled to be heard is Mr . Amend Article V.F.2 by adding a paragraph to the end of that sectlon which shall read as follows: Overrime rates for individual public saf~ty employees attending special activities not part of their usual work dutiPS, the costs of which are reimbursable to the City, will be calculated at 1-1/2 times the hourly rate based on a 2080 hour year. 3. Further smend the ordinance by adding a paragraph to the end, of the ordinance to read as follows: The effective date of this ordinance shall be Julq 1, 19?? 4. Also. amend Article VIII.C.(b) to state Firefighters/Fire F.ngineers are based on s 56 hour w2ek and amend ~irticle VIII.C .(c) to state Commutii- caHons Personnel are based on a 42 hour week. r~ LJ~ ~ Councilman Sweet stated he objected that the firefighters would receive a higher rate of pay for fire fighting school than for their regular duties. Councilman Morgan stated it was unclear in the ordinance with regard to temporarq employees and regular employees in that such prograTns as the Recreation Program did not provide funding for personnel ~ however, Councilman Morgan stated he felt that regular Citq employees should not be used for maintenance of Citq parks, etc. but rather give the youth of the community part-time employment. Thus. the Personnel Ordinance should provide that these temporary employees should not be paid the same benefits as regular full-time employees. Mr. Wise advised that clarifying lang-uage or amendment could be made upon resolution of the matter . QUE3TION . AMENDMENT , Passed bq roll call vote. Voting yes; Whelan, Glick. Ambarian, snd Elson. Passed unanimously by roll call vote. ~ B-2: Becreation Site License - Twin City Raceway - Administration advised that Twin City Raceway, Inc. had applied to the ~ Alcoholic Beverage Control Board for a new recreation site license and Administration recommended approval of their application . Voting no; Sweet G-20: Discussion - Public Nuisances Mr. Wise advised that several of the publie nuisances had been taken care of, however, there were four structures that the City would have to take action on. Mr. Wise requested Counci~ authorization to proceed with the proper transferring of funds to provide the monies to take care of these four structures. There was no objection from Council. G-21: Ordinance 364-77 - Amending Personnel Regulations Mayor Elson read Ordinance 364-?7 by title only. An ordinance of the Council of the City of Kenai amending the Personnel Regulatons to clarify Paragraph N concerning relatives of Council members in Citq Service. MOTION • Councilman Ambarian moved, seconded by Councilman Morgan, for introduction of Ordinance 364-77, amending Paragraph N of the Personnel Ordinance. Motion passed unanimously by roll call vote with Councilwoman Glick and Mayor Elson abstaining due to possible personal conflict of interest. G-22: Resolution ??-120, Certifjring the census of the City of Kenai as of ?-1-77 Maqor Elson read Resolution ?7-120. A resolution of the Council of the City of Kenai certftqing the census of the City of Kenai, Alaska as of Julq 1, 1977. Whereas the Citq of Renai is submitting its applicat~on af State Aid to Locat Governments, aad Whereas, a portion of this application is based upon a population census, and Whereas, the Council of the City of Kenai has reviewed the new population census computatfon, and Whereas, the Council of the City of Kenai is in agreement with the cenaus computation. Now~ therefore, be it resolved by the Council of the Citq of Kenai as follows: The population census of the City of Kenai as of July 1, 1977 is 5, 822 . Motion passed unanimously by roll call vote. B-5: Ordinance 363-77, Highway Safety Planning Agency Grant #49-?7-3-C/28 Maqor Elson read Ordinance 363-77 by title only. "An ordinance of the Council of the City of Kenai. Alaska amending the 1977-78 General Fund Budget by appropriating $2,050 to the General Fund, Budgetary Guideline entitled "Highway Safety Planning Agency Grant #49-?7-3-C/29" and increasing estimated revenue "Highway Safetq Planning Agency Grant #49-7?-3-C/29" bq $2,050." Maqor Elson opened the hearing to the public. Veata Leigh - stated it was her opinion that that additional equipment will bring more revenues into the City and the Palice Department will have proper equipment to work with. Les Borgen - stated that any grant is out of your "right hand pocket" . There being no further comment, Mayor Elson returned the hearing to the Council ~ table. MOTION: Councilman ~Vhelan moved, seconded by Councilwoman Glick, for adoption of Ordinance 363-?7, Highwaq Safety Planning Agency Grant #49-77-3-C/29, for purchase of a radar gun. B-6: Ordinance 3B4-77 ~ Amending Personnel Re~-ulations to clarifq Paragraph N concerning relatives of City Council in City service Maqor Elson read Ordinanee 364-77. "An ordinance of the Council of tlie City of