' ~ Capital Project "Port Facilities Grant" - $715,000 ; MOTIONs - :; Councilman Wagoner moved, seconded by Councilman ' . _ Measles, to fntroduce the ordinance. ; Councilman Mueller asked, is this creating a new • capital project fund? Also, he didn't understand the breakdown. Admin. Coordinator Davis explained it relates to the 1974 Port Development graat. The $600,000 in State bond money required a feasi- . bility study. The study was made at the last Harbor Commission raeeting. He recom~uended acceptance of the study. The purpose is to release bond moneys. The City's 108 share has been approved by DOT. . Mayor O'Reilly asked, are we bound by the classi- • fication on this? Finance Director Brown replied no, if they approve the 5750,000 budget, we can . "-"- - transfer from one acc~unt to another. Mr. Davis agreed, there had been some details added. Atty. Delahay noted, after Mr. Roper's first proposal, we asked the State if this could be de- ducted from these funds, they said no. Councilman Measles asked, have we asked the State if we could use the funds for a buy-back of land? Atty. Delahay replied he didn't see any problem. Mayor O•Reilly asked, how do we give the Council a chance to study this? City Manaqer Brighton explained, this ordi- nance is preconditioned on the study getting to Juneau. The ordinance won't mean anything till the State qives us the qrant. We have to hold baak the resolution if we hold back the ordinance. This document is only a request and justification for the requisition. There is nothinq locked or bind- inq. Councilwoman Glick said she would still like the opportunity to read before sending it to Juneau. We aeed to be sure the project is feasible. Council- man Waqoner said this stud_y does not qo to Juneau, it iust goes to Anchorage. Mr. Tully has the author- ity to release the funds. This is not a leqal ` document. Mr. Brighton noted the Roper lease is ~ included in the proposal. Mr. Davis asked, can't there be conceptual approval so he knows if he can go ahead till the contract is siqned? It was mailed Oct. 22 froia Juneau, the Borouqh does not have it. Community 6 Reqional Affairs says the date fs October 27, the day of signing. Could the Coitsicil qive him assurance that it wiil be approved? Motioa passed unanimously by roll call vote. City blanager Brighton said the iiaportaat thing is the day the contract was siqned, it is permitted to spend funds. He noted Mr. Davis may be liable for funds spent if not approved. Mr. Davis safd he also needs an office, etc. Cowacilman Waqoner said he has no problesa with that. The qrant comes to the Borough, not the City. The emphasis with the Borough is what is fmportant. He doesn't think Mr. Davis should purchase qoods, etc.~tiil the Horouqh signs. Councilman Measles asked, what are the odds the Borouqh may not enter into the contract with the City? Mayor 0'Reilly said Phil Waring froni the Borouqh had a meetinq aad wanted to develop a Borouqh contsact reqardinq the Roper situation. What's chanqed is the elements not dealinq with the harbor, the scope of work has chaaged with the de- velopment of a s~nall boat harbor, the contract be- tween the City and the Borough has been chanqed to elitainate the harbor. City Manaqer Brighton noted, also the Assembly has changed. She doesn't think Mr. Davis should spend funds till the contract is signed. Councilman Wagoner said the Assembly has already passed it, it does not have to qo b~ck to the Assembly. The cantract will go throuqh, it is just a matter of time. No motion is needed. Mr. Davis said, regardinq the Coastal Zone Manaqe- ment letter to City Manaqer Brighton reqarding Kenai wetlands working group. In Mr. Davis' letter he indicated there should be a letter or action that someone has authority to represent the City of Kenai. Zn his job description it says, "the Admi.nistratfve ~oordir_ator will coordinate the wetlands study." Mayor O*Reilly asked to explain, Coastal Zone Management has to come up with a plan. It has to be brought to Council, Murray Walsh has qot agencfes to agree when they corne to concensus on a plan, they have to hold there. The plan will come back to us.Councilwoman Glick said whoever sits at the table, the} have power to represe»t the City.Once the plan comes to the City, we can accept or not. Why can't they vote also? The represeatative shoul8 have the authority to state for the City also. 1Kayor O•Reilly said we cannot de2eqate this authority. Couricilwoman Glick asked, are the other aqencies aware of that? She didn~t thir~Is they would go for that. Mr. Davfs eJCplained, this has not been dis~ cussed. 8is letter says the representative should have some letter stating this representative has th~ rfqht to participate. The City is not the aqeacy. It is not a requirement, it is his sugqestion. Council- woman Glick asked Mr. Davis, will he have to siqn the same as the aqencies? Mr. Davis replied, no it is not his job. ~City Manager Brighton said the intent is to let the agencies know he can sit on behalf of the City. Councilwoman Glick asked, could we have a letter from the aqencies that he has the right to participate? Vice Mayor Glick took the chair. Mr. Davis replied S. Councilman Measles asked, all 8 will have the power to make decisions? He couldn't visualize the EPA givinq anyone that authority. City Manaqer Brighton explained this was to enhance people with the ability to qet per- mfts.~ It was a pilot progran- to qet agencfes to siqn off, so people could come to the City for permits, using our Comprehensive Plan. He further stated Murray Walsh, Coastal Zone Manaqement, fs workinq to lessen the time. As yet, they do not have that comutit ~aent, they aze workinq to that point. They are not trying to 5~t the City to that point. The Council is under no obligation to accept proposals of the aqencies. Mayor O'Reilly said the power still resides with the Couacil. Vote fai].ed, with Mayor O'Reilly, Councilmen Hall and Waqoner votinq yes; Councilwoman Glick, Council- men Malston, Measles and Dlueller voting no. Mayor O'Reilly resumsd the chair. Councilwoman Glick said she would like to see the agencies• powers in writinq, and alsa that they understand our position. 3he has no trouble with the concept. G-27 Union Oil Drilling Permit - Cannery Loop Well ~2 Rich Soyle of Union Oil Ppoke. He explained the permit was issued May 1980, they forqot to ask for exceptfons far earth and slush pit. They have used it in ~l and $3, they just need approval of the exception. Iyayor O'Reilly asked if this was approved by Planainq & Zonfaq. Councilwoman Glick replied yes. There comes a time when we want to gek out of the achools. Francis Meeks spoke. She noted part of the cuiture center was a museum. That couid not be part of the high school. Councilman Waqoner explained, he did not say to do away with the culture center. He just thouqht we should rethink our proposals. Councilwoman Giick suqqested we desiqn the facility for all other proposals and make the auditorium an option. Councilman Waqoner agreed, noting per- haps we could mak~ it a congerence center. OLD BUSINESS F-1 Coatraat for Administsative Coordinator City Manager Brighton said he picked up the contract signed by the Borough. Ths Council wfll have to authorize the City Manager to sfgn the contract. Se said he didn't foresee any ~roblem. MOTIONs Councilwoman Glick, ~econded by CounciLaan Malston, move8 to au~horize City Manager Brighton to sign the contract between the City and the Borough for Adsninistrative Coordinator dealing with Coastal Zone Development. Councilman Mueller noted in Appendix A, #2 - it was his understandinq we have shelved that. Also, the pcints on page 9, ftem 6- have all the points been looked at and addressed? City Manager Briqhton replied this fs dependent on the ~oishes of the Council. The Borough has agreed to be responsible that the City research the smail boat harbor operation.