Kenai, Alaska amending the Personnel Regulations to clarify Paragraph N concerning relatives in City service. whereas, the question has arisen as to whether Article 6, Paragraph N of the Personnel Regulations prohibits employment by the City of relatives of City Council members, and Whereas, it was not the intention of Council to prohibit such employment, and G~'hereas, further legislation is needed to clarify this intention. Now, therefore, b~ it ordained by the Council of the City of Kenai that Chapter 22, Article 6, Paragraph N of the Code of the City of Kenai be and hereby is amended by adding the following sentence to the end of the first paragraph: ".....This section shall not be construed to prohibit employment by the City of relatives of City ~ Council members.". Alsyor Elson opened the hearing to the public. Mrs. Borgen stated that the spaces did not provide proper septic systems, etc. and did not complq with the codes. Mr. Wise advised that he had researched the matter to determine validity of th situation and had not been able to find a reference to the matter in previous Council or Planning Co:nmissian minutes. Councilwoman Glick inquired if the Department of Environmental Conservation had been contacted to verifq if the operator was in compliance for on-site sewers. etc. and N[r. 1+Vise reported that Howard Keiser of DEC advised he would be issuing a permit. Maqor Elson stated that first of all the Citq must determine if all five existing trailers have complied and secondedly would the new trailers be in compliance. The City would also have to determine if a trailer park was being set up or were the trailers on individual lots and if it were determined that a trailer park was being operated do the zoning ordinances allow a trailer park in the area? lliaqor Elson further stated that the City should querq the Borough as to their records and any reference to the matter and if this matter did fall under Borough ordinances, all the facts should be presented to the Borough Attorney for an opinion. Mr. Lester Borgen stated that he felt he was living across the street from an illegal trailer court with very poor sewage systems existing and would therefore, request assistance from the City. Councilwoman Glick stated that the City should take some action as a public nuisance apparently did exist. Mayor Elson stated that as a"Home Rule" Cfty we had certain legal abilities. City Attorney Williams was directed to review the ordinance pertaining to "public nuisances" and upon determination. Administration was to proceed accordingly. There is a question as to ~vhether both of these tracts are, in fact, being used for the purposes stated in the application. We are reviewing the projects and will have a report for the Council and for the Bureau of Land Management. hopefully, by the next Council meeting. ?. Baptist Temple Mr. Stock, representing the Baptist Temple, dropped in to the office and questioned whether or not the City might reconsider its denial of the Conditional Use request if, in fact. the Temple had a contract to sell the property and building in question to someane say perhaps in .Iune of next year. Assuming that they had a contract to sell it was deemed possible by myself that the Planning Commission may well grant a temporary periodic use. 8. Personnel Rules ana Regulations I have enclosed a Position Paper trying to eliminate some of the questions that I have with reference to the Personnel Rules and Regrulations. I would request that a work session be held to provide the Administration with some guideli.zes on these several questions . 9. ADAP Study The eonsultants will be in Kenai on the 28th and 29th of September as well as the FAA Planning Representative and we will review and proceed on the initial design study. I plan ta request an Advisory Commission meeting on the night of the 28th to revie~v th~ ConsuItant's plans and to provide input to the consultant. Regretably, this is in conflict with the Chamber of Commerce visit from Seattle and necessarily this is the only time we can expect the consultant to be available. 10. Ralifonsky Subdivision This subdivision final platting was reviewed by the Planning Commission Thursday evening. I was present at that meeting and noticed that a 30 ft. rig-ht-of-way was being recommened for approval for this particular tract. In my thinking on the matter later I realized that we were accepting e 30' right-of-way street on the presumption that at some future date the other 30' adjacent tract would be dedicated to the City. This, I believe~ is an erronenus assumption in that the property could change hands. the development could perhaps never occur and we would be stuck with a 30' right-of-way. In special concern, the regulations only relate to Classified empioyees and not to the Council or other ` appointed of~cials; Manager, Attorney, or City Clerk.
